WELCOME AND APOLOGIES 2.1 Apologies were received from: Mr Barker-McCardle, Mr Finnigan, Sir Peter Fahy, Mr Polin, Miss Beaton and Ms Buttery. 3. MINUTES OF THE PREVIOUS MEETING 3.1 Members agreed the Minutes of the previous meeting held on 10 October 2012 as a true record. 4. STANDING ITEMS 4.1 Action Log 4.1.1 Mr Flaherty confirmed that the majority of the actions had been discharged. 4.1.2 Members noted the update. Items for information 5. PRESIDENTIAL UPDATE 5.1 The President advised that a series of reviews were being conducted into historic child sex abuse cases. CC Mark Polin, Chief Constable of North Wales Police had asked CC Keith Bristow, Director General of the National Crime Agency (NCA), to undertake a review of North Wales abuse enquiry from the 1970s and 1980s. 5.2 Mr Murphy advised that CC Keith Bristow had requested specialist resources from him to assist in carrying out the review in his capacity as Head of Crime Business Area and Chief Constable of Merseyside Police. 5.3 The President pointed out that this was the first investigation to be conducted by a national agency as opposed to force Chief Constable. 5.4 The President confirmed the success of the recent ACPO Autumn Conference, which took place on 23-25 October 2012. 5.5 An update was provided on the future of ACPO. Ms Thornton undertook to send the Home Secretary a formal proposal for a statutory Chief Constables’ Council. Action: Ms Thornton 5.6 The President congratulated Mr Marshall on his appointment as Chief Executive of the College of Policing; however, the position of Chair was yet to be announced. A protocol between Chief Constables’ Council and the College would be developed. 5.7 The Police and Crime Commissioners’ (PCC) Elections would be taking place in 8 days time. The ACPO PCC Transition Board would have a 24-hour ‘Helpdesk’ on Election Day and ACC Gary Cann had issued guidance on the election process. 5.8 A PCC briefing event was being arranged on 3 December to discuss Counter Terrorism and Organised Crime. CC Murphy, CC Creedon and AC Cressida Dick would be delivering briefings. The decision to take part in such events fell to individual chief constables, with reference to principles contained in the ‘Guiding Principles: ACPO Engagements in Events and Conferences’. 5.10 Members noted the update. Items for decision 6. ASSESSING THE IMPACT OF A UK OPT-OUT OF EU THIRD PILLAR CRIMINAL LAW AND POLICING MEASURES UNDER THE LISBON TREATY 6.1 The President introduced a paper on behalf of Mr Barker-McCardle who had been asked at the June meeting to consult across business areas and produce a more detailed assessment of the impact of the UK opting out of the Pre-Lisbon Treaty Police and Crime Measures. 6.2 The President invited Mr Duffin to elaborate on the paper which sought to determine which of the third pillar measures (TPMs) UK law enforcement should seek to opt back into. 6.3 Members were invited to: i. Consider the impact assessment ii. Agree to recommend that 55 separate TPMs were opted back into in the same terms that were currently held iii. Agree to recommend that 7 TPMs should not be opted back into iv. Agree to recommend that the European Arrest Warrants (EAW) be opted back into under the same arrangements that were currently in place. 6.4 Mr Duffin added that the government needed to be informed of EU decisions by May 2014 and that if the recommendations contained in the paper were endorsed, then more consultations were anticipated. 6.5 Members broadly agreed with the proposed recommendations; however, the following points were raised in the discussion which followed: • Resources were required to deal with anticipated consultations and ACPO needed to engage with Home Office officials in order to progress this further • It would be helpful to gather more factual data and qualitative cases • There was a need to ensure an evidence based approach, which should be impact assessed and where relevant supported by academic study • There was a need to examine the CT issues in more detail • The numbers indicated at paragraph 5.1 of the paper required emendation. 6.6 The President undertook to liaise with Mr Barker-McCardle after the meeting and a further paper would be presented at Chief Constables’ Council. Action: President/Mr Barker-McCardle 6.7 The recommendations contained in paragraph 8.1 of the paper and at 6.3 above were agreed, subject to the comments raised. MISSING PERSON DEFINITION 7.1 Mr Murphy introduced a paper which requested Members to support a change in the ACPO definition for a ‘missing’ person, from ‘anyone whose whereabouts is unknown whatever the circumstances of disappearance. They will be considered missing until located and their well- being otherwise established’ to ‘anyone whose whereabouts cannot be established and where the circumstances are out of character or the context suggests the person may be subject of crime or at risk of harm to themselves or another’. 7.2 Mr Geenty, ACPO lead for Missing Persons, added that there were 330,000 missing persons cases reported each year, which were currently not being risk assessed. The proposed change in definition would reduce risks and allow the Missing Persons Coordinator to analyse records and work effectively with care homes in order to target the most vulnerable. Mr Geenty also confirmed that he would work closely with stakeholders, the NPIA and ACPO Press Office on the issue. 7.3 It was added that in using the new definition, there should be a proportionate response to risks and a consistent working approach with local authorities. 7.4 Members supported the change in the current definition, and requested that this should go to the Chief Constables’ Council.
