The matter was placed before the RTA held on 31.01.2013. RTA considered it as item No.14 and decided as follows. “ Heard. Adv.G.Prabhakaran the learned counsel represented the applicant. Secretary RTA Ernakulam has reported that vide file No.G/4795/2012 /E dated 09.11.2012 that portion of the route from Kumbalam to Tripunithura, 18.6 KM in length lies in Ernakulam Dist. Secretary RTA Alappuzha will call concurrence of RTA Ernakulam for the portin lying in Ernakulam Dist. And place it in next RTA. Hence adjourned”. After obtaining concurrence from Secretary RTA Ernakulam, the matter was again placed before the RTA held on 21.02.2014 as item no.1. RTA considered the item and decided as follows; “ The learned counsel represented the applicant. The applicant has not offered particulrs of a suitable vehicle even at the meeting of this authority. As per para 6 in 2010 (4) KLT 597 (SC) it is clear that RTA may grant permit U/S 72 (2) of M.V.Act 1988 for a stage carriage of a specified description. The expression specified description it is very wide and it shall be brought to the notice of RTA while granting the regular permit. In this case the applicant has not offered description of the suitable vehicle before this authority. The applied route objectionably overlaps 5 Kms on the notified route Ernakulam-Thekkadi from Vyttila to Boys HS Jn. Thripunithura and 1 KM from Aroor temple to Aroor church overlaps Trivandrum-Palakkad and Trivandrum-Kannur notified route. The total overlapping is 6 KM which is more than 5 % of total route length admissible in the notification as per clause 5 © of GO(P) No.42/2009/Tran. Dated 14.07.2009. For the above reason application for regular permit on the route Cherthala-Thripunithura is rejected.” Against the rejection of the application, the applicant has filed MVAA No.61/2014 before the Hon’ble STAT. The STAT vide judgement in MVAANo.61/2014 has directed the “appellant to submit a modified application for regular permit afer excluding objectionable overlapping to the notified route, before the Secretary RTA Alappuza and in that event of the RTA Alappuzha, before taking any decision on such modified application shall afford an opportunity of being heard to the appellant and the 3rd respondent who 7

represents the KSRTC and then, dispose of that application in accordance with law.” As such the applicant submitted modified application on the route Cherthala - Tripunithura via Chenganda – NSScollege – Infopark – Kelamangalam – Ottappunna – Thavanakkadavu – Polekkadavu – Thykkattussery – Mariathrikkai – Thevarvattom - Poochakkal Electricityu Jn. - Thaliyaparambu – Vaduthala – Perumbalam – Veeramangalam - Kattupuram – Arookutty – Aroor – Kumbalam – Kundannoor - Marad and Petta SN junction. Detailed enquiry has been conducted by Jt.R.T.O Cherthala and RTA held on 13.07.2016 considered the application as item No.S-01 and decided as follows.

1. Perused the Judgment in MVAA No. 61/2014 of State Transport Appellate Tribunal Eranakulam. 2. Perused the Judgment in WP© No. 21971 of 2015 (V) of the Hon’ble High Court of . 3. Heard Adv. G. Prabhakaran the learned counsel represented the applicant. This is an application for inter district fresh regular permit on the modified route as Cherthala – Thrippunithura for 5 years. Detailed enquiry has been conducted through Jt. RTO Cherthala and has submitted a report in this regard. Total route length is 72.5 kms. There is no virgin portion. There is an overlapping of 3.5 kms which is within the permissible limit of 5% of the total route length as per GO(P) No. 42/2009/Trans dtd. 14.07.2009. The learned counsel represented for KSRTC alleged that there is a total overlapping of 3.8 kms. The counsel also requested for combined inspection regarding the overlapping length and place it in next RTA. Hence adjourned.

On 08.08.2017 the applicant submitted a modified application alongwith a judgment in MVAA No. 270/2015 dtd.29.05.2017 of the Hon’ble State Transport Appellete Tribunal, Ernakulam. It is directed to reconsider the entire matter in the light of Exts.P2 and P3 (Modified application) and pass fresh orders within four months from the date of receipt of copy of this judgment.

The matter was placed before the Regional Transport Authority Alappuzha held on 13.07.2016. The RTA considered the application and decided as follows;

“Heard Adv. G. Prabhakaran, the learned counsel represented the applicant. This is an application for the grant of fresh regular permit on the route Kanichukulangara – Cherthala – Vyttila Hub. The learned counsel represented KSRTC has objected the grant stating that the route length is 11

different. The enquiry officer has reported that there is only 2 Kms overlapping on notified route. KSRTC alleged that there is 2.8 Kms overlapping and which is 5.91% of the total route length is objectionable. The applicant is also directed to provide additional trip to Kanichukulangara at peak hours of 9 to 11 and 4 to 6 so as to increase the travelling facility of the public. Secretary RTA Alappuzha is directed to collect a fresh enquiry report regarding the route length and overlapping and place the matter in the next RTA. Hence adjourned”.

Against the decision of the RTA dated 13.07.2016, the applicant produced a judgment in WP(C) No. 32401/2016 dtd.06.10.2016. It is directed to consider the application within one month from the date of receipt of a copy of this judgment. Fresh enquiry report is also received from JRTO, Cherthala and the matter was placed before the Regional Transport Authority Alappuzha held on 11.11.2016. The RTA considered the application and decided as follows;

“Heard the learned counsel represented the applicant. This is an application for reconsider the application for the grant of Fresh Regular Permit in respect of Suitable Vehicle on the route Kanichukulangara - Cherthala – Vyttila Hub (via) P.S. Kavala – Vallayil – Cherthala – Ottappunna – Thavanakkadavu – Poochackal – Perumbalam –Aroorkutty and Aroor Temple for 5 years. RTA held on 13.07.2016 directed Secretary RTA to re enquire regarding the distance of route length and overlapping. Re enquiry report collected and furnished by Secretary RTA and it is found that total route length is 49 kms out of which 39.8 kms lies in and 9.2 kms in Eranakulam district. The details of overlapping is as follows;

1. 0.3 km from Iron Bridge to Court Jn. on Trivandrum – Palakkad Notified scheme (25275/B/66/PW dtd. 26.08.1966) and also overlapping Trivandrum – Kannur (18118/TB3/PW dtd. 11.08.1966) 2. 1.2 kms from Court Jn. to Boys HS Jn. Overlapping on the same scheme as in 1. 3. 1.2 kms from Aroor Temple to Aroor overlapping in the same scheme as in 1&2. 4. 0.02 km from Vyttila exit to Vyttila Signal Jn overlapping Eranakulam – Thekkadi Scheme (26929/TB3/66/PW dtd. 12.10.1966) The total overlapping distance is 2.9 Kms which is 5.88 % of total route length and is objectionable and violating GO(P) no. 42/2009/Trans dtd. 14.07.2009. Hence this application for fresh regular permit is rejected”. 12

Against this decision the applicant produced a judgment in MVAA No.47/2017 dtd.28.06.2017. It is directed to re-examine the matter and pass fresh orders within a period of three months from the date of receipt of copy of the order.

Notes:-Stage Carriage KL 02 S 7474 is covered by Regular Permit on the route Aroormukkam – Kanichukulangara via Aroor, Ezhupunna, Thuravoor, Vayalar, Cherthala, Kuruppankulangara, Perumbrakavala, Areeparambu & Thiruvizha which is valid till 15/11/2021. Permit holder has applied for revision of existing timings. Enquiry conducted through MVI Cherthala reveals that it is not merely a time revision. It is found that the trips are changing towards Kanichukulangara in the afternoon. Since there is curtailing trip towards Kanichukulangara at 06.04pm from Cherthala and extending trip towards Kanichukulangara at 01.15pm. So it is purely an application for variation. Hence applicant is directed to submit application for Variation of permit. As such permit holder has submitted PVA application along with require fee for Variation. But no report has been ascertained from Joint Regional Transport Office, Cherthala regarding the variation.

Hence RTA may hear the applicant peruse the file and take a decision. 21

10. Necessity of variation with specific remark : Increase travelling facility on the en-route coastal area .

The above application was considered by Regional Transport Authority , Alappuzha held on 11/11/2016 and rejected with following remarks. On hearing KSRTC strongly objected the grant of variation. They objected that one number of trips increased in the notified route violating clause 19 of notification vide GO(p) No.42/2009/Trans dtd 14.07.2009. The proposed timings are entirely different with the existing timings which will cause inconvenience to the existing travelling public. The other operators and public raised their objections. Also the termini of the existing route has also varied. In these circumstances the authority feels that the proposed variation has not feasible. Hence the application rejected. Aggrieved by this decision the applicant filed appeal before the Hon’ble State Transport Appellate Tribunal, Ernakulam. In MVAA No.37/2017 dtd 09/10/2017 the Hon’ble court has directed Secretary RTA ,Alappuzha to consider the matter afresh and pass fresh orders, after taking into consideration of the G.O issued by the government and also in view of the contention raised within a period of four months from the date of receipt of copy of the judgment.

But the report provided with an advancement in departure time as 2.31 pm and 3.23 pm. The proposal includes both extension and curtailment.This route is now well served by KSRTC and other private stage carriages.The proposed curtailment of trips with their timings are noted below.

1) From Charumoodu to Chengannur at 2.31 pm 2) From Chengannur to Bharanicavu at 3.23 pm 3) From Bharanicavu to Chengannur at 5.27 pm 4) From Chengannur to Thamarakkulam at 7.35 pm.

The report also claims that, the proposed extension is beneficial to traveling public.

Requestant : Secretary, Regional Transport Authority, Pathanamthitta vide Endorsement No. G1/78143/2016/PTA dtd. 13/07/2017

The Regional Transport Authority, Pathanamthitta in its meeting held on 30/05/2017 considered the application for the grant of fresh regular permit in respect of suitable stage carriage on the route Sharngakkavu - Konny as item No:2 and the decision is made as follows. ”Heard, Secretary RTA is directed to obtain concurrence of RTA, Alappuzha for the portion from Sharngakkavu to Iranikuzhi Bridge (8.3 km) lying in Alappuzha district and hence adjourned.”.

With reference to the request of Secretary, Regional Transport Authority, Pathanamthitta enquiry has been conducted in this regard through JRTO, Chengannur and it revealed the following:

1. The portion of the route lying in Alappuzha district is from Sharngakkavu to Iranikuzhi Bridge 2. The distance of the portion lying in Alappuzha district is 8.3kms. 3. There is no virgin portion 4. The route portion in Alappuzha district is not overlapping in any of the notified route /Nationalized scheme.

Hence the RTA may hear the applicant, peruse the records and take a decision in the matter. 49

Notes:- The Hon’ble State Transport Authority, Kerala in its sitting held on 14.06.2017 has decided to fix the age limit for the stage carriages in applying and granting fresh regular stage carriage permits as follows.

 8 years for ordinary stage carriages  7 years for city/town stage carriages and  5 years for LSOS.

However, the life span of the stage carriages will be the same as per the earlier decision of the STA i.e., 15 years for ordinary city services and 10 years for LSOS.

Notes:- The Hon’ble State Transport Authority, Kerala in its sitting held on 14.06.2017 considered the scope of review of the decision taken by STA in the enhancement of general concurrence for stage carriage permits to 50 Kms instead of 20 Kms in the adjacent district at the time of renewal of inter district stage carriage permits and decided as follows.

“It is decided to grant renewal of permit without insisting concurrence from the sister RTAs. The Secretary RTA shall obtain detailed route enquiry and ascertain that there is no variation in the existing route along with the feasibility of the renewal application before placing it in the concerned RTAs”.
