KSA 77-436 requires the JCARR to hear all proposed rules and regulations during the public comment periods for those rules and regulations; for nearly all types of rules and regulations, that public comment period is only 60 days. The JCARR has remained up to date with rules and regulations noticed for hearing through the Session, but it is already aware of multiple sets of proposed rules and regulations that have met the requirements to proceed to hearing. The committee also plans to examine proposc1ls for changes to the Rules and Regulations Filing Act.

On behalf of the Joint Committee on Corrections and Juvenile Justice Oversight (Joint Committee), I request the Legislative Coordinating Council approve three meeting days for the 2021 Interim for the Joint Committee to meet and fulfill its statutory duties and to tour the Kansas Juvenile Correctional Complex (KJCC) in Topeka and the Lansing Correctional Facility (LCF).

KSA 2020 Supp. 46-2801 directs the Joint Committee to monitor inmate and juvenile offender populations and to review and study the programs, activities, plans, and operations of the Kansas Department of Corrections (KDOC). The issues outlined below fall squarely within the statutory duties placed upon the Joint Committee.

The Joint Committee proposes to study issues related to KDOC operations, including prison population and capacity, prison construction, and bed contracts; KDOC employee retention; KDOC appropriations and planning generally; and the continuing implementation and impact of the juvenile justice reforms originally enacted in 2016.

Additionally, the Joint Committee proposes to study:

• Compassionate medical release and terminal medical release under Kansas and federal law; • Overview of Kansas Sentencing Commission (KSC) data and trends, and analysis of past legislative initiatives that were adopted; • Perspectives on adult and juvenile community corrections issues by community stakeholders; • Review of the Judicial Council report and recommendations concerning offender registration; • Review ofthe Juvenile Evidence-Based Programs Account; and • Update on the SB 123 Treatment Program by the KSC and providers.

The Joint Committee requests authorization to tour the KJCC so that members may observe the daily operations of the state's only juvenile facility. The Joint Committee was authorized to tour the facility during the 2020 Interim but was unable to do so due to the COVID-19 pandemic. The Joint Committee

2 also requests authorization to tour the LCF so that members may be provided a first-hand view of the facility's new construction and learn more about LCF's substance abuse program and career center initiative.

The Robert G. (Bob) Bethell Joint Committee on Home and Community Based Services and KanCare Oversight respectfully requests the Legislative Coordinating Council approve a total of four meeting days (two two-day meetings) during the 2021 Interim.

Pursuant to KSA 2020 Supp. 39-7, 160, the Committee is to meet at least once for two consecutive days during each of the third and fourth calendar quarters, on the call of the chairperson, in addition to meeting at least once in January and once in April when the Legislature is in session.

KSA 2020 Supp. 39-7, 160 directs the Committee to oversee long-term care services including home and community based services (HCBS), which are to be provided through a comprehensive and coordinated system throughout the state. In its oversight role, the Committee is to oversee the savings resulting from the transfer of individuals from state or private institutions to HCBS and to ensure any proceeds resulting from the successful transfer be applied to the system for the provision of services for long-term care and HCBS, as well as to review and study other components of the state's long-term care system. Further, the Committee is to oversee the Children's Health Insurance Program, the Program for All-Inclusive Care for the Elderly, and the state Medicaid programs, and monitor and study the implementation and operations of these programs including, but not limited to, access to and quality of services provided and any financial information and budgetary issues.

The four meeting days requested would enable the Committee to effectively discharge its statutory responsibility for the third and fourth quarters of calendar year 2021.

On behalf of the Joint Committee on Information Technology, I request six meeting days during the 2021 Interim. I believe six meeting days will allow the Joint Committee enough time to fulfill its responsibilities in oversight and review of information technology projects.

The duties assigned to the Joint Committee by its authorizing statute KSA 46-2102 are noted below, and the first three duties also define its general areas of interim activity:

• Study the use of computers, telecommunications, and other information technologies by state agencies and institutions. The state governmental entities defined by KSA 75-7201 and subject to legislative oversight include executive, judicial, and legislative agencies, and regents institutions;

• Review proposed new acquisitions, and the implementation plans for them, including project budget estimates and three-year strategic information technology plans of state agencies and institutions. All state governmental entities are required to comply with provisions of KSA 75-7209 et. seq.;

• Monitor newly implemented technologies of state agencies and institutions;

• Make recommendations to the Senate Committee on Ways and Means and the House Committee on Appropriations on implementation plans, budget estimates, and three-year plans of state agencies and institutions; and

• Report annually to the Legislative Coordinating Council (LCC) and make special reports to other legislative committees as deemed appropriate. The Joint Committee also provides an annual report in compliance with KSA 46-1207 for submission to the Legislature not later than December 1.

6 In addition to the Joint Committee's statutory duties, the Legislature or its committees, including the LCC, may direct the Joint Committee to undertake special studies and to perform other specific duties. The Joint Committee is authorized by KSA 46-1701, which includes provisions allowing the Joint Committee to meet on call of its chairperson at any time and any place within the state and to introduce legislation. I request two of the five meeting days be designated as travel days. Specifically, I request three days to review the agency five-year capital improvement plans and laboratory proposals, as well as two days to travel to Hale Library at Kansas State University in Manhattan, the 35th Infantry Division Readiness Center in Leavenworth, and the Lansing Correctional Facility.

The Joint Committee on Fiduciary Financial Institutions Oversight respectfully requests the Legislative Coordinating Council approve one meeting day during the 2021 Interim.

Pursuant to provisions in 2021 Senate Sub. for HB 2074, the Joint Committee is directed to monitor, review, and make recommendations regarding fiduciary financial institutions' operations in the state of Kansas; monitor, review, and make recommendations regarding the fiduciary financial institutions pilot program; and receive a report from the Office of the State Bank Commissioner (OSBC) prior to December 31 , 2021 , that provides an update on the implementation of the Technology-enabled Fiduciary Financial Institutions Act and the pilot program. This report is to include recommendations from the OSBC for any legislation necessary to implement provisions of this act. The new law also requires the OSBC to appear annually before this joint committee and present a report on the fiduciary financial institutions industry.

The authorized meeting day will permit this new Joint Committee to fulfill its statutory duties and to monitor fiduciary financial institution activities in Kansas and consider possible legislation to assist in the development and regulation of this new industry in Kansas.

We respectfully respect the Legislative Coordinating Council approve one meeting day during the 2021 Interim for a joint meeting of the House Committee on Agriculture and the Senate Committee on Agriculture and Natural Resources.

Governor's Budget Amendment (GBA) No. 3, Item 15 recommended the establishment of a standalone Animal Facilities Inspection Division within the Department of Agriculture. The Animal Facilities Inspection Program is currently housed in the Division of Animal Health. During discussion of this GBA item, the House Committee on Appropriations suggested such a move should seek approval through the committee process rather than through a GBA. We are seeking funding for the travel and other e~penses through campaign donations from interested industries making this meeting request a no cost meeting for the state. Garden City, area businesses, the Community College, and others are arranging for meals, housing, and transportation.

Provisions of 2021 SB 159, the Omnibus Appropriations bill, create two separate special committees. On behalf of the Senate Committee on Ways and Means and House Committee on Appropriations, we request:

• Two meeting days during the 2021 Interim for a study on child support enforcement and collection, as provided in Section 20(b) of SB 159; and

• Two meeting days during the 2021 Interim for a review of the federal 340B program, as provided in Section 20(c) of SB 159.

The objective for the two days requested for a special committee to study child support enforcement and collection is to gain a better understanding of the current process and contracts, as well as the impact of child support payment collections on Kansans within the system. The Committee would review an evaluation conducted by Midwest Evaluation and Research, LLC, of the IV-D Program in 2020; hear testimony from the Office of the Judicial Administration; and hear from a Court Trustee the non-lV-D perspective.

The 340B Drug Pricing Program allows certain hospitals and other health care providers that care for high numbers of uninsured and low-income patients to obtain discounted prices on outpatient drugs from drug manufacturers. The objective for the two days requested for a special committee to review the 340B program is to gain a better understanding of how this program is implemented in Kansas and the experience of participating entities. Topics for review include federal requirements of the program; the role qualifying 3408 providers, pharmacies, and pharmacy benefit managers play in such program; the fiscal impact of such program on all participants; any recent federal or state law changes affecting such program; any recent marketplace developments of interest; and the impact of such program on health care payers.

24 Section 20( c) of SB 159 specifies that the 340B special committee be composed of 13 members appointed by the Legislative Coordinating Council and the chairperson be appointed by the Speaker of the House of Representatives.

The two days are requested for the Committee to review and study issues, including but not limited to, the waiver wait list, adequate provider networks, and waiver reimbursement rates. The makeup of the committee is envisioned to include the following individuals or their designees:

• House Committee on Appropriations chairperson; • Senate Committee on Ways and Means chairperson; • House Committee on Social Services Budget chairperson; • Senate Committee on Ways and Means Subcommittee on Human Services chairperson; • House Committee on Health and Human Services chairperson; • Senate Committee on Public Health and Welfare chairperson; • House Committee on Appropriations member - Appointed by the House Minority Leader; and • Senate Committee on Ways and Means member - Appointed by the Senate Minority Leader. Once the Committee has completed its review, the Committee would report its findings to the Robert G. (Bob) Bethell Joint Committee on Home and Community Based Services and KanCare Oversight, House Committee on Social Services Budget, and the Senate Committee on Ways and Means Subcommittee on Human Services.

During the 2021 budget hearings for the Kansas Department for Aging and Disability Services (KDADS), the House Committee on Social Services Budget heard testimony regarding issues with the HCBS I/DD Waiver related to the waiver wait list, adequate provider networks, and reimbursement rates. As of April 2021, there were 9,072 participants eligible receive HCBS services, and an additional 4,477 individuals on the I/DD waiver wait list. The House Committee on Social Services Budget recommended a request be submitted to the Legislative Coordinating

27 Council for a special committee study of the waiver during the 2021 Interim. The House Committee on Appropriations concurred with that recommendation.

Should a special committee not be authorized, we would respectfully request that either Legislative Budget Committee, the Robert G. (Bob) Bethell Joint Committee on Home and Community Based Services and KanCare Oversight, or a similar social services oriented interim committee study the I/DD waiver issues described above.

The Kansas Criminal Justice Reform Commission (Commission) respectfully requests the Legislative Coordinating Council (LCC) approve the following meeting days and related requests for the 2021 Interim as the Commission completes the tasks assigned to it by the 2019 and 2021 Legislatures. We are submitting this request in advance of the 2022 Legislative Session because we anticipate the Commission will need to schedule meetings throughout the remainder of the 2021 Interim in order to fully complete the duties assigned.

HB 2290 (2019) established the Commission and directs it to address various specified issues involving the Kansas criminal justice system (KSA 21-6902). HB 2077 (2021) amended Commission study topics, added a public defender member and extended the final report date. Provisions of the law as amended by HB 2077 require:

• The Commission prepare and submit its final report to the Legislature by December 1, 2021;

• The Commission organize and appoint task forces or subcommittees as necessary to discharge its duties;

• Staff of the Office of Revisor of Statutes, the Legislative Research Department provide assistance as may be requested by the Commission as authorized by the LCC; and

• Subject to approval by the LCC, members of the Commission attending meetings authorized by the Commission be paid amounts provided in KSA 75-3223(e).

Commission Meeting Approval In order to carry out the duties assigned to the Commission in 2019 HB 2290 and 2021 HB 2077, we request six additional meeting days for the Commission during the 2021 Interim, which would allow the Commission to meet monthly for the remainder of 2021: July, August, September, October, November, and December. We also request additional meeting days for the subcommittees formed by the Commission and approval of certain other limited support to those subcommittees, as discussed in the remainder of this letter.

Subcommittee Meeting Approval At its June 28, 2021, meeting, the Commission identified six subcommittees that will help meet the Commission’s goals. To allow the subcommittees to be able to meet during the remainder of the 2021 Interim and complete the work contemplated by HB 2290 and HB 2077, the Commission requests:

• LCC approval of 4 meetings for each of the 6 subcommittees for FY 2021 (24 total meeting days for the 6 subcommittees;

o Legislative staff assistance to the subcommittees, specifically to provide meeting notice;

o Paying legislative members of the Commission attending subcommittee meetings authorized by the Commission amounts provided in KSA 75- 3223(e); and

o Using Statehouse facilities and technology for meetings. Summary To summarize, on behalf of the Commission, I request a total of 30 meeting days (6 Commission meeting days and 24 subcommittee meeting days).

The Alvin Sykes Cold Case DNA Task Force (Task Force) respectfully requests the Legislative Coordinating Council (LCC) approve the following meeting days and related requests for the 2021 Interim as the Task Force completes the tasks assigned to it by the 2019 and 2021 Legislatures.

HB 2290 (2019) established the Task Force and directs it to develop a plan to ensure uniform statewide policies and procedures that address specified items related to hits to closed cases (KSA 21-6901). On September 25, 2019, the Task Force held an organizational meeting. The Task Force did not meet in 2020, but a group of stakeholders collaborated on recommendations at the direction of Rep. Patton. The full Task Force now needs to meet to review those recommendations.

HB 2077 (2021) modified provisions of KSA 21-6901 to:

• Change the name of the Task Force from the Kansas Closed Case Task Force to the Alvin Sykes Cold Case DNA Task Force; • Extend the deadline, from October 1, 2020, to October 1, 2021, for completion of the protocol implementation plan relating to closed cases; • Extend the deadline, from December 1, 2020, to December 1, 2021, for the Task Force’s report containing a plan for uniform implementation of the protocol; • Extend the sunset date for the Task Force from December 30, 2020, to December 30, 2021; and • Require the Office of Revisor of Statutes, the Kansas Legislative Research Department, and the Division of Legislative Administrative Services to aid the Task Force as requested by the co-chairpersons.

HB 2077 also amended the membership of the Task Force to allow a designee to serve in place of the state combined DNA index system (CODIS) administrator, but otherwise continues the Task Force as it existed on December 29, 2020, with all other members appointed prior to that date continuing as members of the Task Force. Subject to approval by the LCC, legislative members attending meetings authorized by the Task Force are to be paid amounts provided in KSA 75-3223(e). 36 To allow the Task Force to be able to meet during the remainder of the 2021 Interim and complete the work contemplated by HB 2290 and HB 2077, the Task Force requests:

• LCC approval of 2 meeting days for the 2021 Interim, plus: o Legislative staff assistance to the Task Force, specifically to provide meeting notice; o Paying legislative members of the Task Force attending meetings authorized by the Task Force amounts provided in KSA 75-3223(e); and o Using Statehouse facilities and technology for meetings.
