T H E F UR T H E R A ND H I G H E R E DU C A T I O N A C T 1992 THE SIXTH FORM COLLEGE CORPORATIONS (MODIFICATION OF INSTRUMENTS AND ARTICLES OF GOVERNMENT) ORDER No.1 2012 The Young People’s Learning Agency for England makes the following Order in exercise of the powers conferred by section 33L(3) of the Further and Higher Education Act 19921. In accordance with section 33L(4)(b) of that Act, the Young People’s Learning Agency has consulted the sixth form college corporations listed in the Schedule to this Order (“the colleges”). 1. This Order may be cited as the Sixth Form College Corporations (Modification of Instruments and Articles of Government) Order No.1 2012 and comes into force on 31st March 2012. 2. The Young People’s Learning Agency for England modifies the instrument and articles of government as set out in articles 3 and 4. Amendments to the A rticles of Government 3. After article 3(1)(a) insert— “ (aa) publishing arrangements for obtaining the views of staff and students on the determination and periodic review of the educational character and mission of the institution and the oversight of its activities;”. 4. After article 24 insert— “ Modification or replacement of the Instrument and A rticles of Government 25-(1) Subject to paragraph (2), the Corporation may by resolution of the members modify or replace its instrument and articles of government. (2) The Corporation shall not make changes to the instrument or articles of government that would result in the body ceasing to be a charity. Dissolution of the Corporation 26. The Corporation may by resolution dissolve itself and provide for the transfer of its property, rights and liabilities.”.
