DUNBARTON BOARD OF SELECTMEN MINUTES OF MEETING THURSDAY, FEBRUARY 24, 2011 TOWN OFFICES – 7:00 P.M.

The Dunbarton Board of Selectmen held their regularly scheduled meeting at the above time, date and place with Les Hammond, Chairman, presiding.

The following were present:

DEPARTMENTS:

Fred Dion - Joint Meeting with Planning Board and Board of Selectmen:

Les Hammond, Chairman, reported that he had met with Ken Swayze, Chairman, Planning Board, and Fred Dion recently regarding a driveway off a Class VI Road. It was agreed that the Planning Board and the Board of Selectmen will have a Joint Meeting with Fred Dion regarding the use of Everett Road Extension (Class VI) to access a garage/barn Fred would like to build. The Joint Meeting is scheduled for Wednesday, March 16, 2011 at 7:00 p.m.

He stated that the Planning Board is the Board which gives permission for the Driveway Permit, and they would then refer it to the Board of Selectmen. In talking with Mr. Dion, he would have to get Wetlands Permits to cross his property from Tucker Hill Road. It would be better for him if he were able to utilize Everett Road Extension and expend up to $1,500 on a culvert, etc. which would be considerably less than the cost of the Wetlands Permit. Les Hammond stated he could not speak for the rest of the Board but this was his feeling on the matter.

There presently is already a bar gap at the place where Mr. Dion would be entering the proposed garage off Everett Road Extension. There are various pieces of equipment already on Mr. Dion's property, including a boat, tractor, etc.

Ron Wanner asked if we are making him pay the Town to fix the culvert and they are presently running logging trucks over the culvert, what happens when the culvert fails when he is only running a pickup truck over it? If he gives the Town $1,500, how are we going to fix it because it is on a Class VI road and the Town is not allowed to spend money on a Class VI road?

It was noted that this had been considered by Ken Swayze and noted there would be a way to do it because the money ($1,500) would not be town monies, etc. It would be similar to an Exaction Fee. 2

Les Hammond did state that this is a Public Access and we should assume we can fix the culvert. The Town also owned Conservation land down Everett Road Extension. In addition, the Zellers own two or three lots down on Everett Road Extension which at this point are not developed.

Jeff Crosby, Road Agent, noted that if the Town fixes it, it becomes an issue for the Town. Jeff stated he would recommend that we put in a concrete culvert at least 18" to 24" as required. Some trees would have to be cut. It is more work than just digging a trench and putting in a culvert.

Les Hammond noted that Mr. Dion can go down the first 300 feet on Everett Road Extension according to our procedures.

Federal Gasoline and Diesel Taxes - Burke Oil Company:

Les Hammond stated he would like to check with someone other than the oil company which supplies the fuel, with regard to whether or not the Town is exempt from Federal Taxes on fuel. It was noted that Burke Oil was called and they stated that municipalities were not exempt from the Federal Taxes as listed on their invoice which were environmental taxes, etc.

Les Hammond asked Line Comeau, Town Administrator, to call the State and find out an answer.

Town Hall Restoration Committee:

Les Hammond stated he had met with the Town Hall Restoration Committee last night, Wednesday, February 23, 2011. They had someone from the New Hampshire Preservation Alliance present to answer questions regarding what can be done to the building. It was noted that they can do anything they want to the building including tearing it down.

In addition, they will be pursuing obtaining a 501:C, 3 status as a Non-Profit.

Barbara McCann, Building Department, Job Description:

Les Hammond stated that this coming week, he would like to sit down with Barbara McCann, Building Department, and review her Job Description.

Road Postings:

Jeff Crosby, Road Agent, brought up the fact that he will be posting Town Roads in the near future. Mentioned a previous problem on Putney Road with Bow's Trash Pickup (Pinard Waste) turning around on Putney Road and causing an issue with the road last year. Didn't want to deal with this again this year, suggested posting the roads and then having the Selectmen follow up with a letter to Pinard Waste, etc.

It was noted that he was told that trash trucks are exempt from road postings, etc.

Selectmen reached an agreement that they would prefer not to do anything at this point.

Jeff will tell them verbally that roads are posted. The tonnage limit is 12 tons.

Stark Bridge:

Les Hammond brought up Stark Bridge and stated that he heard recently from another person that they would like to see it open again for travel. 3

Jeff Crosby, Road Agent, and Ron Wanner, Selectman, will make an appointment to meet with Nancy Mayfield, DOT, regarding any suggestions as to what can be done with regard to repairs for the bridge. Ron Wanner noted that she will probably let us know about DOT funds which will require Matching Funds, etc. Les Hammond noted that we were looking for help from them for engineering.

Dunbarton Country Stores:

Les Hammond stated that he had finally stopped at the Dunbarton Country Store at the bottom on the hill to find out any information about when and if they will be open. The Gas Company which presently owns both stores has the one with gasoline open for business. In addition, the owner (Gas Company) of Pages Country Store is in the process of interviewing applicants for leasing of the store.

Town Report Dedication:

The Town Report has been received and will be mailed out on Monday, February 28, 2011. The Selectmen will present the first copy to the person whom it is dedicated to prior to receipt by residents.

Pakistan Representatives - Town Meeting:

It was noted that Pakistan will have twelve representatives present at Town Meeting this year.

Appointments:

Linda Peters, Town Clerk, presented the following residents for appointments:

Susan Johonnett - Alternate Ballot Clerk Daniel VanKalken - John Stark Scenic Byway Committee

The Selectmen signed the Appointment Paperwork for both.

Linda Peters, Town Clerk re Town Meeting:

Refrigerator-Community Center:

Linda Peters, Town Clerk, reported that Fred Mullen has been preparing for Town Meeting. It has just come to our attention that the refrigerator at the Community Center which is used for food for Town Meeting is not working. Pat Lackner, who Linda Peters has contracted with for the food for Town Meeting uses this refrigerator for storage of food for the workers, etc. at Town Meeting. Noted that she has contracted with Pat Lackner for a price of $175.00 for the food setup for the day of Town Meeting.

Selectmen suggested checking with Rene Ouellet, Selectmen's representative from the School Board, to see if the refrigerator can be repaired or replaced.

Stage Area - Community Center:

Linda Peters, Town Clerk, noted that Patrick Bowne has been speaking with the Janitor at the Community Center regarding Election and Town Meeting setup. There is a stage that will be set up during the time Town Meeting is scheduled. Patrick Bowne told him that the stage cannot be set up during Town Meeting. It will have to be taken down.

Fred Mullen, Moderator, will speak to the Janitor at the school regarding making sure the stage it taken down. 4

Revised Welfare Application:

Line Comeau, Town Administrator, presented a revised Welfare Application from the Welfare Director for Selectmen to review and approve.

Selectmen will review this week and vote on Revised Welfare Application at next Selectmen's Meeting.

MOTION:

Charles Graybill made a motion to adjourn the Dunbarton Board of Selectmen's meeting at 8:00 p.m. Ron Wanner seconded the motion. The motion passed unanimously.
