INTRODUCTION “Law and order” became a potent theme in American politics in the 1960s. With that simple phrase, politicians evoked a litany of troubles plaguing the country, from street crime to racial unrest, urban riots, and unruly student protests. Calling for law and order became a shorthand way of expressing contempt for everything that was wrong with the modern permissive society and calling for a return to the discipline and values of the past. The law and order rallying cry also signified intense opposition to the Supreme Court’s expansion of the constitutional rights of accused criminals. In the eyes of law and order conservatives, judges needed to stop coddling criminals and letting them go free on legal technicalities. In 1968, Richard Nixon made himself the law and order candidate and won the White House, and his administration continued to trumpet the law and order theme and blame weak-kneed liberals, The William R. Reasonable Provocation DISTINGUISHING THE VIGILANT FROM THE VIGILANTE IN SELF-DEFENSE LAW INTRODUCTION The right of self-defense is “intended to preserve the legal order by granting every person the right to fend off unlawful attacks.”1 The state essentially grants an exception to its usual monopoly on the use of force and allows an individual to act as a “substitute policeman.”2 That right, however, is subject to certain restrictions. Among those restrictions is the requirement in most jurisdictions that the individual claiming self-defense cannot have provoked the conflict.3 The precise contours of what constitutes provocation vary by jurisdiction.4 Each jurisdiction, to some extent, leaves unanswered the question of whether individuals can intentionally insert themselves into situations where violence is reasonably foreseeable and still maintain a claim of self-defense. The key problem in making these determinations is distinguishing between vigilant community members hoping to protect their communities and vigilantes seeking to mete out their own brand of extrajudicial law enforcement.

Copyright 0 1993 by Washington Law Review Association DEATH WISH: WHAT WASHINGTON COURTS SHOULD DO WHEN A CAPITAL DEFENDANT WANTS TO DIE Laura A. Rosenwald Abstract: The Washington Supreme Court held in State v. Dodd that a capital defendant may waive general review of conviction and sentence, and failed to determine whether a defendant may also withhold all mitigating evidence from the sentencing proceeding. The holding limits appellate oversight of death sentences to a degree that fails to ensure Wash- ington's interest in reliable capital punishment. The court should have required general review of both conviction and sentencing in all capital cases. It also should have estab- lished a procedure for third-party presentation of mitigating evidence on behalf of capital defendants who insist on withholding such evidence.

  • Developments in Revenge, Justice and Rape in the Cinema
Int J Semiot Law https://doi.org/10.1007/s11196-019-09614-7 Developments in Revenge, Justice and Rape in the Cinema Peter W. G. Robson1 © The Author(s) 2019 Abstract The index to the 2018 VideoHound Guide to Films suggests that under the broad heading of “revenge” there have been something in excess of 1000 flms. This appears to be the largest category in this comprehensive guide and suggests that this is, indeed, a theme which permeates the most infuential sector of popular cul- ture. These flms range from infuential and lauded flms with major directors and stars like John Ford (The Searchers (1956) and Alejandro González Iñárritu (The Revenant (2015)) to “straight to video” gorefests with little artistic merit and a spe- cifc target audience (The Hills Have Eyes (1977)). There is, as the Film Guide numbers suggest much in between like Straw Dogs (1972) and Outrage (1993). The making and re-making of “revenge” flms continues with contributions in 2018 from such major stars as Denzel Washington in The Equalizer 2 and Brue Willis in Death Wish. Within this body of flm is a roster of flms which allow us to speculate on the nature of the legal system and what individual and to a lesser extent commu- nity responses are likely where there appears to be a defcit of justice. One of the sub-groups within the revenge roster is a set of flms which focus on revenge by the victim for rape which are discussed for their rather diferent approach to the issue of justice.
