(version 2) Sec. 223. Section 641 of the Tariff Act of 1930, as amended (19 U.S.C. 1641), is further amended by

(a) repealing subsection (a)(3) and inserting a new subsection (a)(3) to read as follows:

"(a)(3) The term "Commissioner" means the Commissioner of the Bureau of Customs and Border Protection."

(b) replacing "Secretary" with "Commissioner" wherever it appears;

(c) inserting in subsection (d)(2)(B), after the first sentence, the following sentence:

"In the case of willfulness or where public health, interest or safety requires, the suspension of a license or permit may be effective immediately upon service of such notice."

(d) replace "Customs Service" with "Customs and Border Protection" wherever it appears; and

(e) repealing subsection (g) and re-labeling current subsection (h) as new subsection (g);
