5.1 Evansburg Water/Sewer Local Improvement Plan

Council has included some initial funds in the 2019 budget to begin the Local Improvement Process for the next phase of the Evansburg water and sewer

replacement program. The actual construction (if approved) would occur commencing in 2020.

To begin this council lead initiative, a Local Improvement Plan must be prepared. The plan must describe the proposed local improvement, the parcels of land in respect to which a local improvement tax will be imposed, the person who will be liable to pay the local improvement tax and state how the tax is to be based.

The Options before Council with respect to how the tax could be based include: 1)the assessment prepared in accordance with legislation, 2)each parcel of land, 3)each unit of frontage, or 4)each unit of area.

In addition to the above, the plan must also state the estimated cost of the local improvement, time period in which the local improvement will be spread, and any other information the proponents of the local improvement consider necessary.

Some initial background has the estimated costs of the project (water/sewer replacement and new pavement and sidewalks) at $4.4 million with $840,000 attributed to the 50/50 cost share between the County and the residents. As such, approximately $420,000 will be charged back via local improvement charges if the project does not get petitioned down by the residents.

To complete the Local Improvement Plan, Administration needs to know Council's preferred option with respect to implementing the tax. The particular section of neighborhood being improved has a few lots of differing size/shape and as such, to avoid conflicts, utilizing the option of "unit of area" makes for a clean allocation of costs and it likely the fairest method to utilize.

9.1 Second and third reading of Bylaw 07.18 to establish alternative methods for advertising statutory notices

RFD - 1015

The Municipal Government Act (MGA) requires municipalities to advertise and provide notice to the public about proposed bylaws, public hearings, resolutions and meetings, among other things. Recent amendments to the MGA now allow for electronic advertising such as advertising on a municipal website or through the use of social media platforms (e.g. Facebook, Twitter, etc.).

Previously, a municipality was required to provide notice through newspaper advertising, mail or delivery to every residence in the area to which the bylaw or other matter related. The proposed bylaw will not prevent the continuation of advertising by these means. To ensure residents are adequately notified, Administration intends to continue providing notification in accordance with current practices.

To utilize electronic advertising methods, Yellowhead County must pass an authorizing bylaw. The new legislative changes provide additional flexibility that allows Yellowhead County to more quickly respond to the needs of residents and businesses.

Mayor Soroka clarified that according to the Municipal Government Act 6.06, Municipalities are still obligated to use Newspapers but allows addition of one or more other means of notification.

2.1 Edson and District Recycling Society Update

Anne Auriat, Manager, introduced the Board Members, Louise Connolly, Board Chair, Jan Fitch and Keith Linford also attending the Council Meeting before beginning her power point presentation. Several items were covered including:  a shortfall in 2018 for the first time since inception of the Society in part due to China blocking purchase of uncleaned materials and causing prices to drop.  it has been brought to the Board that certain programming be removed from the 2019 Budget.  the Edson and District Recycling Society remains a standard for other Recycling facilities.

3 GOVERNANCE AND PRIORITIES ISSUES

3.1 Hamlet Amenities Chart

During the Strategic Planning session held by Council, it was decided that Council wished to review the amenities available in the various County hamlets, for the purpose of considering future projects/standardization/etc.

The attached chart has a breakdown of the Hamlets and the respective amenities/services provided to each. The purpose of this chart is to begin the dialogue relative to future council direction on services and amenities within the various hamlets of the County.

Discussion included that each hamlet is unique and does not require the same amenities and that any amenity considerations should be community driven.

3.2 Big Horn Country Proposal

Council has asked that this item be placed on the Governance and Priorities Agenda for Council review as some Councillors do have concerns about this concept.

Attached for Council information is documentation from the Province outlining the proposal.

Several concerns were raised about the Big Horn Country Proposal.

Council directed Administration to notify Brazeau County that we would support them in opposing the Big Horn Proposal..

3.3 Athabasca Watershed

Attached letter requesting financial contribution was discussed. Yellowhead County has given a contribution in the past but nothing in recent years. There is no specific information in the letter as to how much is being requested or how it would be used. The County does pay fees for Councillor Olson to be a member and attend meetings.

Council directed Councillor Olson to inform the Athabasca Watershed at the next meeting she attends, that we will not be making a financial contribution at this time.

3.4 Transfer Station Buildings

The Attendant buildings at Yellowhead County Transfer Stations are owned by the Contractor and placed on the sites for their employees in accordance with their contract. There is a high volume of vandalism and theft at these buildings. Although there is no electricity at these sites, lights and cameras might be a deterrent to criminal activities.

Council directed Administration to bring forward information on which sites could have power and associated costs to future Governance and Priorities Meeting.

3.5 Security on Farms Seminars

Member of Parliament, Jim Eglinski, hosted a seminar in Peers concerning protecting Rural Properties. It was discussed if more of these types of seminars would be beneficial to Yellowhead County Residents.

Council directed Administration to bring forward ideas, possible presenters and associated costs (quotes) to Council.

3.6 Over Night Parking at Halls and Recreation Complexes

Currently there is no Bylaw against overnight parking on any Yellowhead County Property and it has been charged to individual Hall Societies to determine whether they

would allow it. Discussion included whether a fee or deposit for a permit would be useful.

Council directed Administration to submit a Bylaw regarding overnight parking on Yellowhead County Property in hamlets at a future Council Meeting.

Mayor Soroka stated that Council would change the Agenda order and move to Closed Sessions with Mayor and Councillor Reports to follow.

Public Hearing for Bylaw 01.19 that would amend Land Use Bylaw 16.13, being the Land Use Bylaw, by defining and incorporating cannabis related uses. PUBLIC HEARING 1. Call hearing to order. 2. Mayor makes introduction of those present. 3. Mayor outlines Meeting Procedure to be followed as follows: o First we will hear from Administration who will introduce the bylaw or resolution and briefly describe its purpose, followed by the Department presentation o Second, we will open the floor to public presentations. Those individuals who have registered with the Recording Secretary will speak first. A person wishing to speak must identify themselves for the record. A Person who does not identify them self will not be given the opportunity to speak. Verbal presentations shall be limited to five (5) minutes. Council shall limit questions or discussion of clarification to a total of five (5) minutes. o Third, written submissions will be collected by the Recording Secretary, read into the minutes and retained for information purposes. o Lastly, the public hearing will be closed after all public presentations have been made. Debate concerning matters raised at the Public Hearing shall take place during the next regularly scheduled Council Meeting or at the discretion of Council 4. Bylaw 01.19 aligns with the requirements set forth by provincial legislation and regulations with regards to cannabis-related uses. 5. BEING A BYLAW TO AMEND LAND USE BYLAW NO. 16.13

WHEREAS, the Municipal Government Act, being Chapter M-26, R.S.A. 2000, authorizes a Council to amend a land use bylaw;

AND WHEREAS, a public hearing was held in respect to the proposed bylaw pursuant to the Municipal Government Act, being Chapter M-26, R.S.A. 2000;

NOW THEREFORE, the Yellowhead County Council, in the Province of Alberta, duly assembled, hereby enacts as follows:

Bylaw 16.13, as amended, the Land Use Bylaw, is hereby further amended by:

1. Adding the following definitions to Section 10 [Definitions] in alphabetical order:

CANNABIS means a cannabis plant, fresh cannabis, dried cannabis, cannabis oil, cannabis plant seeds, and any other substance defined and controlled as cannabis in the Cannabis Act () including edible products that contain cannabis but excluding industrial hemp.

CANNABIS means a development licensed under the Cannabis Act (Canada) PRODUCTION, that authorizes a person or business to do one or more of the PROCESSING, following activities: AND (a) Grow, cultivate, propagate, or harvest cannabis for sale; DISTRIBUTION (b) Make cannabis products, process, manufacture, or synthesize cannabis; (c) Sell cannabis for medical purposes; or (d) Perform research or analytical testing with cannabis.

INDUSTRIAL means a cannabis plant, or any part of that plant, in which the HEMP concentration of THC is 0.3% (weight by weight) or less in the flowering heads and leaves.

RETAIL means a development used for the retail sale of cannabis licensed CANNABIS under the Gaming, Liquor and Cannabis Act. This use shall not be STORE carried on in conjunction with, or accessory to, any other use. A Retail Cannabis Store may not have any part of an exterior wall that is located within 100m of: (a) An approved hospital, as defined in the Hospitals Act, or a boundary of the parcel of land on which the facility is located; (b) A building containing a school, as defined in the School

Page 15 of 61 Act, or a boundary of a parcel of land on which the building is located; or (c) A boundary of a parcel of land that is designated as school reserve or municipal and school reserve under the Act.

2. Section 118 HC – Hamlet Commercial District is amended by adding “Retail Cannabis Store” as a Discretionary use.

3. Section 119 HG – Hamlet General District is amended by adding “Retail Cannabis Store as a Discretionary use.

4. Section 96 RD – Rural District is amended by adding “Cannabis Production, Processing, and Distribution” as a Discretionary Use.

5. Section 120 BCLI – Business Commercial/Light Industrial District is amended by adding “Cannabis Production, Processing, and Distribution” as a Discretionary Use.

6. Section 121 RI – Rural Industrial District is amended by adding “Cannabis Production, Processing, and Distribution” as a Discretionary Use.

7. Section 122 HI – Hamlet Industrial District is amended by adding “Cannabis Production, Processing, and Distribution” as a Discretionary Use.

8. Section 123 LI – Light Industrial District is amended by adding “Cannabis Production, Processing, and Distribution” as a Discretionary Use.

SUBJECT Edson/Yellowhead Multi-Use Recreation Complex

ISSUE Council to consider accepting the recommendations of the Joint Steering Committee relative to building a Multi-Use Recreation complex in Edson.

BACKGROUND As Council is aware, a joint Steering Committee made up of Councillors from the Town of Edson and Yellowhead County have been working with a consultant to review site locations and building design options that meet the requirements set out in the project scope as desired by the communities.

Now that this work is done, the Committee is comfortable that this is the right plan for the communities moving forward and as such is recommending that each Council agree with the location and concept design in principle.

As the County is adverse to borrowing funds for this project, a more conservative timeline is being proposed to bring this project to fruition. It is proposed that once the concept is presented to the communities for information and clarity, that pending any unforeseen negative reactions, the detailed design work would commence. This would begin likely at the end of 2019 or early 2020. It is anticipated that a project of this magnitude may take 1 1/2 - 2 years to complete the detailed design component. At that point, if the economy is showing signs of strength, the project can move into the construction phase in early 2022. With an estimated two year construction schedule, the facility may be completed by 2024.

FINANCIAL It is estimated that the project will cost $70 million dollars. Additional costs will include the demolition of Repsol Place (town to determine a demolition number) and the town will confirm that no additional off site work is required to support such an initiative. (Water/sewer line upgrades, fire protection, intersection traffic control devices etc.) It is anticipated that the annual operating subsidy for the proposed facility will range from a low of $1.7 million to a high of $3.4 million. The existing Repsol facility requires a $1.5 million subsidy.

OPTIONS 1. That Council support the recommendation of the Joint Steering Committee to proceed with the Project at an estimated cost of $70 million. 2. That Council declines to support the Project and advises other direction for the Steering Committee to consider.

RECOMMENDATION Administration recommends that Council supports in principle the recommendation of the Joint Steering Committee to move forward with the project at an estimated cost of $70 million.

BACKGROUND The tender for the 2019 Evansburg - Wildwood Gravel Supply contract (multiple year) was closed on February 7, 2019. The tender requires the supply of 40,000 Tonnes of 25mm gravel for each year in the 2019, 2020, and 2021 Summer Gravel Programs, respectively.

SUBJECT First reading of Bylaw 02.19 to amend Land Use Bylaw 16.13 to incorporate recent changes to the MGA

ISSUE First Reading of Bylaw 02.19, an amendment to Land Use Bylaw 16.13 to align the County's Land Use Bylaw with recent changes to the Municipal Government Act.

BACKGROUND The Municipal Government Act (MGA) sets out the processes and the timelines for reviewing and issuing decisions on applications for development permits and subdivision. Recent amendments to the MGA now establish: • how long municipalities have to determine if an application is complete (20 days), • timelines for decision making once an application is deemed complete (40 days), • when the decision must be provided to the applicant (on the day of the decision), and • the appeal time-frame on a decision (21 days).

This Bylaw will bring Land Use Bylaw 16.13 into alignment with the MGA and incorporate impacts from Bylaw 07.18, as they relate to the advertisement of decisions and public hearings for Land Use Bylaw Amendments. Most significantly, the amendments will enable development permits for discretionary uses to be processed 6-12 days faster than relying on advertising the decision solely in the newspaper.

a) Adding the following provisions to Section 19:

(6) Unless extended by an agreement in writing between the applicant and the Development Authority, the Development Authority must determine the completeness of an application for a development permit within twenty (20) days of receipt. If the Development Authority does not provide the applicant a written acknowledgement on the completeness of the application then the application is deemed to be complete on the twentieth (20th) day after receipt.

(7) If an application for a development permit is deemed incomplete by the Development Authority, the Development Authority must issue a written notice to the applicant advising that the application is incomplete, listing the documentation and information that is still required, and setting a date by which the required documentation and information must be submitted.

(8) If an application is deemed to be incomplete, the applicant may submit the information identified by the Development Authority to complete the application within the time specified in the notice or as agreed to between the applicant and Development Authority. If the information is not submitted by the time specified in the notice or as agreed to between the applicant and the Development Authority the application will be deemed refused.

(9) Notwithstanding any written acknowledgment that an application for a development permit is complete, the Development Authority may request any additional information it considers necessary during the review and decision making process.

SECTION 21 NOTIFICATION OF DEVELOPMENT PERMITS

(1) A notice of decision on an application for a development permit will be given to or sent by regular mail to the applicant on the date the decision was rendered by the Development Authority.

(2) A notice of decision on an application for a development permit will be advertised on the date the decision was rendered, in accordance with Yellowhead County’s Public Notification Bylaw in effect at the time.

(3) A permit issued pursuant to this PART does not come into effect until twenty-one (21) days after the date the approval is first publicized. c) deleting Section 22(4) entirely, and replacing it as follows:

(4) An appeal to the Subdivision and Development Appeal Board is commenced by filing a notice of the appeal (including the required fee), containing the reasons for the appeal, to the Secretary of the Subdivision and Development Appeal Board within twenty-one (21) days, (a) in the case of an appeal made by an applicant after: (i) the date on which the person receives notice of the decision or order or the issuance of the development permit; or (ii) if no decision is made with respect to an application within the forty (40) day period or within any extension of this period as the applicant may have approved in writing, the date the period or extension expires; (b) in the case of an appeal by another person claiming to be affected, after the date on which the notice of the issuance of the development permit was published. d) deleting Section 27(4) entirely, and replacing it as follows:

(4) Unless extended by an agreement in writing between the applicant and the Subdivision Authority, the Subdivision Authority must determine the completeness of an application for a subdivision within twenty (20) days of receipt. If the Subdivision Authority does not provide the applicant a written acknowledgement on the completeness of the application then the application is deemed to be complete on the twentieth (20th) day after receipt. e) adding the following provisions to Section 27:

(5) If an application for a subdivision is deemed incomplete by the Subdivision Authority, the Subdivision Authority must issue a written notice to the applicant advising that the application is incomplete, listing the documentation and information that is still required, and setting a date by which the required documentation and information must be submitted.

f) deleting Section 29(2) entirely, and replacing it as follows:

(2) An appeal to the Subdivision and Development Appeal Board is commenced by filing a notice of the appeal (including the required fee) to the Clerk of the Subdivision and Development Appeal Board within twenty-one (21) days from the date the decision was mailed.

g) adding the following provision to Section 29:

(3) The notice of appeal must contain the legal description and municipal location, if applicable, of the land proposed to be subdivided; and the reasons for appeal, including the issues in the decision or the conditions imposed in the approval that are the subject of the appeal.

h) deleting Section 35(1) entirely, and replacing it as follows:

(1) Where a public hearing is required by the Act for a proposed amendment to this Bylaw, notice of the public hearing shall be in accordance with the Act.

SUBJECT Bylaw 03.19 to Repeal Bylaw 1.79 Establishment of Hamlet Boundaries (MacKay)

ISSUE Status of the Hamlet of MacKay

BACKGROUND In 1979, a Ministerial Order was issued to establish MacKay as a hamlet within Improvement District #14. This Order was approved by the Minister so that MacKay could be eligible for a street restoration funding available from Alberta Transportation. The Order served no other purpose but to receive Provincial funding.

As MacKay is not considered a hamlet for planning or growth purposes in the Land Use Bylaw and was for only Provincial funding, Administration is requesting that Council repeal Bylaw 1.79 which established MacKay as a hamlet. Municipal Affairs defines a hamlet as a community that consists of five or more dwellings, has a generally accepted boundary and name, and contains land that is used for non-residential purposes. In the case of MacKay, all the lands are zoned Rural District and the general purpose is residential.

OPTIONS 1. That Council for Yellowhead County gives first, second and third readings to Bylaw 03.19 to repeal Bylaw 1.79, being a bylaw to establish the Hamlet of MacKay. If Council approves all three readings, Bylaw 1.79 will be repealed and MacKay will no longer be designated as a hamlet. 2. That Council for Yellowhead County gives first and second readings to Bylaw 03.19 to repeal Bylaw 1.79 and defer third reading to a later date. If Council approves first and second reading and postpones third reading, the Bylaw will need to go back to Council at a future date for third reading. 3. That Council not give first reading to Bylaw 03.19 to repeal Bylaw 1.79. If Council denies first reading, Bylaw 1.79 will not be repealed and Mackay will still be classified as a hamlet. 4. That Council provide other direction to Administration.

RECOMMENDATION That Council for Yellowhead County gives first, second and third readings to Bylaw 03.19 to repeal Bylaw 1.79, being a bylaw to establish the Hamlet of MacKay.

BEING A BYLAW TO REPEAL BYLAW NO. 1.79

WHEREAS, the Municipal Government Act, Being Chapter M-26, R.S.A., 2000, Section 191(1) authorizes a Council to repeal bylaw;

AND WHEREAS, pursuant to Section 63(2)(a) of the Municipal Government Act, Being Chapter M-26, R.S.A., 2000; Council may authorize the repeal of a bylaw that is inoperative, obsolete, expired, spent or otherwise ineffective.

NOW THEREFORE, under the authority of the Municipal Government Act, the Council of Yellowhead County, in the Province of Alberta, enacts as follows:

1) That Bylaw No. 1.79 is repealed.

ISSUE Status of the Hamlet of Pinedale

BACKGROUND In 1987, a Ministerial Order was issued to establish Pinedale as a hamlet within Improvement District #14. This Order was approved by the Minister so that Pinedale could be eligible for funding to install a communal low pressure sewage system. The Order served no other purpose but to receive Provincial funding.

As Pinedale is not considered a hamlet for planning or growth purposes in the Land Use Bylaw and was for only Provincial funding, Administration is requesting that Council repeal Bylaw 2.87 which established Pinedale as a hamlet. Municipal Affairs defines a hamlet as a community that consists of five or more dwellings, has a generally accepted boundary and name, and contains land that is used for non-residential purposes. In the case of Pinedale, the lands are zoned Country Residential with four Rural District parcels and the general purpose is residential.

OPTIONS 1. That Council for Yellowhead County gives first, second and third readings to Bylaw 04.19 to repeal 2.87, being a bylaw to establish the Hamlet of Pinedale. If Council approves all three readings, Bylaw 2.87 will be repealed and Pinedale will no longer be designated as a hamlet. 2. That Council for Yellowhead County gives first and second readings to Bylaw 04.19 to repeal Bylaw 2.87 and defer third reading to a later date. If Council approves first and second reading and postpones third reading, the Bylaw will need to go back to Council at a future date for third reading. 3. That Council not give first reading to Bylaw 04.19 to repeal Bylaw 2.87. If Council denies first reading, Bylaw 2.87 will not be repealed and Pinedale will still be classified as a hamlet. 4. That Council provide other direction to Administration.

ISSUE Council approval to rescind Bylaw 13.99, being the Guenette Area Structure Plan that is located within the NE 1/4 32-52- 17-W5M

BACKGROUND On June 22, 1999, Yellowhead County Council approved Bylaw 13.99 that adopted the Guenette Area Structure Plan, allowing for the creation of a one lot subdivision south of Edson. At that time a policy of Municipal Development Plan Bylaw 6.98 required that an Area Structure Plan be prepared to allow for further subdivision (six lots of greater from a quarter section) within the Edson Urban Fringe plan area. Since that time, the policies have changed and developing an additional lot would not require such detailed planning, especially in a rural location.

As this plan does not contemplate any further development , Administration would like to request that Council rescind the Guenette Area Structure Plan.

A referral was sent to the Town of Edson as the plan area is within the Edson Urban Fringe. The Town had no objections to having this Area Structure Plan repealed.

BACKGROUND In 1995, the Municipal District of Yellowhead No. 94 and the Town of Hinton adopted the Terrace Heights North Area Structure Plan. As this was a joint plan approximately 45ha of land was in the MD and the remaining 31 ha was located within the Town's boundary. The future uses included commercial, residential and park space.

In 2009, the Municipal Government Board approved an annexation application that included 892.7ha of County land being annexed into the Town of Hinton. Part of these lands included a portion of lands within the Area Structure Plan (see attached plan). As all of the lands within this plan area are now within the Town of Hinton, Administration is requesting that Council rescind the Area Structure Plan. A referral regarding this matter was sent to the Town of Hinton and they have no objections to the plan being rescinded.
