Custer County Commissioner Meeting Date: February 26th, 2015

Chairman Lampert called the meeting to order at 8:00 a.m. with the Pledge of Allegiance. Mark Hartman, David Hazeltine, Travis Bies, Jim Lintz and the Auditor were present. The Board moved to approve the agenda with the following addition:  Emergency Management - Shelters  Hazard Mitigation Grant under Work Session. Motion carried. In the following proceedings, all action taken was first duly moved and seconded, received a unanimous vote of the Commissioners without dissenting vote or abstention, unless otherwise stated. Minutes The February 11th, 2015 Commissioner meeting minutes have been amended to read: Unfinished Business -The Board reviewed suggested changes to county fees submitted by the department heads. The fee changes are acceptable to the Board with the exception of Mark Hartman who opposed the changes…… Dave Hazeltine moved and Mark Hartman seconded to approve the minutes of the February 11th, 2015 Commission meeting as amended. Motion carried.

Declaration of Conflict of Interest - None declared

Application to Occupy ROW Mark Hartman moved and Travis Bies seconded to approve an application to occupy ROW made by Mt Rushmore Telephone Co for fiber optic cable on highway number 12 Cobb Rd in Section 36, Township 3S, Range 7E, Custer County, South Dakota. Motion carried. Mike Carter – Emergency Management -Mike has been working with citizens in Buffalo Gap to secure a grant for a generator for the community center. As part of the development plan a grant will be applied for and needs an approval of participation from the Custer County Commissioners. The Board has granted affirmation of participation of the grant process. Executive Session – Contract Negotiations -Mark Hartman moved and Dave Hazeltine seconded to go in and out of executive session for contract negotiations at 8:20 am and adjourned at 8:40 am. Motion carried. Bid Letting – East County Highway Shop -Jim Lintz moved and Dave Hazeltine seconded to accept the bid of Semmler Construction for the East County Highway Shop as the lowest bidder. Motion carried. Plat Approval

1 -Dave Hazeltine moved and Travis Bies seconded to table the Bland plat proposal until it has be reviewed further by the planning commission. Motion carried.

Hermosa Fair Board -Greg Neugebauer, John Wiles and Crystal Wiles with the Hermosa Ball Club Committee presented a plan for improving ball field #1 at the Hermosa Fair Grounds. Travis Bies moved and Mark Hartman seconded a motion to allow the Ball Club Committee to make improvement to ball field #1. Motion carried. Jim Lintz moved to surplus the fencing and materials that would be removed in the renovation on site at auction. Motion died for lack of second. Fire Advisory Board -Dar Coy presented a draft of by-laws for the Fire Advisory Board to the Commissioners. Dar has been appointed as Chairman by the members of the FA Board. Three committees have been formed, a by-law committee, an automatic aid committee and a training committee. Hazard Mitigation Grant -Jim Lintz moved and Mark Hartman seconded to authorize the Chairman to sign a hazard mitigation grant application. Motion carried. Travel Requests -Jim Lintz moved and Dave Hazeltine seconded to approve a travel request from Rick Wheeler to attend the South Dakota Sheriff’s Association Conference from April 22nd thru 24th, 2015 in Deadwood SD with an approximate cost to the county of $240.00. Motion carried.

Meeting Schedule The following upcoming meetings/events were approved by the commissioners for purposes of providing notice to the public as required by law: Executive Session – Indigent and Personnel -Mark Hartman moved and Travis Bies seconded to go in and out of executive session at 10:24 a.m. and adjourned at 11:42 a.m. Dave Hazeltine moved and Jim Lintz seconded to approve an indigent claim for $850.00 for rent assistance. Motion carried. Human Resources/Personnel -The Board acknowledged the following letters: A resignation letter from Deb Davis, Dispatcher effective April 30th, 2015. A resignation letter from Aleta Stender, Deputy Treasurer effective May 20th, 2015. -Dave Hazeltine moved and Jim Lintz seconded to approve the hire of Teresa Cornelison as Director of Equalization effective March 2nd, 2015 with a starting wage of $35,000 per year. Motion carried. Abatement and Refund Requests: -Travis Bies moved and Dave Hazeltine seconded to approve abatement #1065A in the amount of $126.00 on parcel #11992 for Battle Mt Rd Dist. Motion carried -Mark Hartman moved and Dave Hazeltine seconded to approve the following: abatement #1066A in the amount of $268.56, refund #987R in the amount of

2 $278.45, refund #988R in the amount of $297.60 and refund #989R in the amount of $331.78 on parcel #13870. Motion carried. -Dave Hazeltine moved and Jim Lintz seconded to approve abatement #1067A in the amount of $508.87 on parcel #1611. Motion carried. -Mark Hartman moved and Jim Lintz seconded to approve abatement #1068A in the amount of $24.24 for parcel #6785. Motion carried. -Mark Hartman moved and Travis Bies seconded to deny abatement #1069A in the amount of $1,546.54 on parcel #4386. Motion carried. Resolution 2015-3 -Jim Lintz moved and Travis Bies seconded a motion to defer the resolution to set county fees until the March 11th, 2015 meeting. Motion carried. US Department of Interior -A letter from US Dept of Interior proposing to add parcel #6918 to the Wind Cave boundaries. SDPAA Declarations Page -Travis Bies moved and Dave Hazeltine seconded to authorize the Chairman to sign an acceptance page for our SDPAA insurance declaration. Motion carried.
