The legislation in Scotland on the display of all tobacco products and smoking related products and the display of prices of tobacco products and smoking related products has changed. The legislation came into effect for large retailers in April 2013 and from 6th April 2015 all remaining tobacco retailers must comply. This includes “on trader” licensed premises such as pubs and clubs including private members clubs. Trading Standards will be carrying out visits to local traders to ensure the display ban requirements are being complied with. All tobacco retailers must store tobacco products and smoking related products out of public sight, and there are restrictions on the size of each temporary display for making sales and carrying out maintenance. From the same date all prices and price labels must be displayed in specific formats set out in the legislation. Trading Standards will also be carrying out work in relation to proxy sales of tobacco products. It is illegal for a person aged 18 or over to purchase cigarettes for a person under the age of 18. If a person is caught doing this then they can face a fine of £200, prosecution and a criminal record.
