Advertiser’s announcement Money Column Holistic Medical By Margaret Black Don’t ignore the taxman Doctor joins team It is never wise to ignore the taxman. If you do then they have substantial powers to at Cheshire Natural determine the amount of tax that is owed and to pursue it. Those powers, however, are not unlimited and this was illustrated in a recent case that was appealed by the taxpayer to Health the First Tier Tribunal (“FTT”).

It appears that HMRC received information from World Pay that the taxpayer, Cussons (“C”) had received payments in respect of the buying and selling of used cars. They David Watkinson and approached C about this but he failed to Margaret Black reply to HMRC both at the start of the enquiry and at every stage thereafter. Therefore, HMRC were compelled to use “best judgements” to arrive at the tax due from the limited information available to them. They issued determinations for the years 2004/5 to 2015/16 which totalled a staggering £342,943.11 in tax and penalties. This was based on receipts for 2015/16 from which they deducted 50% in expenses. This “profit” was then worked back over the previous 11 years using the Retail Prices Index to allow for inflation.

Not surprisingly, this caused C to lift his head from out of the sand and to appeal the determinations to the FTT. At that appeal he stated that he was in receipt of enhanced employment and support allowance, which is paid to people unable to work due to physical or mental impairments, and had no income that took him above the personal allowance. At the hearing C was accompanied by his 81 year old father who stated both that the vehicles were actually traded through his company and that the average profit was £200 per vehicle.

In cases such as this the FTT must follow a two-stage process. Firstly, did HMRC use their best judgement in making their assessments based on the HAVE you ever wished that you could see a doctor who understood and embraced information available. If not, the assessments fail. If (and only if) they did the use of complementary therapies? does the FTT then consider whether the assessments should be reduced on the basis of any additional evidence available. In doing so, the FTT must One who would recommend acupuncture and herbal medicine for menopausal assume as its starting point that HMRC made an honest and genuine attempt symptoms, or colonic hydrotherapy and reflexology for IBS? to arrive at a fair assessment. Also, it is not sufficient for the FTT to disagree Cheshire Natural Health is delighted to now be able to offer this service every with HMRC’s conclusions. They say that although heartbroken, they take some comfort from knowing she is back in the arms of her soulmate, Kevin, who died of a heart attack last year. Helen, aged 34, was found in the Mersey at Seacombe, Wirral, on October 2 after last being seen in Lime Tree Avenue, Stockton Heath, on September 25. Police had mounted a major search for her after her disappearance. In their statement, Helen’s family said: “We will always remember our Helen as the beautiful, kind and generous person that she was; a brilliant mother to her two sons, and a shining light in all of our lives. “Since Helen lost Kevin so suddenly last year, she has done her best to cope for the sake of her boys. She fought so hard to get the boys to where they are now, through everything that life threw their way. She was so brave to the end, and we are very proud of her. “The pain of Helen’s passing is hard to put into words. We are lost, we are down, and we are weakened, but we won’t stay that way for long. We now have the most important job of all; to be pillars of strength, love and courage for the boys as they grow into strong men. Men that will always know how much they are truly loved, by their mum and dad, and the rest of their family. “While we are heartbroken, we take some comfort in knowing that Helen is back in the arms of her soulmate, and that they are together for all eternity. Not a day will ever pass where we won’t think of both of them. We will miss them always.” Kevin died just two weeks before he and Helen were due to be married last year.
