Vermont Division for Historic Preservation Statement of Work for Services Hubbardton Battlefield State Historic Site Historical & Property Survey Documentation Project

1.0. INVITATION

The STATE OF VERMONT, Division for Historic Preservation (DHP) is soliciting proposals from qualified individuals, team, or firm to prepare a historical and property survey documentation project for the Hubbardton Battlefield State Historic Site.

2.0 BACKGROUND

The Hubbardton Battlefield State Historic Site in Hubbardton, Vermont is listed in the National Register of Historic Places and is owned and operated by the Vermont Division for Historic Preservation. The July 7, 1777, battle was the only Revolutionary War battle fought entirely in Vermont and is nationally significant for its role in the Northern Campaign. This successful American rear guard action was the first time British Gen. John Burgoyne met American resistance. The action protected the Northern Department Army under Maj. Gen. Arthur St. Clair after their withdrawal from Fort Ticonderoga, NY, and Mt. Independence, VT, and saved it for the successful Battles of Bennington (August 16) and Saratoga (October), turning points in the American Revolution. The Hubbardton Battlefield currently retains high integrity in all areas. The setting is much as it was the day of the battle. According to Edwin C. Bearss, Historian Emeritus, National Park Service, of all the Revolutionary and Civil War battlefields in the United States the Hubbardton Battlefield is one of the most evocative of the period in which the battle took place. The site is approximately 667 acres, with 413+ acres owned by the DHP and 254+ acres owned by the VT Agency of Natural Resources as the Hubbardton Wildlife Management Area. Buildings on the site include the 1970 visitor center, c.1850 one room schoolhouse, mid 19th century farmhouse, and a reconstructed early 20th century barn. Near the visitor center is the 1859 marble battle monument surrounded by an 1875 cast iron fence. The DHP has received a grant from the National Park Service American Battlefield Protection Program (ABPP) for this project. The DHP is soliciting proposals from qualified individuals, teams or firms to: conduct a historical and property survey documentation project for the Hubbardton Battlefield State Historic Site, as outlined in the scope of work (section 5.0).

3.0 OBJECTIVES

3.1 To conduct a military analysis of the Hubbardton Battlefield State Historic Site, according to guidelines from the National Park Service American Battlefield Protection Program, with accompanying reports and GIS mapping, and to confirm the boundaries of the Hubbardton Battlefield property owned by the State of Vermont and present information in a GIS format, as part of the on-going

Page 1 of 10 systematic documentation of the site for its protection and conservation of critical lands.

4.0 WORK PLAN

4.1 The individual, team, or firm will conduct a military analysis, using National Park Service ABPP guidelines, of the Hubbardton Battlefield and will map the results, using GIS.

4.2 The individual, team, or firm will confirm the property boundaries of the Hubbardton Battlefield land owned by the State of Vermont, produce a boundary survey map, and convert it into a GIS format.

5.0 SCOPE OF WORK

5.1 Complete the Field Survey: Complete a field survey of the Hubbardton Battlefield. This involves gathering primary source material from archives, libraries, and institutes. John Williams, The Battle of Hubbardton: The American Rebels Stem the Tide, (Montpelier, Vt.: Vermont Division for Historic Preservation, 1988, reprinted 2002) and Hartgen Archeological Associates, “Hubbardton Battlefield State Historic Site Cultural Resource Management Plan,” 2001, also will be useful. Perform a GIS survey of the battlefield, using the National Park Service battlefield survey data dictionary (available at http://www.cr.nps.gov/hps/gis/reports/datadict/toc.htm). Correlate the data gathered from the GIS survey with historical descriptions of action during the battle. Conduct a preliminary surface archeological assessment, paying special attention to battlefield boundaries.

5.2 Draft a Technical Report: Produce a draft historical technical overview that summaries the results of the boundary survey, evaluation, and all mapping. Submit GIS data files in shapefile (*.shp) format. For each shapefile submitted, also include Federal Geographic Data Committee (FGDC) compliant metadata. Include copies of all data layers used in the project, including historic or topographic maps, USGS quad maps, or aerial maps. Where applicable, submit all raw, uncorrected GPS data. The draft technical report should also include an assessment of the battlefield’s potential eligibility for National Historic Landmark status under Criteria A, B, and D. Allow for four copies and 60 days for American Battlefield Protection Program approval. Collect background information that will include maps, historic information, current land uses, cultural landscape features, archeological resources, land uses, development trends, threats and other land issues. Describe the historical significance of the battle. Determine the historical significance and battlefield boundaries, and identify natural and cultural resources, including historic and abandoned roads, farmsteads, and house sites. Provide an inventory of all significant cultural resources of the battlefield. In addition identify significant viewsheds to and from the battlefield.

Page 2 of 10 5.3 Produce a boundary survey map: Oversee and develop GIS database work to support the conservation and preservation of the state-owned battlefield lands and lands surrounding the site. Confirm property boundary lines of state-owned land. Capture other information, such as troop positions, artillery positions, troop movements, and points of historic interest, from maps and project research (including battlefield maps maintained by the National Park Service, with the core and study area for these battles available in an approved format) and convert into a GIS format.

5.4 Produce a revised and final report: Produce a revised report and submit four copies to DHP. After review by ABPP, allowing for a 60 day review, prepare final report, addressing ABPP comments. Make four acid-free copies and two digital copies (on CD) of final products and submit for final approval. Provide information to project manager on project accomplishments for VDHP Final Program Performance Report.

5.5 Participate in at least one public program at the Hubbardton Battlefield State Historic Site in 2009, presenting research.

5.6 Project deliverables: Four (4) copies of the first draft historical technical overview and four (4) copies of all revised drafts. Four (4) archival acid-free paper copies of the final historical technical overview. Four (4) digital copies of all the GIS data produced during this report. All GIS data files shall be in shapefile (*.shp) format. Federal Geographic Data Committee compliant metadata shall be submitted for each shapefile. Copies of all data layers used in the project must be included. Where applicable, also submit all raw uncorrected GPS data. Four (4) copies of any brochures, PowerPoint, and/or printed battlefield maps created under this grant project.

6.0 INDIVIDUAL OR FIRM OBLIGATIONS

6.1 Individual, team, or firm reports directly to project manager, Elsa Gilbertson, Regional Historic Site Administrator based at the Chimney Point State Historic Site in Addison, Vermont.

6.2 Job shall be conducted in a neat, orderly and safe fashion with the understanding that the site is open to the public.

6.3 Job site shall be secure at all times.

6.4 Individuals, team, or firms interested in submitting proposals can attend a pre-bid meeting to be held at the Hubbardton Battlefield State Historic Site in Hubbardton, Vermont, on March 19, 2009, at 10:30 am.

Page 3 of 10 6.5 Insurance: Before commencing work on any contract the contractor must provide certificates of insurance to show that the minimum state requirements for coverage outlined in Attachment A – Standard State Contract Provisions.

7.0 INDIVIDUAL OR FIRM QUALIFICATION

7.1 Individual, team, or firm shall have the requisite experience and training in historic preservation, GIS mapping, and property survey to perform the work in the scope of work. The individual or a team member performing or overseeing the historic research, military analysis of the battlefield, and National Historic Landmark assessment must meet the U.S. Secretary of the Interior’s Historic Preservation Professional Qualifications Standards (see http://www.nps.gov/history/local-law/arch_stnds_9.htm) for “historian” and “archeologist.” Experience in battlefield and/or military property analysis, including the ABPP recommended military analysis, is preferred. The individual or team member confirming and mapping the boundaries of the property owned by the State of Vermont must meet the professional qualifications for a property surveyor. The individual or team member performing the GIS survey and preparing the mapping as per the scope of work must demonstrate adequate experience.

7.2 Have own means of transportation.

7.3 Ability to complete the job prior to DECEMBER 30, 2009.

9.0 PROPOSALS

9.1. The following information shall be included in submitted proposals:

9.1.1 A brief description of the firm, team, or individual which includes their history, size, and philosophy on historic property management, military history, research, and analysis.

9.1.2 A list of relevant projects performed by the firm, team or individual in the last five years, including a short narrative describing the project(s).

9.1.3 References from three individuals on your prior contracts.

9.1.4 A list of all team members with their qualifications.

9.2. The cost for undertaking the project will be an hourly rate of firm, team, or individual.

10.0 EVALUATION CRITERIA

10.1 Proposals will be judged by a Review Team on their relative strengths and scored as follows:

11.0 PAYMENT PROVISIONS

11.1 An invoice shall be submitted outlining the work progress and will be submitted every two weeks. The final payment will be paid by the State of Vermont within four weeks of acceptance of a satisfactory job.

12.0 MISCELLANEOUS

12.1. Selection of the Contractor will be on a non-discriminatory basis without regard to race, color, national origin, gender, sexual orientation, or age.

12.2. Proposers shall submit three copies of their proposal and clearly identified as specified in 8.3.

12.2.1. In the event that an addendum is issued, please acknowledge receipt of the addendum on your proposal form.

12.3. The Division for Historic Preservation reserves the right to accept or reject any or all proposals.

12.4. Proposals shall be submitted to the Division for Historic Preservation by 3:00 pm, Friday, April 3, 2009. Proposals shall be mailed to: Vermont Division for Historic Preservation, John P. 12.5. Proposals shall include reference of prior work of this nature.

12.6. The budgeted cost for the project, including fees travel, and supplies: $40,000.00.

STANDARD STATE CONTRACT PROVISIONS

1. Entire Agreement: This contract represents the entire agreement between the parties on the subject matter. All prior agreements, representations, statements, negotiations, and understandings shall have no effect.

2. Applicable Law: This contract will be governed by the laws of the State of Vermont.

3. Appropriations: If this contract extends into more than one fiscal year of the State (July 1 to June 30), and if appropriations are insufficient to support this contract, the State may cancel at the end of the fiscal year, or otherwise upon the expiration of existing appropriation authority.

4. No Employee Benefits For Contractor: The Contractor understands that the State will not provide any individual retirement benefits, group life insurance, group health and dental insurance, vacation or sick leave, workers compensation or other benefits of services available to State employees, nor will the state withhold any state or federal taxes except as required under applicable tax laws, which shall be determined in advance of execution of the contract. The Contractor understands that all tax returns required by the Internal Revenue Code and the State of Vermont, including but not limited to income, withholding, sales and use, and rooms and meals, must be filed by the Contractor, and information as to contract income will be provided by the State of Vermont to the Internal Revenue Service and the Vermont Department of Taxes.

5. Independence, Liability: The Contractor will act in an independent capacity and not as officers or employees of the State.

The Contractor shall defend the State and its officers and employees against all claims or suits arising in whole or in part from any act or omission of the Contractor or of any agent of the Contractor. The State shall notify the Contractor in the event of any such claim or suit, and the Contractor shall immediately retain counsel and otherwise provide a complete defense against the entire claim or suit.

After a final judgment or settlement the Contractor may request recoupment of specific defense costs and may file suit in Washington Superior Court requesting recoupment. The Contractor shall be entitled to recoup costs only upon a showing that such costs were entirely unrelated to the defense of any claim arising from an act or omission of the Contractor.

The Contractor shall indemnify the State and its officers and employees in the event that the State, its officers or employees become legally obligated to pay any damages or losses arising from any act or omission of the Contractor.

Page 7 of 10 6. Insurance: Before commencing work on this contract the Contractor must provide certificates of insurance to show that the following minimum coverages are in effect. It is the responsibility of the Contractor to maintain current certificates of insurance on file with the State through the term of the contract.

 Workers Compensation: With respect to all operations performed, the Contractor shall carry workers’ compensation insurance in accordance with the laws of the State of Vermont.

 General Liability and Property Damage: With respect to all operations performed under the contract, the Contractor shall carry general liability insurance having all major divisions of coverage including, but not limited to:

Premises – Operations Products and Completed Operations Personal Injury Liability Contractual Liability

The policy shall be on an occurrence form and limits shall not be less than:

$1,000,000 Per Occurrence $1,000,000 General Aggregate $1,000,000 Products/Completed Operations Aggregate $ 50,000 Fire/Legal/Liability

Contractor shall name the State of Vermont and its officers and employees as additional insureds for liability arising out of this contract.

 Automotive Liability: The Contractor shall carry automotive liability insurance covering all motor vehicles, including hired and non-owned coverage, used in connection with the contract. Limits of coverage shall not be less than $1,000,000 combined single limit.

Contractor shall name the State of Vermont and its officers and employees as additional insureds for liability arising out of this contract.

No warranty is made that the coverages and limits listed herein are adequate to cover and protect the interests of the Contractor for the Contractor’s operations. These are solely minimums that have been established to protect the interests of the State.

7. Reliance By The State On Representations: All payments by the State under this contract will be made in reliance upon the accuracy of all prior representations by the contractor, including but not limited to bills, invoices, progress reports and other proofs of work.

Records Available For Audit: The Contractor will maintain all books, documents, payroll papers, accounting records and other evidence pertaining to costs incurred under this agreement and make them available at reasonable times during the period of the contract and for three years thereafter for inspection by any authorized representatives of the State or Federal Government. If any litigation, claim, or audit is started before the expiration of the three year period, the records shall be retained until all litigation, claims or audit findings involving the records have been resolved. The State, by any authorized representative, shall have the right at all reasonable times to inspect or otherwise evaluate the work performed or being performed under this contract.

9. Fair Employment Practices And Americans With Disabilities Act: Contractor agrees to comply with the requirement of Title 21 V.S.A. Chapter 5, Subchapter 6, relating to fair employment practices, to the full extent applicable. Contractor shall also ensure, to the full extent required by the Americans with Disabilities Act of 1990, that qualified individuals with disabilities receive equitable access to the services, programs, and activities provided by the contractor under this contract. Contractor further agrees to include this provision in all subcontracts.

10. Set Off: The State may set off any sums which the contractor owes the State against any sums due the Contractor under this contract; provided, however, that any set off of amounts due the State of Vermont as taxes shall be in accordance with the procedures more specifically provided hereinafter.

11. Taxes Due To The State:

 Contractor understands and acknowledges responsibility, if applicable, for compliance with State tax laws, including income tax withholding for employees performing services within the State, payment of use tax on property used within the State, corporate and/or personal income tax on income earned within the State.

 Contractor certifies under the pains and penalties of perjury that, as of the date the contract is signed, the contractor is in good standing with respect to, or in full compliance with, a plan to pay any and all taxes due the State of Vermont.

 Contractor understands that final payment under this contract may be withheld if the Commissioner of Taxes determines that the Contractor is not in good standing with respect to or in full compliance with a plan to pay any and all taxes due to the State of Vermont.

 Contractor also understands the State may set off taxes (and related penalties, interest and fees) due to the State of Vermont, but only if the Contractor has failed to make an appeal within the time allowed by law, or an appeal has been taken and finally determined and the Contractor has no further legal recourse to contest the amounts due.

Page 9 of 10 12. Child Support: (Applicable if the Contractor is a natural person, not a corporation or partnership.) Contractor states that, as of the date the contract is signed, he/she:

 Is not under any obligation to pay child support; or  Is under such an obligation and is in good standing with respect to that obligation; or  Has agreed to a payment plan with the Vermont Office of Child Support Services and is in full compliance with that plan.

Contractor makes this statement with regard to support owed to any and all children residing in Vermont. In addition, if the Contractor is a resident of Vermont, Contractor makes this statement with regard to support owed to any and all children residing in any other state or territory of the United States.

13. Subcontractors: Contractor shall not assign or subcontract the performance of this agreement or any portion thereof to any other contractor without the prior written approval of the State. Contractor also agrees to include all subcontract agreements and a tax certification in accordance with paragraph 11 above.

14. No Gifts Or Gratuities: Contractor shall not give title or possession to any thing of substantial value (including property, currency, travel and/or education programs) to any officer or employee of the State during the term of this contract.

15. Copies: All written reports prepared under this contract will be printed using both sides of the paper.

16. Certification Regarding Debarment: Contractor certifies under pains and penalties of perjury that, as of the date that this contract is signed, neither contractor nor contractor’s principals (officers, directors, owners, or partners) are presently debarred, suspended, proposed for debarment, declared ineligible or excluded from participation in federal programs or programs supported in whole or in part by federal funds.
