ACTION: Notice of review. SUMMARY: In this candidate notice of review (CNOR), we, the U.S. Fish and Wildlife Service (Service), present an updated list of plant and animal species that we regard as candidates for or have proposed for addition to the Lists of Endangered and Threatened Wildlife and Plants under the Endangered Species Act of 1973, as amended. Identification of candidate species can assist environmental planning efforts by providing advance notice of potential listings, and by allowing landowners and resource managers to alleviate threats and thereby possibly remove the need to list species as endangered or threatened. Even if we subsequently list a candidate species, the early notice provided here could result in more options for species management and recovery by prompting earlier candidate conservation measures to alleviate threats to the species. This document also includes our findings on resubmitted petitions and describes our 1 progress in revising the Lists of Endangered and Threatened Wildlife and Plants (Lists) during the period October 1, 2016, through September 30, 2018. -

However, wildlife can cause damage to agricultural resources, natural resources, property, and threaten human safety. When people experience damage caused by wildlife or when wildlife threatens to cause damage, people may seek assistance from other entities. The United States Department of Agriculture, Animal and Plant Health Inspection Service, Wildlife Services (WS) program is the lead federal agency responsible for managing conflicts between people and wildlife. Therefore, people experiencing damage or threats of damage associated with wildlife could seek assistance from WS. In Mississippi, WS has and continues to receive requests for assistance to reduce and prevent damage associated with several bird species. The National Environmental Policy Act (NEPA) requires federal agencies to incorporate environmental planning into federal agency actions and decision-making processes. Therefore, if WS provided assistance by conducting activities to manage damage caused by bird species, those activities would be a federal action requiring compliance with the NEPA. The information ranges from strategic, national assessments of coastal and estuarine environmental quality to real-time information for navigation or hazardous materials spill response. Through its National Status and Trends (NS&T) Program, ORCA uses uniform techniques to monitor toxic chemical contamination of bottom-feeding fish, mussels and oysters, and sediments at about 300 locations throughout the United States. A related NS&T Program of directed research examines the relationships between contaminant exposure and indicators of biological responses in fish and shellfish. Through the Hazardous Materials Response and Assessment Division (HAZMAT) Scientific Support Coordination program, ORCA provides critical scientific support for planning and responding to spills of oil or hazardous materials into coastal environments. Technical guidance includes spill trajectory predictions, chemical hazard analyses, and assessments of the sensitivity of marine and estuarine environments to spills. To fulfill the responsibilities of the Secretary of Commerce as a trustee for living marine resources, HAZMAT’s Coastal Resource Coordination program provides technical support to the U.S. Environmental Protection Agency during all phases of the remedial process to protect the environment and restore natural resources at hundreds of waste sites each year. -

FEATURE: ENDANGERED SPECIES Conservation Status of Imperiled North American Freshwater and Diadromous Fishes ABSTRACT: This is the third compilation of imperiled (i.e., endangered, threatened, vulnerable) plus extinct freshwater and diadromous fishes of North America prepared by the American Fisheries Society’s Endangered Species Committee. Since the last revision in 1989, imperilment of inland fishes has increased substantially. This list includes 700 extant taxa representing 133 genera and 36 families, a 92% increase over the 364 listed in 1989. The increase reflects the addition of distinct populations, previously non-imperiled fishes, and recently described or discovered taxa. Approximately 39% of described fish species of the continent are imperiled. There are 230 vulnerable, 190 threatened, and 280 endangered extant taxa, and 61 taxa presumed extinct or extirpated from nature. Of those that were imperiled in 1989, most (89%) are the same or worse in conservation status; only 6% have improved in status, and 5% were delisted for various reasons. Habitat degradation and nonindigenous species are the main threats to at-risk fishes, many of which are restricted to small ranges. Documenting the diversity and status of rare fishes is a critical step in identifying and implementing appropriate actions necessary for their protection and management. Howard L. The pearl darter Percina aurora is a small-bodied freshwater fish endemic to the Pearl and Pascagoula river systems of Mississippi and Louisiana (USA). The last collected specimen from the Pearl River drainage was taken in 1973, and it now appears that populations in this system are likely extirpated. This reduced the historical range of this species by approximately 50%, ultimately resulting in federal protection under the US Endangered Species Act in 2017. To better understand the current distribution and general biology of extant popula- tions, we analyzed data collected from a series of surveys conducted in the Pascagoula River drainage from 2000 to 2016. Neves, Chair Fisheries and Wildlife Sciences (ABSTRACT) Distribution of the orangefin madtom (Noturus gilberti) was determined from 347 sites sampled in Virginia and North Carolina. This species inhabited 264 stream kilometers, over twice the reported range, in the following systems: Craig Creek, Roanoke River, Dan River, Big Chestnut Creek, South Mayo River, Pigg River, and Smith River. The orangefin madtom was somewhat common; 33% (Dan River) to 70% (Craig Creek) of the sites sampled were occupied. Negative interspecific associates of orangefin madtoms included chubs, mountain redbelly dace, rosyside dace, crescent shiners, and crayfish; only Roanoke darters were considered positive associates. Sand and silt levels were significantly lower at sites with !L. gilberti, while per- centage of small cobble, local gradient, and depth were sig- nificantly higher. Discriminant function analysis identified large gravel, local gradient, silt, and occurrence of rosyside dace and crayfish, as significant predictors of the occurrence of the orangefin madtom. Seasonal samples from Craig Creek consisted of three age groups. The smallest individual captured was 33 mm total length (TL) and the largest was 111 mm TL. -

Many madtoms (Noturus spp.) are considered imperiled; however, the efficacy of frequent monitoring efforts has been questioned due to their cryptic and nocturnal behaviors. We systematically evaluated a madtom monitoring tool by (1) evaluating the use of small (8 × 2 mm), surgically implanted 125 kHz passive integrated transponder (PIT) tags for frecklebelly madtom N. munitus and (2) assessing the effectiveness of a radio-frequency iden- tification (RFID)-enhanced artificial cover unit to index madtom abundance. Surgically implanted PIT tags had no apparent influence on madtom survival between 45 and 110 mm total length, and all tags were retained throughout a 21 d laboratory study. In experimental mesocosms, the enhanced cover units confirmed occupancy during nearly all replicates (77.6%), even at ex - tremely low densities (n = 2 madtoms). The enhanced cover units provided representative esti- mates of madtom relative abundance (p < 0.01), whereas catch per unit effort was not significantly associated with previously validated visual observations (p = 0.12). -

Washington, D.C. 20240 Washington, D.C. 20240 [email protected] [email protected] RE: 60-day Notice of Intent to Sue the U.S. Fish and Wildlife Service for Violations of the Endangered Species Act in Failing to Designate Critical Habitat for the Pearl Darter (Percina aurora) Dear Secretary Bernhardt and Director Skipwith: The Center for Biological Diversity (“Center”) provides this 60-day notice of its intent to sue the U.S. Fish and Wildlife Service (“Service”) over violations of the Endangered Species Act, 16 U.S.C. §§ 1531-1544 (“ESA”). Specifically, the Service has violated the ESA by failing to designate critical habitat for the Pearl darter (Percina aurora), a freshwater fish that received “threatened” status under the ESA on September 20, 2017.1 Section 4 of the ESA requires the Service to designate critical habitat concurrently with listing.2 Because the Service was unable to determinate critical habitat at the time of listing, the Service had until September 20, 2018 to designate critical habitat for the Pearl darter.3 However, to date, the Service has not designated critical habitat for the species and is therefore in violation of Section 4 of the ESA.4 This letter is provided pursuant to the 60-day notice requirement of the citizen suit provision of the Act, to the extent that such notice is deemed necessary by a court.5 Without protections for its critical habitat, the Pearl darter will continue to lose what little habitat remains throughout its range. -

VIVES Department of Zoology, University of Wisconsin, Madison 53706 ABSTRACT: The ictalurid, Noturus exilis, was studied from 13 February 1981 to 23 May 1982 in Flint and Cloud creeks in northeastern Oklahoma. Current speed, depth and substrate type in areas occupied by N. exilis were compared with frequency distributions of habitat availability. Noturus exilis were selective in their choice of cur- rent speed and substrate type; however, depths were used in the same proportion they were available. Slender madtoms in Flint Creek consumed ephemeropteran naiads and dipteran larvae most frequently by number (57.8% and 25.9%, respectively) and these organisms also occurred in proportionally more stomachs (66.1% and 57.6%, respectively). Compared with N. exilis in Green Creek, Illinois (studied by R.L. Mayden and B.M. Burr): (1) Flint Creek N. exilis were smaller at a given age; (2) Flint and Cloud creek N. exilis had a higher percentage of females that were mature in their 1st summer of life (age 0 + ); (3) Flint and Cloud creek N. exilis had signifi- cantly fewer ova per gram adjusted body weight, and (4) Cloud Creek N. exilis had significantly larger ova and Flint Creek N. exilis nearly so.
