This council meeting is being held during the COVID-19 emergency declaration and is being conducted as a virtual meeting in accordance with Ohio’s Open Meetings Laws as amended by Sub. H.B. 197. Council Rule 49, requiring the attendance of the Mayor and director of all departments at council meetings is waived for this and any other virtual council meetings held under amended Sub. H.B. 197. The meeting of the Council was called to order at 1:16 p.m. with the President of Council, Kevin J. Kelley, in the Chair.

Ordinances and Resolutions

First Reading Emergency Ordinances Referred

An ordinance is a City law written and enacted by City Council. Ordinances govern the actions, responsibilities and tax dollars of residents, businesses, organizations, city departments and visitors in Cleveland. Ordinances can be written and passed to address issues about housing, safety, public services, employment, the City budget and economic development. Many ordinances authorize the City to spend money on contracts and projects that support the mission of the City of Cleveland.

Ordinances are effective 30 days after passage. Emergency ordinances take effect immediately upon the Mayor’s signature or 10 days after passage.

Under the Charter, legislation cannot be passed until it has been read on three separate days, unless this requirement is dispensed with by a two-thirds vote of the Council. This is known as passing legislation “under suspension.” Ordinances may be passed under suspension after either the first or second reading.

If not passed under suspension after the first reading, the legislation is then sent to the appropriate City departments for review.

Ordinance No. 714-2020

An emergency ordinance authorizing the Director of Finance to enter into an amendment to the Lease Agreement with MidCity, Ltd. authorized by Ordinance No. 1070-17, passed on September 25, 2017, for the lease of office space for the Cleveland Police Commission located at 3631 Perkins Avenue for an additional two years, with one option to renew for an additional year, exercisable by the Director of Finance.

WHEREAS, under Ordinance No. 1070-17, passed September 25, 2017, the Director of Finance entered into a Lease Agreement with MidCity, Ltd. for the lease of office space for the Cleveland Police Commission located at 3631 Perkins Avenue for a term of two years, with a one-year option to renew (“Original Lease”); and

WHEREAS, the City wishes to extend the lease; and

WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CLEVELAND:

Section 1. That the Director of Finance is authorized to enter into an amendment to the Original Lease with MidCity, Ltd., authorized by Ordinance No. 1070-17, passed on September 25, 2017, to extend the lease of approximately 2,500 square feet of office space located at 3631 Perkins Avenue, Unit 3A2 for the Cleveland Police Commission, for an additional two years, with one option to renew for an additional year, exercisable by the Director of Finance.

Section 2. That the rent under the amendment shall be $11,400 annually, plus utilities and trash, payable from Fund No. 01-6010-6360, RQS 0103, RL 2020-78.

Section 3. That all other terms and conditions of the Original Lease shall remain the same.

Section 4. That the amendment shall be prepared by the Director of Law.

Section 5. That this ordinance is declared to be an emergency measure and, provided it receives the affirmative vote of two-thirds of all the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law.

Ordinance No. 730-2020

An emergency ordinance authorizing the Director of Public Health to enter into one or more contracts without competitive bidding with the Center for Disease Detection, LLC for the purchase of lab services for reproductive health clinics that are needed under the Title X grant, for the Division of Health, Department of Public Health, for a period of approximately six months.

WHEREAS, the Ohio Department of Health will no longer cover certain screening tests for certain patient populations that are in need of reproductive health services, and the Center for Disease Detection, LLC is the only lab service that contracts with the Ohio Department of Health to conduct screening tests for our patients at the reproductive clinics and is the only agency that uses the same software used by clinical staff to upload and transmit patient information to the Ohio Department of Health; and

WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CLEVELAND:

Section 1. That this Council determines that the within commodities are non- competitive and cannot be secured from any source other than the Center for Disease Detection, LLC. Therefore the Director of Public Health is authorized to make one or more written contracts with the Center for Disease Detection, LLC in the approximate sum of $41,858.60, based upon its proposal dated August 24, 2020, for the purchase of lab services for reproductive health clinics that are needed under the Title X grant from September 18, 2020, to March 21, 2021, to be purchased by the Commissioner of Purchases and Supplies, for the Division of Health, Department of Public Health. The contract or contracts authorized shall be paid from Fund No. 15 SF 117, RQS 5005, RL 2020-79.

Section 2. That this ordinance is declared to be an emergency measure and, provided it receives the affirmative vote of two-thirds of all the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law.

Ordinance No. 731-2020

An emergency ordinance authorizing the Director of Capital Projects and/or City Planning to enter into one or more contracts with Steven Gutierrez for professional services necessary for the design, production and installation of a yet-to-be designed public artwork associated with, and installed at, the new Cleveland Kennel.

WHEREAS, the City desires to install new artwork at the new City Kennel; and

WHEREAS, under Chapter 186 of the Codified Ordinances of Cleveland, Ohio, 1976, artists are selected by the City Planning Commission through its Public Art Committee, and are based upon a specific concept; and

WHEREAS, however, artist Steven Gutierrez was selected based upon his qualifications and his agreement to develop a public art concept specific to and appropriate to the new Kennel after receiving input from the City, the Kennel, community representatives, and other appropriate groups; and

WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CLEVELAND:

Section 1. That, notwithstanding the provisions of Chapter 186 of the Codified Ordinances of Cleveland, Ohio, 1976, the Director of Capital Projects and/or City Planning is authorized to enter into one or more contracts with Steven Gutierrez for professional services necessary for the design, production and installation of a yet-to-be designed public artwork associated with, and installed at, the new Cleveland Kennel, for the Office of Capital Projects and/or the Department of City Planning under the Public Art Program as more fully described in Chapter 186.

Section 2. That the final design of the artwork referenced above shall be approved by the City Planning Commission.

Section 3. That to the extent any part of this ordinance conflicts with Chapter 186, this ordinance shall control for this public artwork project.

Section 4. That the contract or contracts shall not exceed $58,147 and shall be paid from Fund Nos. 20 SF 215, 20 SF 226, 20 SF 562, 20 SF 566, 20 SF 573, and 01-6006- 6926, RQS 0103, RL 2020-76.

Ordinance No. 732-2020

An emergency ordinance determining the method of making the public improvement of rehabilitation of the Kirtland Crib; and authorizing the Director of Public Utilities to enter into one or more public improvement contracts for the making of the improvement.

WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CLEVELAND:

Section 1. That, under Section 167 of the Charter of the City of Cleveland, this Council determines to make the public improvement of rehabilitation of the Kirtland Crib, for the Division of Water, Department of Public Utilities, by one or more contracts duly let to the lowest responsible bidder or bidders after competitive bidding for a gross price for the improvement.

Section 2. That the Director of Public Utilities is authorized to enter into one or more contracts for the making of the public improvement with the lowest responsible bidder or bidders after competitive bidding for a gross price for the improvement, provided, however, that each separate trade and each distinct component part of the improvement may be treated as a separate improvement, and each, or any combination, of the trades or components may be the subject of a separate contract for a gross price. On request of the director, the contractor shall furnish a correct schedule of unit prices, including profit and overhead, for all items constituting units of the improvement.

Section 3. That the Director of Public Utilities is authorized to apply and pay for permits, licenses or other authorizations required by any regulatory agency or public authority to permit performance of the work authorized by this ordinance.

Section 4. That the cost of the improvement and other expenditures authorized shall be paid from Fund No. 52 SF 001, RQS 2002, RL 2020-63.

Section 5. That this ordinance is declared to be an emergency measure and, provided it receives the affirmative vote of two-thirds of all the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law.

Ordinance No. 733-2020

An emergency ordinance authorizing the Director of Public Works to employ one or more professional consultants to assess, and make recommendations to improve, the West Side Market operations, for a period not to exceed three years.

WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CLEVELAND:

Section 1. That the Director of Public Works is authorized to employ by contract or contracts one or more consultants or one or more firms of consultants for the purpose of supplementing the regularly employed staff of the several departments of the City of Cleveland in order to provide professional services necessary to assess, and make recommendations to improve, the West Side Market operations, for a period not to exceed three years. The selection of the consultant or consultants for the services shall be made by the Board of Control on the nomination of the Director of Public Works from a list of qualified consultants available for employment, as may be determined after a full and complete canvass by the Director of Public Works for the purpose of compiling a list. The compensation to be paid for the services shall be fixed by the Board of Control. The contract or contracts authorized shall be prepared by the Director of Law, approved by the Director of Public Works, and certified by the Director of Finance.

Section 2. That the cost of the contract or contracts authorized shall be paid from Fund No. 01-9997-6970 and other funds approved by the Director of Finance, RQS 7005, RL 2020-77

Section 3. That this ordinance is declared to be an emergency measure and, provided it receives the affirmative vote of two-thirds of all the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law.

Ordinance No. 734-2020

An emergency ordinance authorizing the Director of Public Works to enter into a second amendment to the June 30, 2016, Property Operations and Programming Agreement with the Group Plan Commission for Public Square to provide a restricted contribution to support the Commission’s maintenance obligations on Public Square.

WHEREAS, under Ordinance No. 1061-14, passed September 15, 2014, this Council, among other things, authorized the Director of Public Works to enter into a Property Operations and Programming Agreement with the Group Plan Commission relating to operating, preserving, maintaining, and providing ongoing programming and supplemental maintenance at Public Square; and

WHEREAS, under Ordinance No. 554-2019, passed May 13, 2019, this Council authorized an amendment to the above referenced Agreement to provide a restricted contribution to support the Commission’s maintenance obligations on Public Square; and

WHEREAS, this ordinance constitutes an emergency measure for the immediate preservation of public peace, property, health or safety; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CLEVELAND:

Section 1. That the Director of Public Works is authorized to enter into a second amendment to the June 30, 2016, Property Operations and Programming Agreement with the Group Plan Commission for Public Square, authorized by Ordinance No. 1061- 14, passed September 15, 2014, to provide a restricted contribution to support the Commission’s continuing maintenance obligations on Public Square. All other terms and conditions contained in the Agreement shall remain the same.

Section 2. That the amendment referenced in Section 1 shall be prepared by the Director of Law.

Section 3. That the costs of the contract amendment authorized herein shall not exceed $500,000 and shall be paid from Fund No. 01-9998-6320.

Section 4. That this ordinance is hereby declared to be an emergency measure and, provided it receives the affirmative vote of two-thirds of all the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law.

Ordinance No. 737-2020

An emergency ordinance authorizing the Director of Economic Development to enter into a Tax Increment Financing Agreement with 75 Public Square, Ohio, LLC, and/or its designee, to support debt service related to the project and assist with the development of new market rate apartments, a restaurant, and retail space; to provide for payments to the Cleveland Metropolitan School District; and to declare certain improvements to real property to be a public purpose.

WHEREAS, under Section 5709.41 of the Revised Code, improvements to real property may be declared to be a public purpose where fee title to the real property was, at one time, held by the City of Cleveland and the real property is then leased or conveyed by the City; and

WHEREAS, pursuant to Ordinance authority, the City will have duly entered into the chain of title for the Property which is more particularly described in this ordinance (the “Real Property’) pursuant to the requirements of Section 5709.41 of the Revised Code prior to the passage of this ordinance; and

WHEREAS, the Real Property is to be developed in accordance with the Cleveland 2020 Citywide Plan, a copy of which is placed in File No. 737-2020-A; and

WHEREAS, under Section 5709.41 of the Revised Code, the improvements declared to be a public purpose may be exempt from real property taxation; and

WHEREAS, under Section 5709.41 of the Revised Code, the owners of the improvements may be required to make annual service payments in lieu of taxes that would have been paid had the improvement not been exempt; and

WHEREAS, under Section 5709.41 of the Revised Code, the exemption may exceed 75% of the improvements for up to 30 years when a portion of the service payments so collected are distributed to the Cleveland Metropolitan School District (“District”) in an amount equal to the amount the District would have received had the improvement not been exempt; and

WHEREAS, the District has been notified of the intent to enter into the agreement authorized by this ordinance in compliance with division (C)(4) of Section 5709.41 and Section 5709.83 of the Revised Code; and

WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CLEVELAND:

Section 1. That the improvements to be constructed by 75 Public Square, Ohio, LLC, and/or its designee, (“Redeveloper”), are declared to be a public purpose for purposes of Section 5709.41 of the Revised Code (the “Improvements”). The Real Property is more fully described as follows:

Situated in the City of Cleveland, County of Cuyahoga and State of Ohio and known as being part of Original Two Acres Lot Nos. 59 and 60, and bounded and described as follows:

Beginning on the Northwesterly line of Public Square, at a point 88 feet Southwesterly from its point of intersection with the Northeasterly line of Original Lot No. 60, which Northeasterly line is also the Southwesterly line of Ontario Street; thence Northwesterly on a line parallel to said Southwesterly line of Ontario Street, 168.75 feet; thence Southwesterly on a line parallel to the Northwesterly line of Public Square, 79.75 feet to the Northeasterly line of West 2nd Street; thence Southeasterly along the Northeasterly line of West 2nd Street, 168.75 feet to the Northwesterly line of Public Square; thence Northeasterly along the Northwesterly line of Public Square, 79.75 feet to the place of beginning, together with all of Grantor’s right, title and interest, if any, to the streets and alleys abutting the above premises, be the same more or less, but subject to all legal highways.

Section 2. That one hundred percent (100%) of the Improvements are declared exempt from real property taxation for a period of thirty years, effective and commencing the first year the value of the Improvements are reflected on the tax duplicate; and that in no event shall the exemption period extend beyond 2053. The terms of the agreement, which shall not be materially changed without further legislative action by Council, will be as follows:

Project Summary and Discussion 75 Public Square Ohio, LLC or designee (“Developer”), an entity of The Millennia Companies, is proposing to redevelop the historic building located at 75 Public Square, Cleveland, Ohio 44113 (“Project Site”). In order to assist with project financing, the Developer has requested the City impose a 5709.41, 30-year, Non-School Tax Increment Financing (TIF). The TIF will support debt service related to the project and assist with

No. 737-2020 Official Proceedings – City Council September 11, 2020 The City Record 17 the development of approximately 114 new market rate apartments, a 3,060-square-foot restaurant, and 1,250 square feet of retail space. The Project will create and/or cause to create 13 new full-time equivalent jobs with an approximate annual payroll of $270,000. The total project investment is expected to exceed approximately $41.9 million.

The Developer is a subsidiary of The Millennia Companies. The Millennia Companies is a full-service real estate and property management company based in Cleveland, Ohio. Established in 1995 by Frank T. Sinito, Developer works in all facets of real estate development, from property management to construction and development. Their portfolio consists of over 275 multi-family residential communities, servicing more than 30,000 apartments nationwide. In 2017, The Millennia Companies led the acquisition and restoration of the Key Tower complex in Downtown Cleveland, making a significant impact on the Downtown commercial real estate market.

Proposed City Assistance • This ordinance will authorize the Director of Economic Development to enter into a 30-year non-school Tax Increment Finance (TIF) agreement with 75 Public Square Ohio, LLC or its designee. The City will declare certain improvements with respect to the project to be a public purpose and exempt 100% of the improvements from real property taxes. • The Developer agrees to make certain improvements to those parcels and making payments in lieu of taxes (PILOTs) equal to the taxes that would have been paid for those parcels but for the TIF. A portion of the PILOT will be paid to the Cleveland Municipal School District in the amount the District would have otherwise received but for the TIF (“District Payments”). • The balance of the PILOTs will be utilized to fund eligible project costs and project debt. WHEREAS, under Section 5709.41 of the Revised Code, improvements to real property may be declared to be a public purpose where fee title to the real property was, at one time, held by the City of Cleveland and the real property is then leased or conveyed by the City; and

WHEREAS, pursuant to Ordinance authority, the City will have duly entered into the chain of title for the Property which is more particularly described in this ordinance (the “Real Property’) pursuant to the requirements of Section 5709.41 of the Revised Code prior to the passage of this ordinance; and

WHEREAS, the Real Property is to be developed in accordance with the Cleveland 2020 Citywide Plan, a copy of which is placed in File No. 738-2020-A; and

WHEREAS, under Section 5709.41 of the Revised Code , the improvements declared to be a public purpose may be exempt from real property taxation; and

WHEREAS, under Section 5709.41 of the Revised Code, the owners of the improvements may be required to make annual service payments in lieu of taxes that would have been paid had the improvement not been exempt; and

WHEREAS, under Section 5709.41 of the Revised Code, the exemption may exceed 75% of the improvements for up to 30 years when a portion of the service payments so collected are distributed to the Cleveland Metropolitan School District (“District”) in an amount equal to the amount the District would have received had the improvement not been exempt; and

WHEREAS, the District has been notified of the intent to enter into the agreement authorized by this ordinance in compliance with division (C)(4) of Section 5709.41 and Section 5709.83 of the Revised Code; and

The TIF will support debt service related to the project and assist with the development of approximately 241 market rate and workforce housing apartment units, two floors of enclosed heated parking, and 15,000 square feet of amenity space. The amenity space includes a second level pool area, a fitness center, top floor lounge, a dog park inclusive of an indoor dog wash, and a bike storage and repair facility with storage for over 100 bikes. The total project investment is expected to exceed approximately $64.6 million. The project will create and/or cause to create five new W-2 jobs at the Project Site with an approximate payroll of $285,683.

Stoneleigh Companies LLC is a Class A multifamily development company with a national footprint representing 40,000+ units nationwide. Based out of Chicago, the

Proposed City Assistance • This ordinance will authorize the Director of Economic Development to enter into a 30-year non-school Tax Increment Finance (TIF) agreement with Stoneleigh Companies LLC or designee. The City will have declared certain improvements with respect to the project to be a public purpose and exempt 100% of the improvements from real property taxes. • The Developer agrees to make certain improvements to the parcel and make payments in lieu of taxes (PILOTs) equal to the taxes that would have been paid for the parcel but for the TIF. A portion of the PILOTs will be paid to the Cleveland Metropolitan School District in the amount the District would have otherwise received but for the TIF by the County (“District Payments”). The balance of the PILOTS will be utilized to fund eligible project costs and project debt. That under division (B) of Section 4117.10 of the Revised Code, this Council approves the collective bargaining agreement with the Municipal Foremen and Laborer’s Union (Chartered: Municipal, County & State Employees’ Union Local 860, AFL-CIO) (Supervisory and Non-Supervisory), formerly Local 1099, under the terms contained in File No. 727-2020-A, for the period from April 1, 2019, through March 31, 2022, and which provides, among other things, for an increase in the salaries and wages for members of the bargaining unit under the following schedule:

That the Director of the Department of Public Works is hereby authorized to enter into agreement effective July 1, 2020, with the Tremont West Development Corporation for the Arts in August Expo for the public purpose of providing performing arts education to city of Cleveland residents through the use of Ward 3 Casino Revenue Funds.

Section 2. That the cost of said contract shall be in an amount not to exceed $3,000 and shall be paid from Fund No. 10 SF 188.

Section 3. That the Director of Law shall prepare and approve said contract, and that the contract shall contain such terms and provisions as he deems necessary to protect the City’s interest.

Section 4. That this ordinance is hereby declared to be an emergency measure and, provided it receives the affirmative vote of two-thirds of all the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law.

An emergency resolution approving the expansion of the Downtown Cleveland Improvement District; accepting the petitions from owners of property in the proposed District as expanded; approving the amended Articles of Incorporation of the Downtown Cleveland Improvement Corporation; approving the comprehensive services plan for the continued operations of the District; declaring it necessary to provide for additional security, cleaning, maintenance and economic development and marketing of the District; and providing for the assessment of the cost and expense of such work upon benefited property in the District; and declaring an emergency.

WHEREAS, Chapter 1710 of the Revised Code authorizes the formation of special improvement districts within the boundaries of a municipality by petition of property owners in a district and approval by the municipality for the purpose of developing and implementing plans for public improvements and public services that benefit a district; and

WHEREAS, by Resolution No. 1386-05, adopted on August 3, 2005, this Council approved the formation of the Downtown Cleveland Improvement District and approved an initial plan for public services benefitting all of the District from 2006 through 2010; and

WHEREAS, by Resolution No. 272-10, adopted on March 8, 2010, this Council approved the comprehensive services plan for the continuation of the operations of the Downtown Cleveland Improvement District, which plan pertained to the period 2011 through 2015; and

WHEREAS, by Resolution No. 699-15, adopted July 22, 2015, this Council approved the expansion of the Downtown Cleveland Improvement District and approved the comprehensive services plan for the continuation of the operations of the expanded Downtown Cleveland Improvement District, which plan pertains to the period 2016 through 2020; and

WHEREAS, owners of sixty percent or more of the front footage of property that abuts upon any street, alley, public road, place, boulevard, parkway, park entrance, easement, or other existing public improvement within the Downtown Cleveland Improvement District, excluding certain property as provided in division (E) of Section 1710.02 of the Revised Code, and including certain additional property in and around the area known as the Columbus Road Peninsula, have signed a petition (the “Petition”) requesting that the City of Cleveland approve the expansion of the Downtown Cleveland Improvement District (as so expanded, the “District”) and to approve a comprehensive services plan

(the “Plan”) for the continuation of operations of the District for the period 2021-2025 and have submitted the Plan as part of the Petition; and

WHEREAS, the District is to be governed by the Downtown Cleveland Improvement Corporation, an Ohio nonprofit corporation formed pursuant to Chapters 1702 and 1710 of the Ohio Revised Code (the “Corporation”), and the Corporation proposes to amend its Articles of Incorporation to include the expanded territory (as so amended, the “Articles”); and

WHEREAS, the Petition, the Articles and the Plan have been filed with the Clerk of Council and copies have been delivered to the Mayor of the City; and

WHEREAS, the Petition is to be approved or disapproved by resolution of this Council within sixty days of the filing of the Petition with the City; and

WHEREAS, this resolution constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CLEVELAND:

Section 1. That the Petition, the Articles and the Plan, referred to in the preambles of this resolution and on file in File No. 713-2020-A, are approved.

Section 2. Pursuant to Chapter 1710 of the Ohio Revised Code, the Petition, the Articles and this resolution, the special improvement district known as the Downtown Cleveland Improvement District is confirmed as expanded, the expanded district consisting generally of that portion of the City which is bounded on the North by the Conrail lines; on the West by the Cuyahoga River from the Conrail tracks south to West 3rd Street at Stones Levee/Eagle Street; on the South by Stones Levee/Eagle Street to Ontario Street and the Inner Belt; and on the East by East 18th Street.

Section 3. That, consistent with the approval of the Plan, this Council hereby commences proceedings to provide for special assessments in accordance with the Plan, which special assessments shall be levied in accordance with Chapters 727 and 1710 of the Revised Code.

Section 4. That it is determined and declared necessary and conducive to the public health, convenience and welfare of the City of Cleveland to provide additional security for the District, additional cleaning and maintenance of the public rights-of-way within the District and collective economic development and marketing of the District for a five-year period commencing after passage of the ordinance to proceed in this matter.

Section 5. That it is determined that the property contained within the District will be specially benefited by the above described public services and shall be assessed to pay for the cost of the services, calculated in proportion to the benefits that may result from the services.

Section 6. That the Plan on file in File No. 713-2020-A is approved at an estimated cost of $25,366,969.

Section 7. That the entire cost of the Plan in the District be specially assessed in proportion to the benefits that may result from the services within the District. The cost of the Plan shall include the cost of printing, serving and publishing notices, resolutions and ordinances, the costs incurred in connection with the preparation, levy and collection of the special assessments, expenses of legal services, the cost of all labor and materials and all other necessary expenditures allowed by law.

Section 8. That the City will not issue securities in anticipation of either the levy or the collection of the special assessments for the cost of the Plan.

Section 9. That the Commissioner of Assessments and Licenses is authorized to prepare and file in the Office of the Clerk of Council an estimated assessment under the provisions of this resolution showing the amount of the assessment against each lot or parcel of land to be assessed. Such estimated assessment shall be based on the estimated cost of the Plan which is now on file in the Office of the Clerk of Council. When the estimated special assessments have been filed, the Clerk of Council shall cause notice of the adoption of this Resolution and the filing of the estimated special assessments to be served in the manner provided by law on the owners of all lots and parcels to be assessed.

Section 10. That payment for the assessments shall be due in each of the years 2021, 2022, 2023, 2024, and 2025. The Clerk of Council is authorized to cause unpaid assessments to be certified to the county fiscal officer to be placed on the tax records and collected with and in the same manner as other taxes.

Section 11. That this Council finds and determines that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of the Council and that all deliberations of the Council and of any of its committees that resulted in those formal actions were in meetings open to the public in compliance with the law.

Section 12. That this resolution is declared to be an emergency measure and, provided it receives the affirmative vote of three-fourths of all the members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law.

Resolution No. 715-2020

An emergency resolution supporting displaced Service Employees International Union, Local 1 janitors, who have cleaned buildings in Downtown Cleveland for decades and urging that the displaced janitors are reinstated and that any cleaning contractor hired adheres to standards established by the terms and conditions of the existing Collective Bargaining Agreement which janitors have worked diligently to establish.

WHEREAS, the Service Employees International Union (SEIU) Local 1 Janitors work in many of the largest buildings in the Cleveland area, and they have established a standard for wages and benefits in downtown Cleveland over many decades through their union; and

WHEREAS, the SEIU Local 1 janitors have been recently displaced from employment after cleaning downtown Cleveland office buildings for decades; and

WHEREAS, these workers have maintained a clean and safe environment for the tenants and guests of those buildings, particularly during the COVID-19 pandemic; and

WHEREAS, this Council is concerned about the increasing disparity in our City between the wealthy and the poor, and the existence of too many low-wage jobs that keep citizens in a cycle of poverty; and

WHEREAS, this Council believes that taxpayer dollars should support businesses and corporations that contribute to bringing and keeping livable wage jobs in our city; and

WHEREAS, SEIU Local 1 janitors who are now considered essential workers insure that tenants and guest in many of the downtown Cleveland buildings are in a clean and safe environment; and

Second Reading Emergency Ordinances Passed

An ordinance is a City law written and enacted by City Council. Ordinances govern the actions, responsibilities and tax dollars of residents, businesses, organizations, city departments and visitors in Cleveland. Ordinances can be written and passed to address issues about housing, safety, public services, employment, the City budget and economic development. Many ordinances authorize the City to spend money on contracts and projects that support the mission of the City of Cleveland.

Ordinances are effective 30 days after passage. Emergency ordinances take effect immediately upon the Mayor’s signature or 10 days after passage.

Under the Charter, legislation cannot be passed until it has been read on three separate days, unless this requirement is dispensed with by a two-thirds vote of the Council. This is known as passing legislation “under suspension.” Ordinances may be passed under suspension after either the first or second reading. If not passed under suspension after the first reading, the legislation is then sent to the appropriate City departments for review.

After departmental review, the ordinance is returned to Council for consideration in a public hearing before the appropriate Council Committee(s). Council Members and City departments can recommend changes, or amendments, to the legislation during the hearing process. After the review is complete and any amendments have been made, the legislation is read a second time at a Council meeting. A second reading allows Council Members and the public to hear what changes have been made to the law. Amendments cannot be made after the second reading of the legislation.
