    VOLUME 50, OCTOBER 2018 THE NEWSLETTER Update Yourself Stamp Duty not Necessary for Enforcing Foreign Award he Hon’ble Supreme Court of India in its recent judgment in the case of Shriram EPC Limited vs. Rioglass Solar SA decided on 13.09.2018, has T observed that foreign award is enforceable without paying any stamp duty un- der the Indian Stamp Act, 1899 (“Stamp Act”). The dispute at hand arose before the Hon’ble Supreme Court on appeal filed by Shriram EPC Limited (“Appellant”) against the decision of the Division Bench of the Madras High Court. Initially, Rioglass Solar SA (“Respondent”) filed a petition before the Single Bench of the Madras High Court to enforce a foreign award delivered by the International Chambers of Commerce in London against Appellant. The Single Bench of the Madras High Court en- forced the foreign award and the Appellant filed an appeal against this enforcement before the Division Bench of the Madras High Court. One Inside this issue: of the contentions raised by the Appellant before the Division Bench was that stamp duty had not UPDATE YOURSELF been paid by the Respondent on the foreign Maharashtra State Ad- 2 award under the provisions of the Stamp Act. The Division Bench of the Madras High vance Ruling Appellate Court decided the appeal in favour of the Respondent and upheld the enforcement of the foreign award. Consequently, the dispute was brought before the Supreme Court, Karnataka HC Imposed 2 but only to the extent of the question of law that whether stamp duty is payable on a Cost on Deputy VAT foreign award under the provisions of the Stamp Act.

    Dated: 7.11.2019 To HON’BLE THE CHIEF JUSTICE OF INDIA SUPREME COURT OF INDIA BHAGWAN DAS ROAD NEW DELHI 110201 Hon’ble Supreme Court should refrain from passing a judgment on the Ayodhya Ram Janma Bhoomi – Babri Masjid matter, in view of the manifest massive manipulation of the issue and associated judicial process, by the ruling dispensations (be it Congress or BJP) to implement their political agendas. Judiciary has not yet adjudicated upon the 70 years old criminal fraud committed against the nation by so called ‘Hindu’ groups who planted Ram Lalla idols in the Masjid. The Congress, with help of the administration and Judiciary, maintained status quo in order to keep the Muslims trapped as a vote banks for decades – now the BJP has taken over with the diference that they are scaring Muslims to make inroads into Hindu vote bank. Four conspicuous Issues I. Criminal case fled on 23.12.1949, on installations of idols in Babri Masjid, (u/s 147, 448, 295, in Faizabad) II. Criminal matter on Babri Masjid demolition 1992, (initiated by Liberhan Commission, currently with CBI since 2017) III. Supreme Court Judgement 1994, Ismail Faruqi case regarding ‘Masjid not essential to Islam’ (1994, 6 SCC 360) IV.
