Grundlage für die Anzeige ist das Gesetz über die Deutsche Nationalbibliothek (DNBG) vom 22. Juni 2006 (BGBl. I, S. 1338). Monografien und Periodika (Zeitschriften, zeitschriftenartige Reihen und Loseblattausgaben) werden in ihren unterschiedlichen Erscheinungsformen (z.B. Papierausgabe, Mikroform, Diaserie, AV-Medium, elektronische Offline-Publikationen, Arbeitstransparentsammlung oder Tonträger) angezeigt. Alle verzeichneten Titel enthalten einen Link zur Anzeige im Portalkatalog der Deutschen Nationalbibliothek und alle vorhandenen URLs z.B. von Inhaltsverzeichnissen sind als Link hinterlegt. As the prototype of that group, I shall use the law of Germany or, more specifically, the law of the Federal Republic of Germany. The re- lation between the law of that country and the other Germanic laws is not entirely the same as that between the law of France and the other Romance laws, all of which consist of legislative enactments consciously based upon the model of the laws of France. INTRODUCTION Euthanasia, a subject that has long been a dilemma for medical ethics, has received more attention in the last decade than ever before in the United States.! SwEIGERT* Last year I had the privilege of spending a month in Germany, with a group of six American lawyers, at the invitation of the German govern- ment for the purpose of making a survey of the legal system of the Republic. The trip took us to Bonn, the federal capital, for conference with representatives of the Federal Ministry of Justice and Federal Parliament; to Karlsruhe, the seat of the principal federal courts; to Munich, capital of the State of Bavaria, for a study of the state courts; and to Berlin, Hamburg and other cities for further observation of the bench, the bar and the ministries. We had the fine experience of attending courts of all kinds, federal and state, trial and appellate, and the pleasure of conferring with many German judges, lawyers and officials. Some of them had visited the United States to observe our courts.

    The Congress of Local and Regional Authorities 22nd SESSION CG(22)7 14 March 2012 Local and regional democracy in Germany Monitoring Committee Rapporteur:1 Britt-Marie LÖVGREN, Sweden (L, ILDG2) Draft recommendation (for vote) .............................................................................................................. 2 Explanatory memorandum ....................................................................................................................... 5 Summary This report is the first general monitoring of the European Charter of Local Self-Government on Germany (a visit carried out in 1999 focused solely on local finances, evaluated at the time as being in a critical situation). The report sets out in detail the complex structure of the regional and local authorities in the country. The Rapporteurs praise the federal and regional (Länder) constitutions for their recognition of the principle of local self-government. They draw the attention of the German authorities, however, to the persistent financial deficits of local and regional authorities, and underline the need to establish practical guarantees that complement constitutional provisions. It is recommended to the German authorities that they strengthen and institutionalise the participatory rights of associations of local authorities both at federal and regional (Land) level. They are encouraged to set standards and criteria for concomitant financing in order to provide transparency in the whole financial calculation and planning process. The Government is also invited to consider extending counties’ rights to impose taxes directly beyond the available ones. Finally, Germany is called on to ratify the Additional Protocol to the European Charter of Local Self-Government on the right to participate in the affairs of a local authority. 1 The Co-rapporteur Mr Ignacio Sanchez Amor is no longer a member of the Congress since December 2011.

ALLISON*, Departmental Editor A number of cases involving questions of international law have been decided recently by both federal and state courts. Production of Evidence Located in Foreign Jurisdictions The Case of United States of America v. FirstNational City Bank, 396 F. 2d 897 (2d Cir. 1968), raises an issue that has become more important with the increase in foreign trade and the number of companies with branch offices abroad. First National City Bank of New York refused to comply with a subpoena duces tecum to produce certain documents located at its office in Frankfurt, Germany in connection with a Federal Grand Jury investigation of alleged violations of the United States antitrust laws by two of its customers on the grounds that violation of bank secrecy could subject the bank to civil liability and economic loss under the laws of Germany. The court affirmed the lower court's decision holding the bank and the officer responsible for the refusal in contempt, and held that under international law a state which has jurisdiction to enforce a law is not precluded from exercising its jurisdiction solely because it requires a person to engage in conduct subjecting him to liability under the laws of another state which has jurisdiction with respect to that conduct. Since the court had in personam jurisdiction over the bank, it had the power to require the production of the documents located in Germany despite the potential civil liability. In reaching its decision the court, with the assistance of expert witnesses, carefully reviewed the so-called "bank secrecy law" of Germany, which, it was found, is not statutory but rather is in the nature of a privilege that may be waived by the customer but not the bank.

    Agreement between the Federal Republic of Germany and the Republic of Bulgaria for the Avoidance of Double Taxation and of Tax Evasion with respect to Taxes on Income and on Capital - 2 - The Federal Republic of Germany, and the Republic of Bulgaria – Desiring to promote their mutual economic relations by removing fiscal obstacles and to strengthen their cooperation in tax matters – Have agreed as follows: Chapter I Scope of the Agreement Article 1 Persons Covered This Agreement shall apply to persons who are residents of one or both of the Contracting States. Article 2 Taxes Covered (1) This Agreement shall apply to taxes on income and on capital imposed on behalf of a Contracting State, of a Land or a political subdivision or local authority thereof, irrespective of the manner in which they are levied. (2) There shall be regarded as taxes on income and on capital all taxes imposed on total income, on total capital, or on elements of income or of capital, including taxes on gains from - 3 - the alienation of movable or immovable property, taxes on the total amounts of wages or salaries paid by enterprises, as well as taxes on capital appreciation. (3) The existing taxes to which this Agreement shall apply are in particular: a) in Germany: - the income tax (Einkommensteuer); - the corporation tax (Körperschaftsteuer); - the trade tax (Gewerbesteuer) and - the capital tax (Vermögensteuer) including the supplements levied thereon (hereinafter referred to as “German tax”); b) in Bulgaria: - the personal income tax; - the corporate income tax and - the real property tax (hereinafter referred to as “Bulgarian tax”).

    Card Payments and Consumer Protection in Germany by Maximilian Yang1 Freie Universität Berlin First published in the Anglo-German Law Journal 2016, 6-37. Abstract (English) While the lion’s share of consumer payments in Germany is still cash-based, card payments are steadily becoming more popular in retail. However, many consumers are unaware of their rights against merchants trying to impose unfair conditions on them. The first part of this article discusses the payments culture in Germany which differs significantly from the situation in many neighbouring EU countries. The second part focuses on consumer protection matters in the cardholder-merchant relationship, discussing the discharge of contractual debt by card payment as performance, potential contractual duties of merchants to accept cards and legal restrictions of surcharges on consumer payments. Furthermore, the practice of certain local government councils to require customers to pay with domestic cards of a specific brand (girocard) in place of cash or cards of other brands, is analysed with reference to European law.
