Undati Prasad s/o.Sammaiah, 25 yrs, Erukala, r/o.Mamidalapalli village of Veenavanka mandal of Karimnagar district. 2. Angidi Devender s/o.Saraiah, 23 yrs, Erukala r/o.Mamidalapalli village of Veenavanka mandal of Karimnagar district. 3. Bandi Sai Kiran @ Kiran s/o.Saraiah, 23 yrs, Erukala r/o.Mamidalapalli village of Veenavanka mandal of Karimnagar district. ….Petitioners/ Accused No.1, 3 & 4 and The State through Station House Officer, Veenavanka P.S. ….Respondent/Complainant. Offences under Sections 354 (d), 366, 504, 506 r/w 34 of IPC PETITION FILED UNDER SECTION 439 OF CR.P.C. This petition coming before me on today for hearing in the presence of Sri B.Thirupathi, Advocate for the petitioner/accused and the learned Public Prosecutor for the state, having been heard and stood over for consideration to this day, the Court made the following: :: O R D E R:: 1. The bail application is filed under Section 439 Cr.P.C., praying the Court to enlarge the petitioners/accused on bail pending investigation. 2. Notice given to Public Prosecutor, who submitted that the entire investigation is completed and charge sheet is filed. 3. Heard both sides. 4. Now the point for consideration is:- Whether the petitioners/accused can be enlarged on bail ? 5. POINT: The learned counsel for the petitioners/accused submitted that on 29- 2 8-2020 the defacto-complainant lodged a report alleging that since one year A1 harassing her stating that he is loving her and he would marry her, but she refused the said proposal. Sine 10 days A1 threatening her by saying that he would kill himself, and on 27-8-2020 he came to her house and stood infront of her house by saying that if she will not come along with him, he would commit suicide, when she came out of the house, A1 to A4 took her forcibly and performed her marriage with A1 without her consent, and also threatened her with dire consequences. Later she came to her parents house escaping from them. Thereby requested to take necessary action. Basing on the above report the police Huzurabad registered a case in Cr.no.124/2020 for the offences under Sections 354 (d), 366, 504, 506 r/w 34 of IPC. [ 6. On the other hand the learned Public Prosecutor submitted that the entire investigation is completed and charge sheet is filed. 7. Perused the record. It is seen that the present crime was set in motion on 27-8-2020. C.D. Part I discloses that the alleged offences are under Sections 354 (d), 366, 504, 506 r/w 34 of IPC. C.D Part I further discloses that the entire investigation in the above crime is completed and charge sheet is also filed. In view of the circumstances and since the entire investigation is completed and charge sheet is filed, I am inclined to grant bail to the petitioners/ accused No.1, 3 & 4. 8. In the result, the petition is allowed and the petitioners/ accused Nos.1, 3 & 4 are ordered to be released on bail on their executing a self bond for a sum of Rs.25,000/-(Rupees twenty five thousand only) each with 2 sureties for a like sum each to the satisfaction of learned Addl.
