The Minister of Health has published an amendment to the above regulations pertaining to the dispensing fee for pharmacists in Government Gazette No 26875 dated 26 September 2013.
1. Definition of “dispense”:
"dispense" in relation to a dispensing fee means the supply of medicines based on a prescription to a patient or someone on behalf of the patient to a health professional authorised by law to supply medicines and includes-
(a) The interpretation and evaluation of the prescription; (b) The selection, reconstitution, dilution, labeling, recording and the actual supply of the medicine; (c) The provision of information and instructions to ensure safe and effective use of a medicine by a patient; and (d) The provision of information on the interchangeable multi-source medicine or scheduled substance available in the market with the lowest single exit price.
2. Definition of dispensing fee
"dispensing fee" means a fee determined in terms of these regulations, exclusive of VAT, that may be charged to dispense a medicine.
3. Amendment to Regulation 10:
The appropriate dispensing fee to be charged by a pharmacist, must:
Where SEP of a medicine or scheduled substance < R81, the dispensing fee shall not exceed R6.30 plus 46% of SEP in respect of that medicine or scheduled substance; Where SEP of a medicine or scheduled substance is ≥ to R81 < R216, the dispensing fee shall not exceed R16.00 plus 33% of SEP in respect of that medicine or scheduled substance; Where SEP of a medicine or scheduled substance is ≥ to R216 < R756, the dispensing fee shall not exceed R55 plus 15 % of SEP in respect of that medicine or scheduled substance; Where SEP of a medicine or scheduled substance is ≥ to R756, the dispensing fee shall not exceed R131 plus 5% of SEP in respect of that medicine or scheduled substance.
The provisions of this regulation 10 must be reviewed annually by the Minister.
