Miscellaneous News • SMG announced this week Scott Neal has been appointed General Manager of Rabobank Arena, Theater and Convention Center. Neal previously held the position of Assistant General Manager/Director of Event Services and Marketing Director at INTRUST Bank Arena in Wichita, Kansas. Neal will begin his tenure on November 28th. A news release from SMG is enclosed.

• The new playground at Central Park opened this week to rave reviews! The playground is the City’s first inclusive playground - containing access ramps to elevated structures, rubberized safety surface throughout the play area and a specialized swing seat with advanced restraints for upper and lower body support. Please see the enclosed picture.

• The Bakersfield Police Department hosted a very successful Citizen’s Forum this week. The Forum provided the opportunity for citizen’s to participate in realistic scenarios which police officers face on a daily basis. Approximately 40 attendees were present. Please see the enclosed pictures.

• Bakersfield continues to attract a variety of groups for conventions and events. One of those is the Solution Focused Brief Therapy Association, which held its annual conference in Bakersfield this past week at the Marriott Convention Center Hotel. The conference was expected to attract between 250 and 300 people from throughout the nation, and Mayor Hall presented a proclamation to the group declaring it Solution Focused Counseling Week. Last year the group’s national conference was held in Banff, Alberta.

• Amtrak’s Exhibit Train will be in Bakersfield this weekend as part of a national tour. The train commemorates Amtrak’s 40th Anniversary this year with stops throughout the country. It will stop in only two Central Valley locations: Sacramento and Bakersfield. Amtrak’s Exhibit Train will be at the Bakersfield Amtrak Station this Saturday and Sunday from 10 a.m. until 4 p.m. each day.

High Speed Rail News . The legal hurdles are mounting for the High Speed Rail Authority. We learned this week that a Sacramento Superior Court Judge ruled HSR officials failed to show how the proposed route from Gilroy to San Jose would harm local traffic and homes. Under this ruling the Rail Authority must rescind the Peninsula route to study how the traffic in the far South Bay would suffer if the tracks force the elimination of lanes on Monterey Highway.

In separate, but related legal action this week, Kings County and two of its residents filed a lawsuit against the High Speed Rail Authority, stating that its plan for the central San Joaquin Valley portion of the rail line violates sections of Proposition 1A. According to the suit, the authority's construction of the Valley portion of the rail line illegally uses Prop 1A bond funds for a non-electric, or conventional, rail line. The suit states that because the proposition called for an electric rail system, the use of proposition funds for a non-electric rail line -- even in the "preliminary" stage -- violates state law. Both articles are enclosed for you.

. In accordance with Council comments made during the November 16th meeting, staff will be scheduling a hearing and will present recommendations for Council to consider in response to citizen concerns at the December 14th meeting.

TRIP News  Motorists are advised that the outside northbound lane on Allen Road, between Stockdale Highway and Brimhall Road in the vicinity of the Westside Parkway construction, will be closed on Monday, November 21, 2011 between the hours of 8 a.m. and noon. The closure is needed to allow the contractor to prepare existing pavement for the tie-in to the future bypass road. A news release is enclosed.

SMG Appoints New General Manager of Bakersfield Venues

SMG is pleased to announce the appointment of Scott Neal as General Manager of the event facilities owned by the City of Bakersfield, including the Rabobank Arena, Theater & Convention Center, Bakersfield Ice Sports Center, and Bright House Networks Amphitheater.

Since joining SMG in 2008, Neal has worked at INTRUST Bank Arena in Wichita, Kansas as Assistant General Manager/Director of Event Services and Marketing Director. While at INTRUST Bank Arena, Neal was intricately involved in the grand opening of the facility, and was responsible for booking events, event production and marketing.

Prior to joining SMG, Neal worked for several other facilities, including Kemper Arena/ American Royal Center in Kansas City, EnergySolutions Arena and Maverik Center in Salt Lake City, and Fargodome in Fargo. In addition, Neal has also worked for the Harlem Globetrotters and VEE Corporation (producers of Sesame Street Live).

“I am excited about the opportunity to join the SMG staff in Bakersfield and becoming part of the community,” said Neal. “These facilities have a great history, and I look forward to utilizing my previous experience in booking and venue management in my new position.”

Neal received a Bachelor’s degree in Communication from William Jewell College in Liberty, MO and a Master’s degree in Educational Policy and Leadership from the University of Kansas in Lawrence. He and his wife, Audrey, and their daughters, Alexandria and Julianna, and son, Dylan, are relocating to Bakersfield.

Kings County and two of its residents filed a lawsuit against the California High Speed Rail Authority, stating that its plan for the central San Joaquin Valley portion of the rail line violates sections of Proposition 1A.

The suit, filed Monday in Sacramento County Superior Court, claims that the authority's use of funds from Prop 1A, which created the agency and commissioned a high-speed rail line, cannot be used under current plans.

According to the suit, the authority's construction of the Valley portion of the rail line illegally uses Prop 1A bond funds for a non-electric, or conventional, rail line. The suit states that because the proposition called for an electric rail system, the use of proposition funds for a non-electric rail line -- even in the "preliminary" stage -- violates state law.

Redwood City attorney Michael Brady, who is representing Kings County and co-plaintiffs John Tos and Aaron Fukuda, said the authority failed to seek approval from the Public Utilities Commission and federal agencies following the passage of Prop 1A.

The suit also challenges the state's obligations to pay for the Valley rail line under current cost and grant projections. Under Prop 1A, bond funding could not exceed 50% of the funds spent on the Valley rail segment. Currently, the U.S. Department of Transportation has granted about $3 billion, which equates to a total of $6 billion available for the first segment. The total cost of the segment is estimated over $30 billion, the suit says.

Because of the disparity in available funds and cost projections, the plaintiffs asked that the authority's business plan, released Nov. 3, be declared out of compliance with the proposition and that no bond funding be supplied under Prop 1A.

In April, Brady filed a lawsuit in Sacramento County Superior Court that alleged similar problems. According to Brady, Monday's lawsuit evolved from that case, and includes recent developments from the High Speed Rail Authority.

"The judge said that, because the authority had not yet said it would use Prop 1A funds, the case was not 'ripe' yet," Brady said.

Brady approached Kings County following a unanimous Board of Supervisors vote to reject the rail agency's plan to construct the rail line through the county.

The county even offered to front some of the costs related to the case, but Brady said he'll work pro bono.

The two other plaintiffs are focused on the effect of the current rail line design and its impact on property

owners, including Kings County farmers and ranchers.

The California High Speed Rail Authority declined to comment Monday because its legal department hadn't yet seen the lawsuit.

AQUATICS:

• Monthly attendance at the McMurtrey Aquatic Center decreased by 27% as compared to the same time last year. Total attendance for this October was 2,231. The decrease in attendance that has occurred over the past year is attributed to the following: o Garces Memorial High School utilized the McMurtrey Aquatic Center for water polo practice and games in 2010 & 2011. Garces water polo practice is now taking place at Garces High School’s new pool. • Lap swim attendance increased by 14% as compared to the same time period last year. • 100 Mile Club – The fifth annual 100 Mile Club Social took place on Thursday, October 27th at McMurtrey Aquatic Center. The awards ceremony was held to recognize club members and celebrate their combined distance of 93,542 miles. That distance is 3 ½ times around the world! One year ago the club had swum a total of 66,376 miles! The club began in January 2006 with a handful of members; over the club’s history, a total of 918 members have participated.

• Funding/Donations: o Swim Suits, Gift certificates, Food Total Donations: $2,460.00

• Volunteer Donations o 3 Volunteers 3 @ 17 hrs. ea. @$11/hr. Total Donations: $561.00

• Adult, Youth, Fitness and Adaptive Programs over-all attendance for the month of October was 29,037 which is an increase of 18.8% from last year’s attendance of 24,438. • Adult Softball League: o The Fall Softball League continued through the month of October playing 81 games a week. o Connors Concession reported earning $8,678 in sales for the month at Mesa Marin Sports Complex.

• League of Dreams – Adaptive League: o League of Dreams finished their sixth (6) week basketball league on October 30th with a special “Closing Celebration and Creature Crawling Course” complete with various games, awards and pizza. • Fifth Annual Hershey’s Track & Field After School Meet: o The After School Programs at the Dr. Martin Luther King’s Jr. Community Center and Silver Creek Community Center participated in this track meet on Wednesday, October 26th at the MLK Park. o Forty-four children competed in the standing broad jump, softball throw, 50 & 100 meter races, relays and obstacle course. Winners from each event were presented medals and everyone received a goodie bag and certificate. • Adult Adaptive Co-Rec Softball League: o This six week Adaptive Softball League for adults with disabilities started on Thursday morning October 13th at Beach Park. o Four teams from local adult day programs play in this modified softball league. Each program brings their clients to cheer on their team and enjoy the exciting games. • Volunteer Donations: o 80 Angel Volunteers 400 hrs. @ $9.60/hr. $3,840.00 o 3 Adaptive Tennis Inst. 9 hrs. @ $9.60/hr. $86.40 o 2 Tennis Instructors 24 hrs. @ $9.60/hr. $230.40 Total Volunteer Hours: $4,156.80

Other Sports Highlights: o Pee Wee Sports was held at Silver Creek Park with 14 participants. th o The Adaptive Youth Tennis Program wrapped up their classes on Tuesday, October 18 at Jastro Park. o Junior and High School Tennis Drill classes continued this month at Jastro Park. Participants engaged in tennis drills and games following USTA quick start format. o In addition to the above programs, staff are currently working on the following: Pee Wee Sports at Jastro Park Mesa Marin Sports Complex Softball Tournaments Kern County Disc Golf City Championship at the City in the Hills Park. • Total Attendance: 29,037

DR. MARTIN LUTHER KING, JR. COMMUNITY CENTER:

• Overall attendance for the Martin Luther King, Jr. Center was 4,210 which is a decrease of 5% from October 2010. The decline was due to the loss of several CPR classes that were taught at the center last year. • The Good Neighbor Festival – held on October 15th from 11am -2pm with approximately 1,200 in attendance. The Southeast Neighborhood Partnership had over 40 booths, a petting zoo, pony rides and a cake walk. Awards were given to 8 hidden heroes who have helped the Southeast community. Organizations who make this event possible are listed below:

o Clinica Sierra Vista o Stay Focused Ministries o Kern High School Superintendent of Schools o Kern County Probation Department • Hershey’s Track & Field – Twenty-Seven (27) children from the MLK Center participated in the Hershey’s Track & Field event. The participants were able to compete in a variety of events to include the standing long jump, the 50 and 100 yard dash and the relay race. • Chinese Class – This class started on October 5th and it runs from 3p-4:30p. This month, we combined the healthy eating class with the Chinese class and made traditional Chinese food and taught the participants how to eat with chop sticks. • Total Attendance: 4,210

SILVER CREEK COMMUNITY CENTER/SAUNDERS MULTI-USE FACILITY:

• Silver Creek Community Center Total attendance for the Silver Creek Community Center was 2,566. Due to the small increase in attendance in the After School Program and large increase in the total of rentals, the increase in attendance from 2010 to 2011 was approximately 27%. The Silver Creek Community Center was rented a total of eighteen (18) times for the month of October with a total revenue of $2,360.00. o Halloween took center stage for the After School Program. Each participant made their own costume and Halloween treats. Parents were invited to a party and costume parade. • Saunders Recreational Facility o Total overall attendance for the Saunders Recreational Facility was 800. The facility was rented a total of four (4) times for the month. Revenue generated was $3,445.00. o Soccer League – o Soccer is currently taking signups for the next season that will start in November. o Hockey League- o Hockey season started in October. • Total Attendance for Silver Creek & Saunders Recreational Facility : 3,366

PARKS:

• Sports Village o Area staff trimmed down shrubs in parking lot and along north side entry road to parking lot. o Cables on west side of parking lot were repaired by Klassen Contractor. o Pressure regulator for domestic water line backflow device was installed on 10/27/11.
