    Ruling of Austria’s Federal Administrative Court (Bundesverwaltungsgericht) on the planned third runway for Vienna International Airport (Schwechat). 2 February 2017 (Original in German) Executive Summary (from Climate Blog of Columbia Law School1) Plans for a third runway at the Vienna-Schwechat airport were first submitted for review by the government of Lower Austria (one of Austria’s 9 regions) in March 2007. (In early February) the Lower Austrian government’s approval of those plans was struck down by Austria’s Federal Administrative Court (Bundesverwaltungsgericht) because authorizing the runway would do more harm to the public interest than good, primarily because it would be contrary to Austria’s national and international obligations to mitigate the causes of climate change. Before arriving at its decision, the court examined expected changes in future air traffic, the emissions impacts of those changes, and the extent to which it would be possible for the airport to control or otherwise limit various sources of emissions. It also considered the economic benefits of the additional runway, the adverse impacts of climate change on Austria, and the state of Austria and Europe’s effort to reduce emissions generally and from air traffic. After reviewing several estimates, the court concluded that a third runway would increase Austria’s annual CO2 emissions by between 1.79 and 2.02% by 2025. This is at odds, the court noted, with Austria’s 2020 transport sector emissions reduction target of 2.25%. The court also observed that short-term gains in the form of commerce or jobs were easily outweighed by the likely economic consequences of a destabilized climate.

Sakura (Cherry) trees which are the symbol of Spring were in full bloom on 24 March (Sunday) in Tokyo. Full bloom in Tokyo was ten days earlier than usual because of global warming?? April is the beginning of everything like school, business and the government in Japan. Entrance ceremony of elementary school, junior high school, high school, universities and colleges will be conducted in April. So will be the entrance ceremony of companies and governments. Sakura trees goes well with those entrance ceremonies as if they are celebrating the new start of schools, companies and governments. Ryanair, HLX (which was merged with Hapagfly in 2007 into the new brand Tuifly) and Tuifly now need to repay the incompatible aid to Austria. Klagenfurt is a small regional airport located in the south of the State of Carinthia in Austria. It is owned by the State of Carinthia and the City of Klagenfurt. Between 2000 and 2015, the airport's traffic has been fluctuating between 200 000 and 500 000 passengers per year. The in-depth investigation revealed that various grants provided to the airport operator Kärntner Flughafen Betriebsgesellschaft (KFBG) from 2000 to 2011 by its public ownersgave the company a selective advantage over competitors. They involved state aid within the meaning of the EU rules. The Commission's 2014 Aviation Guidelines allow Member States to support regional airports under certain conditions. The Commission's investigation found that Klagenfurt airport is an important factor for the development and accessibility of the Carinthia region. Moreover, the airport is located in a mountainous area with long travel times to other airports, especially during winter (the closest airport in Ljubljana is around 80 km away). This reduces potential negative effects of the support on competition and trade, which are outweighed by the benefits to the connectivity of the region, in line with EU state aid rules.
