SPENCE MEMORIAL 12 COMMISSION TO DESIGN AND ESTABLISH AN 13 APPROPRIATE MEMORIAL ON THE NORTH PORTICO OF 14 THE STATEHOUSE TO CONGRESSMAN SPENCE AND 15 PROVIDE FOR THE COMMISSION’S MEMBERSHIP, 16 DUTIES, AND RELATED MATTERS. 17 18 Whereas, the late Floyd D. Spence is among the Palmetto State’s 19 greatest statesmen; and 20 21 Whereas, Floyd D. Spence began his career in public service as a 22 member of the South Carolina House of Representatives from 23 1956 through 1962, followed by a term in the South Carolina 24 Senate from 1966 through 1970; and 25 26 Whereas, Representative Spence was elected to the United States 27 House of Representatives in 1970 and served continuously until 28 his death, performing yeoman service as Chairman of the Armed 29 Services Committee, a ranking member on the Committee on 30 Standards of Official Conduct, and a senior member on the 31 Veterans Affairs Committee; and 32 33 Whereas, his career in public service reflected his personal sense 34 of honor, an unshakable integrity, and a commitment to the 35 nation’s armed forces and the men and women who serve in the 36 armed forces; and 37 38 Whereas, all who knew Floyd Spence came to learn that he 39 understood the words duty and loyalty in their larger context and 40 in their nobler adjuration - to listen quietly, to counsel wisely, and 41 to keep confidences; and 42

1 [912] 1 1 Whereas, in a life in midcareer marked by illness, he persevered 2 with his congressional duties and, following a successful double 3 lung transplant, recovered his health and vigor and became one of 4 the country’s foremost and most outspoken promoters of organ 5 donation; and 6 7 Whereas, following an outstanding academic and athletic career at 8 the University of South Carolina, he took his law degree at USC, 9 where among other honors he served as editor of the S.C. Law 10 Quarterly, and in a navy career that began with active service in 11 the Korean Conflict and continued in the Naval Reserve from 12 which he retired with the rank of captain, he developed his lifelong 13 interest in national defense issues that served the nation so well in 14 his devotion to that cause during his congressional service and his 15 special affection for the Navy and those who serve in the Navy, so 16 that, as the old prayer asks “that they may be a safeguard unto the 17 United States of America, and a security for such as pass on the 18 seas upon their lawful occasions”. Now, therefore, 19 20 Be it enacted by the General Assembly of the State of South 21 Carolina: 22 23 SECTION 1. The Floyd D. Spence Memorial Commission is 24 created to design and establish an appropriate memorial to be 25 placed in an existing recessed niche on the north portico of the 26 State House to recognize the accomplishments of the late 27 Honorable Floyd D. Spence, United States Congressman from 28 South Carolina. The commission is empowered and directed to 29 raise private funds, to receive private grants, to receive gifts to 30 carry out the purpose for which it is created, and to designate the 31 location of the memorial; provided, that this memorial must be 32 funded entirely by private funds. By January 15, 2003, the 33 commission shall report the proposed design, location, and 34 dedication date of the memorial to the General Assembly. Upon 35 the dedication of this memorial, the commission shall dissolve. 36 Upon dissolution the State shall ensure proper maintenance of the 37 memorial as is done for other historical memorials on the grounds 38 of the Capitol Complex. 39 The commission shall be comprised of three members of the 40 Senate to be appointed by the President Pro Tempore of the 41 Senate, three members of the House of Representatives to be 42 appointed by the Speaker of the House of Representatives, and 43 three members who may or may not be members of the General

1 [912] 2 1 Assembly to be appointed by the Governor. Notwithstanding 2 Section 8-13-770 of the 1976 Code of Laws or any other provision 3 of law, members of the General Assembly may be appointed to 4 this commission and may serve on the commission. 5 Commission members are not entitled to receive the subsistence, 6 mileage, and per diem otherwise provided by law for members of 7 state boards, committees, and commissions. 8 9 SECTION 2. This joint resolution takes effect upon approval by 10 the Governor. 11 ----XX----
