Report of the Director and Commissioners • Director Holman reported: o The CRD approved 2021 Budget on March 24, 2021. o 1.2% requisition increase, less than inflation. o Transit portion of the requisition was reduced; funding replaced with Covid Relief funding, which reflects impact on revenue. o $234,000 from Federal Covid Recovery funding went to BC Transit. o Federal government doubling gax tax transfer to local governments, $600,000 for Salt Spring. o Provincial Covid Relief funding for local governments brings $540,000 to the CRD to address revenue shortfalls and cost increases; distribution between the Electoral Areas to be worked out. o Regarding motion to return half of Martin Ogilive’s funds, Director Holman says there is no legal obligation and it sets an unwanted precedent. Ogilive’s funds were received for re-zoning his property, which was done. The Director will work with the Island’s Trust to clarify policies and make sure they are consistently applied. • Chair Baker reported: o The Trail was discussed in a ZOOM meeting with Adam Olsen. o Grant opportunities need to be taken advantage of with plans and preparations ready to go.

4 7. Outstanding Business

7.1 Project Updates:

• Ganges Hill Project o MOTI and staff agree that the pathway issue would be better addressed after the paving project is complete. o MOTI is hoping to finalize negotiations with property owners soon. o Director Holman requested a letter outlining commitments and timelines for the re-paving.

• Booth Canal-Vesuvius Pathway o Signage and reflectors needed for corners and visibility. o MOTI responsible for road sweeping and catch basin maintenance. o Sight issues if taking a left-hand turn from Baker Road onto Fulford- Ganges. o Grafitti might become an issue on the cement blocks. o Slope might be a concern for users with less mobility. o Commission requests staff to review concerns.

• Advocacy Strategic Priorities o Advocate for shoulder/road sweeping and line painting to happen more frequently.

7.2 Petition from Curt Firestone: Incorporate Car Stops in the Ganges Transportation Plan • 80 people signed petition, 100-150 attended protest when Embe ridesharing signs were removed. • The Transportation Commission was not involved in the removal of signs. • Ridesharing has a long history on Salt Spring.

REPORT TO SSI TRANSPORTATION COMMISSION MEETING OF MONDAY, APRIL 26, 2021

SUBJECT SPEED READER BOARDS AT ENTRY POINTS TO GANGES - UPDATE

BACKGROUND

As part of the Transportation Commission’s desire for traffic calming initiatives within the Ganges core, the need for speed reader boards at strategic entry points to Ganges was raised.

The Commission suggested two locations as potentially suitable and desirable areas for the placement of speed reader boards.

1. Fulford Ganges Road as one enters Ganges from the south 2. Lower Ganges Road as one proceeds down the hill from Country Grocer towards the intersection of Upper Ganges Road

The Transportation Commission reached out to The Ministry of Transportation and Infrastructure (MoTI) and ICBC with this initiative to understand the process and enquire as to what funding may be available.

CRD staff consulted with MoTI to determine the protocols and process to have speed boards installed on Salt Spring Island.

PROCESS AND CRITERIA

When considering speed reader boards within the jurisdiction of MoTI the specifications are governed by the MoTI Traffic & Electrical Manual. Speed reader boards are typically used at speed transition zones where traffic speed is reduced from 70 to 50. All requests for speed boards and their proposed locations must be directed through MoTI. The CRD must justify a speed board for each proposed location, such as encouraging drivers to slow down when travelling above the speed, built-in traffic data collection to assess if additional traffic control measures are needed, accident reports, or visual observation. If approved by, MoTI is responsible for coordinating the installation of the speed reader boards.

COST AND COST SHARING

MoTI has indicted that each speed reader board will cost between $35,000 and $50,000 depending on location and accessibility to power. Depending on location, MoTI may elect to install a solar power speed reader board, a more expensive unit. MoTI has advised they will not be funding any speed boards for Salt Spring; however have stated that if the CRD is willing to pay for speed boards, cost of installation, and willing to take the responsibility for maintenance and power costs they will be willing to install and apply for ICBC grant funding.

ICBC FUNDING

In general ICBC will support speed reader boards on the approach to communities where speed is identified as problematic. The locations are to be assessed by MoTI and the CRD to determine if speed reader boards are warranted. If MoTI and CRD agree that the boards are warranted, ICBC may contribute $2,500 per speed reader board (without collision history). The contribution level may increase when risks are determined to be high. ICBC funding for infrastructure projects

RECOMMENDATION

1. That the Salt Spring Island Transportation Commission recommends making an application to the Ministry of Transportation and Infrastructure to install two speed reader boards at the following locations, subject to approval for Community Works Funding: (1) southern entrance to Ganges, between Drake Road and Seaview on Fulford Ganges Road; and (2) at the northern entrance to Ganges, on Lower Ganges Road near the intersection of Upper and Lower Ganges Road.

2. That the Capital Regional District amend the 2021 Salt Spring Island Transportation service Five Year Financial Plan to include the purchase of one speed reader board to be installed at one of the entrances to Ganges; and that a maximum of $36,000 to be funded from the capital reserve fund.

RECOMMENDATION 1. That the Salt Spring Island Local Trust Committee request the applicant revise the Development Permit application for greater consistency with the applicable Development Permit Area 1 guidelines, specifically to address deficiencies related to pedestrian circulation (SS-DP-2020.15).

REPORT SUMMARY This report brings forward an application to amend a Development Permit (DP) within Development Permit Area 1 – Island Villages that was previously issued on the subject property – a permit that enabled the establishment of a restaurant and retail store on that site that was formerly a gas station. The current application seeks to modify site layout and landscaping. Some of the proposed work – primarily a deck patio in front of the restaurant – has already been completed without a permit. Staff analysis determined that the application continues to be consistent with only 24 of 51 applicable Development Permit Area 1 guidelines. Staff recommend that the applicant revise the application to be more consistent with applicable DPA 1 guidelines.

BACKGROUND The application is proceeding as the applicant is seeking to modify the previous Development Permit (SS-DP- 2017.13), issued in 2018. The DP was issued in conjunction with SS-DVP-2017.13 and controlled various aspects of site layout, parking reduction, landscaping, signage and lighting. The current DP application seeks primarily to modify landscaping, site furniture and site layout. The LTC previously required a landscaping security of $5800 – this amount is still deposited with Islands Trust. No further estimate of costing for the update and proposed plan has been provided.

ANALYSIS

Policy/Regulatory Official Community Plan: The subject property is designated as Ganges Village Core in Salt Spring Island Official Community Plan Bylaw No. 434. The following OCP objectives are relevant to this proposal:

B.5.2.1.3 To encourage pedestrian and bicycle trail connections and amenities throughout Ganges.

B.5.2.1.6 To maintain the economic viability of Ganges Village by guiding development into a compact, pedestrian-friendly form within a defined containment boundary with a broad variety of complementary uses.

B.5.2.1.7 To ensure that development respects the small-town feel and heritage aspects that make the village attractive to visitors and residents alike.

The subject property is within Development Permit Area 1 – Island Villages. Development permits are to be issued in accordance with development permit guidelines and, therefore, cannot be withheld if in the opinion of the LTC, the guidelines are met.

Staff evaluation of Development Permit Area 1 guidelines has identified that 51 guidelines are applicable, that 24 are consistent with the proposal, and that 27 guidelines are at variance with the proposal. The application appears to be at variance with the following aspects of the Development Permit Area 1 guidelines:

13 154 General Guidelines

 Major new commercial, industrial and multi-family developments should include construction of a sidewalk or walking path on adjacent road rights-of-way.

 Site access to commercial and multi-family developments should encourage use by pedestrians and cyclists. Internal circulation routes for pedestrians and cyclists should be segregated from vehicular routes, with an emphasis given to pedestrian and cyclist safety over vehicular convenience if necessary.

 Along pedestrian routes, attractive public seating and resting areas should be incorporated into project designs.

Offstreet Parking Lot Location and Design  If parking behind a building is not possible, streetfront parking lots should be designed with a maximum street frontage of 10 m and an effective landscape screen.  To avoid an urban or "strip mall" appearance in island villages, parking lots should not be located on a corner lot or between a building and the adjacent sidewalks  Offstreet parking spaces should not be located so that cars must exit or manoeuvre by backing over a sidewalk or other pedestrian route.  Areas should be provided for the loading and unloading of trucks. Sites should allow delivery trucks to manoeuvre without having to block or back onto an adjacent street, parking aisle or pedestrian route.

Building Form  A pleasant pedestrian environment in villages should be enhanced by pedestrian-oriented features

Landscaping and Parking Surfaces  Informal, natural landscaping that gives a native appearance is encouraged as opposed to formal, decorative plantings  Landscaping should be used to as an integral part of developments and should help in the function and organization of a site; to create the sense of entry into buildings and to define and enliven public spaces. While screening of unattractive building features is important, landscaping should be designed to ensure a broader function.  Soft landscaping should cover a minimum of 40% of parcel areas in multifamily residential developments and at least 20% of the parcel area in commercial and industrial developments.  All hard and soft landscaping and paving, including sidewalks, pedestrian amenities, street furniture, cycle racks and parking lot lines on major new developments should be installed prior to issuance of any building occupancy permit.  The use of trees and other vegetation along roadways in a manner that "crowds" the street, and causes automotive traffic to slow is strongly encouraged.  Deciduous boulevard trees should be included with a spacing of 10 m in all large new commercial and multi-family projects in Ganges Village with frontage on Fulford-Ganges and Lower Ganges Roads.

Regulation: Variance:

Section 7.1.1 - Requirements for Parking and Loading Varied from 15 automobile parking spaces- for 30 Spaces indoor seats and 122 m2 of floor area for other commercial uses- to 6 automobile parking spaces.

Section 7.6.3 - Standards for Loading Spaces Varied to permit the combined use of the Loading Space for commercial loading and maneuvering aisle.

The DVP was approved in accordance with a site plan specifying the following site layout:

The layout proposed through the current application – some of which has already been constructed – alters this approved layout by eliminating the vehicle entrance off of McPhillips Ave, adding an additional parking space on the northern lot line and relocating the handicapped parking space.

Staff consider that while the proposed layout may no longer be substantially in conformity with the approved DVP, the required variances are not affected – most significantly that six parking spaces continue to be provided.

Staff note that the proposed design is an improvement over the previous design, as it appears to be prepared by a professional landscape architect. Variance with DPA 1 guidelines related to an informal aesthetic, larger tree plantings, and screening of parking are still noted.

The previous permit approval resulted in deposit of $5800 with the Islands Trust to secure the landscaping. This amount is still held by Islands Trust. The applicant has not provided and updated cost estimate to complete the proposed work.

Consultation Development Permits do not require public consultation; none has been undertaken.

Protocols No Islands Trust, Islands Trust Conservancy or Local Trust Committee agreements have been determined relevant to the consultation/engagement process (i.e. protocols, MOUs, LOAs).

Agencies Staff have consulted with the Ministry of Transportation and Infrastructure (MOTI) regarding the Commercial Access Permit and determined that the changes to site layout do not require an amendment to the permit previously issued by MOTI. Ministry engineers indicated that the access and egress from one entrance (Lower Ganges Rd.) would have been approved.

First Nations The application has not been determined to require First Nations review; none has been undertaken.

Rationale for Recommendation Staff have assessed that the work proposed in this permit amendment represents an improvement over work approved in earlier permits as it relates to applicable DPA 1 guidelines. However, staff also note that the proposed amendment does not satisfy a majority of applicable Development Permit Area guidelines, namely those related to pedestrian connectivity as well as type and amount of landscaping. Staff therefore recommend that the proposal be modified to address these shortcomings. The LTC may wish to specify which guidelines in particular they would like to see satisfied prior to issuing the amended permit.

ALTERNATIVES The LTC may wish to consider the following alternatives to the staff recommendation:

1. Approve the permit If the LTC considers that the application has merit and is effectively consistent with all applicable OCP guidelines, the LTC may approve issuance of the permit. Recommended wording for the resolution is as follows:

That the Salt Spring Island Local Trust Committee approve the issuance of SS-2020.15, amending SS-DP- 2017.13

2. Request further information The LTC may request further information prior to making a decision. Staff advise that the implications of this alternative are increased processing time and potentially increased cost to the applicant. If selecting

19 160 this alternative, the LTC should describe the specific information needed and the rationale for this request. Recommended wording for the resolution is as follows:

That the Salt Spring Island Local Trust Committee request that the applicant submit to the Islands Trust an Assessment Report, completed by a [insert professional designation if relevant], which identifies the potential impacts of the proposed development on [identify impacts required for review].

3. Deny the application The LTC may deny the application. Staff advise that the implications of this alternative are file closure and that the applicant will be required to re-submit a new application to amend the existing, approved DP. The decision should state reasons for denial. Recommended wording for the resolution is as follows:

That the Salt Spring Island Local Trust Committee deny application SS-DP-2020.15 for the following reasons [insert reasons, e.g. the proposal is not consistent with landscaping guidelines].

4. Hold the application in abeyance pending the rescinding or modifying Standing Resolution SS-2020-146 The LTC may choose to hold the application in abeyance pending the rescinding or modification of Standing resolution SS-2020-146 which defers Bylaw Compliance and Enforcement action for restaurants that have expanded outdoor seating areas due to COVID-19 restrictions. Staff recommend that the LTC hold the application in abeyance only if they believe the applicant is required to submit a DVP or modify the DP application and do not wish to require them to do so at this time. Staff advise the implication of this resolution is that the applicant will be prevented from fully developing the site as desired and that they will be required to take some future action once the resolution is rescinded or altered. Recommended wording for the resolution is as follows:

That the Salt Spring Island Local Trust Committee hold application SS-DP-2020.15 in abeyance while Standing Resolution SS-2020-146 allows the expansion of outdoor seating.

That the Salt Spring Island Local Trust Committee request the application modify the proposed plan in the following manner [list changes] prior to reconsideration by the Salt Spring Island Local Trust Committee.

NEXT STEPS If the LTC accepts staff’s recommendation, the applicant will be required to rework the proposal before further consideration by the LTC.

Upon receipt of the “Vegetation Certification”, Islands Trust shall return the “Vegetation Bond”.

3.3 Landscaping Planter Boxes and Patio The landscaping planter boxes and patio shall be constructed of painted wood – consistent with the colour of the buildings – or natural cedar.

3.4 Recycling and Waste All waste, composting, and recycling containers shall be kept indoors.

3.5 Lighting The lighting shall be in substantial accordance with Schedule 2.

3.6 Signage All signage is subject to the following requirements:

3.6.1 One sign advertising each principal commercial use is permitted not exceeding 1.8 m2. The sign shall be consistent with the colours of the buildings. The lettering on the sign shall not exceed 20 cm in height. The sign should not be posted at a height greater than 3 m.

3.6.2 Signs for directions, parking, loading space, and other functional purposes shall not exceed 1.2 metres in height.

3.6.3 All signs shall be constructed solely of wood or plywood.

3.6.4 Any lighting for signage shall be front-lit and oriented to avoid light spillage.

3.6.5 Moving, neon, and audible signs are prohibited.

4. The land described herein shall be developed in substantial accordance with the terms, conditions and provisions of this Permit and in accordance with Schedules 1 and 2, attached to and forming part of this Permit, as signed and dated by the Deputy Secretary of Islands Trust.

5. This is not a Building Permit, nor does it remove any obligation on the Permittee to obtain other approvals necessary for the lawful completion of the development.

6. Any further development, redevelopment, or any changes to this permit may require a new Development Permit.
