And Respondent: The Assistant Executive Engineer, Electrical Sub Division, Pathanapuram. ORDER Forum received a petition drawn by the petitioner praying to dismantle the electric connections effected in the building owned by the petitioner without her knowledge or consent. Petition in short:- Petitioner Smt.K.Indira is the owner of the building bearing Nos. TP IX/719 to IX/724 under Thalavur Grama Panchayath. She has neither applied for electric connection nor gave consent to anybody for availing electric connection in the buildings/rooms bearing Nos TP IX/720 and 721. On receipt of the electricity bills dated 6.7.07 against consumer Nos.16631 and 16632 for Rs.138/- each the petitioner enquired with the KSE Board office and came to know that the above 2 nos connections have been effected in the name of petitioner, smt. K.Indira. The petitioner has lodged a complaint on 7.9.07 to the Assistant Engineer, Electrical Section, Vilakudy against obtaining electric connection in her name by impersonation. But no action has been taken so far. More over the petitioner has applied for electric connection for the buildings bearing Nos from. TP IX/723 and TP IX/724 on 12.9.07. The petitioner prays for canceling the connections effected as above, and to dismantle the meter and other equipments. 3 Version filed by the respondent: As per the office records service connection is seen effected to building nos. 722 and 721 as consumer Nos. 16631 and 16632 respectively in favour of Smt.K.Indira, Thekkevilayil Puthen Veedu, Njarakkad. No service connection is effected to building No. IX/720. Copies of documents were furnished by the respondent in the name of Smt.Indira.K, namely the agreement executed in her name, copy of ownership certificate in her favour etc. Findings of the Forum:- Forum considered the petition on 26.04.08 and 12.05.08. The Forum examined the copies of Identity cards furnished by the petitioner and convinced the identity of the petitioner as Smt.Indira, wife of Sri.Ramachandran, R.C Bhavan, Andoorkonam. It is admitted by the respondent that, 2 nos electric connection were given in the name of the petitioner, on the strength of ownership certificate, tax receipt etc produced in the name of Smt.K.Indira, Thekkevilayil Puthen Veedu, Njarakkad, Thalavoor.P.O. The documents furnished were verified with the particulars in the application for electric connection, and found satisfactory, before effecting the connections. But the identity of the applicant was not verified while processing the application as it is not done usually. On comparing the signatures in the service connection documents and in the petition submitted before the Forum, it is seen that these two signatures are entirely different and hence an impersonation misleading the KSE Board authorities has taken place. On examining an application dated. nil from smt. K.Syamala Devi Amma, Thekkevila Puthen Veedu, Nadutheri, Thalavoor addressed to the Assistant Engineer, Electrical Section, Vilakudy for getting reconnection to the consumer Nos.16631 and 16632, it is seen that Smt.Syamala devi admits that, she had furnished the application for electric connection in the name of Smt.Indira.K. The signature in the application was put by Smt. Indira herself when she came to her residence. On verifying the signature of Smt.Indira it is seen that the signature put on the application and the agreement for service connection are bogus and so also the very application for electric connection. Thus it is evident that Smt.Syamala devi has managed to get the above 2 nos electric connections in the name of Smt. Indira.K, by pretending herself to be smt. Indira.K, and misleading the KSE Board authorities. This is a case of impersonation/misrepresentation and cheating of KSE Board authorities and hence Smt.Syamala devi is liable to be prosecuted for such criminal offences. 4 The above service connections (consumer nos. 16631 and 16632) shall be treated as those obtained by misrepresentation with or without connivance of the officers of the Board as the connections have been obtained after misrepresenting to the employees of the Board that the applicant is in ownership of the premises to which supply were required, as provided in clause 21(7) (e) of the Terms and Conditions of Supply 2005. On detection of connections as above obtained by misrepresentation, the service is liable for disconnection with 24 hrs notice. The respondent shall take actions as provided in clause 21(8) of the terms and Conditions of Supply 2005. In view of the above findings the Forum orders, to disconnect the supply to the service connection vide consumer nos.16631 and 16632 under Electrical Section, Vilakudy after giving 24 hrs. notice to the party who has obtained the connection, as per the provisions under clause 24(8) of the Terms and Conditions of supply 2005 and to terminate the service connection agreement as it is found to be bogus. The Forum is of the view that Smt.Syamala devi, the person who has obtained the connection by misrepresenting the KSE Board shall be prosecuted for impersonation/cheating KSE Board officials-which are criminal offences. It is open to the opposite party that actions shall be initiated to prosecute the above person. The petition stands disposed as above.
