(I) Shri SS Ahluwalia Raised a Matter Regarding Sixtieth Anniversa MATTERS RAISED WITH PERMISSION 1. 26th November, 2009:— (i) Shri S. S. Ahluwalia raised a matter regarding Sixtieth Anniversary of adoption of the Constitution. (ii) Shri Prasanta Chatterjee raised a matter regarding Cultural and Heritage Committee of the Railways and safety. (iii) Shri Rajniti Prasad raised a matter regarding children falling sick due to mid-day meals. (iv) Shri Bhagat Singh Koshyari raised a matter regarding the additional central assistance to 18Uttarakhand being withheld by the Central Government. (v) Shri Prakash Javadekar raised a matter regarding non provision of the required assistance, as promised by the Government to the victims of 26/11 terrorist attack and their dependents. Shri Balvant alias Bal Apte also spoke. (vi) Shri Nand Kishore Yadav raised a matter regarding crisis arising out of the lack of fertilizers and seeds in Uttar Pradesh. (vii) Shri D. (ii) Shri Ali Anwar Ansari raised a matter regarding death of labourers on Manali-Leh Highway in Himachal Pradesh. (iii) Shri Prabhat Jha raised a matter regarding crisis in NTPC power house in Bihar. (iv) Shri Kalraj Mishra raised a matter regarding exposure of workers to radioactive substance in Kaiga Nuclear Power Plant. Shri S.S. Ahluwalia also spoke. (v) Shri A. Vijayaraghavan raised a matter regarding impact of Dubai debt crisis on India. (vi) Shri P. Rajeeve raised a matter regarding Indian stand in the last meeting of the International Atomic Energy Agency. (vii) Shri Bharatkumar Raut raised a matter regarding 19 failure of online CAT examination at certain place. 3. 2nd December, 2009:— (i) Shrimati Brinda Karat raised a matter regarding internet advertisements on sex selection tests. (ii) Shri Tiruchi Siva raised a matter regarding situation arising due to massive circulation of fake currency throughout the country. Shri Moinul Hassan also spoke. (iii) Shri Shantaram Laxman Naik raised a matter regarding need to ban an institution working with the name ‘Sanatan Sanstha’ in Goa. (iv) Shri Shyamal Chakraborty raised a matter regarding situation arising due to sudden increase in prices of coal by the Coal India Ltd. (v) Shri Shreegopal Vyas raised a matter regarding need for clarification on the issue of stopping the construction of road in Ladakh. Shri Kumar Deepak Das also spoke. (vi) Shri Birendra Prasad Baishya raised a matter regarding construction of a dam on the river Brahmaputra by China. (vii) Shri Rudra Narayan Pany raised a matter regarding dharna by LIC agents. (viii) Shri Tarini Kanta Roy raised a matter regarding killing of eleven gangmen in train accidents in five days. 4. 3rd December, 2009:— (i) Shri D. Raja raised a matter regarding mass rally by bank employees in protest against the banking reform policies of the Government. (ii) Shri Sabir Ali raised a matter regarding relations of India with Iran. (iii) Shri Sitaram Yechury raised a matter regarding the 25th Anniversary of the Bhopal Gas Tragedy. (iv) Dr. (Smt.) Najma A. Heptulla raised a matter regarding issue of Identity Cards to the people living in high security area around the Prime Minster’s residence. (v) Shri Prakash Javadekar raised a matter regarding agitation in Andhra Pradesh for formation of Telangana State. 20 5. 7th December, 2009:— (i) Shri Arun Jaitley, Leader of the Opposition, raised a matter regarding conflicting statements from Government authorities on the issue of climate change. Shri Sitaram Yechury and Shri D. Raja also spoke. Shri Jairam Ramesh, Minister of State (Independent Charge) of the Ministry of Environment and Forests, responded. (ii) Shri Ali Anwar Ansari raised a matter regarding delay in payment of salary to employees of the United News of India (UNI). (iii) Shri M. Venkaiah Naidu raised a matter regarding Telangana issue. Shrimati Ambika Soni, Minister of Information and Broadcasting, responded. (iv) Shri R.C. Singh raised a matter regarding looting of money from labourers by motorcycle gangs in Ludhiana, Punjab. (ii) Shri Prasanta Chatterjee raised a matter regarding need for expansion of the network of rural banks in the country. (iii) Shri Saman Pathak raised a matter regarding the alleged threat by the Army to evict people of Darjeeling and Jalpaiguri from the defence land. 21 7. 11th December, 2009:— (i) Shri M. Venkaiah Naidu raised a matter regarding Telangana issue. Shri Prithviraj Chavan, Minister of State (Independent Charge) of the Ministries of Science and Technology and Earth Sciences; Minister of State in the Prime Minister’s Office and Ministries of Personnel, Public Grievances and Pensions and Parliamentary Affairs, responded. (ii) Shri Balbir Punj raised a matter regarding demand for an inquiry into the incidents of alleged ‘Love Jihad’ in the country and take strict measures to punish the culprits. (iii) Shri Rajiv Pratap Rudy raised a matter regarding the three day bandh announced in Darjeeling. (iv) Shri Tiruchi Siva raised a matter regarding missing Indian Coast Guard personnel. (v) Shrimati Brinda Karat raised a matter regarding Supreme Court judgement on honour killing. 8. 15th December, 2009:— (i) Shri M. Venkaiah Naidu raised a matter regarding the violent situation, which has arisen after the declaration of formation of the separate state of Telangana out of Andhra Pradesh. (ii) Shrimati Brinda Karat raised a matter regarding revelations about the terrorist David Headley’s antecedents and status of FBI’s co-operation with the Indian intelligence agencies. (iii) Shri Jesudasu Seelam raised a matter regarding O.M. of Department of Personnel and Training regarding de-reservation of vacant posts belonging to SCs, STs and OBCs, as reported in newspaper. Shri D. Raja and Shri V. Hanumantha Rao also spoke. (vi) Shri Raghunandan Sharma raised a matter regarding demand to curb the alleged sale of meat blended with cow flesh in Uttar Pradesh and other states in the country. On 16th December, 2009, Shri Tapan Kumar Sen raised a matter regarding the countrywide protests and demonstrations being staged by the Central Trade Unions. Shri S. S. Ahluwalia also spoke. 10. 18th December, 2009:— (i) Shri S.S. Ahluwalia raised a matter regarding selling of Gurudwara land in Lahore. Shri S.M. Krishna, Minister of External Affairs, responded. (ii) Shri Manohar Joshi raised a matter regarding the Maharashtra-Karnataka border dispute. PRABHA THAKUR: Will the Minister of HOME AFFAIRS be pleased to state: (a) the number of accused persons who are under arrest as criminals and are in different jails of various States for the last seven years and the State-wise details thereof; (b) whether most of the undertrial accused persons are confined in jails for many years due to not getting bail or other different reasons if so, the details of those reason; (c) whether Government would consider to make amendment in the law for releasing of such undertrial accused persons who are in police confinement for more than one year, on some other ground even after rejection of their bail; and (d) if so, the details thereof and if not, the reasons therefor? ANSWER MINISTER OF STATE IN THE MINISTRY OF HOME AFFAIRS (SHRI R.P.N SINGH) (a): “Prisons” is a State subject as per entry 4 of List II of the Seventh Schedule to the Constitution of India. Therefore, the administration and management of prisons is primarily the responsibility of the State Governments. Data is available with the National Crime Records Bureau (NCRB) for undertrials in jail for more than 5 years and at the end of 2012, there were 2028 undertrial prisoners(UTPs) lodged in jails of India. A State/UT wise data is annexed. (b) to (d): A comprehensive advisory dated 17th July 2009 has been issued by the Government of India on “Prison Administration”, which provides for steps to be taken by the States/UTs for providing free legal aid to undertrials, setting up of Lok Adalats/Special courts in prisons for expediting review of cases of undertrials.
