THE OLD EDITORS. Jpl| EORGE ARDEN, the Co-Proprietor and Editor of the Gazette, was an accomplished and florid writer, not only as a journalist, but as a pamphleteer. The literary power of which he was capable was unballasted by experience, and, there was no mental brake to keep him within bounds. He had for a time the sole newspaper at his command; but he was absorbed by an inordinate self-sufficiency, and lacked perseverance. When newspapers were small, and their success mainly depended on the active personal supervision of the editor, Arden, who understood little of, and cared less for, journalistic minutice, was satisfied when he supplied an elaborate "leader." He was also much given to libelling, and falling into trouble thereby. In 1839, he was convicted and fined; in 1841, he was committed for trial, but the prosecution was abandoned; in 1843, he was again convicted of libel in connection with the first Corporation selections, and his brilliant and splenetic tirades against the first Resident Judge (Willis), though powerful agents in the ultimate un-benching of the official, proved the ruin of the writer.

    “Judges’ Sons Make the Final Sacrifice”: The Story of the Australian Judicial Community in the First World War Tony Cunneen* This article focuses on the experiences of judges’ families, particularly their sons, in battle in the First World War. It is both a memorial to the sacrifice made by the Australian judicial community in the First World War as well as a contribution to the limited historiography concerning the social history of Australian judges.This article continues research into the activities of the wider Australian legal profession in the First World War. INTRODUCTION In proportion to numbers, no trade or profession in Australia has suffered more bereavement in the war than have the judges in the higher tribunals.1 There is great scope for the extension of judicial biography into the role of Australian judges in the First World War.2 Well respected accounts of that conflict, such as Ernest Scott’s, Australia During the War,3 Connor, Stanley and Yule’s, The War at Home,4 or Michael McKernan’s, The Australian People and The Great War,5 make minimal mention of judges, particularly at the State level. The many accounts of industrial relations during the war tend to focus on judges’ roles in exacerbating class based matters,6 with minimal representation of judges’ social dynamics and their personal commitment to the conflict. In reality, Australian judges during the war ceased whatever reticence they may have had to be involved in public life and adopted prominent roles which extended far beyond the usual range of judicial activity.7 They became national figures whose speeches and activities were reported across the country.

Richard Posner is probably the best known commentator; apart from being a federal appeal judge and (yes, these things are measured) the most cited legal scholar of the 20th century, his “Law and Literature” is in its third edition. In Australia we have Nicholas Hasluck, justice of the Supreme Court of Western Australia, novelist, poet, and author of “The legal labyrinth: the Kisch case and other reflections on law and literature”. Kisch’s Australian experience is a fascinating study for anyone interested in the politics of citizenship (and the joys of dictation tests). Malcolm Oakes SC has led the production of a list of members of the Sydney Bar who have published books beyond legal texts. Others have contributed, including Dr John Bennett AM, Philip Selth OAM and David Ash. The list covers 200 years. The criteria are authorship of a work which does not have the better (or at least more well-informed) practice of law as its purpose and has 45 or more pages.     Stuart Macintyre* WHAT MAKES A GOOD BIOGRAPHY? AbstrAct Judicial biography is an undeveloped form of writing in Australia, and one that lacks any clear agreement over its purpose, audience and methods. This article considers the nature of biography both as a medium employed in various fields of professional activity and as a branch of historical analysis. A survey of some notable judicial biographies reveals the different approaches taken by lawyers and non- legal historians, and the problem of integrating an interpretation of the judicial record with a proper realisation of the biographical subject. It is suggested that those earlier judges who combined a political with a judicial career have attracted the most substantial attention, and that the full potential of the genre has yet to be achieved. as any historian ever finished a biography with a conviction that it is complete? I have not and I am in good company: Keith Hancock laboured over Smuts,1 Kathleen Fitzpatrick was laid low by Henry James, Allan H 2 Martin lost his nerve with Henry Parkes. A history project often begins with the finished publication somewhere in your mind. You know what you want to make of it, you can even hear some passages, and the whole enterprise has a deceptive clarity. It is only as you embark on the research and wrestle with the problems of putting ideas into words that the enterprise escapes your control. At some later point, sometimes dictated by a deadline, sometimes by the law of diminishing returns, you conclude, taking comfort in the finitude of academic knowledge.

    Medical History, 1977, 21: 365-383 JOHN HUTCHINSON IN AUSTRALIA AND FIJI by BRYAN GANDEVIA* WHEREABOUTS UNCERTAIN JOHN HUTCHNSON, described as "surgeon", was one of seven cabin passengers who left London in September 18521 on the first Australian voyage of the Washington Irving (900 tons, Captain John Jones).2 The voyage was recorded as "without untoward incidents and very pleasant" although one of approximately 270 intermediate and steerage passengers (including about fifty children) hanged himself in a fit of despondency. But excitement and tension must have mounted as the slhip negotiated the dangerous heads to Port Philip Bay and sailed to a crowded anchorage close to Melbourne on 11 December 1852. News of the startling gold discoveries in Victoria in 1852 had already created a migratory wave from England, for the most part of young, healthy, single men. In 1852, Dr. Hutchinson was but one of 45,000 arrivals from England amongst a total from all sources of nearly 80,000, which almost doubled the population ofthe district. Unfortunately, we know nothing of his impressions of the disorganized, turbulent, flamboyant and insanitary Melbourne during its dramatic period of transition from a village not two decades old to the "Queen city of the South". What were his reac- tions to the extortionate costs of landing and transporting his luggage to lodgings remarkable more for their rental than their comfort and service, or to the realization that his sterling pounds were transferable into local currency only at a discount of twenty per cent?
