Seven of the world’s 10 fastest- growing economies currently are in Africa. High prices for the continent’s oil and mineral exports have brought a surge of government revenue and investment, but the growth is occurring in O commodity-poor countries as well. Better governance, less war and the rapid spread of cell phones and other communication technologies are fostering growth even in nations with few natural resources. Debt for - giveness and the rise of China, India and other emerging markets as trading partners and sources of investment also have spurred economies forward. Demographers say that with the continent’s working-age population projected to expand by a third by 2020, Africa could benefit from a “demographic dividend” that would fuel sustained economic growth, even as populations in developed coun - tries and Asia are growing older. Yet, the population boom also poses challenges: Africa’s economies must provide enough jobs for the growing number of workers with expectations of a better life. Construction cranes punctuate the skyline of Luanda, Angola’s capital, where a building boom is being financed in part by high world prices for the country’s oil exports. As in other oil-exporting African countries, a flood of petro-dollars has fueled Angola’s robust growth — more than 14 percent annually in recent years — despite a sluggish global economy. South Africa’s anti-corruption bodies Judith February The National Prosecuting Authority and the Public Protector were intended to operate in the interests of the law and good governance but have they, in fact, fulfilled this role? This report examines how the two institutions have operated in the country’s politically charged environment. With South Africa’s president given the authority to appoint key personnel, and with a political drive to do so, the two bodies have at times become embroiled in political intrigues and have been beholden to political interests. Abstract The purpose of this study is to investigate how the media have been reporting on land and agrarian reform developments in South Africa focusing on the post green paper (2011). Land and agrarian reform has been a sensitive field in the post-apartheid South Africa mainly because of the racial disparity on land ownership and the widening gap between the rich and poor. This study explores the literature available on land and agrarian reform, tracing the history of dispossession back to 1650 when Jan van Riebeck built a Fort in Cape Town in the shape of designated reserves. The 1894 Glen Grey Act, the 1913 Native Land Act and the 1936 Native Trust and Land Act as well as sundry other apartheid racist laws led to forced removals of native South African from their fertile lands into reserves, whilst the minority whites were acquiring vast tracks of farmland (Hendricks 2000, Baldwin 1975). This study further explores post apartheid government’s efforts to reverse the history of dispossession. The Department of Land Affairs introduced sundry policy interventions since 1994 which were supported by the Constitution of South Africa and in line with the dictates of the RDP program. These include the White Paper on Land Affairs (1997) policy framework, and several laws on land tenure, restitution and redistribution. South African democracy is more than two decades old, yet the land reform process is far from achieving the 30% target which had been set to be met in five years. More than three quarters of the productive agricultural land is still in the hands of the white minority, communal tenure system have not yet fully been addressed, farm labourers are still working under squalid, land restitution has been successful mainly on urban financial compensation claims and some rural land claims are still to be resolved. -

It is also a country run by a government which has itself become increasingly lawless. This is so despite all the commitments to legality set out in the Constitution. Not only is the post–apartheid South Africa founded upon the principle of legality, but courts whose independence is guaranteed are vested with the power to ensure that these principles are upheld. Prosecuting authorities are enjoined to exercise their functions “without fear, favour, or prejudice”. The same duty is laid upon other institutions established by the Constitution, among them the public protector and the auditor general. Everyone is endowed with the right to “equal protection and benefit of the law”. We are all also entitled to “administrative action that is lawful, reasonable, and procedurally fair”. Unlike the old South Africa – no doubt because of it – the new Rechtsstaat was one where the rule of law would be supreme, power would be limited, and the courts would have the final say. This edifice, and these ideals, are under threat. Lawlessness on the part of the state and those who run it is on the increase. The culprits run from the president down to clerks of the court, from directors general to immigration officials, from municipal managers to prison warders, from police generals to police constables, from cabinet ministers to petty bureaucrats. -

Committed to Unity: South Africa’s Adherence to Its 1994 Political Settlement Paul Graham IPS Paper 6 Abstract This paper reviews the commitment of the remaining power contenders and other political actors to the settlement which was reached between 1993 and 1996. Based on interviews with three key actors now in opposing political parties represented in the National Assembly, the paper makes the case for a continued commitment to, and consensus on, the ideals and principles of the 1996 Constitution. It provides evidence of schisms in the dominant power contender (the African National Congress) which have not led to a return in political violence post-settlement. The paper makes the point that, while some of this was the result of President Nelson Mandela’s presence, more must be ascribed to the constitutional arrangements and commitments of the primary political actors and the citizens of South Africa. © Berghof Foundation Operations GmbH – CINEP/PPP 2014.
