Jim Molan Biography
Jim Molan Biography Retiring from the Australian Army in July 2008 after 40 years, Jim Molan served across a broad range of command and staff appointments in operations, training, staff and military diplomacy. Jim has been an infantryman, an Indonesian speaker, a helicopter pilot, commander of army units from a thirty man platoon to a division of 15,000 soldiers, commander of the Australian Defence Colleges and commander of the evacuation force from the Solomon Islands in 2000. He has served in Papua New Guinea, Indonesia, East Timor, Malaysia, Germany, the US and Iraq. In April 2004, Major General Molan deployed for a year to Iraq as the Coalition’s chief of operations, during a period of continuous and intense combat. On behalf of the US commanding general, he controlled the manoeuvre operations of all forces across all of Iraq, including the security of Iraq’s oil, electricity and rail infrastructure. This period covered the Iraqi elections in January 2005, and the pre-election shaping battles of Najaf, TalAfar, Samarra, Fallujah, and Ramadan 04. Described in the recently (2017) declassified ‘unofficial history’ of ‘Australia’s Participation in the Iraq War’ as “… the ADF member most directly involved in fighting the insurgents”, Major General Molan was awarded the Distinguished Service Cross by the Australian Government for “distinguished command and leadership in action in Iraq”, and the Legion of Merit by the United States Government. Before retiring he was the Adviser to the Vice Chief of the Defence Force on Joint Warfighting and the first Defence Materiel Advocate, promoting Australian defence industry overseas. -

18/02/2021 MPs in drive for nuclear energy - The Australian, 2/18/2021 MPs in drive for nuclear energy EXCLUSIVE GREG BROWN COALITION’S CLIMATE PUSH Nationals senators have drafted legislation allowing the Clean Energy Finance Corporation to invest in nuclear power as twothirds of Coalition MPs backed lifting the ban on the controversial fuel source to help shift the nation to a carbon- neutral future. The block of five Nationals senators, led by Bridget McKenzie and Matt Canavan, will move an amendment to legislation establishing a $1bn arm at the green bank to allow it to invest in nuclear generators, high-energy, low-emissions (HELE), coal- fired power stations and carbon capture and storage technology. The Nationals’ move comes as a survey of 71 Coalition backbenchers conducted by The Australian revealed that 48 were in favour of lifting the longstanding prohibition on nuclear power in the EPBC act. Liberal MPs Andrew Laming, John Alexander and Gerard Rennick are among backbenchers who want Scott Morrison to take a repeal of the nuclear ban to the upcoming election — a move that would open a new divide with Labor as the nation sets a course for a low-emissions future. “I’m very keen to see the prohibition lifted,” Mr Laming said. “It is something that has to be taken to an election so Australians realise there is a significant change in energy policy.” Mr Alexander said it was like “trying to fight Muhammad Ali with one arm tied behind your back if you are going to ignore nuclear energy”. “This is a new era; let’s be right at the cutting edge,” Mr Alexander said. -

This was because they appeared to be dual citizens. These politicians were: Matt Canavan (Italian citizenship); Barnaby Joyce (New Zealand citizenship); Larissa Waters (Canadian citizenship); Scott Ludlam (New Zealand citizenship); Fiona Nash (British citizenship); Malcolm Roberts (British citizenship); and Nick Xenophon (British Overseas citizenship). Section 44(i) prevents a person from being a senator or a member of the House of Representatives if they hold a dual citizenship. As per Sykes v Cleary, a person must take "all reasonable steps" to renounce their foreign citizenship prior to running for office, otherwise they would be disqualified from sitting as a senator or member. The "Citizenship Seven", as the politicians came to be known, were referred to the High Court which was sitting in its position as the Court of Disputed Returns. Issues Were the Citizenship Seven ineligible to sit as senators/members? Held In an unanimous judgment, the High Court held that section 44(i) of the Constitution should be interpreted as to its "ordinary and natural" meaning. -

HARVEY (Scarborough — Leader of the Opposition) [2.56 pm]: I rise to continue my remarks about this amending legislation. I put on the record once again that the position of the Liberal Party room was a consensus position to not oppose this legislation. I would like to get on the record that we do not support the actions of Clive Palmer, which is why we are not opposing this legislation. During question time, I asked the Premier whether he would support a short sharp committee inquiry. It is ridiculous to say that the suggestion of a committee inquiry or that contentious legislation go to a committee to potentially strengthen it is in any way, shape or form showing that the legislation is not supported. That is ridiculous. The amending legislation in front of us is backdated to have effect from 11 August. It was read in just after 5.00 pm yesterday so that Mr Palmer and his lawyers could not get wind of it and could not lodge a writ in court. It needed to be read in yesterday after that opportunity had lapsed. The legislation is backdated to be effective from yesterday, 11 August 2020, at around about 5.00 pm. Should the upper house choose to send it to a committee to potentially strengthen it and ward off a potential High Court challenge, it could be done and dusted by 15 September. -

RESEARCH PAPER SERIES, 2017–18 14 JUNE 2018 Office of profit under the Crown Professor Anne Twomey, University of Sydney Law School Executive summary • Section 44(iv) of the Constitution provides that a person is incapable of being chosen as a Member of Parliament if he or she holds an ‘office of profit under the Crown’. This is also a ground for disqualification from office for existing members and senators under section 45. There has been considerable uncertainty about what is meant by holding an office of profit under the Crown. • First the person must hold an ‘office’. This is a position to which duties attach of a work-like nature. It is usually, but not always the case, that the office continues to exist independently of the person who holds it. However, a person on the ‘unattached’ list of the public service still holds an office. • Second, it must be an ‘office of profit’. This means that some form of ‘profit’ or remuneration must attach to the office, regardless of whether or not that profit is transferred to the office- holder. Reimbursement of actual expenses does not amount to ‘profit’, but a public servant who is on leave without pay or an office-holder who declines to accept a salary or allowances still holds an office of profit. The source of the profit does not matter. Even if it comes from fees paid by members of the public or other private sources, as long as the profit is attached to the office, that is sufficient. • Third, the office of profit must be ‘under the Crown’.
