This is an international effort. 71 people from many countries attended a conference organised by NIKE in Edinburgh 25-27th February. There are now 8 cases in the UK linked to this conference -3 in Scotland, 3 England, 1 NI. NIKE contacted all attendees after a positive case was confirmed and they have all been monitoring their health and the now positive cases came forward to be tested when they developed symptoms. There is an international effort on contact tracing which is still ongoing- PHE and PHA also involved. There is some sensitivity internationally about the index case- which people were or were not symptomatic at the time of the conference – this is still ongoing. That is, an additional 5 positive cases today and 11 total positive cases in Scotland so far. At 2pm each day we will report the total number of negative and positive cases reported to us by 9am that day. At the same time we will publish the health board areas of the positive cases. The information for today is 1,514 negative cases and 11 positive cases. The 11 positive cases are split as follows:

We are not aware of any of these patients giving cause for concern. Contact tracing is at different stages for the different cases – some concluded and some underway. The request for full correspondence is provided in the attached email. - When tracing contacts how far back do we go - from point person starts having symptoms or before?  In March, the contact tracing policy in Scotland was to trace close contacts from symptom onset of the confirmed case.  As the scientific evidence about transmission has improved since then, and particularly as there is now strong scientific evidence of infectivity prior to symptom onset, we now identify close contacts from 2 days prior to symptom onset.  This change reflects improved understanding of the novel coronavirus. E.g. in contact tracing guidance published on 25 February by ECDC, it says “A case is believed to be most infectious when symptoms are present, but could possibly already be infectious before the onset of symptoms.” By contrast, the ECDC guidance published on 8 April says, “A contact of a COVID-19 case is any person who has had contact with a COVID-19 case within a timeframe ranging from 48 hours before the onset of symptoms of the case.”  https://www.ecdc.europa.eu/sites/default/files/documents/covid-19-public- health-management-contact-novel-coronavirus-cases-EU.pdf

- Disclosure programme said until last week guidance was that CV patients in care homes should not be hospitalised - that doesn’t sound correct to me but can we double check We can confirm this is not correct.

Top lines:  We are absolutely clear that we expect anyone who would benefit from hospital care to be admitted to hospital. This includes care home residents, when this is deemed to be in their best interest.  It is often the case that hospital admissions for older and very frail people may be inappropriate. In such instances, additional support may need to be provided within the care home setting depending on availability of local services. That was the case before the outbreak of COVID19 and remains so.  Any decision on admission to hospital needs to be an individual decision based on someone’s needs and medical situation and the services available in the community.

- Briefing on the Crosslet Care Home in Dumbarton and the use of Do Not Attempt CPR there. In particular she would like the briefing to include all the correspondence CMO and CMO/RCGP and BMA have issued on this. Given the Cab Sec has a topical on care home guidance tomorrow she is fully expecting this to come up. Please see briefing and letters attached. 1. The BBC has interviewed an epidemiologist from at Edinburgh University who is leading a team preparing to publish a scientific modelling study estimating how many lives may have been saved had Scotland locked down sooner. The scientists, whilst accepting a degree in uncertainty in their model (as with all models) estimate that if Scotland had imposed a lockdown on the 10th March, as of May 3, Scotland could have seen fewer than 600 covid related deaths in comparison to the real number of 2,795 (as published on May 6). Other eminent experts have told our programme that there was enough information coming out of Italy and China for Scotland to have acted much sooner, including banning mass gatherings and introducing from the beginning of March. Does the Scottish government accept that if it acted sooner than the UK government, many hundreds of Scottish deaths might have been prevented?

At all times, the Scottish Government’s actions have been guided by the best and most up to date expert scientific and medical advice, working closely with Governments across the UK. The virus doesn’t respect borders or boundaries and it makes sense to align our activity as much as possible. However, as the First Minister has previously said, the Scottish Government will not hesitate to do things differently if that is in the best interests of tackling the virus here in Scotland. Examples of this approach include the announcements on banning mass gatherings and school closures that were made in advance of UK-wide decisions, and recent guidance issued by the Scottish Government on the use of face coverings in enclosed public spaces. 2. On 10 March, just two days before the UK abandoned its contact tracing policy, a document was published on the ScotGov website https://www.gov.scot/publications/coronavirus-how-contact-tracing-works/ by the then deputy CMO. Can you explain why a policy which is recognised as “a fundamental part of outbreak control” and which was clearly initially a key plank of the ScotGov reaction, was stopped two days after this publication, at a time when the number of confirmed cases in Scotland numbered only 60?

It was announced on 12 March that the UK was moving from the contain phase to the delay phase, at which point contact tracing was stopped. As a result, those who displayed symptoms of a new continuous cough and/or a high temperature, regardless of their travel history or contact with confirmed cases, were asked to self- isolate. As set out in Dr Smith’s paper on 10 March, the Scottish Government was clear that we could reach a point of sustained transmission when we would rely less on contact tracing, and focus instead shifting to providing the best care to help those who have developed COVID-19, delaying and reducing the spread as much as possible, and protecting those who are particularly vulnerable. 3. If the explanation for Q2 above is a lack of contact tracing infrastructure, please explain why Scotland had not to adequately prepare for this situation, given a global emergency had been declared by WHO as far back as January?

On the advice of senior clinicians and public health experts at the time, Scotland’s testing capacity was initially prioritised where it would have the greatest effect – for the seriously ill, and to allow key workers to return to work. Since then we have significantly ramped up our testing capacity. At the start of the outbreak, we had two NHS labs, in Glasgow and Edinburgh that between them could do 350 tests a day. We set a target of having the capacity to process 3,500 tests a day. We now have lab capacity for over 6,200 to be carried out within the NHS, and are aiming to reach 8,000 a day by the middle of this month. NHS labs are now operating in all 14 health board areas. Between the tests processed in our NHS labs and those in the Lighthouse Lab, the total normal daily capacity in Scotland is now over 10,000. We expect that number to exceed 12,000 by the end of next week. 4. ScotGov’s actions to date have by and large been in lockstep with the UK Govt’s. a) Does the ScotGov accept that it did not have the requisite expertise in place to enable it to take independent decisions prior to lockdown and b) why did it take till 25 March to set up its own advisory panel, by which time many of the most important decisions about this lockdown had already been taken? a) No. b) The establishment of a separate Scottish advisory panel – the COVID-19 Advisory Group – drawing on existing expertise within Scotland, allows us to tailor advice to specific Scottish circumstances, which may differ from the rest of the UK, as the situation develops. The Chair of the CMO Advisory Group (Professor Andrew Morris) is also a member of SAGE. 5. It emerged that Scotland’s chief scientists had been prevented from playing an active part in Sage meetings. What is ScotGov’s response to this? Scotland has been able to contribute to the overall process through UK-wide meetings such as COBRA discussions, at which SAGE advice has been discussed. As the number of cases in Scotland increased, the COVID-19 Advisory Group was established to provide additional scientific analysis of how COVID-19 was spreading in Scotland, and its impact. The group supplements the advice coming to the four nations from the Scientific Advisory Group on Emergencies (SAGE) to further strengthen Scottish Government modelling work informing national and local decisions in Scotland during the pandemic. 6. We have spoken to relatives of a resident of the Crosslet Care Home in Dumbarton, run by West Dunbartonshire Council, who allege their loved one, a [redacted] had a DNR notice placed upon her without notification or seeking consent from her family, one of who had power of attorney. We are seeking comment from WDC and NHSGGC but I am asking if this home or the patient’s GP has been in breach of ScotGov guidance on nursing homes (https://www.gov.scot/publications/coronavirus-covid-19-clinical-guidance-for- nursing-home-and-residential-care-residents/pages/2--measures-to-prevent- and-prepare-for-infection-in-residents/ ) which stipulates that discussion should take place with the resident or their carers before such actions. Will ScotGov look into this?

The COVID-19 outbreak has brought about absolutely no change to the use of Do Not Attempt CPR (DNACPR) forms in the Scotland’s NHS, and no change to the advice issued to GPs about their use. Letters have recently been issued to GP practices to provide advice and support on having anticipatory care planning (ACP) conversations. It also reinforced existing approaches and provided advice about how to ensure these conversations are taken forward in a sensitive, respectful manner in all cases. While discussions around DNACPR forms may feature in these conversations, the guidance makes clear that there is no requirement for health professionals to have conversations about DNACPR, unless the patient raises it or the health professional deems it clinically necessary. 7. We have testimony from another family whose relative [redacted] was in Burlington Care Home in Glasgow, where at least 16 died. She died on the 15 April, and her family claim she was denied hospital treatment. It seemed to be broad Govt policy that care residents should not be admitted to hospital (https://www.gov.scot/publications/coronavirus-covid-19-clinical-guidance-for- nursing-home-and-residential-care-residents/pages/5--managing-covid-19- cases-in-long-term-care-settings/ - point 5) and the family of [redacted] believe the elderly have been “written off” in the Govt’s response to this pandemic. How does ScotGov respond to this?

While we cannot comment on the specific details of individual cases, we expect all care homes to ensure the safety of staff and residents. Our guidance says that decisions about care and treatment, including hospital admission, for residents who have a deterioration in their condition should be on an individual basis, based on the person’s best interests and in consultation with the individual or their families/representatives. For many older and frail residents, hospital admission may not be appropriate - additional support within the care home setting may be preferred and deemed a more appropriate response. Care home residents will be admitted to hospital if that is the clinical advice. Clinical decisions will be made taking consideration a range of issues including the best treatment for a patient and the best place for the patient for that treatment to take place. Every death related to COVID-19 is a tragedy and our thoughts are with the families and friends of those who have died in these unprecedented circumstances and to all those affected in all of the outbreaks in care homes. The BBC has discovered that a conference for senior Nike employees took place in Edinburgh in late February. I have already asked a number of questions I relation to this, and those questions still stand. In addition to those questions (which I attach below for ease of reference) I would like to ask: a) why ScotGov and HPS decided not alert the Scottish public to a potentially dangerous outbreak in Scotland? b) please explain how ScotGov’s position is that the first community transfer of covid 19 took place on 11 March – when this outbreak is clearly an example of community transmission as far back as late February? c) It was suggested to me this morning ScotGov may not release details of exactly where this conference took place – I ask that this position is reconsidered, in the spirit of openness and transparency the FM has promised the Scottish people. The group at increased risk of COVID-19 were all identified and all contacts were traced, so public health authorities were satisfied that there was no further infection risk. The initial case had recently travelled to a specified high risk country during their incubation period before attending this conference. All of the cases linked to this event were traced by their close contact with this case, or contact with conference delegates who tested positive after the event. Therefore it is not an example of community transmission. An example of community transmission would require a confirmed case, with no known history of international travel to a risk area, or link to close contact of such a case. 9. We’ve interviewed public health expert Prof Allyson Pollock, who says she wrote to the FM on the 21 March urging her not to follow the rest of the UK’s path and resume a contact tracing policy, amongst other things. Prof Pollock, who posted the letter on her website, says she was has not received a reply. Does ScotGov have a response to this? It was announced on 12 March that the UK was moving from the contain phase to the delay phase, at which point contact tracing was stopped. NHS Scotland’s online system for Scotland will build on our existing technology already used for other infections and which people will use to input details on all their contacts supporting the work of the contact tracer. We will reply to Professor Pollock’s letter in due course. I’m investigating a line I’ve become aware of that involves an early outbreak of corona virus in Edinburgh in late February. I understand that the annual Nike Head Coach European Conference (“Head Coach” means store manager) was held in Edinburgh this year around the 27/28 February. I’ve confirmed that a number of Nike staff from around the UK and Europe subsequently fell ill with covid symptoms and tested positive. I’ve been told that the virus was likely brought into Scotland to the conference from a Nike employee from Amsterdam. In light of this I have a number of questions: is ScotGov/HPS aware how many Nike staff or people associated with this conference (including conference venue staff) were tested positive? When did the first staff member test positive? How did ScotGov become aware? can you confirm if all people attending the conference (as well as conference venue employees) were “contacted and traced” by the Scottish authorities in a bid to contain the virus? What other action was taken by HPS/ScotGov? please confirm the exact location and dates of the conference please confirm what action was taken by the conference venue many Nike stores around the world and in the UK were closed for deep cleans following this conference – can you confirm whether the Scottish authorities were communicating with Nike about steps to contain the virus? Health Protection Scotland (HPS), now part of Public Health Scotland, and Scottish Government were alerted by international public health authorities on 2 March 2020 of an individual who had tested positive for COVID-19 following their attendance at a conference for over 70 delegates in Edinburgh at the end of February. HPS set up an Incident Management Team (IMT), with representatives from Scottish NHS boards and national and international public health agencies, to ensure all attendees were contacted and given appropriate public health advice. This included advice regarding self-isolation and contact tracing of any attendee showing symptoms of COVID-19. The conference organisers shared full details of all delegates which allowed the IMT to ensure contact tracing of all attendees. Close contacts of those individuals who tested positive were also contacted in each country. Investigation revealed that a total of 25 cases within and outside the UK were confirmed to be linked to the event itself or were close contacts of attendees. Eight of these cases were resident in Scotland. All were contact traced and reported in details of the number of cases in Scotland at the time. NHS Lothian and Edinburgh City Council worked closely with the conference venue to ensure that all public health issues were addressed including advice for close contacts of delegates and infection prevention and control considerations.

DISCLOSURE SCOTLAND (COVID-19)

She estimates that if Scotland had imposed a lockdown on the 10th March, as of May 3, Scotland could have seen fewer than 600 covid related deaths in comparison to the real number of 2,795 (as published on May 6). Disclosure Scotland will be reporting on an International NIKE conference on 27 February that took place in Edinburgh where an attendee from Amsterdam was subsequently tested positive for coronavirus. On Tuesday 3 March, HPS informed us that one of the cases that tested positive related to attendance at the NIKE conference and they held a IMT to seek more information. This involved Dutch and Irish health protection teams to allow them to undertake full contact tracing. The HPS contact tracing revealed that a total of 25 cases within and outside the UK were confirmed to be linked to the event itself or were close contacts of attendees. Eight of these cases were resident in Scotland. All were contact traced and reported in details of the number of cases in Scotland at the time Ministers were briefed as part of the sitrep on Tuesday 3 March, but this did not include details of the individuals and advice was provided through CMO not to publicly reference the conference in order to protect patient confidentiality. At the time the contact who attended the conference was identified there were a total of 3 confirmed cases. This one, the first case announced on Sunday 1 March and the second case which was related to the first case. The following were reported to us (and subsequently to Ministers via sitreps on a daily basis) as being connected to the NIKE conference up to 7 March at which point HPS stopped providing a detailed link to each case due to complexity: Index case (3rd case from Ayrshire) Case 5 (contact with index case in Ayrshire) Case 7 (Forth Valley) Case 9 (Lothian) Case 12 (Lanarkshire) Case 15 (Grampian)

Top Lines

 Health Protection Scotland were alerted an individual had tested positive on Tuesday 3 March and, as is usual practise, convened an Incident Management team meeting to undertake contact tracing. This was the third confirmed case in Scotland at the time.  Daily updates were published on the Scottish Government website at 2pm of the number of tests undertaken which included the number tested positive.  We understand that for this specific case, an international IMT was held which included Dutch and Irish Health protection teams where a total of 25 cases were confirmed (8 of which in Scotland) linked to the NIKE conference in Edinburgh.  Steps were then taken by the respective health protection teams to provide advice and follow up in the event that these contacts starting to display symptoms.  Our response to the outbreak has been guided by the best clinical science and Scotland, in line with other countries, followed the well-established practise of seeking to contain the spread as long as possible.  That is why I activated SGoRR, the Scottish Government Resilience Room, and chaired a meeting on Tuesday 25/02/2020.

Stopping Contact tracing  The announcement to impose restrictions on 23 march, marked a move from the contain to the delay phase and at this point testing was prioritised to support clinical assessment.  This was set out in a paper published on the 10 March explaining that we could reach a point of sustained transmission when we’d rely less on contact tracing, and focus instead shifting to providing the best care to help those who have developed COVID-19, to delaying and reducing the spread as much as is possible and to protecting those who are particularly vulnerable  We are now moving to the test, trace, isolate and support (TTIS) approach, which involves anyone in Scotland who has symptoms of Covid-19 immediately isolating themselves, quickly getting in touch with the NHS to arrange a test and sharing details of the people they’ve been in contact with.  In the meantime we continue to increase our testing capacity to meet future demands.  We now have lab capacity for over 6,200 to be carried out within the NHS, and are aiming to reach 8,000 a day by the middle of this month. NHS labs are now operating in all 14 health board areas. Between the tests processed in our NHS labs and those in the Lighthouse Lab, the total normal daily capacity in Scotland is now over 10,000. Many thanks Regards [Redacted], [Redacted], Chamber Desk Document reference: 7 Disclosure Scotland reported on an International Nike conference on 27 February that took place in Edinburgh where an attendee from [Redacted] was subsequently tested positive for coronavirus. On Tuesday 3 March, HPS informed us that one of the cases that tested positive related to attendance at the Nike conference and they convened an incident management to seek more information. This involved Dutch and Irish health protection teams to allow them to undertake full contact tracing. The HPS contact tracing revealed that a total of 25 cases within and outside the UK were confirmed to be linked to the event itself or were close contacts of attendees. Eight of these cases were resident in Scotland. All were contact traced and reported in details of the number of cases in Scotland at the time Ministers were briefed as part of the sitrep on Tuesday 3 March, but this did not include details of the individuals and advice was provided through CMO not to publicly reference the conference in order to protect patient confidentiality. At the time, the contact who attended the conference was identified there were a total of 3 confirmed cases. This one, the first case announced on Sunday 1 March and the second case which was related to the first case. HPS updated ministers and confirmed they had held a IMT to seek more information. This involved Dutch and Irish health protection teams to allow them to undertake full contact tracing. Ministers informed of this update in daily sitrep.

Wednesday SG announces via press release 2 new cases, 4 March bringing total cases to 3. That news release confirmed:

One patient is resident in the Grampian area, the second patient is resident in the Ayrshire area. One patient has recently travelled to northern Italy and the other has had contact with a known positive case – this contact was not with the first positive case confirmed in Scotland.

HPS have confirmed that one of those new cases was connected to the conference.

The news release also confirmed contact tracing was underway for these patients:

Clinicians have begun contact tracing, the process of gathering details of the places they have visited and the people they have been in contact with. It is important to note that this tracing process does not involve people the patients may have passed on the street or in a shop – as the risk in these situations is very low. Close contact involves either face-to-face contact or spending more than 15 minutes within two metres of an infected person. Those at risk of infection will be contacted by health protection teams for further advice. Those who are not contacted are not at risk.

Thursday 5 FMQs – FM announces 3 new cases, bringing total March to 6. Thursday 5 14:55 Officials notify Cabinet Secretary of an additional 2 March presumptive cases. Email confirms that “the information available is that one is a [redacted- section 30(b)(ii)] and the other is a person returned from Italy.”

Thursday 5 17:42 Officials notify Cabinet Secretary there are an March additional 3 presumptive cases in Scotland that day. One in Lothian [redacted-section 30(b)(ii)]. E-mail confirms that this means 5 new presumptive cases in Scotland that day, bringing total to 11.

Two new cases of coronavirus (COVID-19) Public have vital role to play in helping contain any outbreak.

Two further patients in Scotland have tested positive for COVID-19, bringing the total number of cases to three.

Both patients are being admitted to hospital and are currently receiving treatment in isolation. Both are currently clinically well.

One patient is resident in the Grampian area, the second patient is resident in the Ayrshire area. Both have had contact with known separate positive cases. Due to patient confidentiality, we are unable to give any more details. Clinicians have begun contact tracing, the process of gathering details of the places they have visited and the people they have been in contact with.

It is important to note that this tracing process does not involve people the patients may have passed on the street or in a shop – as the risk in these situations is very low. Close contact involves either face-to-face contact or spending more than 15 minutes within two metres of an infected person. Those at risk of infection will be contacted by health protection teams for further advice. Those who are not contacted are not at risk.

“Our first thoughts must be with the patients diagnosed with coronavirus, I wish them a speedy recovery.

“We expect the number of cases to rise and Scotland is well-prepared for a significant outbreak of coronavirus. There is currently no treatment or vaccine so early detection measures will continue to be vital in helping to prevent the spread of the virus.

“People have a vital role to play in helping us contain any outbreak by following the latest health and travel advice, and following basic hygiene precautions, such as washing hands frequently, not touching their face and covering their nose and mouth with a tissue when coughing or sneezing.”

Scotland’s Chief Medical Officer Dr Catherine Calderwood said:

“Firstly our thoughts are with those who have been diagnosed, and with their families.

“Scotland is well equipped to deal with infections of this kind. We have a proven track record of dealing with challenging health issues, and have been preparing for this possibility since the beginning of the outbreak.

“We practice and prepare our response to disease outbreaks and follow tried and tested procedures, following the highest safety standards possible for the protection of NHS staff, patients and the public.”

The positive sample has been sent to Public Health England’s Colindale laboratory in London for a confirmatory test. Scottish Laboratories will send all positive samples to Public Health England’s WHO designated Colindale laboratory for confirmatory testing.

In addition to the response provided to the BBC (attached), we have also issued statement below (on SpAd clearance to ensure it was carried) to PA, Telegraph, Times and the Sun to correct BBC line that “the Scottish Government did not comment on the study’s findings”. We have contacted the BBC to correct this. [redacted] A Scottish Government spokesperson said: “This claim is wrong – the Scottish Government was asked about this study and we gave a response to the question which was asked. “At all times, the Scottish Government’s actions have been guided by the best and most up to date expert scientific and medical advice, working closely with Governments across the UK. “Health Protection Scotland (HPS), now part of Public Health Scotland, and Scottish Government were alerted by international public health authorities on 2 March 2020 of an individual who had tested positive for COVID-19 following their attendance at a conference for over 70 delegates in Edinburgh at the end of February. “HPS set up an Incident Management Team (IMT), with representatives from Scottish NHS boards and national and international public health agencies, to ensure all attendees were contacted and given appropriate public health advice. This included advice regarding self-isolation and contact tracing of any attendee showing symptoms of COVID-19. “The conference organisers shared full details of all delegates which allowed the IMT to ensure contact tracing of all attendees. Close contacts of those individuals who tested positive were also contacted in each country. “The initial case had recently travelled to a specified high risk country during their incubation period before attending this conference. BBC Scotland’s disclosure reveals findings of an epidemiological study suggesting earlier lockdown in Scotland could have prevented 2000 deaths

More than 2,000 coronavirus deaths could have been prevented if Scotland had locked down two weeks earlier, according to a new study.

A team of epidemiological scientists at University of Edinburgh produced the findings, which feature in tonight’s BBC Scotland Disclosure investigation at 8.30 pm on BBC One Scotland.

They suggest the death rate in Scotland could have been reduced by 80% with earlier action. Experts also told BBC Disclosure: Scotland’s Lockdown the UK as a whole should have acted earlier.

The Scottish government said its actions had been guided by the best and most up- to-date scientific advice.

The BBC Disclosure programme also reveals there were multiple transmissions of the virus in Edinburgh in February, well before the first confirmed cases in Scotland, but this was not disclosed to the public.

And a Glasgow family has told of their devastation after three grandparents were taken by the virus.

Wendy Russell and her father, Dougie Chambers, were among several people who fell ill after her 40th birthday party on 7 March.

"I started to think this doesn't look good. When do you ever go to a party and five people all fall ill on the same day?" said Wendy.

Within days 66-year-old Dougie, who had an underlying health condition, went into hospital and tested positive for Covid-19. He died two weeks later.

Wendy's sister, Lynsey Chambers, said her nine-year-old daughter Anna was then faced with losing another two grandparents. Lynsey's parents-in-law Andy and Mary Leaman, contracted the virus soon after the party. The couple, aged 73 and 72, died within days of each other.

Lynsey said: "For a nine-year-old girl whose three grandparents were her world… why does a wee girl need to get punished like that over and over again?"

The family say they believe the warnings about the coming pandemic should have been louder in early March.

Wendy said: "If we knew then what we know now, we wouldn't have had the party. It wouldn't have happened.

"And it's these things that keep you up at night."

News of Scotland's first confirmed coronavirus case, in Tayside, was announced on 2 March.

The BBC can reveal the virus had been brought to Scotland the week before.

An outbreak began in Edinburgh on 26 and 27 of February at a conference for the sportswear giant Nike. More than 70 employees from all over the world attended the conference at the Hilton Carlton Hotel.

One of the delegates from abroad brought the virus into Edinburgh and infected many of their fellow Nike employees, who then returned to their own countries. At least 25 people linked to this one event are confirmed to have been infected – eight of them resident in Scotland.

Health authorities in Scotland were aware of this potential outbreak by 2 March, but the public were not told about it. Nike closed many of its stores around the UK and worldwide for deep cleans.

Nike told the BBC it instigated enhanced measures, including contact tracing and increased cleaning and disinfection processes in their stores and offices, and that all its staff had now recovered.

The Scottish government confirmed health authorities were alerted to the potential outbreak on 2 March.

It said those at increased risk were identified, their close contacts were traced and public health authorities were satisfied there was no further infection risk.

Those cases resident in Scotland were reported in details of the number of cases in Scotland at the time.

The BBC spoke to one guest who had been staying at the hotel during the conference, who said he had been in close contact with numerous Nike delegates. However, he said had not been contact traced by anyone from the Scottish health service to tell him about the risk.

Despite knowing the virus had been in Scotland since at least late February, Scotland did not ban mass gatherings until 16 March, or go into lockdown until 23 March - the same day as the restrictions were announced by the UK government.

Scotland's own advisory panel - featuring Professor , chair of public health at Edinburgh University - was set up two days after the lockdown was introduced.

Prof Sridhar said there had "definitely" been more than enough information about the coming pandemic for action to have been taken much sooner across the UK.

She said: "We should have been acting by mid-February. We could see that this was not easily a virus to be contained."

Prof Dame Anne Glover, who is president of the Royal Society of Edinburgh and the former chief scientific advisor to the Scottish government, said: "Mistakes have been made and that has resulted in lives being lost."

BBC Disclosure asked a team of epidemiological scientists at the University of Edinburgh to model what might have happened to Scotland's death rates if we had locked down sooner.

Prof Rowland Kao and his team developed a model which simulated the epidemiological behaviour of the Scottish population.

It was based on figures which were published by the National Records of Scotland last week, which said a total of 2,795 people had died with a confirmed or suspected case of the virus.

Professor Kao said: "The question we're addressing here is what would have happened if rather than having lockdown on around 23 March, we'd done it about two weeks earlier.

"While… there's quite a bit of uncertainty in what the final outcome will be, all those [projections] are now substantially below what actually happened."

The model, while allowing for uncertainty, predicted the death toll would have been around 577 - about 80% lower than the actual total. He added: "What that indicates to you is that these measures could have easily taken effect and reduced those death rates."

The Scottish government did not comment on the study's findings.

It said it has been guided at all times by the best and most up-to-date expert scientific and medical advice, working closely with governments across the UK.

It may mean, and I stress it may mean, at a later stage that some non-urgent activity in the National Health Service would be postponed in order to prioritise capacity for people who needed hospital treatment. So these are the kind of things that the NHS works through. It may mean encouraging retired medics or nurses or other healthcare professionals to come back into work, and again, these are all things that are in the plan and things that the NHS is well used to having to work through.

We’re planning for potentially the worst-case scenario while taking actions to avoid that happening and to mitigate it. So my advice to the public is that this is a serious situation, but it is being treated seriously. We’re not powerless in the face of this and all of us can make a contribution, and for all of us that means following the advice about hand-washing and what to do when you cough and sneeze.

Reporting Scotland (04/03/20)

The two cases that have been confirmed in Scotland overnight, bringing the total to three, one of those is a patient from the Grampian area, the other is a patient from Ayrshire. One has returned from travel in Italy, the other has had contact with another confirmed positive case, although I would stress that’s not the first confirmed case in Scotland. So I’m not able to give more information obviously, patient confidentiality continues to be important, but all appropriate steps are being taken, both to care for the patients, who are both clinically well, but also to make sure that the contact-tracing is under way because we’re still very much in the containment phase of this outbreak and that means ensuring that anybody that a confirmed case has been in contact with is followed up, tested where necessary, and given all of the appropriate advice.

Contacts, in this context, don’t mean somebody who might have passed a person with coronavirus on the street or had fleeting contact, it’s people who have been in contact close face-to-face contact or who have been within two metres for periods of fifteen minutes or more. And if the health protection teams think you are one of the close contacts of any confirmed patient, they will contact you.

[redacted] redacted FM Covid Briefing Unit [email protected] redacted 11 May: Nike conference: Disclosure Scotland reported on a conference held by Nike on 26 and 27 February in Edinburgh where an attendee from Amsterdam subsequently tested positive for coronavirus. On Tuesday 3 March, HPS informed SG that one of the new Scottish cases that day related to the conference. They convened an incident management to seek more information. This involved Dutch and Irish health protection teams to allow them to undertake full contact tracing. HPS contact tracing revealed that a total of 25 cases within and outside the UK were confirmed to be linked to the event itself or were close contacts of attendees. 11 May: Edinburgh University modelling: BBC report Edinburgh University modelling which estimated that if Scotland had imposed a lockdown on the 10 March, as of May 3, we could have seen fewer than 600 Covid related deaths. 26 April: Media reported you were not present at the first five Covid Cobra meetings. This follows a report on 19 April in the Sunday Times, which said the PM skipped five Cobra meetings on the virus.

 The Scottish Government has been present at every Cobra meeting since our resilience operation was activated.  The Health Secretary participated in the ministerial Cobra meetings on 24 and 29 January, 5 February, 26 February and 4 March.  I have attended ten of these – from the 2nd March, and have attended every meeting held since 4th of March  I have also been chairing meetings of the Scottish Government Resilience Committee since 29 January.  Our resilience room is the main point of contact between UK Government and Scotland’s Resilience Partnerships.

SAGE/SGORR

 The Scottish Government participated in a precautionary SAGE meeting on the Wuhan coronavirus on 22 January.  The Scottish Government Resilience Room was stood up on 29 January.  Since then, the ministerial resilience committee has met on 12 occasions. I have chaired all but one of those meetings.  The Deputy First Minister chaired the meeting on 17 February as I was visiting communities hit by flooding.  As well as official resilience committee meetings, I have chaired eight subject- specific resilience meetings.  These have examined topics such as food supply, testing, care homes and shielding.  In addition, there have been a further 15 non-ministerial meetings of the committee to monitor resilience issues.

NIKE CONFERENCE (timeline at annex B)  There is a suggestion that there was knowledge of this outbreak at the point the conference was happening. That is not the case.  We confirmed the first case in the whole of Scotland on 1 March. This was an individual in Tayside.  Health Protection Scotland were alerted on 2 March that an individual overseas who had been at the conference had tested positive.  On that date, there had been no positive cases in Scotland linked to the conference.  The next day – 3 March - Health Protection Scotland recorded a positive case in Scotland of an individual who had been a conference delegate.  That case and the details of the potential outbreak was confirmed to ministers on the evening of 3 March.  Details of that case were then included in a news release we issued on 4 March and included on our normal case reporting schedule.

At the time, I asked whether we should be putting more information into the public domain  The advice – which I accepted – was that it was not appropriate. One of the reasons for that was patient confidentiality.  Had there been more information about that event put into the public domain that would not have changed the steps taken to protect public health.  At the time, the numbers of cases remained low.  That meant, to identify where any case contracted the virus could potentially have identified the patients concerned.

The most important thing at the time was the implementation of measures to protect public health

 Health Protection Scotland convened an incident management team meeting to undertake contact tracing.  This included representatives from Scottish NHS boards and national and international public health agencies.  The aim was to ensure all attendees were contacted and given appropriate public health advice.  This included advice regarding self-isolation and contact tracing of any attendee showing symptoms of COVID-19.  The conference organisers shared full details of all delegates which allowed the incident management team to contact trace all attendees.  Close contacts of those individuals who tested positive were also contacted in each country.  Investigation revealed that a total of 25 cases within and outside the UK were confirmed to be linked to the event itself or were close contacts of attendees.  Eight of these cases were resident in Scotland.  All were contact traced and reported in details of the number of cases in Scotland at the time.  NHS Lothian and Edinburgh City Council worked closely with the conference venue to ensure that all public health issues were addressed.  This includes advice for close contacts of delegates and infection prevention and control considerations.  Steps were then taken by respective health protection teams to provide follow up in the event these contacts started to display symptoms.

EDINBURGH UNIVERSITY MODELLING

 Neither the BBC nor the scientists have shared the statistical model used in the Disclosure programme with us.  From watching the programme, the graph appeared to show very wide confidence intervals.  It appeared that the confidence intervals overlapped but we don’t know because we haven’t seen the data.  Any modelling done now is done with the benefit of hindsight.  Unfortunately this is not how the real world works. We couldn’t see the future on 9th March.  Any move to lockdown earlier would have also risked increasing the other harms that we are now experiencing as a result of the restrictions.  At the point they chose to model from, we had 23 confirmed cases in a population of over 5 million.  At that point, we knew their names, their contacts and their locations and tracing efforts were underway.  The announcement to impose restrictions on 23 March, marked a move from the contain to the delay phase.  At this point testing was prioritised to support clinical assessment.  This was set out in a paper on the 10 March, which explained we could reach a point of sustained transmission when we would rely less on contact tracing.  Instead, we would shift to delaying and reducing the spread as much as is possible.

EXERCISE SILVER SWAN

ISSUE: 3 MAY – Sunday post article carrying criticism of our approach to pandemic planning following the completion of Exercise Silver Swan. This was a pandemic flu planning exercise carried out in 2015. The results of the exercise were distributed to relevant partners in 2016.

Richard Leonard claims:  The report identifies issues distributing PPE and yet there are ongoing problems in this area. The report states PPE is only necessary for staff carrying out high risk proceduresm which he is seeking to suggest has led to us “limiting PPE for staff”  The repor highlights difficulties with “fit testing” of PPE which appear not to have been addressed, given the army has been drafted in to help with this.  The report fails to address the issue of the need for testing as part of a pandemic response.  The report only focuses on influenza and we should have prepared for other pandemic solutions.  We should now publish details of how each agency took forward the recommendations.  If we carried out other exercises on situations more comparable to Covid, we should publish details of those.

ISSUE: There has been widespread criticism in the media for the UK Government not publishing details of at the outcome of the exercise in 2016.

TOP LINES:  Exercise Silver Swan was a specific pan flu exercise carried out in Scotland in 2015, which reported in 2016.  That exercise involved frontline NHS boards and social care bodies.  All of the learning points from Exercise Silver Swan were circulated to health boards, councils and resilience partnerships.  This was to ensure they were incorporated into local ongoing resilience planning efforts.  Scotland is better prepared to deal with various pandemic situations due to improvements made from exercises such as this.  However, no amount of planning can foresee all of the challenges set by novel viruses like Covid-19.

PERSONAL PROTECTIVE EQUIPMENT . Exercise Silver Swan did highlight some learning points for PPE that were circulated to boards and resilience partnerships. . However, it is worth noting the specific demand for PPE is dependent on the scenario presented by the virus or disease we are facing. . Our pandemic stockpiling approach is based on a wider body of evidence than this single report. . The stockpiling is based on expert advice and scientific modelling of what will be required to deal with a pandemic event. . This is based on a reasonable worst-case pandemic flu scenario. . At the outset of Covid-19, we held substantial stockpiles of a range of PPE and medicines designed to combat a pandemic event. . We started this year with 45 million PPE items in our stockpile and continue to procure and distribute large quantities of PPE to health and social care providers across Scotland . . That is an increase from 35 million at the start of 2019. . That includes almost 15 million facemasks and increasing our stockpile of aprons by over 10 million in the last year. . We will of course look to learn lessons from the experience of Covid 19 to inform future pandemic planning

FIT-TESTING: FFP3 RESPIRATOR MASKS . Fit testing of FFP3 respirator masks is specific to every individual member of staff and must be carried out for each make and model of mask. . Given the specific challenges of Covid-19 this has meant that more staff require to be fit-tested . Additional challenges are presented when switching to a new model of mask if the original is no longer available. . This means that staff need to undergo new fit testing procedures in order to ensure the mask fits correctly.

TESTING APPROACH . Testing of patients is not routinely included in pandemic influenza exercising. . Clearly we need to be able to adapt to the specific challenges posed by novel viruses, such as Covid-19. . That means any testing approach will be based on the emerging science of the virus. . It will based on modelling of the specific challenges posed by that virus right now, as well as the testing technology available to fight it.

FOCUS ON INFLUENZA . Expert advice has been that an influenza pandemic has been the highest risk we faced. . It was therefore only right that we based our pandemic preparations on that likelihood. . However, much of our local and national planning for pandemics remains relevant whether for influenza or coronavirus . Exercises are an important tool for organisations to plan and prepare for real events which may impact on their ability to provide services. . However, when we are dealing with real-world situations, we need to adapt to the specific challenges and adjust our approach accordingly. . Influenza planning is also not the only scenario we plan for. . Other high-risk scenarios are regularly examined at national, regional and local levels. . We do not routinely publish exercise reports such as this as they deal with a wide range of hypothetical scenarios. . However, any such reports would influence our planning guidance and that is published.

EXERCISE CYGNUS . Exercise Cygnus was a planning exercise primarily for the NHS in England. . Scottish Government officials and Health Protection Scotland took part in it, but nobody from the frontline in NHS Scotland. . The final report was compiled by Public Health England and was shared with the Scottish Government and then NHS Boards. . The report did not focus specifically on individual countries’ capacity and there were no specific recommendations for Scotland. . It was primarily focused on the overall UK command and control response structures.

This is in addition to the passing of the Coronavirus Bill and the Coronavirus (Scotland) Bill and the scrutiny involved in that. . Dropping Ministers off for the moment. I’ve attached two outline drafts, and grateful for views as the Cabinet Secretary has asked for this before 10am tomorrow. The first is a very short note based on previous approaches that have been used, but the second is slightly more expansive highlighting that there has indeed been a consistent approach given that all contact cases have not divulged information that would lead to the identification of patients. By way of context the press release issued on Sunday 1 March (https://www.gov.scot/news/coronavirus-covid-19/ ) said “…The patient is a resident of the Tayside area and has recently travelled from northern Italy”.

And in the press release on Wednesday the 4 March (https://www.gov.scot/news/two-new-cases-of-coronavirus-covid-19/) we said “…One patient is resident in the Grampian area, the second patient is resident in the Ayrshire area. One patient has recently travelled to northern Italy and the other has had contact with a known positive case – this contact was not with the first positive case confirmed in Scotland.” I’ve copied others into this who may been able to enhance the patient confidentiality component here from the patient centred and participation team and Cabinet Secretariat colleagues who can advise on any procedural issues. I suspect SpADs will wish to consider the tone of any final draft.

Neil Findlay (Lothian) (Lab): On a point of order, Presiding Officer. I raise the matter reluctantly, after the debate that we have had, but I feel that I must. When she responded to my urgent question, referring to the first Covid patient in Scotland, the Cabinet Secretary for Health and Sport said: “In the first case, we said that the individual was a resident of Tayside and we believed that they had contracted the virus from travel in a country where the virus was present. We did not name the country. Our approach has been consistent in all this.” However, on 1 March, before the Edinburgh Nike conference outbreak was recognised, the Scottish Government’s website carried the statement: “First positive case in Scotland: a patient has been diagnosed with coronavirus (Covid-19) in Scotland. The patient is a resident of Tayside and has recently travelled from northern Italy.” The Government named the country: it has not been consistent and has treated the outbreak at the Hilton Edinburgh Carlton differently from the first outbreak in Tayside. Will the Deputy First Minister and Cabinet Secretary for Education and Skills ask the Cabinet Secretary for Health and Sport to correct the record? More important, will he ask her to explain why we have not seen consistency between the first case in Tayside, where patient confidentiality was clearly treated differently from the case in Edinburgh, where patient confidentiality was given as the reason why the news was not made public. The Presiding Officer (Ken Macintosh): The issue is not a point of procedure for me to rule on; however, Neil Findlay has drawn the matter to the attention of the Government, and I am sure that the cabinet secretary will have taken note.

Monday 2 Health Protection Scotland were notified by March international public health authorities that somebody who had been at the conference but had subsequently left Scotland had tested positive. HPS set up an Incident Management Team to contact attendees and give appropriate public health advice.

NOTE: This notification was not a confirmation of a positive case in Scotland. That would only be done following receipt of a positive test result. There had been no positive test in Scotland linked to the Nike conference at this point.

Tuesday 3 Health Protection Scotland notified the Scottish Government of two new cases following confirmation March of laboratory results that morning. This notification was received too late to allow these cases to be included in the daily website update. That publication reports

positive cases confirmed up to 0900 each day.

Ministers were updated on the two new cases in the evening of Tuesday 3 March.

Davie, CC Cab Sec Health. FM asked that the transcript of her answer on the Nike conference be sent to Ms Freeman ahead of her urgent question. I am aware Ms Freeman watched proceedings, but see below for info.

I was satisfied then and am satisfied now that all appropriate steps were taken. Can I just be clear on one point and then answer the question more substantively. There is a suggestion that there was knowledge of that outbreak at the point the conference was happening. That is not the case. The knowledge of the cases associated with that event transpired when the cases that were then associated with that event began to be confirmed and reported through the Scottish reporting system. All of the cases associated with that event of people in Scotland were reported through our normal daily figures. Health Protection Scotland established an incident management team. All Appropriate contact tracing was done so all appropriate steps were taken in order to ensure that public health was being protected. Had there been more information about that event put into the public domain at that that would not have changed the steps that were taken to protect public health At the time, I probed whether we should be putting more information into the public domain. The advice – which was advice I accepted – was that it was not appropriate. One of the reasons for that was patient confidentiality. At a time when the numbers of cases remained as low as they were to identify where any case contracted the virus could potentially have identified the patients concerned. That is the process that was gone through – the most important thing is that all appropriate steps were taken there to make sure that the wider issues of public health were properly dealt with and public health was properly protected. ISSUE: Lines on the sequencing of Covid-19 strain associated with Nike Conference

Top Lines Scientists working with Public Health Scotland have been conducting work on the molecular sequencing of some strains of the virus within Scotland. One of those strains is the strain associated with the conference in Edinburgh. That work is near completion and when concluded will show us whether or not it had a significant impact in Scotland – we will be able to see whether, as we believe it did, it led to just the small number of cases we know about or whether it spread more widely in Scotland.

Newcastle's first case of COVID-19 was confirmed on Wednesday afternoon and the patient is being treated at the Royal Victoria Infirmary. Now it has emerged the patient is a member of a church that has several branches in the region and letters were sent out to other members informing them that a fellow churchgoer had been diagnosed with coronavirus. It is understood the patient works for Nike in Sunderland and contracted the virus after attending a conference in Edinburgh, although this has not been confirmed by the firm.

I have spoken to one person who works in the same building as Nike Glasgow (based in Buchanan Street, one of Scotland’s busiest shopping districts). His staff share a lift and some communal space with Nike Glasgow employees. However, they were not told by either the Scottish Government or Nike about the possible coronavirus contagion. On W/C 9th march, their building underwent a deep clean, however they were not told why (by either the Scottish Government or Nike). Shortly after this time, some of this gentleman’s staff, who had been sharing lifts etc. with Nike staff from the time of the conference up until the deep clean in early March, developed coronavirus symptoms. He only found out about the outbreak on Monday. I have also spoken to a kilt maker who fitted Nike delegates with kilts – thereby spending a lot of time in close proximity to them. Shortly after this, one member of his staff with asthma developed coronavirus symptoms. More staff later developed similar symptoms. He too only found out about the outbreak on Monday. Neither businesses were contact traced by anyone. Critics fear that a lack of contact tracing meant that the virus was able to spread. If the outbreak had been spoken about publicly, perhaps these businesses would have known a possible reason why their staff developed symptoms. A UK Gov source told me that the Department of Health was notified of two cases in early March in Scotland but were not told anything about a conference. They say it is the responsibility of the four nation’s CMOs to tell the public about any outbreak. It suggests Catherine Calderwood made the decision to not tell the public. As mentioned on the phone, I have spoken with Hilton hotels and am aware that they were not informed of the Nike outbreak until March 4...that's two days after Health Protection was informed.

I am aware that the first Scottish case was not confirmed until the evening of March 3 - but why did it take two days to inform the venue of the conference that there had been concerns over the virus.

I have copied in below a comment from the Tories, can you please respond? Miles Briggs, Scottish Conservative shadow health secretary – “At a number of crucial stages the Scottish response to the Covid-19 outbreak appears to have been very slow and unresponsive. “Given the extremely infectious nature of this virus, waiting two days before informing the hotel of a possible outbreak will have exposed a number of other people to the contagion. “This simply exposes the very basic failure of test, trace and isolate.”

There are lines contained within this and I’ve included the statement that was issued on Tuesday evening. In terms of the lines not included within the FMQ - the main one is: I absolutely refute any allegation that there was a cover up. We followed clinical advice not to release information that would run the risk of breaching patient confidentiality and if we had released information about this event, it would have done exactly that. This approach was consistent with other public health agencies who identified contacts that attended that event (in Ireland, England and Holland).

A Scottish Government spokesperson said: “On Monday 2 March, Health Protection Scotland (HPS) were alerted by international public health authorities regarding an individual who had tested positive for COVID-19 following their attendance at a conference for over 70 delegates in Edinburgh at the end of February. “The individual was not based in the UK and had tested positive on returning home, having previously been in an area at high risk of COVID-19. “HPS set up an Incident Management Team (IMT), with representatives from Scottish NHS boards and national and international public health agencies, to ensure all attendees were contacted and given appropriate public health advice.

“This included advice regarding self-isolation and contact tracing of any attendee showing symptoms of COVID-19. “On Tuesday 3 March HPS were notified that an individual in Scotland connected to that event had tested positive. Scottish Government ministers were also informed on the evening of 3 March. “On Wednesday 4 March, this case was confirmed in a Scottish Government press release, in line with standard reporting procedures for confirmed COVID-19 cases at the time. “All individuals who had attended the conference were contact traced. FMQ Brief ISSUE: 19 May: Various outlets report comments from a tour company that claims it showed Nike delegates around Edinburgh and wasn’t contact traced. ISSUE: 18 May: Sky News reports that Lloyds Bank held an event in the same hotel as the Nike conference, sharing common areas with Nike delegates. The bank told Sky none of its staff had been traced. ISSUE: 18 May: Ian Murray wrote stating that: patient confidentiality - as the reason to withhold information from the public - is unfounded in terms of law (citing Public Health (Scotland) Act 2008 Section 117 (2) which states: "A relevant authority may disclose information held by it to any other person if the authority considers that it is necessary to do so for the purposes of, or in connection with, the protection of public health) and that the decision not to disclose information was a matter of judgement about whether it was "necessary". ISSUE: 18 May – Daily Mail reports employees from neighbouring business came down with Covid symptoms after coming into contact with conference delegates and suggests Ms Freeman is accused of pointing 'the finger of blame' at victims. ISSUE: 15 May – Daily Mail reports hotel were only informed of possible outbreak two days after HPS was told a conference delegate tested positive for Covid-19. ISSUE: 11 MAY - Disclosure Scotland reported on the conference held by Nike on 26 and 27 February in Edinburgh where an attendee from Amsterdam subsequently tested positive for Covid-19.

All appropriate steps were taken to ensure public health was protected More than 60 contacts were traced in Scotland, and around 50 others were traced in England It is not for the Scottish Government to comment on the actions taken elsewhere. However Public Health England took the same approach to individuals’ confidentiality. Public Health England were part of the IMT and were fully informed. Any questions in relation to the North East of England should be directed to the appropriate health authorities in England. It is not possible to be definitive at this stage to link any single event or patient with the spread of the virus. Work on genome sequencing should help with this but we know that there were already confirmed cases in the other parts of the UK when the Nike conference was taking place As we set out last week, detailed research is being conducted on the strain of the virus involved in the Nike conference, This will provide further information on whether, as we believe, the spread was contained through effective public health measures. The Scottish Government has been entirely consistent in its handling and publication of information relating to positive cases of COVID-19 in Scotland. There is a suggestion that there was knowledge of this outbreak at the point the conference was happening. That is not the case. We confirmed the first case in the whole of Scotland on 1 March. This was an individual in Tayside. Health Protection Scotland were alerted on 2 March that an individual overseas who had been at the conference had tested positive. On that date, there had been no positive cases in Scotland linked to the conference. The next day – 3 March - Health Protection Scotland recorded a positive case in Scotland of an individual who had been a conference delegate. That case and the details of the potential outbreak was confirmed to ministers on the evening of 3 March. Details of that case were then included in a news release we issued on 4 March and included on our normal case reporting schedule. Detailed discussions did not take place on every case by any of the four nations. There were already cases elsewhere in the UK and COBRA meetings were not used to talk through the detail of any of these. However, we know that our health protections teams across the four nations were in regular contact on all cases.

In a situation like this an incident management team is established made up of very experienced health professionals. That incident management team will do everything it thinks necessary to protect public health. It is their task to investigate the incident and decide what follow up is required in order to protect public health. As part of that, they will contact trace and in this case this involved tracing contacts internationally. It will have contacted people that met the definition of a contact. If they believed there were further actions necessary to protect public health, they would have taken them. In this case, one of the reasons more information was not put into the public domain was to do with patient confidentiality. This was a legitimate reason when case numbers were so low and numbers of attendees from Scotland were also so low. To have named the event would almost certainly have identified the patients. This decision would not influence how the incident management team deals with the incident from a public health perspective. However, it is also legitimate to question whether that should have been the overriding consideration. We will reflect on that and listen carefully to those views. As part of test, trace, isolate, we are considering what the balance of judgement between patient confidentiality and public information should be.

At the time, we asked whether we should be putting more information into the public domain The advice was that it was not appropriate. One of the reasons for that was patient confidentiality. Had there been more information about that event put into the public domain that would not have changed the steps taken to protect public health.

The key issue was (and is) the implementation of measures to protect public health Health Protection Scotland convened an incident management team meeting to undertake contact tracing. This included representatives from Scottish NHS Boards and national and international public health agencies. The aim was to ensure all attendees were contacted and given appropriate public health advice. Close contacts of those individuals who tested positive were also contacted in each country. At the time, the definition of a close contact was someone who had spent 15 minutes within 2m of the case while they were symptomatic. Our understanding of pre-symptomatic transmission has evolved and we now identify close contacts up to 48 hours before symptoms started.

Investigation revealed that a total of 25 cases within and outside the UK were confirmed to be linked to the event itself or were close contacts of attendees. Eight of these cases were resident in Scotland. All were contact traced and reported in details of the number of cases in Scotland at the time. NHS Lothian and Edinburgh City Council worked closely with the conference venue to ensure that all public health issues were addressed including information for delegates and infection control.

Steps were then taken by respective health protection teams to provide follow up in the event these contacts started to display symptoms.
