This hearing will come to order. Congratulations to all of you on your nominations to these very important offices. I see friends and family behind you, and I wel- come all of you here as well. This morning, we are going to consider four nominations: First, Ms. Sigal Mandelker. She is to be the Under Secretary of the Treasury for Terrorism and Financial Crimes. Second, Ms. Mira Ricardel. Did I get that right, Ricardel? Ms. RICARDEL. Yes, sir. Thank you. Chairman CRAPO. Thank you. To be Under Secretary of Com- merce for Export Administration. Third, Mr. Marshall Billingslea, to be Assistant Secretary of Treasury for Terrorist Financing. And, finally, Mr. Heath Tarbert, to be Assistant Secretary of the Treasury for International Markets and Development. Again, welcome to all of you. All four of these highly qualified nominees have extensive na- tional security experience from their years spent in Government, supplemented by an understanding of the practicalities and specific commerce and finance requirements honed in the private sector. Ms. Mandelker’s experience in senior law enforcement and na- tional security positions equip her with the judgment necessary as Under Secretary to lead Treasury’s Office of Terrorism and Finan- cial Intelligence, the TFI, where she would oversee sanctions policy on Iran, Russia, North Korea, Syria, and some 25 other programs, including narcotraffickers, nuclear proliferators, and the like. Ms. Mandelker would also lead on the Nation’s anti-money laundering efforts and other illicit financial threats. As Assistant Secretary, Mr. Billingslea would work with Ms. Mandelker to coordinate

    Trump and Trade Updates – April 2017 Commerce Moves to Review China’s “Nonmarket Economy” Status 4/3/17 – The Trump administration on April 3, 2017 issued a notice of initiation and request for public comment and information pertaining to whether the People’s Republic of China (PRC) should continue to be treated as a nonmarket economy (NME) country under the antidumping and countervailing duty laws. The notice in the Federal Register indicates that this inquiry is part of the Department of Commerce’s less-than-fair-value investigation of certain aluminum foil from the PRC. The notice states that the Department of Commerce has treated the PRC as an NME country in all past antidumping duty investigations and administrative reviews. Yet, under the agreement with the PRC regarding its accession to the World Trade Organization (WTO), the PRC believes that WTO members were required to begin treating it as a market economy in December 2016. The department is conducting this inquiry in order to obtain the most recent data and information available from U.S. industry, and the notice states that U.S. law allows it to review the PRC's nonmarket economy status "at any time." The timing of this notice is interesting, given that Chinese President Xi Jinping is traveling to the United States for talks later this week.     The People Shaping the Trump Administration Despite Running on a Pledge to ‘Drain the Swamp’ and Crack Down on Special Interests, Donald Trump Has Filled His Transition Team With Lobbyists and Others With Potential Conflicts November 16, 2016 – Donald Trump rode to the White House by raging about alleged rampant corruption in Washington and pledging to “drain the swamp.” Each of the five points in the ethics platform he issued in October focused on diminishing the influence of lobbyists.1 These included a promise to impose a five-year ban on former executive branch officials lobbying the federal government. Trump further promised to crack down on special interest-influence by expanding the definition of lobbyist to include consultants and others who trade on inside government information and expertise.2 But Trump’s nascent transition team, which will shape his administration, is swarming with lobbyists and other special interests. Many of the lobbyists are working for the transition on areas for which they currently are lobbying the federal government. Meanwhile, many of those who aren’t lobbyists appear to have potential conflicts of interest. Vice president-elect Mike Pence reportedly said on November 15 that the transition team would be purged of lobbyists, but the transition team has not made the point official.3 Even if true, that remedy would not address cases such as a defense contractor working on defense interests, or a lawyer for health care interests working on health care reform. The continuing controversy over chemical security preemption reveals one way in which executive power asserts itself in the national security context: the reclassification of seemingly domestic reg- ulatory concerns as matters of national security and the consequent constriction of state regulatory authority. This Note analyzes the DHS’s chemical security regula- tions as a case study for the problem of national security preemption. It argues that the presumption of federal supremacy in foreign affairs can ratify conclusory and unsupported preemption claims because the national security interest mixes both foreign and domestic affairs, while the only doctrinal guidance for defining that interest comes from contested foreign affairs preemption doctrines. The Note pro- poses that, if strengthened, deference doctrines drawn from administrative law pro- vide the best means of scrutinizing and limiting such claims of executive authority. Agency claims of preemption on the basis of national security should be subject to heightened scrutiny. Such scrutiny is more useful than the stalemated positions of the law and security debate for policing the state-federal divide in national security.
