For those of us who teach courses relating to sexuality and the law, it can be a Sisyphean task to help contemporary students grasp a world in which giving a lecture about birth control that involved the visual aid of a packet of spermicide could result in criminal prosecution. Yet, in order to understand today’s headlines about legal challenges to required insurance coverage of contraceptives, one must be able to trace how and why political, social, and legal understandings of sexual- ity moved it from a deeply illicit taboo towards constitutionally protected rights. -

What are 3 aspects of everyday life that it includes? Lesson: Roe v. Wade As this is a required case for the test, there are some ideas that are important to remember. Please write these down in your own words so you know what they are. Term Definition Due process The 14th Amendment clause guaranteeing that no state clause shall “deprive any person of life, liberty, or property, without due process of law.” The Supreme Court has interpreted the due process clause to provide for “selective incorporation” of amendments into the states, meaning that neither the states nor the federal government may abridge individual rights protected by the Constitution. REV. ___ (forthcoming 2017) ANTI-GAY CURRICULUM LAWS Clifford Rosky Since the Supreme Court’s invalidation of anti-gay marriage laws, scholars and advocates have begun discussing what issues the LGBT movement should prioritize next. This article joins that dialogue by developing the framework for a national campaign to invalidate anti-gay curriculum laws—statutes that prohibit or restrict the discussion of homosexuality in public schools. These laws are artifacts of a bygone era in which official discrimination against LGBT people was both lawful and rampant. But they are far more prevalent than others have recognized. In the existing literature, scholars and advocates have referred to these provisions as “no promo homo” laws and claimed that they exist in only a handful of states. -

How could a conservative defend the U.S. Supreme Court's decision to strike down a Colorado state constitutional amendment repealing and prohibiting local gay civil rights laws? Wasn't the decision an unprincipled departure from the intentions of the Framers, the language of the Constitution, and the traditions of the nation? Wasn't it, in short, the very archetype of liberal judicial activism abhorred by conservatives? Many conservatives, including conservative legal scholars, have apparently thought so. GERHARDT* The idea that Justices Hugo Black and Antonin Scalia have anything in common jurisprudentially is counterintuitive. Justice Black is associated with the progressive social and economic legislation symbolized by the New Deal and with judicial activism in protecting the poor and disen franchised.1 He is beloved by many liberals as a champion of individual rights, especially freedom of speech and of the press. Marriage Equality and the Supreme Court A Guide to What Is at Stake in Upcoming Rulings By Crosby Burns and Joshua Field June 10, 2013 This month the Supreme Court will deliver two historic rulings that will affect thou- sands of committed same-sex couples throughout the United States. InHollingsworth v. Perry, the Court will determine the constitutionality of California’s Proposition 8, which stripped same-sex couples in California of their right to marriage in 2008.1 Approximately 109,000 same-sex couples lost the freedom to marry in California that year.2 In United States v. Windsor, the Court will rule on the constitutionality of the Defense of Marriage Act, or DOMA, a federal law passed in 1996 that defines marriage as the union between a man and a woman for the purposes of more than 1,000 federal laws and programs.3 DOMA implicates everything from veterans’ benefits to immigra- tion to federal estate taxes, and it unfairly discriminates against legally married same-sex couples by denying them federal benefits and protections currently enjoyed by oppo- site-sex couples.4 In 2003 the Supreme Court affirmed the civil rights of gay and lesbian Americans in the landmark case Lawrence v. Texas by invalidating state antisodomy laws that prohibited consensual sex between people of the same gender.5 Ten years later the Supreme Court is poised to deliver two similarly monumental rulings that could have sweeping implica- tions for gay and lesbian couples in the United States. In Alabama, a legislator introduced a bill that would have banished any mention of homosexuality from all public libraries-even at the university level.' In Virginia, the legislature's enthusiasm for joining the chorus of states that have amended their constitutions to ban gay marriage was eclipsed by a legislator's suggestion that the state's license plates be pressed into service as political slogans, and made to read: "Traditional Marriage. -

Timeline of Same-Sex Marriage Laws – Student Handout 1969 – Police enter the Stonewall Inn in Greenwich Village, New York City, on a routine raid aimed at arresting gay patrons and encounter violent resistance from the gay community. The event, known as the Stonewall riots, marks the beginning of the modern gay rights movement. 1970 – Jack Baker and Michael McConnell become the first same-sex couple to apply for a marriage license in Minneapolis, Minnesota. Their application is rejected and they lose their appeal. 1973 – Maryland becomes the first state to ban same-sex marriage. 1996 – President Bill Clinton signs the Defense of Marriage Act into law. DOMA says that neither the federal government nor states have to recognize same-sex marriages that were performed in another state, cutting off same-sex couples’ access to marriage benefits in many states. 2000 – Vermont becomes the first state to legalize civil unions between same-sex partners. 2001 – The Netherlands becomes the first country to legalize same-sex marriage. 2003 – The Federal Marriage Amendment is introduced to the House of Representatives. The amendment would add language to the Constitution stating that marriage should only occur between a man and a woman. 2004-2006 – 23 states ban same-sex marriage. 2008 – California bans same-sex marriage by popular vote on Proposition 8, a measure on the state ballot. The following year, the California state Supreme Court upholds that decision. 2011 – President Barack Obama tells the Department of Justice to stop defending DOMA in court, stating that it is unconstitutional. 2012 –Obama publicly states his support for same-sex marriage. -

By Andrea Stone Mountaineer staff Katherine Hammack, assistant secretary of the Army for installations, energy and environment, topped off a three-day visit to Fort Carson by attending a naturalization ceremony at the Freedom Performing Arts Center, Aug. 15. After the ceremony, Hammack discussed the challenges Fort Carson faces at the Piñon Canyon Maneuver Site. On Aug. 13, she met with representatives of the Las Animas County com- munity where PCMS is located to discuss issues related to the site. The Army was granted authority in 2007 to expand PCMS, but never acted on that authority. “We have never budgeted the funds, and we have never followed through on expansion because, as time went by, and with the pace of deployments and fighting the fight, we did not use Piñon Canyon as much as we would have if everyone was stationed at home,” Hammack said. With the reduced pace of deployments and the reduction in forces, there may not be a need for expansion. “Now that everybody’s coming home, we’re going to take a look and see if (there’s) any need to expand and, frankly, with the Army getting smaller, there’s a good chance we will not need to expand,” she said. -

SEXUAL ORIENTATION and the FEDERAL WORKPLACE Policy and Perception A Report to the President and Congress of the United States by the U.S. Merit Systems Protection Board MAY 2014 THE CHAIRMAN U.S. MERIT SYSTEMS PROTECTION BOARD 1615 M Street, NW Washington, DC 20419-0001 The President President of the Senate Speaker of the House of Representatives Dear Sirs: In accordance with the requirements of 5 U.S.C. § 1204(a)(3), it is my honor to submit this U.S. Merit Systems Protection Board (MSPB) report, Sexual Orientation and the Federal Workplace: Policy and Perception. The purpose of our study was to examine Federal employee perceptions of workplace treatment based on sexual orientation, review how Federal workplace protections from sexual orientation discrimination evolved, and determine if further action is warranted to communicate or clarify those protections. Since 1980, the U.S. Office of Personnel Management has interpreted the tenth Prohibited Personnel Practice (5 U.S.C. § 2302(b)(10)), which bars discrimination in Federal personnel actions based on conduct that does not adversely affect job performance, to prohibit sexual orientation discrimination. As this prohibition has neither been specifically expressed in statute nor affirmed in judicial decision, it has been subject to alternate interpretations. Executive Order 13087 prohibited sexual orientation discrimination in Federal employment but provided no enforceable rights or remedies for Federal employees who allege they are the victims of sexual orientation discrimination. Any ambiguity in the longstanding policy prohibiting sexual orientation discrimination in the Federal workplace would be resolved by legislation making that prohibition explicit. Such legislation could grant Federal employees who allege they are victims of sexual orientation discrimination access to the same remedies as those who allege discrimination on other bases. -

Transformative Events in the LGBTQ Rights Movement Ellen Ann Andersen* ABSTRACT Obergefell v. Hodges, the 2015 Supreme Court case holding that same-sex couples had a constitutional right to marry under the Due Process Clause of the Fourteenth Amendment, was widely hailed in the media as a turning point for the LGBTQ rights movement. In this article, I contemplate the meaning of turning points. Social movement scholars have shown that specific events can, on rare occasion, alter the subsequent trajectory of a social movement. Such events have been termed ‘transformative events.’ I ask whether judicial decisions have the capacity to be transformative events and, if so, under what circumstances. I begin by developing a set of criteria for identifying a transformative event which I then apply to a handful of judicial decisions that, like Obergefell, have been described widely as turning points and/or watersheds in the struggle for LGBTQ rights.
