MINUTES WEST VIRGINIA BOARD OF EDUCATION Capitol Building 7, Capitol Room 1900 Kanawha Boulevard, East Charleston, West Virginia September 10, 2014

I. Call to Order

Following the welcome, Pledge of Allegiance and introductions, President Gayle C. Manchin called the meeting of the West Virginia Board of Education (WVBE) to order at 10:10 a.m. on September 10, 2014, in the Capitol Room, Capitol Building 7, Charleston, West Virginia.

The following members were present: President Manchin, Vice President Michael I. Green, Secretary Tina H. Combs (via telephone), Thomas W. Campbell, Robert W. Dunlevy, Lloyd G. Jackson II, L. Wade Linger Jr., and William M. White, and ex officios Charles K. Heinlein, State Superintendent of Schools, and Paul L. Hill, Chancellor, West Virginia Higher Education Policy Commission. Member absent was ex officio James L. Skidmore, Chancellor, West Virginia Council for Community and Technical College Education.

II. Recognitions

The Board recognized the 2014 WVBE School Service Personnel Employee of the Year Ms. A. Gail Shrewsbury, instructional aide, Spanishburg Elementary (Mercer County), and first runner-up Mr. Kyle Linger, bus operator, Upshur County Schools; the Southern Office of the Council of State Governments' 2014 State Transformation in Action recipient, the WVDE Office of Child Nutrition; and the 2014-2015 National PTA Schools of Excellence: Johnson Elementary (Harrison County) and Lubeck Elementary (Wood County).

III. Delegations

Carolyn Arritt, citizen of Fayette County, addressed the Board regarding a letter she presented to the Board regarding the Fayette County Comprehensive Educational Facilities Plan and requested that the letter be made a part of the record. (Copy appended to Official Minutes, Attachment R.)

IV. CREATE Lab Satellite Network

Ms. Lou Karas, Director, Center for Arts and Education, College of Education, West Liberty University, provided an update from West Virginia's CREATE Lab Satellite Network (Marshall, West Liberty and West Virginia Universities). (Information regarding ASSET's STEM program appended to Official Minutes, Attachment S.)

V. Hancock County Schools Cyber Academy 2 Ms. Suzan Smith, Superintendent of Hancock County Schools, assisted by Adam Howell, Teacher, Oak Glen High School, and Vince McIntosh, Teacher, Weir High School, provided a PowerPoint presentation regarding Hancock County Schools' Cyber Academy. (PowerPoint presentation attached to Official Minutes, Attachment T.)

VI. Approval of Agenda

President Manchin called for a motion to approve the agenda. Mr. Linger moved that the agenda be approved. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously.

VII. Update - WVBE Response to Governor's Education Agenda

Ms. Donna Hoylman Peduto (distributed information), WVBE Director of Operations, members of the Board, and WVDE staff, provided an update (PowerPoint presentation attached) regarding progress toward accomplishing the Governor's education agenda including the key provisions of the Governor's request of the WVBE; Commission on School District Governance and Administration (Mr. Campbell); Project 24 (Mr. Green); require every career center to add at least one career pathway to meet SREB requirements for Preparation for Tomorrow; use RESAs more efficiently for cooperative purchasing and local/regional professional development delivery; teacher certification/teacher preparation; professional development; leadership capacity development; early literacy to support reading on grade level by end of third grade; accountability and accreditation/West Virginia school grading model (screen shots document attached - Dr. Gus Penix, Director, Office of Education Performance Audits and Ms. Michele Blatt, Assistant State Superintendent, Division of Educator Quality and System Support); and, WVBE Re-imagining Instructional Time Committee (Dr. White and Mrs. Combs). VIII. Break

President Manchin called for a break for lunch at 12:18 p.m.

IX. Call to Order

President Manchin called the meeting back to order at 1:15 p.m.

X. Superintendent's Report

Superintendent Heinlein (distributed information) provided a PowerPoint presentation (attached) entitled ACT: The Condition of College and Career Readiness. (Copies appended to Official Minutes, Attachment V.) President Manchin thanked Superintendent Heinlein for his service as State Superintendent of Schools.

XI. Chancellor Report

Chancellor Hill (distributed information) provided information regarding the Pre-service Teacher Conference that was held August 22, 2014, Student Success Summit held July 30-31, 2014, and a Statewide Technology Conference for higher education to be held the end of October. Chancellor Hill also provided an update regarding HEPC staff changes and the 3 submission of a GEARUP grant to the United States Department of Education. XII. RESA Liaison Report

Ms. Jane Lynch, Executive Director of RESA 8 and WVBE RESA Liaison, provided a report regarding a number RESA meetings and initiatives.

XIII. WVBE Coordinator of Board Agencies Report

Mr. Jason L. Butcher, WVBE Coordinator of Board Agencies, provided a report regarding his work with WVBE agencies highlighting his work with the West Virginia Schools for the Deaf and the Blind and institutional education programs.

XIV. Capacity Building for Priority Schools and Intervention Counties

Ms. Blatt provided information regarding support services provided to priority schools and county districts. Dr. Serena Starcher-Martin, Superintendent of Fayette County Schools, provided a status report regarding the process for the development of the amended Fayette County Comprehensive Educational Facilities Plan and reported a targeted completion date of September 25, 2014. Mr. Ted Mattern, System Support Liaison, Office of the State Superintendent, provided information regarding support services provided to intervention counties Grant, Logan, Mingo, and Gilmer. Following the capacity building updates, Superintendent Heinlein requested an executive session relating to his earlier report and previously provided capacity building reports, citing the statutory exceptions as W. Va. Code §6-9A-4(b)(2)(A), personnel exception, and W. Va. Code §6-9A-4(b)(9), to consider matters related to the purchase of property and advance construction planning and matters involving commercial competition.

Mr. Linger moved, and Dr. White seconded, that the Board enter into executive session. The Board moved into executive session at 2:18 p.m. Chancellor Hill departed the meeting.

XV. Return from Executive Session

The Board returned from executive session at 3:42 p.m. at which time President Manchin announced that no action was taken or decisions were made.

XVI. Consent Agenda

Mr. Dunlevy moved that the Consent Agenda be approved. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously. (Copies appended to Official Minutes, Attachments B through K.)

 Received information regarding WVDE Personnel Matters (Attachment C) 4  Approved two first time requests and one request for continuation of waiver of WVBE policy (Attachment D)

 Notification, per W. Va. Code §18A-4-7a(l)(3), Transfer of Person Employed in a Professional Position after the Twentieth Day Prior to the Beginning of the Instructional Term, from Harrison, Monroe, Raleigh, and Randolph County Schools (Attachment E)

 Approved the closure of Suncrest Primary School, Monongalia County (Attachment F)

 Approved Policy 2520.1A, Next Generation Content Standards and Objectives for English Language Arts in West Virginia Schools (Attachments G-1 and G-2)

 Approved Policy 2520.2, 21st Century Mathematics Content Standards and Objectives in West Virginia Schools (Attachment H)

 Approved Policy 2520.2B, Next Generation Alternate Academic Achievement Standards for Mathematics in West Virginia Schools (Attachments I-1 and I-2)

 Appointed Mrs. Erin Sponaugle, Tomahawk Intermediate School (Berkeley County Schools), Mrs. Kimberly Cook, Mt. Nebo Elementary School (Nicholas County Schools), Mr. Justin Whitford, Braxton County High School (Braxton County Schools), Mrs. Mary Sue Burns, Pocahontas County High School (Pocahontas County Schools), and Ms. MaryJane Albin, Superintendent, Wirt County Schools to the West Virginia Commission for Professional Teaching Standards to serve no more than two consecutive three-year terms (Attachment K).

President Manchin asked Dr. Penix if he would be agreeable to moving his items to be taken up later in the agenda. Upon Dr. Penix's agreement, and with the consensus of the Board, President Manchin moved all OEPA items to be taken up later in the agenda.

XVII. West Virginia Schools for the Deaf and the Blind (WVSDB) Proposal for 3% Funds

Dr. Lynn Boyer, Superintendent of the WVSDB, presented the WVSDB proposal for 3% funds for the Board's consideration. The WVSDB continues to require funds in excess of its appropriations to address maintenance of selected facilities including replacement of major systems. The current proposal documents for the SBA the need for roof and HVAC repairs and renovations to the School for the Deaf/Secondary and the request for assistance from its 3% funding. The WVSDB is eligible to apply for these funds because of its regional and statewide education function.

Dr. White moved that the submission to the SBA of the WVSDB's proposal for 3% funding to support roof and HVAC repairs and renovations to the School for the Deaf/Secondary be approved. Mr. Jackson seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment L.) 5

XVIII. Recess

President Manchin recessed the meeting at 3:57 p.m. and announced that the meeting would reconvene on September 11 at 9:00 a.m. in the same location.

XIX. Reconvene

President Manchin reconvened the meeting of September 10, 2014, at 9:07 a.m. on September 11, 2014, in the Capitol Room, Capitol Building 7, Charleston, West Virginia. The Board observed a moment of silence on this the thirteenth anniversary of events that occurred on September 11, 2001.

The following members were present: President Manchin, Vice President Michael I. Green, Secretary Tina H. Combs (via telephone), Thomas W. Campbell, Robert W. Dunlevy, Lloyd G. Jackson II, L. Wade Linger Jr., and William M. White, and ex officio Charles K. Heinlein, State Superintendent of Schools. Members absent were ex officios Paul L. Hill, Chancellor, West Virginia Higher Education Policy Commission, and James L. Skidmore, Chancellor, West Virginia Council for Community and Technical College Education.

XX. Report of the WVBE Commission on School District Governance and Administration

Mr. Campbell provided information regarding individuals serving on the commission and introduced those in attendance: Sallie Dalton, Doug Lambert, Karen Price and Newt Thomas. Mr. Campbell also introduced with Dr. Howard O'Cull who provided assistance throughout the reporting process and Dr. Thomas L. Alsbury, Professor of Education Leadership, Seattle Pacific University, who served as consultant to the commission and crafted the commission's report. Dr. Alsbury provided historical and current trends regarding governance models for the Board's consideration and recommended that the report be moved forward in order to begin the implementation phase. Mr. Campbell indicated that the commission members in attendance will inform all commission members of today's discussion for consideration at the next commission meeting.

XXI. Office of Education Performance Audits (OEPA) Director’s Information

Dr. Penix provided brief remarks regarding OEPA initiatives including completion of the training team leaders and team members to perform audits and training has been completed in the eight RESAs on the new grading system and monitoring tool. Dr. Penix distributed and provided brief remarks regarding the Orientation Packet - Promoting Excellence in Each WV School. (Copy appended to Official Minutes, Attachment X.)

XXII. Selection of Schools and County School Systems for Education Performance Audits

President Manchin, as provided in W. Va. Code §18-2E-5(k)(1) “Any discussion by the state board of schools to be subject to an on-site review or dates for which on-site reviews will be conducted, called for a motion to enter into executive session. Dr. White moved, as provided in 6 W. Va. Code §18-2E-5(k)(1), that the Board move into executive session. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously. The Board entered into executive session at 10:26 a.m.

XXIII. Return from Executive Session

The Board returned from executive session at 11:02 a.m. at which time President Manchin announced that no action was taken or decisions were made.

XXIV. Approval of Local Board of Education Policies for Dual Credit

Ms. Betty Jo Jordan, Executive Assistant to the State Superintendent, presented local board of education policies for dual credit for the Board's consideration. Policy 2510, at section 5.4.f.1.C., states “County boards of education shall adopt policies that allow students to earn credit for completion of college courses and other advanced courses outside the school setting. If these courses, including dual credit courses, are used to meet graduation requirements, the county policy must be reviewed by the WVDE and approved by the WVBE.” Thirty-two counties submitted local policies and required documents for dual credit courses. The policies and course documents have been reviewed by WVDE staff to ensure alignment with appropriate Next Generation content standards. Mr. Dunlevy moved that dual credit policies for Berkeley, Boone, Cabell, Gilmer, Greenbrier, Hancock, Hardy, Harrison, Jackson, Jefferson, Kanawha, Lewis, Lincoln, Logan, Mason, Marshall, McDowell, Mineral, Mingo, Nicholas, Ohio, Pleasants, Pocahontas, Preston, Putnam, Raleigh, Randolph, Ritchie, Tyler, Wayne, Wetzel, and Wood counties be approved. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously.

XXV. Policy 2340, West Virginia Measures of Academic Progress Program

Mr. Clayton Burch, Interim Associate State Superintendent, Division of Teaching and Learning, introduced Dr. Beth Cipoletti, Assistant Director, WVDE Office of Assessment and Accountability, who presented Policy 2340 for the Board's consideration. Proposed changes to Policy 2340 include secure materials and test procedure requirements for district technology coordinators and RESA/district/school technology specialists; expanding training requirements for personnel providing technology services, and technical assistance. Changes will also reflect current naming conventions and include additional requirements to protect the security of student data. The assessments under the auspices of the Office of Assessment will be implemented and administered with greater fidelity and thus will have greater validity and reliability. The test scores will be a more accurate measure of student achievement and performance.

Mr. Green moved that the suggested revisions to Policy 2340 be placed on public comment for a period of 30 days. Dr. White seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment M.) 7

XXVI. Policy 4110, Attendance

Ms. Blatt presented Policy 4110 for the Board's consideration. Revisions to Policy 4110 are proposed to enforce compulsory school attendance county-to-county as required by HB 4003 (W. Va. Code §18-8-2). The revisions will enable attendance directors and/or assistants to pursue truancy charges across county lines. Moving from county-to-county will no longer be a method to escape truancy charges.

Mr. Dunlevy moved that the suggested revisions to Policy 4110 be placed on public comment for a period of 30 days. Mr. Jackson seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment Mc.)

XXVII. School Counseling Update

Mr. Burch provided the following school counseling informational update: 1) Addressing Mental Health in School Crisis Prevention and Response: A Resource Guide for West Virginia Schools - Effective 7-1-2014, WVBE Policy 2315 requires school counselors to establish School Crisis Planning and Response Teams and develop school crisis plans addressing mental health considerations. WVDE partnered with DHHR and several community agencies to develop a guide to support schools in developing their plans for crisis prevention, response and recovery. This guide provides action steps, resources and templates to support development of each phase of the crisis planning to ensure all schools implement evidence-based practices when developing their mental health crisis plans. The guide is aimed at ensuring schools make sincere efforts to implement a prevention-based approach to school crisis and in protecting student emotional safety during each crisis phase. (Copy appended to Official Minutes, Attachment N.); and 2) Addition of Prevention and Mental Health Considerations to the School Crisis Template - According to Policy 4373, the state is required to annually update the School Crisis template and, effective July 1, 2014, WVBE Policy 2315 requires school counselors to establish School Crisis Planning and Response Teams to develop school crisis plans addressing mental health considerations. The school crisis template has been updated to include prevention and mental health considerations. (Copy appended to Official Minutes, Attachment O.)

XXVIII. WVBE Personnel Matters Executive Session

President Manchin indicated that an executive session had been requested by Ms. Lynch. Dr. White moved that the Board enter into executive session. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously. Mr. Jackson requested the motion be amended to show that the Board entered into executive session as provided in W. Va. Code §6-9A-4(b)(2)(A) [personnel exception]. Mr. Campbell and Dr. White agreed to the amendment. The Board entered into executive session at 11:26 a.m.

XXIX. Return from Executive Session

The Board returned from executive session at 12:18 p.m. at which time President Manchin announced that no action was taken or decisions were made. 8

President Manchin called for a motion to approve the Board's personnel attachment. Mr. Dunlevy moved, and Dr. White seconded, that the Board's personnel attachment be approved. Upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment P.)

XXX. Items for Future Consideration

President Manchin reminded the assembly of the swearing in ceremony for the State Superintendent of Schools will take place on September 15. Dr. White (distributed information) provided information regarding his participation in a Student Data Quality meeting earlier this month and request Dr. Carla Howe be invited to provide a presentation at the October meeting. Mr. Campbell will provide follow-up regarding the commission's report at the October meeting. Future agenda items are to be provided to President Manchin and Ms. Peduto as soon as possible. XXXI. Future Meetings

The WVBE will meet with the State Superintendent of Schools on September 22, 2014, in Charleston, West Virginia. The next regular meeting of the WVBE will be held October 8, 2014, in Charleston, West Virginia. The meeting will continue on October 9, 2014, if the agenda is not completed on October 8, 2014.

XXXII. Adjournment

Dr. White moved that the meeting be adjourned. Mr. Campbell seconded the motion and upon the call for the question the motion was carried unanimously. The meeting was adjourned at 12:30 p.m.
