Section 1623440 of the 1976 Code is amended to 23 read: 24 25 “Section 1623440. (A) It is unlawful for a person to discharge 26 or cause to be discharged unlawfully firearms at or into a dwelling 27 house, or other building, structure, or enclosure, or outdoor area 28 regularly occupied by persons including, but not limited to, indoor 29 or outdoor shopping areas or malls, movie theaters, parking lots, or 30 any other public gathering where three or more persons have come 31 together as a group. A person who violates the provisions of this 32 subsection is guilty of a felony and, upon conviction, must be fined 33 not more than one thousand dollars or imprisoned not more than 34 ten years, or both. 35 (B) It is unlawful for a person to discharge or cause to be 36 discharged unlawfully firearms at or into any vehicle, aircraft, 37 watercraft, or other conveyance, device, or equipment while it is 38 occupied. A person who violates the provisions of this subsection 39 is guilty of a felony and, upon conviction, must be fined not more 40 than one thousand dollars or imprisoned not more than ten years, 41 or both.” 42
