Lease Provisions: 1. EKU agrees to lease Gardeners one 10x10 plot of land on a first-come, first-served basis for an annual fee of $20. If a Gardener desires another plot of land, they must request it from the Healthy You office, and will incur another $20 fee assignment of subsequent plot(s). Gardeners understand that if assigned a second plot it may not necessarily be directly next to the existing plot. They understand that placing a request for a second plot does not necessarily guarantee the assignment of one.
2. Gardeners understand that they will not get a refund or reimbursement for their expenses, or any other payment if they decide not to garden, or if EKU terminates their right to garden. The right to garden is exclusive and does not include friends and extended family.
3. No transfers. Gardeners may not allow anyone other than their immediate family (spouse, sponsored dependent, children) garden without the express written consent of the contacts listed below.
4. In consideration of being permitted to participate in the EKU Community Garden: I, on behalf of myself and anyone claiming interest through me, DO HEARBY INTENTIONALLY, KNOWLINLY, AND VOLUNTARILY RELESASE, WAIVE, DISCHARGE, INDEMNIFY, AND AGREE TO HOLD HARMLESS EASTERN KENTUCKY UNIVERSITY, and all its employees, regents, and volunteers FROM ANY AND ALL CLAIMS, ACTIONS, SUITS, PROCEDURES, COSTS, EXPENSES, DAMAGES, AND LIABILITIES brought as a result of my involvement in this event, whether such damage, injury, or loss results from NEGLIGENCE or some other cause, and to reimburse them for any such expenses incurred.
5. Gardeners agree to allow EKU to use any photographs, interviews, videotapes, film, other visual or auditory recordings, or any other medium, including the internet, of them or their guests that EKU or others may create in connection with them or their guests’ participation in the garden. Gardeners agree that they do not have to inspect or approve the finished project and they are not entitled to any compensation for the finished product.
6. Gardeners may plant vegetables, fruits and flowers. There is no height restriction. However, crops grown in one gardener’s plot may not cast a diurnal shadow on a neighboring plot.
7. Gardeners are solely responsible for the planting and management of their own plot(s), including providing their own seeds, plants, and any tools not provided by EKU.
8. Gardeners may not keep any personal property on their plots or in the garden when they are not in the garden.
9. EKU has complete authority to interpret the rules and make decisions.
10. The garden is for personal, noncommercial use only. Gardeners may not sell any produce or flowers grown in the garden. 11. Gardening Do’s and Don’ts
1. The garden is open and accessible 24 hours a day. Gardeners may be in the garden at their own risk during any of these hours. Parking is accessible within the adjacent parking lot.
2. Gardeners may bring their own tools into the garden to use in their own plot(s). Gardeners are responsible for any damage caused by tools they bring into the garden and so should use them with care.
3. Gardeners are responsible for watering their own plot(s). They must not overwater their plants or leave a hose unattended. Gardeners must follow land use and water rules, and must not use fertilizers, insecticides, or weed repellants that will in any way affect other plots.
4. Gardeners must keep their crops inside their plot(s), and keep the areas immediately surrounding their plot weeded and tended. Gardeners should understand that if their plot(s) become unkempt they will be given notice by email to clean it up. If not cleaned up within two weeks, the plot may be reassigned or tilled in.
5. Gardeners cannot use drugs or alcohol while on garden premises. They should report any suspicious behavior to one of the contacts listed below or local law enforcement or EKU Police.
6. Gardeners may volunteer their time to the community garden, beyond time spent working on their personal plot, by participating in one or more of the following: opening day, spotlight events, work on a committee and/or arrange other activities benefiting the garden as a whole.
7. If a Gardener must abandon their plot for any reason, it is their responsibility to notify the Healthy You office.
8. Gardeners cannot bring pets to the garden. Gardeners must supervise children in the garden.
9. Gardeners must properly dispose of weeds, plant materials, and garbage in designated compost and garbage areas.
10. Perennials must be planted in designated areas only.
11. Gardeners are permitted to harvest only from their assigned plot(s) unless given permission by another gardener to do otherwise.
