Prior Written Notice Proposed Continuation for Special Education

DATE Mr. DAD SSSS 1234 Butternut Street Syracuse, NY 13209 RE: SSSS Dear Mr. DAD SSSS: DOB: 07/27/1998 ID#: 1234567

The purpose of this notice is to inform you, in writing, of the school district’s recommendation(s) regarding the identification, evaluation, educational placement and/or provision of special education services to your child.

SUBJECT OF THIS NOTICE: The Committee on Special Education recently reviewed your child’s current special education services.

DESCRIPTION OF ACTION PROPOSED OR REFUSED: The Committee on Special Education has recommended that SSSS continue to receive special education services. It is recommended that a positive incentive plan be developed and implemented to address SSSS’s behaviors.

EXPLANATION OF WHY THE ACTION IS PROPOSED OR REFUSED: After careful consideration and review of all evaluative materials and school reports, the Committee has recommended that SSSS continue to be classified as a student with a disability and receive special education services as indicated on the Individualized Education Program (IEP). The Committee determined that SSSSS’s behavior was not a manifestation of his educational disability.

DESCRIPTION OF EACH EVALUATION PROCEDURE, ASSESSMENT, RECORD, OR REPORT USED IN THE DECISION TO PROPOSE OR REFUSE THE ACTION: The Committee considered the reports and evaluations listed under the Evaluations/Reports section of the IEP.

DESCRIPTION OF ANY OTHER OPTIONS CONSIDERED AND THE REASONS WHY THOSE OPTIONS WERE REJECTED: The Committee considered programs and/or services that are less restrictive (more time within the general education setting) but rejected those due to the SSSS’s current functioning levels and skills.

DESCRIPTION OF OTHER FACTORS THAT ARE RELEVANT TO THE PROPOSED OR REFUSED ACTION: There were no other factors relevant at this time.
