Corrections Further Amendment Act 2004 GUIDELINES ISSUED ON THE EXERCISE OF THE DISCRETIONARY POWER OF THE SECRETARY OF THE DEPARTMENT OF JUSTICE TO INCLUDE CERTAIN PERSONS ON THE VICTIMS REGISTER Department of Justice August 2004 PURPOSE These guidelines provide advice on the exercise of the discretion of the Secretary of the Department of Justice to include certain persons on the Victims Register. The guidelines have been developed to ensure consistency and transparency in the administration of this discretion. INTRODUCTION The Corrections (Further Amendment) Act 2004 provides the legislative framework for the establishment of a Victims Register for victims of violent crime and gives statutory recognition to the right of victims of violent crime to lodge a victim submission with the Adult Parole Board. The aim of the Victims Register is to provide timely, relevant and accurate information in a sensitive manner to victims of violent crime. By providing victims with important information relating to the sentence of the perpetrator of a crime against them, the Register may help victims of crime feel more secure. The Act allows a registered victim to receive particular information during the administration of the offenderÕs sentence of imprisonment. The information that a registered victim may receive includes the prisonerÕs earliest release date, eligibility for rehabilitation and reintegration permit programs, interstate or international transfer and other like information. Under section 30A of the Act, a victim is defined as: ● A person who has had a criminal act of violence committed against him or her; ● A family member of a person who has died as a direct result of a criminal act of violence committed against that person; ● A family member of a person who: Ð has had a criminal act of violence committed against that person; and Ð is under 18 years of age or is incapable because of mental impairment. ● A person who is or has been a spouse or domestic partner of the prisoner and has an intervention order (other than an interim intervention order) in force against the prisoner. A person who falls within the definition of victim is entitled to registration on the victims register. The victim need simply apply in writing to the Secretary for inclusion on the victims register. The Act also provides some flexibility to persons who do not fall within the definition of victim but who would justifiably have a claim to information about a prisoner. 2890 G 42 14 October 2004 Victoria Government Gazette

The Secretary of the Department of Justice is empowered by section 30C of the Act with the discretionary power to approve the inclusion of a person on the victims register if that person: ● is not within the meaning of ÔvictimÕ under section 30A but can demonstrate, to the satisfaction of the Secretary, a documented history of domestic violence being committed by a prisoner against that person; or ● can demonstrate, to the satisfaction of the Secretary, a substantial connection to the offence for which the prisoner is serving the sentence of imprisonment. To assist in the determination of such applications, the Secretary may prepare guidelines on the exercise of discretion under section 30C. DEFINITIONS For the purposes of these Guidelines: competent person means: (a) in relation to domestic violence committed against an adult: (i) a person registered as a medical practitioner under a law of a State or Territory providing for the registration of medical practitioners; or: (ii) a person registered as a psychologist under a law of a State or Territory providing for the registration of psychologists; or (iii) a person who: (A) is a registered nurse within the meaning of section 3 of the Health Insurance Act 1973; and (B) is performing the duties of a registered nurse; or (iv) a person who: (A) is a member of the Australian Association of Social Workers or is recognised by that Association as a person who is eligible to be a member of that Association; and (B) is performing the duties of a social worker; or (v) a person who is a court counsellor under the Family Law Act 1975; or (vi) a person holding either of the following positions (A) manager or co-ordinator of: (i) a womenÕs refuge; or (ii) a crisis and counselling service that specialises in domestic violence; or (B) a position with: (i) decision-making responsibility (either singularly or as part of a collective) for: Ð a womenÕs refuge; or Ð a crisis and counselling service that specialises in domestic violence that has a collective decision- making structure; and (ii) responsibility for matters concerning domestic violence within the operations of that refuge or crisis and counselling service. (b) in relation to domestic violence committed against a child: (i) a person referred to in paragraph (a); or (ii) an officer of the child welfare or child protection authorities of a State or Territory. statutory declaration means a statutory declaration under the Evidence Act 1958. violence includes a threat of violence. DETERMINATION OF ELIGIBILITY The Secretary may only approve inclusion of a person on the victims register if that person can: ● Demonstrate a documented history of domestic violence being committed by a prisoner against that person; or ● Demonstrate a substantial connection to the offence for which the prisoner is serving the sentence of imprisonment. Determination of history of domestic violence In establishing to the satisfaction of the Secretary a history of domestic violence the following evidence is required: (a) a statutory declaration (see below) by or on behalf of alleged victims of domestic violence together with: (i) a statutory declaration by competent persons (see below); and (ii) a copy or details of a record of an assault on the alleged victim allegedly committed by the alleged perpetrator, being a record kept by a police service of a state or territory; or (iii) a copy or details of a record of expired intervention order/s. OR (b) a statutory declaration by or on behalf of alleged victims of domestic violence together with 2 statutory declarations by competent persons. A person must not submit for the purposes of an application that relies on (b): (a) two statutory declarations by competent persons who are members of the same occupations specified in each of the sub-paragraphs of the definition of competent persons. (b) two statutory declarations by competent persons as specified in (b)(ii) of the definition of competent person (ie officers of the child welfare or child protection authorities of a State or Territory). Form of Statutory Declaration Statutory Declaration by victim A statutory declaration under these guidelines that is made by a person who alleges that he or she is the victim of relevant domestic violence must: (a) set out the allegation; and (b) name the person alleged to have committed the relevant domestic violence. Statutory Declaration on behalf of a victim Applications which are made on behalf of another person will be accepted where that person is a child under 18 years of age and where the applicant is a parent/guardian. A statutory declaration under these guidelines that is made by a parent/guardian who alleges that the child to which the application relates is the victim of relevant domestic violence must: (a) name the alleged victim; and (b) set out the allegation; and (c) identify the relationship of the maker of the statutory declaration to that other person; and (d) name the person alleged to have committed the relevant domestic violence; and (e) set out the evidence on which the allegation is based. In such cases where the application is successful, the applicant will be treated as a nominee for the purposes of the Victims Register and will receive the information on behalf of the child victim of domestic violence. 2892 G 42 14 October 2004 Victoria Government Gazette

Statutory Declaration by competent person A statutory declaration must be made by a competent person and must: (a) set out the basis of the competent personÕs claim to be a competent person for the purposes of these Guidelines; and (b) state that, in the competent personÕs opinion, relevant domestic violence has been suffered by a person; and (c) name the person who, in the opinion of the competent person, has suffered that relevant domestic violence; and (d) name the person who, in the opinion of the competent person, committed that relevant domestic violence; and (e) set out the evidence on which the competent personÕs opinion is based. Determination of substantial connection to the offence In establishing that a person has a substantial connection to the offence for which the prisoner is serving the sentence of imprisonment, the Secretary must be satisfied that the applicant has genuine apprehension and/or fear of the prisoner and that this apprehension and/or fear is based on reasonable grounds. Under these guidelines this avenue of application to be registered on the Victims Register applies only to a person who was a witness for the prosecution in the trial of the prisoner for which the prisoner is currently serving a term of imprisonment. In establishing that a person has a substantial connection to the offence and a genuine apprehension and/or fear of the prisoner the applicant must set out details of the evidence they gave in the trial and any supporting reasons of why they feel concerned for their safety (ie such as threats made etc). The applicantÕs status as a witness will be verified by the Registrar through either the Police, the Office of Public Prosecutions or via transcripts from the Victorian Government Reporting Service. MANNER OF APPLICATION Persons applying to be included on the Victims Register under section 30C must apply as per the regulations regarding the manner of applications for registration by persons wishing to be included on the victims register. The application forms for persons applying under section 30C will provide further guidance on the type of information and level of detail required. Of particular interest, the regulations provide that applications must be in written form, must be accompanied by any documents necessary to establish eligibility of the applicant to be included, and must contain an authorisation for the Secretary to request information from law enforcement agencies and third parties to assess eligibility and continued eligibility. REPORTING REQUIREMENTS The Secretary of the Department of Justice will report annually to the Minister for Corrections and the Attorney-General in relation to the applications made under these categories and the incidences of approval.

Flora and Fauna Guarantee Act 1988 The Flora and Fauna Guarantee Act 1988 enables members of the public to nominate species, communities and potentially threatening processes for listing under the Act. Nominations under the Act are considered by a Scientific Advisory Committee, which makes recommendations to the Minister. The Committee has made a number of final and preliminary recommendations. A short Recommendation Report has been prepared for each final and preliminary recommendation. ORDERS IN COUNCIL Water Act 1989 BULK ENTITLEMENT (EILDONÐGOULBURN WEIR) CONVERSION FURTHER AMENDMENT ORDER 2004 The Lieutenant-Governor as the GovernorÕs deputy, with the advice of the Executive Council under sections 44 and 47 of the Water Act 1989 makes the following Order Ð 11. Title This Order is called the Bulk Entitlement (EildonÐGoulburn Weir) Conversion Further Amendment Order 2004. 12. Preliminary The Bulk Entitlement (EildonÐGoulburn Weir) Conversion Order 1995 (the Bulk Entitlement Order) was made by the Governor in Council on 29 August 1995 and published in the Government Gazette G35 on 7 September 1995 at page 2367 and amended by Order made by the Minister and published in the Government Gazette dated 29 June 2004 to provide the Minister for Environment with a primary entitlement equivalent to the volume of water saved through the construction and operation of the pipelined supply of water to the Normanville Waterworks District. 13. Purpose The purpose of this Order is to further amend the Bulk Entitlement Order to incorporate the pipelined supply of water to the Normanville Waterworks District, to formalise the supply of water to the Grampians Wimmera Mallee Water Authority, and to make other minor changes. 14. Authorising provisions This Order is made in accordance with sections 44 and 47 of the Water Act 1989. 15.
