NOTICE OF ADOPTION OF A MAJOR AMENDMENT TO THE BRISBANE CITY PLAN 2000 TO AMEND THE PRIORITY INFRASTRUCTURE PLAN At its meeting on 19 November 2013, Council adopted a major amendment to the Brisbane City Plan 2000 by amending Appendix 5, the Priority Infrastructure Plan (PIP) along with necessary consequential and supporting amendments to Brisbane City Plan 2000. The amended Appendix 5, (the PIP) and associated amendments become effective on and from 29 November 2013. Purpose & General Effect The amendment to Appendix 5 (the PIP) inserts a schedule and plan for long-term infrastructure that will: • Assist applicants seeking development approval to identify whether items of long-term infrastructure affect specific sites; and • Assist Council in identifying appropriate conditions for development approval to ensure the long-term network is protected. Local Government (Finance, Plans and Reporting) Regulation 2010 (section 140)

NOTICE OF INTENTION TO SELL LAND

This notice is given to you by Gladstone Regional Council, and relates to property described below.

Background This notice is given because rates or charges levied by the Council on the properties described below are at least 3 years overdue or default judgment has been granted by the Magistrates Court on vacant or commercial land. The Council may sell the property at public auction and use the proceeds to discharge the overdue rates or charges.

The Council is required to give a final notice to the property owner giving details of its decision and giving the owner a final opportunity to pay the overdue rates or charges. If the overdue rates or charges are not paid within 3 months of the notice, the Council will commence proceedings to sell the property. The sale proceedings will be discontinued if the amount of all overdue rates or charges levied on the land, and all expenses incurred by the Council for the intended sale, are paid to it.

The Council has decided to apply this procedure to the properties described below. This document gives notice of the matters which Council is required to notify under the Local Government (Finance, Plans and Reporting) Regulation 2010 to give the property owner a final opportunity to pay the overdue rates or charges and prevent sale of the land by Council.

Formal Notice Council hereby notifies as follows: -

(a) Gladstone Regional Council has decided, by resolution, to sell the land described below because an overdue rate or charge has remained unpaid.

(b) This document is a notice of intention to sell land under section 140 of the Local Government (Finance, Plans and Reporting) Regulation 2010.

(c) The date of the Council meeting at which the resolution to sell the land was made under section 140 of the Local Government (Finance, Plans and Reporting) Regulation 2010 was 19 November 2013 and the resolution was in the following terms:-

(d) “That Council sell the properties described, in accordance with the provisions of Section 140 of the Local Government (Finance, Plans and Reporting) Regulation 2010 for arrears of rates. The properties described are to be sold by way of auction for arrears of rates with an auction reserve and other terms of the process to be set by the Chief Executive Officer having regard to the requirements of the Local Government Act and associated regulations.

Consequences of non-payment If the amount of all overdue rates or charges referred to in this notice, together with interest calculated up to the date of payment, and all expenses incurred by the Council for the intended sale remains unpaid, the Council will sell the land under section 143 of the Local Government (Finance, Plans and Reporting) Regulation 2010. The sale proceeds will be applied to discharge the overdue rates.
