Michael Chertoff Secretary of Homeland Security Department of Homeland Security Washington, DC 20528 Dear Secretary Chertoff: The undersigned companies and associations strongly object to a recent proposal by U.S. Customs and Border Protection (CBP) that ignores significant judicial precedent, suddenly seeks to overturn almost two decades of agency practice, and, if allowed to be implemented, would amount to a hidden tax on U.S. consumers. In a January 24 Federal Register notice, CBP proposed a new interpretation that will dramatically alter the way in which the transaction value of imported articles is calculated. This revised interpretation would overturn the so-called —first sale“ rule, resulting in the assessment of significantly higher duties on U.S. imports, leading to higher prices for U.S. consumers. In justifying this action, CBP is relying upon a non-binding commentary issued by the Brussels- based World Customs Organization‘s (WCO) Technical Committee on Customs Valuation to toss out 20 years of legal precedent and Administrative practice that have been consistently reaffirmed by U.S. courts and by CBP itself. This proposal is not only flawed and highly objectionable, but also is particularly disturbing with regard to the timing, process and manner that CBP employed to publish its position. The Administration and Congress have just completed work on an economic stimulus package that will promote more consumer spending, yet CBP is proposing a move that would undercut essential goals of that package. Moreover, while government and business have collaborated as partners to protect our ports and boost our economy, the decision to put forward such a significant change in practice without consultation with the U.S. -

Math in the Media: Syndicated Programming Math In The Media Syndication Ratings: Talk Shows, Game Shows Finish Season Strong First-Run Strips Gear Up for Sept. 10 Season Premieres By Paige Albiniak — Broadcasting & Cable, 9/5/2007 The 2006-07 syndication season came to a close in the week ending Aug. 26, with talk and game shows hitting a high note while most first-run strips prepared for their Sept. 10 season premieres. In talk, the week’s big winner was NBC Universal’s The Martha Stewart Show, which will also begin running in primetime on Scripps’ Fine Living Sept. 10. The show gained 11% to a 1.0 household rating, according to Nielsen Media Research. That’s thanks in part to a 1.2 rating after Donny Osmond appeared Aug. 21. Warner Bros.’ Ellen also had a good showing, jumping 7% to a 1.6. Ellen kicked off her fifth season Tuesday with an appearance by Sen. Hillary Clinton (D-N.Y.). That show, which aired from New York, averaged a 2.5 rating/7 share in 55 metered markets. That’s up 19% from Ellen’s September 2006 launch, at a 2.1/6, and up 39% from her 1.8/6 average lead-in. The third-largest gain in talk went to NBC Universal’s Maury, which jumped 5% to a 2.1. Among the top three, CBS’ Oprah was flat at a 4.4; CBS’ Dr. Phil was down 5% to a 3.5; and Disney-ABC’s Live with Regis and Kelly dropped 10% to a 2.6 with a week of “repackaged” episodes. -

The story is set in 1968. 1 | P a g e As Gary Jones sat in the hotel restaurant in Norwich eating his steak and chips he reflected on what had been a good week so far for sales. It was a Thursday night in October 1968. He had secured several big orders from customers in his patch. He had been on the road for three days and was looking forward to getting home and seeing his wife in Peterborough tomorrow. Perhaps he might sit at the bar for a drink after dinner. There only seemed to be one other man at the bar, nursing a beer. Nine months ago, he had been working for a tractor dealer in Peterborough. Sometimes he had to travel round Cambridgeshire, Lincolnshire and Norfolk, selling spare parts. Although he was a successful salesman he found it slightly dull. He had been looking for a new job that paid bonuses based on sales as he knew he would make more money that way. It was his wife who had pointed out the advert in the local paper for a sales rep for a local firm, called Webbers. He had seen the ad but had skipped over it. The sales rep would be selling women’s lingerie and hosiery to department stores and family run businesses anywhere in the UK. Although the firm was also based in Peterborough it would probably mean being away from home most weeks. “But I don’t know anything about women’s clothes, “he said in protest. -
