INTRODUCTION One necessary component to the success of the Israeli-Palestinian peace process is economic development and growth in the area under the control of the Palestinian Authority.1 One of the principal requirements for economic growth, and quite possibly for2 the Palestinian Authority's economic survival, is foreign investment in WBG. As they currently exist, laws concerning foreign investment in WBG are a quagmire. Indeed, it is a challenge for an investor to simply identify which law applies to which area, let alone to interpret the law. The areas under the control of the Palestinian Authority consist of portions of the West Bank and the Gaza Strip. Israeli-PalestinianInterim Agreement on the West Bank and Gaza Strip, Sept. 28, 1995, Isr.-PLO, 36 I.L.M. 551 [hereinafter Interim Agreement]. The West Bank is divided into areas "A", "B" and "C." See id. art. XI. The area of Palestinian self-rule consists of areas "A" and "B". See id. Area "A" is currently comprised of eight Arab cities in the West Bank. Id. Area "B" is comprised of smaller towns and villages in which Palestinian jurisdiction extends to civil affairs, but where Israel retains control over internal security. Id. Area "C" consists of the Israeli-controlled remainder of the West Bank. Id. The Palestinian Council currently has jurisdiction over civil affairs in areas "A" and "B". See Interim Agreement, art. It is a comparative study that covers British, Arab and Zionist attitudes to nomadism. By nomadism I refer to a form of territorialist discourse, one which views tribal formations as the antithesis of national and land rights, thus justifying the exteriority of nomadism to the state apparatus. Drawing on primary sources in Arabic and Hebrew, I show how local conceptions of nomadism have been reconstructed on new legal taxonomies rooted in modern European theories and praxis. By undertaking a comparative approach, I maintain that the introduction of these taxonomies transformed not only local Palestinian perceptions of nomadism, but perceptions that characterized early Zionist literature. The purpose of my research is not to provide a legal framework for nomadism on the basis of these taxonomies. Quite the contrary, it is to show how nomadism, as a set of official narratives on the Bedouin of Palestine, failed to imagine nationhood and statehood beyond the single apparatus of settlement. iii The research and writing of this thesis is dedicated to everyone who helped along the way.

    Theoretical Inquiries in Law 4.2 (2003) Colonialism, Colonization, and Land Law in Mandate Palestine: The Zor al-Zarqa and Barrat Qisarya Land Disputes in Historical Perspective Geremy Forman & Alexandre Kedar* This articlefocuses on land rights, land law, and land administration within a multilayered colonial setting by examining a major land dispute in British-ruled Palestine (1917-1948). Our research reveals that the Mandate legal system extinguished indigenous rights to much land in the Zor al-Zarqa and Barrat Qisarya regions through its use of "colonial law"- the interpretation of Ottoman law by colonial officials, the use of foreign legal concepts, and the transformation of Ottoman law through supplementary legislation.However the colonial legal system was also the site of local resistance by some Palestinian Arabs attempting to remain on their land in the face of the pressure of the Mandate authorities and Jewish colonization officials. This article sheds light on the dynamics of the Mandate legal system and colonial law in the realm of land tenure relations.It also suggests that the joint efforts of Mandate and Jewish colonization officials to appropriate Geremy Forman is a Ph.D. candidate in the University of Haifa's Department of Land of Israel Studies. Bauhaus Transfers to Mandatory Palestine Introduction A “Bauhaus style” would be a setback to academic stagnation, into a state of inertia hostile to life, the combatting of which the Bauhaus was once founded. May the Bauhaus be saved from this death. Walter Gropius, 1930 The construction activities of the Jewish community in the British Mandate of Palestine represents a prominent paradigm for the spread of European avant-garde architecture. In the 1930s, there is likely no comparable example for the interaction of a similar variety of influences in such a confined space. The reception of architectural modernism – referred to as “Neues Bauen” in Germany – occurred in the context of a broad cultural transfer process, which had already begun in the wake of the waves of immigration (“Aliyot”) from Eu- rope at the end of the nineteenth century and had a formative effect within the emancipating Jewish community in Palestine (“Yishuv”). Among the growing number of immigrants who turned their backs on Europe with the rise of fas- cism and National Socialism were renowned intellectuals, artists, and archi- tects.     PALESTINE, UTI POSSIDETIS JURIS, AND THE BORDERS OF ISRAEL Abraham Bell* & Eugene Kontorovich** Israel’s borders and territorial scope are a source of seemingly endless debate. Remarkably, despite the intensity of the debates, little attention has been paid to the relevance of the doctrine of uti possidetis juris to resolving legal aspects of the border dispute. Uti possidetis juris is widely acknowledged as the doctrine of customary international law that is central to determining territorial sovereignty in the era of decolonization. The doctrine provides that emerging states presumptively inherit their pre-independence administrative boundaries. Applied to the case of Israel, uti possidetis juris would dictate that Israel inherit the boundaries of the Mandate of Palestine as they existed in May, 1948. The doctrine would thus support Israeli claims to any or all of the currently hotly disputed areas of Jerusalem (including East Jerusalem), the West Bank, and even potentially the Gaza Strip (though not the Golan Heights). Civil society developed around four conditions: shared values, horizontal linkages of participation, boundary demarcation and interaction with the state. These four 6ctors were created and/or enhanced by the provision of medical services and by the organization of public health. In Jewish Palestine, these were developed - especially in the 1930s - by two medical agencies: the Hadassah Medical Organization and Kupat Cholim. First of all, Zionist health developed autonomously from an administrative point of view. Secondly, it was organized in a network of horizontal participation which connect different sections of the (Jewish) population. In the third place, medical provision worked as a connecting element between territory, society and administratioiL Lastly, the construction of health in mandatory Palestine contributed to create a cultural uniformity which was implicitly nationalistic.

    chapter 9 Back into the Imperial Fold: The End of Egyptian Rule through the Court Records of Jerusalem, 1839–1840 Abla Muhtadi and Falestin Naïli The year 1839–1840 often appears as an implicit turning point in chronolo- gies underlying historical research on Palestine and on Jerusalem specifically. It marks the restoration of Ottoman rule over the region after nine years of Egyptian rule and the beginning of the period of Ottoman centralizing reforms in Palestine. The double significance attributed to this year – restoration and reform – translates the ambiguity of the emerging Eastern Question. On the one hand, Britain and her allies actively supported the Ottoman quest to restore rule over Greater Syria, but, on the other, all European countries wished that the door Ibrahim Pasha’s rule opened for European influence in Palestine would remain open and that his reforms would endure. The nine-year period of Egyptian rule has long been presented as a funda- mental turning point in the history of Palestine. Many historians have seen the period spanning from 1831 until 1840 as the beginning of modernity in the region, while others see Bonaparte’s failed Palestine expedition in 1799 as the start of the modern history of Palestine. Both groups have one conviction in common: modernity sprang from elsewhere. It either hailed from Europe or from Khedival Egypt seen as a voluntary or coerced mediator of European wishes for Palestine. Reading local sources and looking beyond the usual timeframe are two ways of checking the veracity of this discourse on the onset of modernity in Palestine.

    UNEXCEPTIONAL FOR ONCE: AUSTERITY AND FOOD RATIONING IN ISRAEL, 1939–1959 GUY SEIDMAN* I. INTRODUCTION Of all the hardships that human societies have endured over history, food shortage stirs some of the strongest emotions.1 Many an older Israeli will often relate the woeful tale of how the State of Israel, soon after its establishment, desperately poor and reeling from a grueling War of Independence, absorbed an enormous influx of newcomers with a food pantry and little hard cash. Israel had to institute an emergency rationing plan for the distribution of food, as well as many other goods and commodities. Emergency legislation was put in place and tough enforcement methods were utilized to make the austerity scheme effective. People remember rationing cards and coupons, police searches of cars and buses for food, black marketers only occasionally brought to justice, and being hungry and severely malnourished. Finally, many recall the humbling, if not humiliating, sense of social unfairness associated with knowing that the rich and privileged were able to feed themselves and their families better than the general population.2 While the physical conditions in nascent Israel were indeed arduous and the legal administration was tough and heavy-handed, what is noteworthy is that this experience was not at all unique to Israel. Berlin ([email protected]) received BEE and BA degrees from the University of Delaware, an MS degree in electrical engineering from Washington University, and an MEd degree in computer science education as well as a doctorate in educational statistics from Widener University. He had been elected as a Senior Member of the Institute of Electrical and Electronic Engineers (IEEE), and elected to RESA, Sigma Xi, and Phi Theta Kappa honor societies. Dr. Berlin had been an electrical engineer with the U.S. Department of Defense for 13 years, during which time he was awarded three U.S. patents. He then retired after 22 years from the Electronic/Electrical Engineering Technology faculty at the Stanton Campus of Delaware Technical Community College. Dr. Berlin has also taught undergraduate and graduate courses at several universities as well as short courses at conferences. He is the author of many magazine articles, journal articles, and editorials, in addition to over 30 books, that cover diverse areas of electronic circuit design, financial markets, numismatics, and the cinema.
