Mr. Steve Kulick made a motion to accept the minutes of the March 11, 2013 meeting of the City Planning Commission. Ms. Rebecca Livengood seconded the motion. The motion passed unanimously.

1) SP-13-01 (Hearing 3/11/13-RC, SK, RL, LH, AK) Special Permit-Restaurant 2400 (aka 2406) Erie Boulevard East Xiao Feng Huang and Min Wu (owner/applicant) Commercial, Class B

Mr. Anthony Catsimatides, of Open Atelier Architects at 451 South Warren Street, spoke to the Commission about the proposal, which consists of establishing a Restaurant within a convenience store on property situated at 2400 (aka 2406) Erie Boulevard East.

Genesee St, LLC (owner/applicant) Residential, Class A, Business, Class A, and Commercial, Class A

Mr. Brian Bouchard, of Clough Harbour and Associates at 441 South Salina Street, spoke to the Commission about the proposal, which consists of combining twelve parcels into three new Lots on property situated at 1009-11, 1025, 1035, 1047 and 1055 West Genesee Street, 405, 407 and 409 North Geddes Street, 712-16 Park Avenue, and 324, 328-30 and 334 Liberty Street.

Mr. Brian Bouchard, of Clough Harbour and Associates at 441 South Salina Street, spoke to the Commission about the proposal, which consists of demolishing a structure at 1047 and 1055 West Genesee Street and a portion of a second structure at 1025 and 1035 West Genesee Street, and constructing three retail buildings on property situated at 1009-11, 1025, 1035, 1047 and 1055 West Genesee Street, 405, 407 and 409 North Geddes Street, and 712-16 Park Avenue.

Mr. Brian Bouchard, of Clough Harbour and Associates at 441 South Salina Street, spoke to the Commission about the proposal, which consists of constructing and establishing a Restaurant with a drive-through lane on property situated at 1009-11 (aka 1001) West Genesee Street.

After further discussion and review, Mr. Steve Kulick made a motion to approve the request with a negative SEQR declaration. Ms. Linda Henley seconded the motion. The motion passed unanimously.

5) 3S-13-01 Three-Mile Limit Subdivision Review-Town of DeWitt Combine Two Parcels into One New Lot 733 North Highland Avenue Charles and Benjamin Kulesa and Christine Kemp (owners) Charles Kulesa (applicant)

Mr. Jeff Harrop, of the City of Syracuse Office of Zoning Administration, spoke to the Commission about the proposal, which consists of combining two parcels into one new Lot on property situated at 733 North Highland Avenue.

After further discussion and review, Ms. Linda Henley made a motion to approve the request with a negative SEQR declaration. Mr. Steve Kulick seconded the motion. The motion passed unanimously.

6) SP-13-05 Special Permit-Restaurant 2807-2815 South Salina Street Salina Shoe Salon, Inc. (owner) Sean Reed, Jr. (applicant) Business, Class A

Mr. Sean Reed, Jr., at 308 First North Street, and Ms. Amatullah Yamini, at 414 Garfield Avenue, spoke to the Commission about the proposal, which consists of establishing a Restaurant on property situated at 2807-2815 South Salina Street. After further discussion and review, whereupon the Commission addressed the number of instances the proposal deviates from the City of Syracuse Zoning Rules and Regulations, as amended, and the applicant agreed to consult with the staff to reduce the number of deviations, the Commission agreed to continue the public hearing at its next regularly scheduled meeting on April 22, 2013.

7) SP-04-50 M1 Special Permit Modification-Restaurant Modify Elevation and Signage 907-915 South Avenue Ahmad Ashkar (owner) Mustafa Dhaifullah (applicant) Business, Class A

Mr. Nate Ashkar, at 1919 South State Street, spoke to the Commission about the proposal, which consists of modifying the signage and elevation to a Special Permit for a Restaurant within a convenience store on property situated at 907-915 South Avenue.

No one spoke in favor of the proposal. Two people spoke in opposition to the proposal, thinking the applicant was requesting to establish a new restaurant.

After further discussion and review, whereupon the staff clarified the purpose of the proposal, Ms. Rebecca Livengood made a motion to approve the request with a negative SEQR declaration. Mr. Arpad Kolozsvary seconded the motion. The motion passed unanimously.

8) SP-08-13 M8 Special Permit Modification Modify Signage 200 South Franklin Street Washington/Walton Company, LLC (owner) Blue Ocean Strategic Capital, LLC (applicant) Central Business District-General Service

Mr. Ted Sarenski, of Blue Ocean Strategic Capital, LLC at 443 North Franklin Street, spoke to the Commission about the proposal, which consists of installing a 33.76-square foot wall sign 27.4 feet above the ground between the second and third floors on property situated at 200 South Franklin Street.

The public hearing was cancelled as the proposal was withdrawn at the request of the applicant.

10) SR-02-05 M1 Site Plan Review Modification-Antennae Replace Five Communication Antennas with Three New Antennas 1000 Bellevue Avenue Bellevue Apartments, LLC (owner) Christine Howell (applicant) Residential, Class AA

Ms. Christine Howell, an agent for HPC Wireless Services at 1765 Whiting Road, Memphis, New York, spoke to the Commission about the proposal, which consists of replacing five existing panel antennas with three upgraded panel antennas and related equipment on property situated at 1000 Bellevue Avenue.

Mr. Brian Bernie, of Bergman Associates, spoke to the Commission about the proposal, which consists of replacing three static price display signs with two LED price display signs on property situated at 971 East Brighton Avenue.
