PROPOSED APPROVAL OF A RISK-BASED REMEDIATION AND TEMRINATION OF THE ALTERNATE MECHANISM IN LEIU OF POST-CLOSURE PERMIT DAIMLER TRUCKS 11550 STATESVILLE BOLUEVARD CLEVELAND, NORTH CAROLINA EPA ID NUMBER: NCD 018 652 339

This is to notify the public of the proposed approval of a Risk-based Remediation and termination of the Alternate Mechanism in Lieu of a Post-Closure Permit (executed on June 12, 2012) by the North Carolina Division of Waste Management’s Hazardous Waste Section for the Daimler Trucks Facility located at 11550 Statesville Boulevard in Cleveland, North Carolina.

A Public Hearing will be held on September 27, 2016, at 1:00 o’clock p.m. in the Rowan County Public Library located at 201 West Fisher Street in Salisbury, North Carolina. All attendees will have the opportunity to present five (5) minute oral statements regarding the proposed Risk-Based Remediation and the proposed termination of the Alternate Mechanism in lieu of Post-Post Closure Permit (Alternate Mechanism) and/or to submit written comments at the public hearing. You may also submit written comments at any time during the forty-five day public comment period, which begins on August 26, 2016, and ends on October 10, 2016. A brief summary of the order follows:

The Facility is located at 11550 Statesville Boulevard in Cleveland, Rowan County, North Carolina. The Facility was used by MAN Truck to manufacture and assemble buses used in urban transport from 1979 until 1989. During its operation, MAN Truck used three spray paint booths and one cleaning booth. Waste water and waste solvents were generated and drained into a 5,000-gallon concrete underground storage tank (UST).

The UST was excavated in 1988. Soils contaminated with solvents were discovered at that time. MAN Truck conducted multiple phases of assessment to evaluate the release. Monitoring results indicated that groundwater in the shallow aquifer had been impacted. The contamination extends to the north-northwest for a distance of approximately 100 feet from the source area. Contamination is located wholly onsite.

N.C.G.S. § 130A-310.65 through 310.77 provides a mechanism for facilities to remediate contaminated sites based on site-specific remediation standards. Man Truck submitted a Remedial Action Plan (RAP) to remediate to site-specific remediation standards. In support of their RAP, MAN Truck evaluated all potential current and future receptors to ensure protection of public health, safety, and welfare. No current risks to human health and the environment have been identified. Perpetual land use restrictions will be implemented to restrict potential exposures.

All comments received during the public comment period or at the hearing will be considered in the decision to terminate the Alternate Mechanism in lieu of Post-Closure Permit. Comments received after the public comment period ends will not be considered. The statutory authority for calling the hearing is G.S. 130A-294(f). Applicable State rules are found in the North Carolina Hazardous Waste Management Rules 15A NCAC 13A .0105, .0109, and .0113. These rules adopt the requirements of the Federal Resource Conservation and Recovery Act as amended by the Hazardous and Solid Waste Amendments of 1984.
