Acts Amendment (Advance Health Care Planning) Bill 2006* (No. 149)

[Name changed to Acts Amendment (Consent to Medical Treatment) Bill 2006]

This Bill reforms the law relating to medical treatment for the dying. This Bill is necessary to give people certainty when dealing with end of life issues, enabling terminally ill people to govern their medical treatment and protecting medical professionals who adhere to their wishes.

Acts Amendment (Assaults on Police Officers) Bill 2008 (No. 267) (Mr R. Johnson)

The purpose of this Bill is to amend two Acts in a number of respects such that minimum mandatory sentences are introduced for offences where individuals seriously assault police and other public officers. Furthermore, anyone found guilty of seriously assaulting a public officer will not be able to have the offence recorded as a spent conviction.

Acts Amendment (Consent to Medical Treatment) Bill 2006* (No. 149)

The Short Title of the Bill was amended from Acts Amendment (Advance Health Care Planning) Bill 2006 to Acts Amendment (Consent to Medical Treatment) Bill 2006.

Acts Amendment (Justice) Bill 2007* (No. 231)

The purpose of this Bill is to amend the relevant Acts in order to allow for the improvement of procedural aspects of existing legislation necessary for the administration of justice.

Acts Amendment (Weapons) Bill 2008 (No. 273)

The purpose of this Bill is to enhance public safety, particularly in entertainment precincts, by introducing a series of four new offences into the The Criminal Code and increasing existing penalties for offences under the Weapons Act 1999. The new offences to be introduced into The Criminal Code are targeted towards the possession of dangerous or offensive weapons or instruments (including firearms), in and around places of public entertainment, by persons who may be involved in illicit activities such as the drug trade.

Alcohol and Drug Authority Repeal 2005 (No. 070)

The purpose of this Bill is to repeal the Alcohol and Drug Authority Act 1974. The Bill dissolves the Western Australian Alcohol and Drug Authority and, as a consequence:  staff employed by the Authority will be employed by the Minister for Health in his incorporated capacity pursuant to section 7 of the Hospitals and Health Services Act 1927; and  all liabilities, rights and assets of the Authority will be appropriately invested in the Minister for Health.

ANZAC Day Amendment Bill 2005 (No. 066)

Casino (Burswood Island) Agreement Amendment Bill 2007 (LC No. 213)

The purpose of this Bill is to ratify the Eleventh Supplementary Agreement, which in turn amends the Casino (Burswood Island) Agreement Act 1985. The Supplementary Agreement expands the purposes on which the Board may expend its funds and changes the composition of the Burswood Park Board.

Children and Community Services Amendment (Body Piercing) Bill 2007 (No. 230) (Dr J. Woollard)

The purpose of this Bill is to amend the Children and Community Services Act 2004 in order to make it an offence for a person to pierce any part of the body of a child (defined in the Act as a person under the age of 18) without obtaining the written consent of the child’s parent.

The Bill will provide the same penalty for body piercing a child under the age of 18 as already exists for tattooing or branding a child.

Co-operatives Bill 2007* (No. 160)

The purpose of this Bill is to replace the existing Companies (Co-operative) Act 1943 and the Co- operative and Provident Societies Act 1903 with legislation that is reflective of the current commercial and social environment of co-operatives in Western Australia.

The purpose of this Bill is to amend the Corruption and Crime Commission Act 2003 to enable the Corruption and Crime Commission and Western Australia Police to engage in joint taskforce operations to investigate offences independently of the Western Australia Police.

Criminal Law Amendment (Homicide) Bill 2008* (No. 269)

The purpose of this Bill is to introduce significant reforms to the law of homicide in accordance with the recommendations of the Law Reform Commission made in the Final Report on the Review of the Law of Homicide. Some of the key reforms implemented by this Bill are the consolidation of wilful murder and murder into one crime of murder; increased flexibility in sentencing for murder, including the ability for judges to impose tougher sentences on murderers; the simplification and clarification of defences to murder; and the introduction of a new offence to deal with ‘one punch’ homicide cases.

Criminal Law and Evidence Amendment Bill 2006* (No. 145)

This Bill is an amalgamation of two proposed reform packages, amending the Evidence Act 1906, the Criminal Code and The Criminal Procedure Act 2004. This will give effect to procedural reforms in sexual assault cases in order to complete the reforms intended as part of the Sexual Assault Reforms Package. It will also amend The Criminal Code, the Criminal Procedure Act 2004 and the Criminal Appeals Act 2004 to provide for a right to appeal by the prosecution against acquittals in trials before juries and to remedy certain deficiencies in existing provisions.

Cross-border Justice Bill 2007* (No. 236)

This Bill seeks to break down the barriers that state borders create in the administration of justice in the cross-border region. The Bill will enable Western Australia to participate in cross-border justice schemes in conjunction with South Australia and the Northern Territory.

For cross-border schemes to operate, it will be necessary for each jurisdiction to have corresponding laws. Therefore the Bill will also serve as a model to be followed by the governments of South Australia and the Northern Territory.

Daylight Saving Amendment Bill (No. 2) 2007 (No. 196) (Mr M.J. Birney)

This Bill seeks to amend the Daylight Saving Act 2006 by removing the months of February and March from the daylight saving trial and any future daylight saving model.

Daylight Saving Amendment Bill (No. 3) 2007 (LC No. 246) (Hon. N. Moore)

This Bill amends the Daylight Saving Act 2006 in order to change the timeframe for the proposed referendum on daylight saving. It changes the prescribed timeframe from between 10 May 2009 and 13 September 2009 to between 13 April 2008 and 18 May 2008.

Dental Bill 2005* (No. 113)

This Bill provides for effective registration of persons practising dentistry and for dental prosthetics. It controls the use of the titles ‘dentist’, ‘dental prosthetist’, ‘dental therapist’, ‘school dental therapist’ and ‘dental hygienist’. It seeks to prevent conduct from non-dental professionals that may be misleading to consumers and the general public. Importantly the Bill adequately identifies members of the dental profession, enabling consumers of dental services to make informed decisions when engaging a practitioner.

Diamond (Argyle Diamond Mines Joint Venture) Agreement Amendment Bill 2008 (No. 290)

The purpose of this Bill is to ratify an agreement made on 21 May 2008 between the State, Argyle Diamond Mines Limited and Rio Tinto Diamonds Limited. This agreement provides for the variation of an agreement made on 17 November 1981, titled the Diamond (Argyle Diamond Mines Joint Venture) Agreement Act 1981.

This legislation is necessary in order to give effect to the variation of the State Agreement set out in the Variation Agreement.

This Bill amends the Director of Public Prosecutions Act 1991 to establish a joint standing committee which oversees aspects of the role of the Director of Public Prosecutions.

This Bill was introduced and read a first time in the Legislative Assembly on 29 November 2006.

Duties Bill 2007 (No. 259)

The purpose of this Bill, alongside the Duties Legislation Amendment Bill 2007, is to put in place a new duties regime to replace the outdated stamp duty arrangements that are currently imposed by the Stamp Act 1921.

Eastern Goldfields Transport Board Repeal Bill 2007 (No. 199)

The purpose of this Bill is to repeal the Eastern Goldfields Transport Board Act 1984 and to amend certain other Acts as a consequence and for related purposes.

The Bill provides for existing employees of the Board to transfer to the Public Transport Authority on commencement of the Act.

Education and Training Legislation Amendment and Repeal Bill 2008 (No. 277)

The purpose of this Bill is to repeal the Industrial Training Act 1975 and modernise the Vocational Education and Training Act 1996. The modernised apprenticeship system will combine apprenticeships and traineeships within a single legislative framework consistent with other states and territories.

The purpose of this Bill is to amend Electoral Act 1907 to provide that the Chair of the Electoral Distribution Commissioners be a judge or a retired judge of the Supreme Court, the District Court or the Family Court of Western Australia, or, a retired judge of the Supreme Court of another State or Territory or of a Commonwealth Court.

Electoral Amendment Bill (No.2) 2008* (No. 285)

The purpose of this Bill is to amend the Electoral Act 1907 to be consistent with Commonwealth electoral legislation by enabling prisoners serving a sentence of less than three years to be eligible to vote in State elections.

Equal Opportunity Amendment Bill 2006 (No. 173)

The purpose of this Bill is to amend Part III of the Equal Opportunity Act 1984, which deals with discrimination on the grounds of race. The Bill inserts a new division into Part III entitled ‘Racially Offensive Behaviour’. It will be unlawful for a person to do any act, otherwise in private, which is reasonably likely to offend, insult, humiliate or intimidate another person on the ground of race, or on the ground of a characteristic appertaining or imputed to persons of that race.

Equal Opportunity Amendment Bill 2008 (No. 271)

Fatal Accidents Amendment Bill 2008 (No. 274)

The purpose of this Bill is to amend the Fatal Accidents Act 1959 so that damages for pain and suffering and loss of enjoyment of life received by the estate of a victim of an asbestos related disease under the Law Reform (Miscellaneous Provisions) Act 1941 are not taken into account when calculating the value of the benefits lost by the victim's dependants for the purpose of a claim by those dependants under the Fatal Accidents Act 1959.

Fines Legislation Amendment Bill 2006* (No. 161)

The purpose of this Act is to amend the Fines, Penalties and Infringement Notices Enforcement Act 1994 and the Sentence Administration Act 2003. The amendments will increase the level of flexibility of fines enforcement to assist people to pay fines whilst maintaining the integrity of the fine as a sentence. Human Reproductive Technology Amendment Bill 2007 (No. 194)

The Bill amends the Human Reproductive Technology Act 1991 (the HRT Act) in respect of the regulation of embryo research and prohibited practices that relate to reproductive technology. In summary, the amendments:  retain the existing framework in relation to embryos created by fertilisation of human eggs by human sperm. Such embryos can only be created for the purpose of achieving pregnancy in women. If at the end of the assisted reproductive technology (ART) treatment the embryos are excess to the needs of the people to whom they were created they can be donated for research. Any use of the ART embryos for research will continue to be subject to the strict licensing requirement that are provided in the HRT Act;  retain the ban on human cloning for reproductive purposes;  allow for the creation of embryos by means other than fertilisation and the use of those embryos for research. Both the creation and the use of the embryo is subject to the same strict licensing that applies to excess ART embryos. Embryos created by means other than fertilisation cannot be developed by any means for more than 14 days and must not be used for reproductive purposes;  require the tabling of reports prepared by the relevant Commonwealth Minister regarding the establishment of a national stem cell bank, a national register of excess ART embryos that have been donated for research and the feasibility of a national approach to non-blood human tissue-based therapies; and  require the Western Australian Minister to cause a further independent review of the legislation in three years (which may be undertaken as part of the required review of the Commonwealth Acts).

Industrial Relations (Prohibition of Bargaining Services Fees) Amendment Bill 2007* (No. 221) (Mr M.J. Cowper)

The purpose of this Bill is to bring the Industrial Relations Act 1979 into alignment with the Workplace Relations Amendment Bill currently before federal Parliament. The proposed amendments would insert an amendment into section 96A of the Industrial Relations Act 1979 which deals with freedom of association. The purpose is to clarify and simplify the interpretation of ‘bargaining services’ and ‘bargaining services fees’. A further proposed amendment would insert after section 96B a section to be known as 96BA which will expressly provide that any award, industrial agreement or order under the Act shall not include in it a ‘bargaining services fee’.

Liquor Control Amendment Bill 2008 (No. 289)

The purpose of this Bill is to introduce a number of amendments to the Liquor Control Act 1988 to allow juveniles, aged 16 or 17 years, who have graduated from a prescribed training course, to serve liquor whilst employed on licensed premises. The service of liquor under this provision must be ancillary to a meal, and the work carried out by the juvenile supervised at all times. Employment of the juvenile on licensed premises must also be approved by the director of liquor licensing.

Local Government Amendment Bill 2008* (No. 288)

The purpose of this Bill is to introduce amendments to improve the operation of the Local Government Act 1995.

The key amendments include provisions for:  new powers for local governments to enter private land to remove graffiti;  widening the circumstances that local government can take gravel and other building materials from land for building purposes;  improving various accountability provisions relating to declaring financial interests, elections donations and restricting the types of gifts that council members may receive; and  stronger powers for the Minister and the Department of Local Government and Regional Development to obtain information from local governments when carrying out investigations.

These amendments will bring the relevant State laws into line with the Commonwealth Bankruptcy Act 1966.

The purpose of the Bill is to prohibit the construction and operation of nuclear facilities in Western Australia. The Bill provides that no State laws or authorisations granted under State laws allow the construction or operation of a nuclear facility or other activities prohibited by the Bill.

The Bill makes it an offence to construct and operate a nuclear facility in Western Australia with a penalty of $500,000.

Pharmacists Bill 2006* (No. 185)

The objective of the Bill is to protect the public of Western Australia from potential harm by providing for the effective regulation of pharmacy. To achieve this objective, the Bill vests the Pharmacists Board of Western Australia with two principal statutory functions:  registration – the Board is responsible for determining who may be registered as pharmacists in Western Australia by reference to eligibility criteria that are contained in the Bill. The Board is also responsible for the registration of pharmacy premises and to ensure that pharmacy premises meet appropriate standards; and  professional regulation – the Board is authorised to inquire into complaints about pharmacists and to take appropriate action where a disciplinary or impairment matter as set out in the Bill is established.

Police (Compensation for Injured Officers) Amendment Bill 2006* (No. 159) (Mr M.J. Cowper)

There is currently no statutory provision for the support, compensation and rehabilitation of members and former members of the WA Police Force who retire, resign or otherwise leave the Police Force with residual illness or injuries which arise through the performance of a police duty or function.

Police are specifically excluded from coverage of the Workers’ Compensation and Injury Management Act 1981 (except in death) and this Bill addresses that anomaly by amending the Police Act 1892 to provide compensation and ongoing medical benefits for officers injured in the course of duty.

Public Trustee and Trustee Companies Legislation Amendment Bill 2006 (No. 102)

The purpose of this Bill is to modernise the Public Trustee’s legislative framework which has remained largely unchanged for over 60 years. This will allow the Public Trustee to remove inequitable investment and fee arrangements which currently disadvantage some of the most vulnerable members of the Western Australian community, and to provide full trustee services in terms of performing essential financial and legal functions. This Bill will provide for the reform of the Public Trustee’s operations and services and enable it to bring its activities up to date with industry best practice, in line with the other Public Trustees in Australia and the Trustee Companies Act. It will also allow the Public Trustee to achieve self-funding over time.

Road Traffic Amendment Bill 2008 (No. 272)

The purpose of this Bill is to prepare for the introduction of the Repeat Drink Driving Strategy. This is intended to provide a further strong deterrent to unauthorised driving. This is considered necessary so that affected drink driving offenders will not consider unauthorised driving as an alternative to obtaining the proposed conditional driving authorisation. In summary, the amendments will:

 increase the period of time a police officer may impound a vehicle used in the commission of an impounding offence (driving) from 48 hours to seven days for a first offence and 28 days for a second and subsequent offence;  extend the definition of ‘road rage circumstances’ to include places other than a road such as car parks and private property;  amend vehicle confiscation provisions as they relate to both hoon and road rage offences so that where an application is made by Police to have a vehicle confiscated, a court may order the impounding of the vehicle for a period of up to six months as an alternative to confiscation; and  target those drivers who speed excessively by increasing the court imposed fines for reckless driving.

Road Traffic Amendment (Confiscation and Disposal of Vehicles) Bill 2008 (No. 268) (Mr R. Johnson)

The purpose of this Bill is to amend the Road Traffic Act 1974 to:  increase the impoundment period of a vehicle to seven days;  require for impoundment of the vehicle for a period of three months upon conviction for a second offence of driving without a driver’s licence, or racing or road rage offences;  require confiscation of the vehicle upon conviction for a third offence of driving without a driver’s licence, or racing or road rage offences;  require confiscation of the vehicle upon conviction for driving without a driver's licence that has been suspended or cancelled due to a drink driving offence; and  give the Commissioner the discretion to sell, crush or use the vehicle in police covert operations upon the making of a confiscation order, or upon a failure to collect an impounded vehicle.

State Supply Commission Amendment Bill 2007* (No. 225)

The purpose of this Bill is to formally transfer accountability for State Fleet from the State Supply Commission (SSC) to the Department of Treasury and Finance (DTF). The amendments incorporated into this Bill will:

 enable the SSC to enter into an agreement with the Minister of another agency (in practice this will be the Treasurer and DFT respectively) for the SCC’s functions to be transferred to the Treasurer, and delegated by the Treasurer to DFT, to the extent necessary to permit DTF to provide the State Fleet services in its own right;  enable DTF to draw on the powers of the State Supply Commission Act 1991 to the extent necessary to undertake the State Fleet functions. The powers required will include powers to contract with any person, to set and retain charges from other government agencies and to borrow; and  amend the Act’s accounting provisions to provide that the State Fleet functions will be accounted for as DTF functions in its budget and annual report, in compliance with the Financial Management Act 2006.

Sunset Hospital Site Bill 2006 (No. 137)

The purpose of this Bill is to facilitate land tenure and planning amendments to A Class reserve 1667 to enable implementation of the Sunset Community Master Plan, providing for:  the timely adaptive reuse and conservation of the heritage-listed Sunset Hospital site;  most of the Sunset site remaining as an A Class reserve and being placed under the custodianship of the University of Western Australia for use as the UWA Arts Centre and for development of a residential aged care facility;  excision of a relatively small part of the A Class reserve 1667 for the development of residential apartments;  appropriate amendment to the Metropolitan Region Scheme; and  minor boundary rationalisation to protect improvements owned by the City of Nedlands.

Surrogacy Bill 2007* (No. 190)

This Bill provides for the regulation of surrogacy arrangements and for the parentage of children born as a result of those arrangements. Under the Bill surrogacy will be provided for by:  allowing access to IVF for a women who has agreed to bear a child for a women or couple who would be eligible for IVF;  providing a parentage order which will alter the birth certificate to make the arranged parents the legal parents of the child; and  regulating activities around the making of surrogacy arrangements.

Terrorism (Preventative Detention) Amendment Bill 2007 (No. 215)

The purpose of this Bill is to amend the Terrorism (Preventative Detention) Act 2006 (the Act) in order to avoid any doubt about the ability of ASIO to take a person who is in preventative detention under the Act into their custody.

It is necessary to amend the Act to refer to the updated provisions of the Australian Security Intelligence Organisation Act 1979. The Bill will achieve this by making a number of housekeeping amendments to the Terrorism (Preventative Detention) Act 2006.
