Can’t say it has been easy for Brendan or his family over the last Eight years with the wrongful conviction still hanging over him, the miscarriage of justice organisation have with the help of his legal team forwarded a submission to the Scottish cases criminal review commission in the hope of having his conviction sent back for appeal.
Business cards and flyers will shortly go to Galston again in the hope of identifying the man with the tattoo on the right hand side of his neck who was in Mrs Irvine’s garden that morning with another man picked out of police mug shots and an identification parade at Kilmarnock police station. Non disclosure of witness statements and evidence never heard in court is abound in the case and the public need to know the true story.
Brendan and his co accused were convicted on circumstantial hearsay evidence from registered drug addicts who all has court pending with charges that were dealt with lenient after the conviction of both men!
This year will be the tenth anniversary of the death of Margaret Irvine in Galston. This is a plea from Brendan Dixon and his co-accused, Patrick Docherty. Both men were convicted on March 1, 2005. Both men continue to protest their innocence of this crime. Margaret Irvine, was found dead in her home on September 28, 2003. Brendan has applied to the Scottish Cases Criminal Review Commission in the hope that they will send his case back to the appeal court.
On the day Mrs Irvine died, Barward road was a hive of activity including a man with a tattoo on his neck standing in the garden of the deceased. A near neighbour of Mrs Irvine stated in court that no one visited them that morning. But that was lies told in court by this witness!
Since the trial there is an outline around the death and Mojo Scotland hope by including Brendan’s business card will help further towards helping both men clear their name.
There is no evidence in this case against the men convicted of the murder only hearsay from unreliable sources outside Galston. Many of them registered drug addicts and also, many of these people have been given get out of jail free cards by Strathclyde police. Ask what is done in your name as no justice has been affronted to Margaret Irvine only the sad sight of miscarriage of justice for the men convicted in court of a crime that neither committed. It would be appreciated if the Galston community could think back nearly ten years and help identify the person with the cross tattoo on the right side of his neck spotted in the garden of Mrs Irvine’s garden that morning.
The men and their families hope that one day a true light will shine on this injustice and truth will come to play, No justice, no peace, no peace, no justice!
