1 Chair

In accordance with Section 4(4) of the Local Government etc () Act 1994, Sue Bruce, Returning Officer, presided at the meeting until the election of the Lord Provost.

2 Election of Lord Provost

The Council was invited to elect the Lord Provost.

Decision

To elect Councillor Donald Wilson as Lord Provost of the City of Edinburgh for the period 2012-2017.

The Lord Provost, having made the declaration de fideli, was invested with the insignia of office and took the Chair.

The Lord Provost thanked the members for the honour they had conferred on him.

3 Election of Depute Convener

The Council was invited to elect the Depute Convener.

Decision

To elect Councillor Deidre Brock as Depute Convener of the Council for the period 2012-2017.

5 Appointment of Members to Committees, Joint Committees and Joint Boards

The Council was invited to appoint members to Committees of the Council and to Joint Committees and Joint Boards in accordance with Standing Order 3. The Council was also invited to appoint the Convener and Vice-Convener of the Policy and Strategy Committee (known as the Leader and Deputy Leader of the Council).

Decision

1) Whereas:

(a) a Local Government election had taken place on 3 May 2012.

(b) this was the first meeting of the Council since that election.

(c) the Labour Group and the SNP Group had entered into coalition for the administration of the City of Edinburgh Council.

(d) the intention of the Administration was to appoint the Lord Provost, Depute Convener, Leader of the Council and Deputy Leader of the Council at this meeting and for all other positions to be appointed on 24 May 2012.

(e) that the Lord Provost and Depute Convener had already been elected (see items 2 and 3 above).

2) Now therefore:

(a) To appoint Councillor Burns as a member and the Convener of the Policy and Strategy Committee and accordingly Leader of the Council.

(b) To appoint Councillor Cardownie as a member and the Vice- Convener of the Policy and Strategy Committee and accordingly Deputy Leader of the Council.

(c) To adjourn this meeting in terms of Standing Order 17 and continue the remaining business of the meeting to an adjourned meeting to take place immediately before the next meeting of the Council on 24 May 2012.

6 Resumption

The Lord Provost reconvened the meeting adjourned from 17 May on 24 May 2012.

7 Election of Bailies

Decision

To appoint five Bailies, 1 each from the Labour, Scottish National Party, Conservative, Green and Scottish Liberal Democrat Groups as follows:

8 Appointment of Members to Committees, Joint Committees and Joint Boards

The Council was invited to appoint members to Committees of the Council and to Joint Committees and Joint Boards in accordance with Standing Order 3. The Council had appointed the Convener and Vice-Convener of the Policy and Strategy Committee (see item 5 above).

Motion

1) To agree the political balance on Committees, Joint Committees, Joint Boards and the Licensing Board as detailed in Appendix 1 to this minute.

2) To note that the SLD Group had not taken up their places on the Planning Committee/Development Management Sub-Committee and the Licensing Board and accordingly to allocate an additional place on the Planning Committee/Development Management Sub-Committee to the SNP Group and to appoint nine members to the Licensing Board.

3) To note that the Council had already appointed Councillor Burns and Councillor Cardownie as Convener and Vice Convener respectively of the Policy and Strategy Committee (known as Leader and Deputy Leader of the Council).

4) To appoint members to the Policy and Strategy Committee, six Executive Committees, the Audit Committee, the Planning Committee/ Development Management Sub-Committee/Local Review Body and the Regulatory 7

Committee/Licensing Sub-Committee as detailed in Appendix 2 to this minute.

5) To appoint members to the Joint Committees, Joint Boards and the Licensing Board as detailed in Appendix 3 to this minute.

6) To recognise that, having been returned by Edinburgh citizens as the two largest political parties represented on the City of Edinburgh Council, the Edinburgh Labour Party and the Scottish National Party had agreed to form a coalition to build a more co-operative and prosperous Edinburgh that benefited every individual and community.

7) To agree that the coalition contract represented a fresh start for Edinburgh and reflected a Council that would listen to, and work with, local people and which would co-operate in a co-operative, fair, accountable and responsible manner.

8) To welcome the coalition Administration’s commitment to more democratic governance arrangements which facilitated greater consensus-based decision-making and which provided for strengthened scrutiny.

9) Therefore, to agree that a review of the political management governance arrangements should be reported to the August 2012 Council meeting for elected member consideration and determination. Further, to agree that the governance review should include specific recommendations for:

(i) proportionate, cross-party representation on committees;

(ii) strengthened scrutiny arrangements for the committee system of governance;

(iii) establishing a Petitions Committee to allow Edinburgh citizens to call for specific action to be taken by the Council;

(iv) establishing a cross-party Budget Committee open to representations;

(v) establishment of a Co-operative Development Unit to support implementation of the partnership’s coalition commitments;

(vi) establishing a city-wide Transport Forum of experts and citizens to consider our modern transport needs;

(vii) establishing a champion for Carers’ issues at senior elected member level;

(viii) establishing a champion for Third Sector issues at senior elected member level;

with recommended timescales for implementing these initiatives.

- moved by Councillor Burns, seconded by Councillor Cardownie (on behalf of the Capital Coalition).

Amendment 1

To approve the motion subject to the deletion of paragraphs 7, 8 and 9(iii).

- moved by Councillor Balfour (on behalf of the Conservative Group), seconded by Councillor Edie (on behalf of the Liberal Democrat Group).

Amendment 2

1) To approve paragraphs 1, 5 and 9 of the motion.

2) To note paragraphs 3, 6, 7 and 8 of the motion.

3) To note that the Liberal Democrat Group had not taken up their places on the Planning Committee/ Development Management Sub-Committee and the Licensing Board.

4) To note that the number of Green Group members appointed to the Planning/Development Management sub-Committee should be 2 (1.55 rounded up) and the number of SNP members 5 (4.66 rounded up). Accordingly to allocate the Liberal Democrat place on the Planning Committee/Development Management Sub-Committee to the Green Group and to appoint nine members to the Licensing Board,

5) To approve the appointment of members to the Policy and Strategy Committee, 6 Executive Committees, the Audit Committee and the Regulatory Committee/Licensing Sub-Committee as detailed in Appendix 2 to this minute.

6) However, to amend the appointments to the Planning Committee/ Development Management Sub-Committee/Local Review Body to appoint Green Councillors Bagshaw and Burgess in order to achieve political balance.

7) Further, to agree that the process of reviewing governance arrangements would be open and transparent and to this end:

(a) the governance review would commence from a position of openness, without any suggestion of a predetermined end point, 9

other than meeting the principles of proportionality and scrutiny, and other specific recommendations outlined above; and

(b) there would be regular discussion and consultation with all party groups about the different possible options during the process.

In accordance with Standing Order 30(7), paragraph 4 of amendment 2 was accepted as an addendum to amendment 1.

9 Appointment of Religious and Teacher Representatives

The Council was invited to appoint religious and teacher representatives for the discharge of its education functions.

Motion

1) To confirm the appointment of the following persons for the discharge of the Council’s education functions:

A Craig Duncan (Church of Scotland) Ted Brack (Roman Catholic Church) Allan Crosbie (Teacher representative) Raymond George Simpson (Teacher representative)

2) To appoint Rev Thomas Couper (The Robin Chapel) as the third religious representative for the discharge of the Council’s education function.

3) To agree that the appointment of the religious and teacher representatives was conditional upon confirmation that they would comply with the Councillors’ Code of Conduct and on membership of the Protection of Vulnerable Groups Scheme.

Amendment

To approve paragraphs 1 and 3 of the motion and to replace paragraph 2 with:
