This cause has come on to be heard before Magistrate Maria Barbosa on XXX, 20__ pursuant to the Plaintiff/Defendant’s Motion XXX. The Magistrate has jurisdiction pursuant to the Florida Rules of Civil Procedure, 1.490, et seq. The Court finds that an Order of Referral for the matters heard by the Magistrate was served upon the parties and that no party made a timely objection to the referral. This Court being otherwise advised, the following Findings of Fact and Conclusions of Law are made:

RECOMMENDED ORDER OF THE MAGISTRATE Based upon the above-stated Findings of Fact and Conclusions of Law, the Magistrate submits the following Recommended Order for the approval of the Court: {Recommended Order or Pronouncement of the Magistrate} (Delete this instruction before submitting)

EXCEPTION PERIOD: Within fifteen (15) days from the date that this Recommended Order is sent to persons set forth below, either party may file an exception to this Recommended Order pursuant to Rule 1.490(h) of the Florida Rules Civil Procedure and the procedures set forth in said Rule. This 15 day period includes a 10 day period allowed for parties to file such exceptions and a 5 day mail period. After 15 days, the Circuit Court will execute an Order Adopting this Recommended Order and said Order shall be final at that time. The Recommended Order is not effective until the Order Adopting has been signed by the Circuit Court Judge. – OR - WAIVER OF EXCEPTIONS: The parties have agreed to waive their right pursuant to Rule 1.490(h) to file Exceptions to this Recommended Order and as such it shall be adopted immediately. This does not constitute a waiver of the parties’ rights to appeal said Order to the appropriate appellate court upon its adoption by the Circuit Court.
