The guardian ad litem submits this memorandum in support of the Motion to Release

Private Guardian ad Litem.

Utah Code Annotated § 78A-2-705 (5) provides that “the court shall issue an order terminating the appointment of a private guardian ad litem made under this section if: (a) after receiving input from the private attorney guardian ad litem, the court determines that the minor no longer requires the services of the private attorney guardian ad litem; or (b) there has been no activity in the case for a period of six consecutive months.” In this case, it is appropriate to release the Private Guardian ad Litem at this time for the following reason(s):

(After receiving input from the guardian ad litem, the court should determine that the minor no longer requires the services of the private guardian ad litem. 705(5)(a) provides that under these circumstances, the court “shall issue an order terminating the appointment of a private guardian ad litem” (emphasis added)).

(There has been no activity in the case for a period of six consecutive months, and Utah

Code Annotated § 78A-2-705(5)(b) provides that under these circumstances, the court “shall issue an order terminating the appointment” of the guardian ad litem (emphasis added)).

The case has been dismissed.

For the forgoing reason(s), the guardian ad litem respectfully requests the court to enter an order releasing the guardian ad litem. A proposed order accompanies the Motion and

Memorandum.
