Walgreens proposes a new prototype store at 1501 Vine Street located within the Sunset and Vine mixed-use development located at the northwest of the intersection of and Vine Street in . The Sunset and Vine project is a five-story, mixed-use project with 300 residential units and approximately 105,000 square feet of ground floor commercial space. The commercial space is cunently occupied with a Baja Fresh, Verizon Wireless, Bed Bath & Beyond, Hungry Cat restaurant, Wolf Liar's restaurant, Kabuki restaurant, Spinlates Fitness, Farmers Kitchen, Jersey Mike's Subs, Cookies and Cream, and Wynn Nails. Approximately 855 total parking spaces are provided on-site for all uses.

Walgreen will occupy a 23,500 square foot space formerly occupied by Borders bookstore. Construction of the store is limited to tenant improvements only and is anticipated to open in November 2012. The Walgreens is a unique prototype store that will feature an extensive collection of innovative offerings, products and services unexpected from a drugstore and follows the recent successful openings of flagship similar stores in New York and Chicago. The prototype concept aims to transfmm Walgreens from a traditional drugstore to a retail health and daily living destination.

The store's expanded and groundbreaking features include:

• An enhanced, state-of-the-art phmmacy designed to encourage greater interaction between pharmacists and patients. An iPad equipped health guide will help phatmacy customers navigate a wide range of health and wellness products, services and resources including immunizations and health tests. The pharmacy also features an "Ask Your Pharmacist" desk, consultation rooms, and a Health Comer space to host health and wellness community events and Express Rx kiosks for swift checkout.

• A Take Care Clinic offering a wide range of health care services including vaccinations, health tests, physicals and treatments for common illnesses and minor injuries.

• An Upmarket Cafe offering a barista preparing fresh brewed premium coffee and bakery that will serve a range of fresh baked breads and pastries daily.

• A juice bar featuring fresh fiuits and vegetables and made-to-order smoothies. Customers can also opt for self-serve frozen yogurt.

• A wide variety of fresh hand-rolled sushi and sashimi prepared daily.

• Hundreds of fresh food items including produce and high-quality, on-the-go meal options such as wraps, sandwiches and salads made fresh daily. • A best~ in-class alcohol selection boasting more than 700 fine wines will pair well with artisan and brie cheeses as well as an assortment of specialty meats, decadent chocolates and more.

"' A LOOK Boutique beauty department featuring dozens of prestige and niche cosmetic, skincare and hair care brands not typically found in drugstores. Specially-trained beauty advisors are on hand to offer guidance finding the best solutions for individual needs. In addition, customers can try new cosmetic shades and styles at the innovative Virtual Makeover kiosk.

On July 15,2012 the Zoning Administrator approved a Conditional Use Permit (Case No. ZA 2012-117 -CUB) to allow for the off-site sale of a full line of alcoholic beverages. State law requires that the City make a Finding ofPublic Convenience or Necessity (''PCN Finding") because the store is located in an area of "Undue Concentration" as defined in Bus. & Prof. Code Section 23958.4 and within a high crime reporting district per statistics from the Los Angeles Police Department. According to the California State Department of Alcoholic Beverage Control licensing criteria, three off-site licenses are allocated to the subject Census Tract No. 1907, which had a population of 3,269 as of January 1, 2005. There are currently three off-site licenses and Walgreens proposes to add one off-site license to this census tract bringing the total number of off-site licenses to four.

The Zoning Administrator found that the proposed Walgreens pharmacy will not adversely affect the community because the proposed use is a desirable use in an area planned and zoned for such. The site is located in a dense urban area, at the nmiheast corner of the intersection of Vine Street and Sunset Boulevard. The location is an appropriate location for a pharmacy with the off-site sales of a full line of alcoholic beverages. As proposed, the usc will serve public convenience and welfare and as sited, the location is compatible with the surrounding community. The Zoning Administrator has imposed a number of conditions addressing alcohol related issues that will safeguard public welfare and enhance public convenience. The proposed use will provide services that are in close proximity to the businesses and residents within the neighborhood.

Walgreens met with the LAPD Hollywood Vice division and agreed to a number of volunteer conditions that will ensure safe and responsible sale of alcohol. In addition, the application was unanimously supported by the Central Hollywood Neighborhood Council. The sale of alcohol at will provide an additional amenity for the neighborhood in a safe, convenient location operated by a trusted brand. Walgreens will not contain any type of use which may typically be associated with adverse effects upon the economic health of a neighborhood, such as a stand-alone bar or nightclub.

Alcohol will be merchandised and sold with a high degree of responsibility and conscientiousness. Walgreens uses a variety of security strategies to ensure the safety of its customers as well as the security ofthe merchandise. Primary tools include cameras and public view monitors that deter criminal activity and promote a safe environment. The digital images captured from these devices are stored for up to 90 days on a Digital Video Recorder and are available upon request by LAPD.

2 Detailed policies and procedures would be employed and strictly enforced for the sale of alcohol. Employees for each eligible store must undergo extensive corporate training including LAPD STAR training. Once trained, all employees regardless of age must sign a Sale of Alcoholic Beverages Policy acknowledgement letter at the beginning of each shift. Walgreens established policy requires that employees must request identification for any customer attempting to purchase alcohol who appem·s to be under the age of 40. The register prompts the employee before proceeding with the transaction and all under age employees are required to seek the assistance of a manager.

Walgreens is an established, reputable operator and the proposed off-sales of alcohol m·e sold as incidental products to the goods and services sold at the pharmacy. There will be no external evidence that alcoholic beverages are and there will be no on-site consumption, loitering or littering permitted in connection with the sales of alcoholic beverages. As noted, the Zoning Administrator detennined that the proposed sale of alcohol will serve a public convenience and has imposed conditions of approval to ensure the use will operate in a reasonable manner in relation to adjacent uses and development of the community. In addition, the application is supported by the local neighborhood council and LAPD. Therefore, a PCN Finding can be made.

Pursuant to Los Angeles Municipal Code Section 12.24-W, 1, I hereby APPROVE:

a Conditional Use to permit the sale and dispensing of a full line of alcoholic beverages for off-site consumption in conjunction with a proposed Walgreens pharmacy in the C4-2D-SN Zone;

upon the following additional terms and conditions:

1. All other use, height and area regulations of the Municipal Code and all other applicable government/regulatory agencies shall be strictly complied with in the development and use of the property, except as such regulations are herein specifically varied or required.

2. The use and development of the property shall be in substantial conformance with the plot plan submitted with the application and marked Exhibit "A", except as may be revised as a result of this action.

30 The authorized use shall be conducted at all times with due regard for the character of the surrounding district, and the right is reserved to the Zoning Administrator to impose additional corrective Conditions, if, in the Administrator's opinion, such Conditions are proven necessary for the protection of persons in the neighborhood or occupants of adjacent property. 4. All graffiti on the site shall be removed or painted over to match the color of the surface to which it is applied within 24 hours of its occurrence.

5. A copy of the first page of this grant and all Conditions and/or any subsequent appeal of this grant and its resultant Conditions and/or letters of clarification shall be printed on the building plans submitted to the Development Services Center and the Department of Building and Safety for purposes of having a building permit issued.

6. Indemnification. The applicant shall defend, indemnify and hold harmless the City, its agents, officers, or employees from any claim, action, or proceeding against the City or its agents, officers, or employees to attack, set aside, void or annul this approval which action is brought within the applicable limitation period. The City shall promptly notify the applicant of any claim, action, or proceeding and the City shall cooperate fully in the defense. If the City fails to promptly notify the applicant of any claim action or proceeding, or if the City fails to cooperate fully in the defense, the applicant shall not thereafter be responsible to defend, indemnify, or hold harmless the City.

7. Approved herein is the sale and dispensing of a full line of alcoholic beverages for off-site consumption in conjunction with a proposed approximately 23,509 square-foot Walgreens pharmacy with hours of operation of 24 hours daily. Alcoholic beverage sales shall be limited to 6:00a.m. to 2:00a.m. daily. The sale of alcoholic beverages shall b·e limited pursuant to Condition No. 32.

8. The authorization granted herein for the sate of a full-line of alcoholic beverages for off-site consumption for a period of five C5) years from the effective date of this grant Thereafter, a new authorization to allow the sale of a full line of alcoholic beverages for off-site consumption will be required.

The applicant is advised that he/she should allow appropriate time for a new entitlement application to be processed and the application should be approved prior to the expiration date of this grant in order to continue the sale of alcoholic beverages at the restaurant.

9. lf at any time during the period of the grant, should documented evidence be submitted showing continued violation(s) of any condition(s) of the grant, resulting in a disruption or interference with the peaceful enjoyment of the adjoining and neighboring properties, the Zoning Administrator will have the right to require the petitioner(s) to file for a plan approval application together with the associated fees, to hold a public hearing to review the petitioner's compliance with and the effectiveness of the conditions of the grant. The petitioner(s) shall submit a summary and supporting documentation of how compliance with each condition of the grant has been attained.

10. The approval is tied to ENV-2012-118-MND, the approved plans must list all mitigation measures contained therein.

12. No dancing is permitted or live entertainment shall be permitted in the drugstore/tenant space.

13. A 24-hour "hot line" phone number shall, be provided for the receipt of complaints from the community regarding the subject facility and shall be:

a. Posted at the entry. b. Posted anhe Customer Service desk. c. Provided to the immediate neighbors, schools, and the Neighborhood CounciL d. The property owner/operator shall keep a log of complaints received, the date and time received, and the disposition of the response. e. The log shall be available for inspection by the LAPD and Zoning Administrator upon request.

14. Within six months of the effective date of this determination, all employees involved with the sale of alcoholic beverages shall enroll in the Los Angeles Police Department "Standardized Training for Alcohol Retailers" (STAR). Upon completion of such training, the applicant shall request the Police Department to issue a letter identifying which employees completed the training. The applicant shall transmit a copy of the letter from the Police Department to the Zoning Administrator as evidence of compliance. In the event there is no change in the licensee, within one year of such change, this training program shall be required for all new staff.

15. Electronic age verification device(s) which can be used to determine the age of any individual attempting to purchase alcoholic beverages shall be installed on the premises at each point~of-sale location. The device(s) shall be maintained in an operational condition and all employees shall be instructed in their use prior to the sale of any alcoholic beverages.

16. Any future operator for this site must file a new Plan approval Application or an equivalent to allow the City of Los Angeles to review the "mode and character" of the usage.

17. The approved conditions shall be retained on the premises at all times and produced immediately upon request of the Police Department and Department of City Planning.

18. Loitering is prohibited on or around these premises or the area under control of the applicant

19. The applicant shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control.

20. Trash/recycling pick-up Is permitted to occur only between the hours of 8:00a.m. and 5:00 p.m., Monday through Saturday.

a. Trash/recycling containers shall be locked when not in use. b. Trash/recycling containers shall not be placed in or block access to required parking. c. Trash/recycling items shall not be emptied or ·disposed into outside containers earlier than 9:00a.m. or later than 9:00p.m. CASE NO. ZA 2012~; i ?(CUB) PAGE4

21. Prior to the clearance of any conditions, the applicant shall show proof that all fees have been paid to the Department of City Planning, Expedited Processing Section.

22. Prior to issuance of any permits relative to this matter, a covenant acknowledging and agreeing to comply with all the terms and conditions established herein shall be recorded ln the County Recorder's Office. The agreement (standard master covenant and agreement for CP-6770) shall run with the land and shall be binding on any subsequent owners, heirs or assigns. This agreement with the conditions attached must be submitted to the Department of City Planning for approval before being recorded. After recordation, a certified copy bearing the Recorder's number and date shall be provided to the Department of City Planning for attachment to the subject case file.

The following conditions are alcoholic beverage specific conditions volunteered by the applicant and shall be complied with:

23. There shalt be no coin-operated games or video machines maintained upon the premises.

24. If at any time during the period of the grant, should documented evidence be submitted showing continued violation(s) of any condition(s) ofthe grant, resulting in a disruption or interference with the peaceful enjoyment of the adjoining and neighboring parties, the Zoning Administrator will have the right to require the applicant to file for a plan approval application together with the associated fees, to hold a public hearing to review) compliance with and the effectiveness of the conditions of the grant. The applicants shall submit a summary and supporting documentation demonstrating compliance with each condition of the grant has been attained.

25. The sale of malt liquor or fortified wine or single cans or bottles of beer from six-packs are prohibited. Single cans or bottles with a minimum size of 20 fluid ounces maybe permitted.

26. There shall be no exterior advertising, neon signs, or signs of any type on the tenant space, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages.

27. That 11 No Loitering 11 and uNo Public Drinking of Alcoholic Beverages~~ signs shall be posted at the front, side, and rear of the tenant. These signs shall be in English and Spanish.

28. That signs shall be posted ln Spanish and English that California State Law prohibits the sale of alcoholic beverages to persons who are under 21 years of age.

29. The applicant shall install and maintain security cameras that cover all common areas of the business, high-risk areas and entrances or exits. The applicant shall maintain a three-month video library which shall be made available to LAPD upon request.

30. There shall be no fixed bar or cocktail lounge maintained on the premises. CASE NO. ZA 2012-117(CUB) PAGE5

31. There shall be no "Happy Hour" type of reduced price alcoholic beverage promotions.

32. The sale of alcoholic beverages shall be limited from 6:00a.m. to 2:00a.m., daily.

All of the mitigation measures indentified in the Environmental Clearance Case No. ENV 2012~118~MND have been adopted as conditions of the instant action and are listed below for the convenience of the reader:

33. Every building, structure, or portion thereof, shall be maintained in a safe and sanitary condition and good repair, and free from, debrfs, rubbish, garbage, trash, overgrown vegetation or other similar material, pursuant to Municipal Code Section 91.8104.

34. The exterior of all buildings and fences shall be free from graffiti when such graffiti is visible from a street or alley, pursuant to Municipal Code Section 91.8104.15.

35. Prior to the issuance of any permit, the project shall obtain clearance from the Department of Cultural Affairs for the proposed work.

36. A property shall be used for its historic purpose or be placed in a new use that requires minimal change to the defining characteristics of the building and its site and environment.

37. The historic character of a property shall be retained and preserved. The removal of historic material or alteration of features and spaces shall be avoided.

38. Chemical or physical treatments, such as sandblasting, that cause damage to historic materials shall not be used.

39. The surface cleaning of structures, if appropriate, shall be undertaken using the gentlest means possible.

40. New additions, exterior alterations, or related new construction shall not destroy historic materials that characterize the property. The new work shall be differentiated from the old and shall be compatible with the massing, size, scale, and architectural features to protect the historic integrity of the property and its environment.

41. New additions and adjacent or related new construction shall be undertaken in such a manner that if removed in the future, the essential form and integrity of the historic property and its environment would be unimpaired.

42. Only low- and non-VOC-containing paints, sealants, adhesives, and solvents shall be utilized in the construction of the project.

43. The following recommendations of the Fire Department relative to fire safety shall be incorporated into the building plans, which includes the submittal of a plot plan for approval by the Fire Department either prior to the recordation of a final map or the approval of a building permit. The plot plan shall include the following minimum design features: CASE NO. ZA 2012-'i 17(CUB) PAGE6

• fire lanes, where required, shall be a minimum of 20 feet in width; all structures must be within 300 feet of an approved fire hydrant, and entrances to any dwelling unit or guest room shall not be more than 150 feet in distance in horizontal travel from the edge of the roadway of an Improved street or approved fire lane.

44. The plans shall incorporate the design guidelines relative to security, semi-pubJfc and private spaces, which may include but not be limited to access control to building, secured parking facllities, walls/fences with key systems, well-illuminated public and semi-public space designed with a minimum of dead space to eliminate areas of concealment, location of toilet facilities or building entrances in high-foot traffic areas, and provision of security guard patrol throughout the project site if needed. Please refer to 11 0esign Out Crime Guidelines: Crime Prevention Through Environmental 11 Design , published by the Los Angeles Police Department. Contact the Community Relations Division,.located at 100 W. 1st Street, #250, Los Angeles, CA 90012; (213) 486-6000. These measures shall be approved by the Police Department prior to the issuance of building permits.

45. (Operational) Recycling bins shall be provided at appropriate locations to promote recycling of paper, metal, glass, and other recyclable material. These bins shall be emptied and recycled accordingly as a part of the projectts regular solid waste disposal program.

46. {Construction/Demolition) Prior to the issuance of any demolition or construction permit, the applicant shall provide a copy of the receipt or contract from a waste disposal company providing services to the project, specifying recycled waste service(s), to the satisfaction of the Department of Building and Safety. The demolition and construction contractor(s) shall only contract for waste disposal services with a company that recycles demolltion and/or construction-related wastes.

47. (Construction/Demolition) To facilitate on-site separation and recycling of demolition- and construction-related wastes, the contractor(s) shall provide temporary waste separation bins on-site during demolition and construction,

48. These bins shall be emptied and the contents recycled accordingly as a part of the project's regular solid waste disposal program.

49. All waste shall be disposed of properly. Use appropriately labeled recycling bins to recycle demolition and construction materials including: solvents, water-based paints, vehicle fluids, broken asphalt and concrete, bricks, metals, wood, and vegetation. Non recyclable materials/wastes shall be taken to an appropriate landfill. Toxic wastes must be discarded at a licensed regulated disposal site.

OBSERVANCE OF CONDITIONS- TIME LIMIT- LAPSE OF PRIVILEGES -TIME EXTENSION

All terms and Conditions of the approval shall be fulfilled before the use may be established. The instant authorization is further conditional upon the privileges being utilized within three years after the effective date of approval and, if such privileges are not CASE NO. ZA 2012-'! 17(CUB) PAGE7 utilized or substantial physical construction work is not begun within said time and carried on diligently to completion, the authorization shall terminate and become void.

TRANSFERABILITY

This authorization runs with the land. In the event the property is to be sold, leased, rented or occupied by any person or corporation other than yourself, it is incumbent that you advise them regarding the conditions of this grant.

VIOLATIONS OF THESE CONDITIONS 1 A MISDEMEANOR

Section 12.29 of the Los Angeles Municipal Code provides:

"A variance, conditional use, adjustment, public benefit or other quasi-judicial approval, or any conditional approval granted by the Director, pursuant to the authority of this chapter shall become effective upon utilization of any portion of the privilege, and the owner and applicant shall immediately comply with its Conditions. The violation of any valid Condition imposed by the Director, Zoning Administrator, Area Planning Commission, City Planning Commission or City Council in connection with the granting of any action taken pursuant to the authority of this chapter shall constitute a violation of this chapter and shall be subject to the same penalties as any other violation of this Code."

Every violation of this determination is punishable as a misdemeanor and shall be punishable by a fine of not more than $1,000 or by imprisonment in the county jail for a period of not more than six months, or by both such fine and imprisonment.

APPEAL PERIOD - EFFECTIVE DATE

The applicant's attention is called to the fact that this grant is not a permit or license and that any permits and licenses required by law must be obtained from the proper public agency. Furthermore, if any Condition of this grant is violated or if the same be not complied with, then the applicant or his successor in interest may be prosecuted for violating these Conditions the same as for any violation of the requirements contained in the Municipal Code. The Zoning Administrator's determination in this matter will become effective after July 16,_2012, unless an appeal there from is filed with the Department of 9ity Planning. It is strongly advised that appeals be filed, early: during the appeal period and in person so that imperfections/incompleteness may be corrected before the appeal period expires. Any appeal must be filed on the prescribed forms, accompanied by the required fee, a copy of the Zoning Administrator's action, and received and receipted at a public office of the Department of City Planning on or before the above date or the appeal will not be accepted. FINDINGS OF FACT

After thorough consideration of the statements contained in the application, the plans submitted therewith, the report by the Department of City Planning Staff thereon, and the statements made at the public hearing on April18, 2012, all of which are by reference made a part hereof, as well as knowledge of the property and surrounding district, I find that the requirements for authorizing a conditional use permit under the provisions of Section 1224-W have been established by the following facts:

BACKGROUND

The subject site is a level rectangular-shaped through parcel consisting of two adjoining lots that comprise a full city block, bounded by Vine Street, Sunset Boulevard, Morningside Court, and Selma Avenue. The site is approximately 3.4 acres in area and is developed with a 5-story mixed use development in four adjoining buildings fronting along Vine Street, Sunset Boulevard and Selma Avenue, and a 7 -level parking structure located mid-block on Morningside Court with parking for 855 vehicles, . . The applicant is requesting to allow the sale and dispensing of a full line of alcoholic beverages for off-site consumption within .a proposed 23,509 square-foot Walgreens pharmacy to be located in an existing ground floor retail space of the 5-story mixed use building with residential dwelling units located on the upper floors. The hours of operation for the pharmacy will be 24 hours daily, with alcoholic beverage sales proposed from 6:00 a.m. to 2:00a.m. daily. · ·

The sale of alcoholic beverages was originally approved on the subject property in 1999 under Case No. ZA 98-0898(CUB)(CUZ)(ZV), which allowed for five full-line and three beer and wine alcohol sales permits in restaurants, one full-line in a movie theater, and two full­ line for off-site sales in retail food markets. Subsequently, in 2002, under related Case No. Case No. ZA 98-0898(CUB)(ZV)(PAD)(PA), the Zoning Administrator revised the approval to include five full line of alcohol and one beer and wine only permit in restaurants, one full line permit in a nightclub/bar, and one full line permit for off-site consumption. Condition 10 of Case No. ZA 98~0898(CUB)(ZV)(PAD)(PA) required that subsequent Plan Approval applications be filed for each future project, requesting permission to serve CASE NO. Although the one off-site license has never been utilized, the time to allow such license through the Plan Approval process has expired. Therefore, the instant new Conditional Use request is required to allow for the off-site sale of alcoholic beverages within the proposed new Walgreens pharmacy.

The general area surrounding the subject property is an intensive commercial district oriented mainly toward Vine Street and Sunset Boulevard with a wide variety of commercial uses, including theaters, restaurants, and retail businesses. Many buildings are also mixed use with residential units on their upper floors.

Properties to the north of Selma Avenue are zoned C4-2D, C4-2D-SN, and (T)(Q)C4-2-SN and developed with a surface parking lot and a small one-story fast food restaurant fronting Vine Street with a large 5-story apartment building (4 stories over at-grade parking) on the west half of the block fronting lvar Avenue to the west.

Properties to the south of Sunset Boulevard are zoned C4-2D-SN and developed with a 3- story bank located on the southwest corner of Sunset Boulevard and Vine Street, with a vacant two-story commercial building farther west. The Arc light Cinerama Dome Theater is located south of the bank building on Vine Street.

Properties to the east of Vine Street are zoned C4-2D-SN and (T)(Q)C4-2-SN and developed with surface parking lots on the east side of Vine Street and a one-story Chase Bank at the northeast corner of Vine Street and Sunset Boulevard.

Case No. ZA 98-0898 CUB ZV PA -On November 20, 2000, the Zoning Administrator approved an Approval of Plans to replace the previously approved movie theater complex with 105,000 sq. ft. of mixed retail and restaurant uses and 300 apartment units.

Case No. ZA 201 0-1139(PAB) - On December 2, 2010, the Zoning Administrator approved an Approval of Plans to permit the on-site sale of a full line of alcoholic beverages in conjunction with the operation of a new 7,950 square-foot restaurant with seating for 197 patrons on two levels ( 17 5 indoor seats and 22 outdoor seats) with occasional live entertainment in [Q]C4-2-SN Zone. The address is 1600 North Vine Street, Suite 103.

Case No. ZA 2010-0460 (CUB)- On June 29, 2010, the Zoning Administrator approved a Conditional Use Permit to allow the sale and dispensing of a full line of alcoholic beverages for on-site consumption in conjunction with a 2,837 square-foot restaurant in the (Q)C4-2D-SN Zone. The address is 6290 Sunset Boulevard.

Case No. ZA 2009-0545(CUI;ll - On September 17, 2009, the Zoning Administrator approved a conditional use to allow the sale and dispensing for consideration of beer and wine for on-site consumption in conjunction with a proposed restaurant. The address is 6278 Sunset Boulevard.

The subject site is located within the Hollywood Community Plan area, ls zoned C4-2D-SN, and has a Regional Center Commercial land use designation ..

Sunset Boulevard is a designated Major Highway, Class II dedicated to a 100-foot width at the project's street frontage and is improved with curbs, gutters, and sidewalks.

Vine Street is a designated Major Highway, Class II dedicated to a 100-foot width at the project's street frontage and is improved with curbs, gutters, and sidewalks.

Selma Avenue is a Local Street dedicated to a 60-foot width at the project's street frontage and is improved with curbs, gutters, and sidewalks.

PUBLIC HEARING

The public hearing was conducted on April 18, 2012 in Room 1020 at downtown Los Angeles City Hall. The public hearing was attended by the applicant's representative, Matt Dzurec, representatives from Walgreens Tri Leu (Southern California-Central District Manger) and Amy Ciolek (Regional Development Manager) and Officer Grey of the Los Angeles Police Department.

Mr. Dzurec made the following statements in support of the request: e The request for on-site tasting, which was part of the Master CUB, has been dropped; "' This Walgreens will different from most as it will have areas for food consumption (sushi and yogurt bar); e Alcohol will be in back of store and moderate to high end; • The complex has its own security officers including 23 on-site security cameras, two of which are on the exterior facing Vine Street and Sunset Boulevard; • Walgreens would prefer not to be required to provide a security officer specific to the business, as that security is adequately addressed building wide;

Officer Grey made the following statements: • Sunset + Vine has a high pedestrian volume • Security will cut down on litter, prostitution, etc • LAPD is opposed to the sale of single cans and bottles • On-site consumption should be prohibited

<11> Applicant should be required to provide three month security library

Matt Dzuerc responded to the security concerns: • The building was security which patrols the entire building, include Walgreens area

The Zoning Administrator requested that the applicant and LAPD meet to craft conditions that were mutually acceptable. Additionally, a condition related to the sale of single bottle cans, the number of fluid ounces, and prohibiting the sale of single cans of beer out of six­ packs will be added.

BASIS FOR CONDITIONAL USE PERMITS

A particular type of development is subject to the conditional use process because it has been determined that such use of property should not be permitted by right in a particular zone. All uses requiring a conditional use permit from the Zoning Administrator are located within Section 12.24 of the Los Angeles Municipal Code. In order for the sale of a full line of alcoholic beverages for off-site consumption to be authorized, certain designated findings have to be made. ln these cases, there are seven standard findings for most conditional use categories.

MANDATED FINDINGS

Following (highlighted) is a delineation of the findings and the application of the relevant facts to same: CASE NO. ZA 2012-117(CUB) PAGE 13

1. The proposed location will be desirable to the public convenience or welfare.

The subject site is located in the Hollywood Community Plan and has a Regional Center Commercial land use designation. The site is approximately 3.4 acres in area and is developed with a 5-story mixed use development with ground floor commercial uses in four adjoining buildings with Vine Street, Sunset Boulevard and Selma Avenue frontages, and a ?-level parking structure located mid-block on the Morningside Court frontage with parking for 855 vehicles. The proposed project involves tenant improvements to accommodate a new Walgreens pharmacy in a ground floor tenant space recently vacated by a Borders book store.

The applicant is requesting a conditional use to allow the full line of alcoholic beverages for off-site consumption in conjunction with a 23,509 square-foot Walgreen's pharmacy. The store will operated 24 hours daily with the sale of alcohol occurring from 6:00 a.m. to 2:00 a.m. daily. The property is located at the intersection of two Class II Major Highways and is well served by public transit. lt is easily accessible to persons working, shopping or conducting business in the area, traveling through, or living in nearby residential neighborhoods. The proposed location is suitable for the project, which promotes the community's convenience and economic vitality while enhancing the development of the community.

In addition, the property is located within the Hollywood Redevelopment Project area, the Los Angeles State Enterprise Zone and the Hollywood Entertainment District Bl D, all of which encourage economic development. The proposed project is in conformance with the spirit and intent of the General Plan and other City polices which aim to promote the subject property and its immediate area with healthy and viable commercial activity. Business activity will be directed away from any nearby sensitive uses and toward the commercially developed thoroughfares.

Furthermore, to ensure the location will be desirable to the public convenience, the Zoning Administrator has imposed conditions of approval that will serve as a safeguard to the public as further explained below.

2. The location is proper in relation to adjacent uses or the development of the community.

The general area surrounding the subject property is an intensive commercial district oriented mainly toward Vine Street and Sunset Boulevard with a wide variety of commercial uses, including theaters, restaurants, and retail businesses. Many buildings are also mixed use with residential units on their upper floors.

Surrounding uses to the north consist of a large 5-story apartment building (4 stories over at-grade parking) on the west half of the block fronting lvar Avenue to the west and a surface parking lot with a recently vacated sma!l one-story fast food restaurant fronting Vine Street in the C4-2D, C4-2D-SN and (T)(O)C4-2-SN Zones.

Properties to the east of Vine Street are zoned C4-2D-SN and (T)(Q)C4-2-SN and developed with surface parking lots on the east side of Vine Street and a one-story Chase Bank at the northeast corner of Vine Street and Sunset Boulevard.

Properties to the west of Morningside Court are zoned C4-2D-SN and developed with a 6-story office building fronting Sunset Boulevard to the south, with an adjoining multi-story parking structure on the north portion of the block.

There are no single-family uses in the immediate area. The project site is located in a dense urban area, at the northeast corner of the intersection of Vine Street and Sunset Boulevard. The location is an appropriate location for a pharmacy with the off-site sales of a full line of alcoholic beverages. As proposed, the use will serve public convenience and welfare and as sited, the location is compatible with the surrounding community. The Zoning Administrator has imposed a number of conditions addressing alcohol-related issues that will safeguard public welfare and enhance public convenience. The proposed use will provide services that are in close proximity to the businesses and residents within the neighborhood.

3. The use will not be materially detrimental to the character of the development in the immediate neighborhood.

The use and location will not be materially detrimental to the character of the development in the immediate neighborhood because the area along Vine Street is developed with similar mixed-use buildings with ground floor retail establishments. Walgreens is an established business in the Hollywood community, and a nationally recognized brand. The company has established detailed procedures in place in all of its stores to sell a full line of alcoholic beverages with a high degree of responsibility. In addition, numerous conditions of approval have been imposed herein to protect the surrounding community from potential adverse impacts related to the use. The subject property is also in an established commercial area which is an appropriate location for the proposed use.

The nearest residential properties are located in the apartments above the project. However, the site was developed as a mixed-use property with multiple ground floor commercial tenant spaces and the proposed Walgreens pharmacy will be located in at the corner of Vine Street and Sunset Boulevard in tenant space recently vacated by Borders bookstore. No expansion of the building is proposed and the building has been in operation since 2002. As such, the sale of a full line of alcoholic beverages for off-site consumption will not be materially detrimental to the character or development in the area.

4. The proposed location will be in harmony with the various elements and objectives of the General Plan.

There are eleven elements of the General Plan_ Each of these Elements establishes policies that provide for the regulatory environment in managing the City and for CASE NO. ZA 2012-117(CUB) PAGE15

addressing environmental concerns and problems. The majority of the policies derived from these Elements are in the form of Code Requirements of Los Angeles Municipal Code. Except for the entitlement described herein, the project does not propose to deviate from any of the requirements of the Los Angeles Municipal Code. The Land Use Element of the City's General Plan divides the city into 35 Community Plans. The project site is located within the Hollywood Community Plan Area and the Plan Map designates the property for Regional Center Commercial land use with corresponding zones of C4, C2, P and PB and Height District No. 20. The project addresses some of the commercial goals and objectives identified in the Hollywood Community Plan, including:

Objective 4 a. Allocating and distributing commercial lands for retail, service, and office facilities in quantities and patterns based on accepted planning principles and standards.

The subject property is planned, zoned and developed for/with commercial uses and the pharmacy is permitted by right. The General Plan promotes the provision of services throughout the City in locations that are convenient to the public yet that do not impact nearby properties. The proposed sale of alcoholic beverages for off-site consumption would not impair the integrity and character of the zone in which it is located. The zone is designated for various commercial uses, and no significant problems or negative impacts have been caused by similar uses in the area or their patrons. However, the Hollywood Community Plan text is silent with regards to alcohol sales. In such cases, the Zoning Administrator must interpret the intent of the Plan. Given the numerous conditions of approval, the proposed use can be deemed to be in harmony with the General Plan. In addition, the proposed use advances the goal of the community plan to encourage appropriate commercial development and revitalize the surrounding community.

5. The proposed use will not adversely affect the welfare of the pertinent community

The approval of the conditional use request will not adversely affect the welfare of the community. The subject property is zoned for commercial uses and will be utilized as such with the proposed sale of alcoholic beverages for off-site consumption in conjunction with a proposed Walgreens pharmacy. The use will not adversely affect the economic welfare of the community because the pharmacy will positively impact the financial health of the property and improve the economic vitality of the area via increases in taxable revenue and local employment. The approval of the conditional use will not adversely affect the welfare of the community.

6. The granting of the application will not result in an undue concentration of

premises for the sale or dispensing for consideration of alcoholic beverages 7 including beer and wine, in the area ofthe City involved, giving consideration to applicable State laws and to the California Department of Alcoholic Beverage Control's guidelines for undue concentration; and also giving consideration to the number and proximity of these establishments within a one thousand foot radius of the site, the crime rate in the area (especially CASE NO. ZA 2012-117(CUB) PAGE16

those crimes involving public drunkenness, the illegal sale or use of narcotics, drugs or alcohol, disturbing the peace and disorderly conduct), and whether revocation or nuisance proceedings have been initiated for any use in the area.

According to the California State Department of Alcoholic Beverage Control licensing criteria, 3 on-site and 3 off-site licenses are allocated to the subject Census Tract No. 1907, which had a population of 3,269 as of January 1, 2005. There are currently 47 active licenses within this census tract, including 44 on-site alcohol licenses, 3 off-site licenses. The applicant is proposing to add one off-site license to this census tract bringing the total number of off-site licenses to four. Over-concentration is not undue when the approval of a license does not negatively impact an area, but rather such license benefits the public welfare and convenience. The proposed Walgreens pharmacy wi ll not adversely affect the community because the proposed use is a desirable use in an area planned and zoned for such.

Statistics from the Los Angeles Police Department's Hollywood Division Vice Unit reveal that in Crime Reporting District No. 646, which has jurisdiction over the subject property, a total of 2,000 crimes were reported in 2010, compared to the citywide average of approximately 169 crimes and the high crime reporting district average of approximately 203 crimes for the same period. Crimes reported by LAPD include Rape (6), Robbery (20), Aggravated Assault (50), Burglary (25), Auto Related (81 ), Personal Theft (14), Other Theft (174), Auto Theft (21), Other Assaults (42), Forging/Counterfeit (3), Embezzlement/Fraud (6), Stolen Property (5), Weapon Violations (4), Prostitution Related (17), Sex Offenses (4), Narcotics/Drug Violations (227), Liquor Law Violations (21 ), Drunkenness (431), Disturbing the Peace (4), Disorderly Conduct (18), DWI Related (182), and Other Violations (615). Based upon the results of consultations between the applicant and LAPD, the Zoning Administrator has imposed a number of conditions related to the service of alcohol that will further reduce any potential crime issues.

7. The proposed use will not detrimentally affect nearby residentially zoned communities in the area of the City involved, after giving consideration to the distance of the proposed use from residential buildings, churches, schools, hospitals, public playgrounds and other similar uses, and other establishments dispensing, for sale or other consideration, alcoholic beverages, including beer and wine.

The Hollywood Community Plan designates the property for Regional Commercial uses and the property is zoned is zoned C4-2D-SN . Sensitive land uses within 1,00 feet of the property include:

Approval of the conditional use at this location will not detrimentally affect nearby multi-family residential zoned properties because the tenant space has historically been utilized for retail purposes in a primarily commercial and entertainment distrlct. The proposed use will be suitable at this location because the building was designed and developed with active ground floor uses along Vine Street which is a prime pedestrian connection between the entertainment and commercial uses on Hollywood Boulevard and Sunset Boulevard and attracts an eclectic and diverse mix of retail and restaurant uses in the heart of the Hollywood Entertainment District Also, the operation of a pharmacy will continue to provide convenience for the residents, workers and visitors within the community. Thus, the approval of the conditional use will not detrimentally affect the residentially zoned properties.

ADDITIONAL MANDATORY FINDINGS

8. The National Flood Insurance Program rate maps, which are a part of the Flood Hazard Management Specific Plan adopted by the City Council by Ordinance No. 172,081, have been reviewed and it has been determined thatthis project is located in Zone C, areas of minimal flooding.

9. On April 4, 2012, the Department of City Planning issued Mitigated Negative Declaration No. ENV-2012-118-MND (Article V - City CEQA Guidelines) and determined that this project will not have a potentially significant effect on the environment, subject to compliance of the mitigation measures outlined in the Mitigated Negative Declaration. 1 hereby adopt that action.
