2. As someone that uses guitar pickups frequently, I regularly buy guitar pickups made by DiMarzio, Inc. or other companies.

3. I have purchased or am otherwise familiar with, DiMarzio’s cream colored humbucker pickups, such as those shown at right.

4. I regard the color cream, as applied to those pickups, to be necessary to achieve my desired aesthetic in instances where I desire my guitar components to match in color.

5. I understand that DiMarzio has the exclusive right to sell cream-colored humbucker pickups due its trademark registration, US Reg. No. 1169205, for the color cream as applied to guitar pickups (the “DiMarzio Registration”).
