Terms of Reference for a Special Service Agreement- Institutional Contract

Position Title: Supporting the development of the national violence against children and youth survey (VACYS) report and action plan

1. Background and Purpose

In 2009 the 5th Children’s Summit organized by the Ministry of Gender and Family Promotion called for a national study on violence against children. This provided the impetus for the violence against children and youth survey (VACYS) in Rwanda.

The Ministry of Health/Rwanda Biomedical Centre have been leading the VACYS, in collaboration with the Ministry of Gender and Family Promotion (MIGEPROF), the National Commission for Children (NCC), the Ministry of Education (MoE), the National Institute of Statistics in Rwanda (NISR), Rwanda National Police (RNP), The National Council of Persons with Disabilities (NCPD), the United Nations Children’s Fund (UNICEF) and the United States Centers for Disease Control (CDC).

With initial funding from the International Development Research Center (IDRC), the VACYS was carried out from 2013 to 2015 with the preparatory phases including the development of protocols, application for visa and study clearance, and data collection to determine the magnitude of violence against children and youth and to study the epidemiological patterns of risk factors for violence that will allow for development of more targeted and informed prevention and response programs. Protocols and questionnaires developed by CDC and used in other countries carrying out the VAC surveys were adapted to the Rwandan context. In addition, the youth up to the age of 24 years were included in the survey.

The survey had a number of objectives including:  Estimate the national prevalence of violence against 13-24 year old females and males in Rwanda;  Identify potential risk and protective factors for violence against children and youth;  Identify the health and social consequences associated with the impact of violence on males and females;

1  Assess knowledge and utilization of medical, psychosocial, legal, and protective services available for children and youth who have experienced violence;  Identify further areas of research needed;  Make recommendations to relevant ministries in Rwanda, UN agencies and international and national non-government organizations on developing, improving and enhancing prevention and response strategies to address violence against children and youth as part of a larger, multi-sectoral approach to child protection.

The survey collected data on three types of violence: physical, emotional and sexual. In addition to the main household survey, an exploratory, qualitative study into the lived experiences of violence against children and youth with disabilities in institutions and day care centers was also conducted as part of the VACYS. This study is the first of its kind in Rwanda and will provide critical insights into the challenges facing female and male children and youth with disabilities. This smaller-scale study aimed to:  Explore the context in which physical, Sexual and emotional and violence and neglect occurs against children and youth with disabilities in institutions;  Identify the perpetrators of physical, sexual and emotional violence and the conditions under which violence occurs;  Describe the role of the institution and caregivers in the context of physical, sexual and emotional violence against children and youth with disabilities in institutions;  Identify risk and protective factors contributing to violence against children and youth with disabilities both in institutional care and in the community.

Progress to date

 The household survey on violence against children and youth has been completed and data has been analyzed. The results in the form of a first draft of a report will be available in March 2017.  The data collection for the smaller qualitative study on children and youth with disabilities in institutional care has been completed and all findings have been transcribed and translated into English but the data has not yet been analyzed.

Follow up on the VACYS:

The information collected from the VACYS is intended to inform a comprehensive, national multi-sector policy and programmatic response to the issue of violence against boys and girls. The recommendations should include and build upon existing programs and platforms, rather than establish parallel structures. The developed VACYS report and action plan will be launched in Rwanda in September 2017 tentatively.

Existing coordinating structures:

The Ministry of Health/Rwanda Biomedical Center has set up a multi-sectoral steering committee made up of different government sectors, civil society and development partners. The role of this committee has been critical in the review of all protocols in the survey and in the data collection and analysis and validation process of the findings.

2 This committee will also be instrumental in coordinating the data analysis for the qualitative study on children and youth with disabilities, and coordinating the writing of the overall VACYS report. The committee is expected to take a lead in launching the survey report, developing a dissemination plan and leading the programmatic and policy actions and developing a multi-year national response plan.

2. Justification

Given the multiple tasks envisaged under the TOR, the volume of work and the required technical expertise in a specialised area, the tasks are beyond the current capacity of UNICEF Rwanda’s in-house personnel. The sensitivity of the analysis and the subject matter, as well as the importance of the work envisaged under the TOR has made it necessary to advertise the ToR through a request for proposal (RFP) to attract the best possible institution globally.

3. Objectives

This consultancy has the following main objectives: 1. Analyze existing qualitative data on the lived experiences of violence against children and youth with disabilities in institutions. 2. Write the final comprehensive report on the VACYS which incorporates the quantitative and the qualitative data analysis. The report should be succinct and easily understood by policy and programme stakeholders who may or may not have prior knowledge of violence against children and youth. 3. Support the dissemination of the results and the response planning through a data to action workshop and key stakeholders’ consultations, including at district level. 4. Develop a multi-sectoral action plan to respond to the findings of the VACYS.

4. Major Tasks, Deliverables & Timeframe

Under direct supervision of UNICEF Rwanda and RBC (Rwanda Biomedical Center) and with close guidance from the VACYS steering committee led by MoH/RBC, the institution is expected to carry out the following tasks:

Preparatory activities:  Meet with stakeholders led by the Rwanda Ministry of Health and Rwanda Biomedical Center to receive an initial orientation on the VACYS and to confirm expectations for the tasks;  Review the ToR’s and develop an inception report with a detailed methodology and timeline to carry out the assignment;  Ensure validation by key stakeholder group of the inception report;

Deliverables:  Inception report.

3 Task 1: Analysis of the qualitative data

In 2015-2016 a qualitative study was carried out on the lived experiences of violence against children and youth with disabilities in institutions and day care centers. The intention was to complement the household survey with critical information on a population that is vulnerable and hard to reach. Sixteen facilities were covered as part of this study.

The methodology used included key informant interviews with 16 administrators from institutions, in-depth interviews with 46 children and youth and focus group discussions with a group of children, interviews with administrators of institutions and 4 focus group discussions with caregivers in institutions. Interviews were audio-recorded and have been transcribed.

Data collection was conducted in March 2016 and the data has now been fully transcribed and translated from Kinyarwanda to English.

Key activities:  Compile, organize and review all the qualitative data collected;  Draft a framework for the analysis of the qualitative data;  Analyze the data with a view of describing the context in which physical, sexual and emotional/psychological violence and neglect occurs against children and youth with disabilities. In particular, describe: o The role the institution and caregivers might play in the context of violence; o The different types of perpetrators of violence; o The risk and protective factors of violence; o Provide a set of recommendation in support of strengthening programme and policies for children with disabilities.  In consultation with the steering committee, draft and finalize a report on the lived experiences of children and youth with disabilities in care settings. The findings will also feed into the main VACYS report.  Develop a power point visual presentation on the key findings ( including graphs/bar charts and pie charts)

Key deliverables:  Final report of the qualitative data specifically looking at violence experienced by children and youth with disabilities in care. The report should be succinct and easily understood by stakeholders without prior knowledge of children with disabilities.  Power point presentation of key findings from the qualitative assessment.

Task 2: Compilation and dissemination of the final comprehensive VACYS report

The final draft of the analysis of the household survey will be available in May 2017. This will have included cleaning, validation and analysis of all data. The draft report will include a number of tables depicting the results of the survey. The role of the selected institution will be to draft a final report and accompanying materials based on the data, in consultation with the steering committee. The compilation of the final report needs to include a review of the

4 quantitative survey draft report and elaborate with the necessary narrative that describes the analysis of the results.

The main aim of the report is to present the results and analysis of the VACYS in a comprehensible and organized manner that is easily digestible to stakeholders and policy makers with or without prior knowledge, programmatic or policy experience of the situation of violence against children and youth in Rwanda.

Key activities:  Gather and review all existing and relevant documentation related to the VACYS in Rwanda, including the qualitative research on children and youth with disabilities;  Produce a first draft of the VACYS report that includes both the quantitative and qualitative components of the survey;  Incorporate feedback into the draft report and submit to the Ministry of Health/Rwanda Biomedical Center and key stakeholders for approval.  The draft report is to link findings of the report with recommendations to feed the action plan. The recommendations of this report should include and build upon existing programs and platforms where available.  Recommend key messages on VACY that can be used to educate/empower the public on: facts and figures; consequences of violence; how to prevent and respond to violence. These messages will form part of an end violence campaign.  Produce a powerpoint presentation of the key VACYS results that can be used during the launch.

Task 3: Development of the VACYS action plan

Following the validation and launch of the main VACYS report, the next task is to facilitate a multi-sectoral consultative process towards the development of a national action plan for the response of violence against children and youth in Rwanda and to put in place strong mechanisms to prevent further incidences of violence.

Key activities:  Develop methodology and plan for consultations with key stakeholders (at national and decentralized level including high level authorities, technical sector ministries, district authorities, implementing partners, families and children as beneficiaries) to discuss results and solicit feedback into draft national action plan;  Co-facilitate a ‘data to action’ workshop to solicit initial feedback and recommendations from a multi-sectoral group of stakeholders, the workshop will also solicit a better understanding of existing programs and platforms suitable for responding and preventing to violence against children and youth that can inform the national action plan;

5  Conduct consultations with national and sub-national level stakeholders (as outlined in the plan) and high level leaders of Rwanda institutions;  Based on the recommendations of the final report, national and district consultations and the data to action workshop, develop the first draft of an action plan to address the situation of violence against children and youth in Rwanda, including a flow chart on the approved referral pathway to report allegations and/or incidences of violence; The action plan is to be developed in a format following the current best practices and national guidelines.  Incorporate feedback from MoH/RBC and key stakeholders into the draft national action plan;  Present key components of the national action plan to stakeholders;  Finalize the action plan;  Produce a final presentation of the action plan.

Key deliverables:

 Facilitation of data to action workshop;  First draft of an action plan to address the situation of violence against children and youth in Rwanda;  Final draft of action plan with feedback incorporated and ready for submission to MoH/RMB for approval.  Final powerpoint presentation of key components of the national action plan.

The table below reflects all the tasks (1 - 3), deliverables, proposed timelines and days. This is only a proposal. Institutions will have to propose their own timeframe and days based on the expected deliverables and activities.

In agreement with the National VACYS Steering committee, a list of key informants will be elaborated for consultation.

6. Qualifications and Requirements

Experience of Company and Personnel to be assigned to this contract - Mandatory. Demonstrated:  Strong experience in child protection including violence against children and youth.  International exposure to low and middle income countries.  Prior work with government and non-government partners.  Proven ability to work across disciplines.  Excellent qualitative and quantitative research analytical skills.  Demonstrable experience in convening multi-stakeholder processes and building consensus on research and policy priorities.  Excellent writing skills.  Relevant academic credentials.  Financial stability of the company.  Proof of similar works done

7. Supervision This contract will be managed by the UNICEF Rwanda Child Protection section, with technical guidance from MoH/RBC and VACYS steering committee.

8. Terms and conditions: UNICEF standard clauses on institutional contracts will apply:  Whenever possible, bidder should be requested to provide an all-inclusive cost in the financial proposal. Bidder should be reminded to factor in all cost implications for the required service / assignment;  When international travel is expected as part of the assignment, it shall be clearly specified (e.g. location, duration, number of journeys …etc.) in the TOR. Bidder shall be required to include the estimate cost of travel in the financial proposal. It is essential to clarify in the TOR that i) travel cost shall be calculated based on economy class travel, regardless of the length of travel and ii) costs for accommodation, meals and incidentals shall not exceed applicable daily subsistence allowance (DSA) rates, as promulgated by the International Civil Service Commission (ICSC).  The contractors are expected to organize their own field transport – all related costs need to be factored into the financial proposal

9  The institution is responsible for provision of all computer, equipment and materials necessary for the performance of the expected deliverables outlined above. It is expected that any cost implications for necessary logistics will be catered for in the agreed upon budget. No additional financial provision will be granted outside of this agreement;  The institution will be responsible for organization of necessary meetings;

 No contract may commence unless the contract is signed by both UNICEF and the consultant or the Contractor.

 UNICEF reserves the right to withhold all or a portion of payment if performance is unsatisfactory, if work/outputs is incomplete, not delivered or for failure to meet deadlines  All materials developed by the consultant will remain the copyright of UNICEF and that UNICEF will be free to adapt and modify them in future.  Payment currency will be made in USD The Contractor shall abide by and be governed by UNICEF Procedure on Ethical Standards in Research, Evaluation and Data Collection and Analysis How to apply:

A two stage procedure will be utilized in evaluating consultancy bidding proposals, with evaluation of the technical proposal being completed prior to the financial proposal.

All documents shall be submitted to UNICEF before the deadline containing the following required documentation:

Technical Proposal: The bidder should prepare a ‘technical proposal’ on the basis of the tasks and deliverables detailed in the ToR. The technical proposal should include:

 Description of past experience reflecting why the institution is suited to fulfill the scope of this work; (please provide references from previous similar work)  Draft workplan and timeline;

10  Risk assessment – please provide a description of the most likely risks which will inhibit this consultancy from achieving its objectives, and what measures you will put in place to reduce or mitigate these risks;

 CV’s of the team of staff/consultants who will be working on this consultancy, including their intended role in this consultancy and the days available over the period of this consultancy.

No financial information should be contained in the technical proposal.

Financial Proposal: The bidder should prepare a proposal with the price broken down for each component of the proposed work, based on an estimate of time taken which needs to be stated. The price proposal should include consultancy fees, travel and other costs Submitted proposals will be assessed using the Cumulative Analysis Method. Technical proposals should attain a minimum of 50 points to qualify and be considered.

The maximum number of points shall be allotted to the lowest financial proposal that is opened/evaluated and compared among those technical qualified candidates who have attained a minimum of 50 points score in the technical proposal. Other financial proposals will receive points in inverse proportion to the lowest price. N.B The contract will be awarded to the candidate obtaining the highest combined technical and financial scores, subject to the satisfactory result of the verification interview. The proposals that do not comply with any terms and conditions contained in this ToR, including the provision of all required information, may results in the proposal being considered non-responsive and not further considered.
