BOWEN AND H. TAYLOR 15 BLALOCK IN SPARTANBURG COUNTY, SO AS TO 16 SPECIFY THE TYPES OF WATERCRAFT TO WHICH THESE 17 RESTRICTIONS APPLY, TO PROVIDE THAT CERTAIN 18 SIGNS THAT CONTAIN THESE RESTRICTIONS MUST BE 19 DESIGNED AND INSTALLED BY THE SPARTANBURG 20 WATER SYSTEM, TO PROVIDE THAT CERTAIN VESSELS 21 ARE EXEMPTED FROM THESE RESTRICTIONS, TO 22 PROVIDE THAT THESE RESTRICTIONS APPLY TO A 23 HYDROELECTRIC GENERATOR OUTFALL, AND TO 24 PROVIDE THAT CERTAIN RESTRICTIONS APPLICABLE 25 TO LAKE H. TAYLOR BLALOCK DO NOT APPLY TO THE 26 HUNTING OF WATERFOWL IN CERTAIN AREAS DURING 27 CERTAIN TIMES OF THE YEAR. 28 29 Be it enacted by the General Assembly of the State of South 30 Carolina: 31 32 SECTION 1. Article 13, Chapter 25, Title 50 of the 1976 Code is 33 amended to read: 34 35 “Article 13 36 37 Restrictions Applicable to Lakes William C. Bowen and H. Taylor 38 Blalock in Spartanburg County 39 40 Section 50251310. On Lakes William C. Bowen and H. Taylor 41 Blalock in Spartanburg County:

[558] 2 1 (1) There is established a no wake zone within three hundred 2 feet of all bridges and public docks. No wake zones must be 3 clearly marked with signs. The signs must be designed and 4 installed by the department. 5 (2) No watercraft of any type boat, watercraft, or any other 6 type of vessel may be operated, anchored, moored, docked, or 7 otherwise enter within five hundred feet of any pump station, 8 water intake of a dam, or spillways hydroelectric generator outfall, 9 or spillway. These restricted areas must be clearly marked with 10 signs. Signs must be designed and installed by the department 11 Spartanburg Water System. Boats, watercraft, and other vessels 12 operated for law enforcement, emergency medical services, or dam 13 maintenance and repair are exempted from this requirement. 14 (3) No boat, watercraft, or any other type of vessel may operate 15 or anchor within one hundred fifty feet of public fishing piers. 16 (4) No sailing craft with a mast height in excess of thirty feet is 17 permitted to operate. 18 (5) No wading, bathing, or swimming is permitted within two 19 hundred feet of any public landing, bridge, or restricted area. 20 These restricted areas must be clearly marked with signs. The 21 signs must be designed and installed by the department 22 Spartanburg Water System. 23 (6) The lake wardens, at their discretion, may limit entrance of 24 boats, watercraft, or any other type of vessel onto the lakes via the 25 public landings when conditions such as overcrowding or adverse 26 weather create an unsafe boating environment. 27 28 Section 50251320. On Lake William C. Bowen: 29 (1) No boat, watercraft, or any other type of vessel with an 30 outboard motor having a horsepower rating in excess of one 31 hundred fifteen horsepower is permitted. 32 (2) No boat, watercraft, or any other type of vessel with an 33 outboard motor in excess of the United States Coast Guard rating, 34 with Coast Guard rating plate missing or changed, is permitted. 35 (3) No boat, watercraft, or any other type of vessel powered by 36 an outdrive or inboard motor having an engine automotive 37 horsepower rating in excess of one hundred ninety horsepower is 38 permitted. This restriction does not apply to towboats which have 39 been approved by the American Waterski Association or any Coast 40 Guard approved boat commonly referred to as an inboard boat 41 designed by the manufacturer for towing waterskiers with the 42 motor or engine located near the midpoint of the boat between the 43 bow and stern, propeller driven by a single rod drive shaft

[558] 3 1 extending through the hull with the propeller located under the 2 boat in front of a rudder. 3 (4) There is no minimum or maximum restriction on length of 4 boats, watercraft, or any other type of vessel. Boats, watercraft, 5 and other vessels operated for law enforcement, emergency 6 medical services, or dam maintenance and repair are exempted 7 from the restrictions in items (1) and (3) of this section. 8 9 Section 50251330. (A) Watercraft No boat, watercraft, or any 10 other vessel may not operate on Lake H. Taylor Blalock with an 11 engine greater than thirty horsepower or greater than twentyfive 12 feet in length, and in the case of a pontoon boat, the engine may 13 not be greater than forty horsepower or greater than twentyfive feet 14 in length, unless: 15 (1) the gas line has been disconnected and the engine or prop 16 is trimmed out of water; and 17 (2) an electric trolling motor or engine of thirty horsepower 18 or less is mounted. Boats, watercraft, and other vessels operated 19 for law enforcement, emergency medical services, or dam 20 maintenance and repair are exempted from the restrictions 21 contained in this subsection. 22 (B) It is unlawful on Lake H. Taylor Blalock to: 23 (1) operate personal watercraft, including jet skis; 24 (2) operate any boat, watercraft, or any other type of vessel 25 between midnight and one hour before sunrise, except that public 26 access to Lake H. Taylor Blalock for the purpose of hunting 27 waterfowl on South Carolina Department of Natural Resources 28 leased premises shall be open weekly on Wednesday mornings 29 beginning at 5:00 a.m. during the federal Waterfowl Hunting 30 Season, provided the hunting of waterfowl shall no longer be 31 allowed on Lake H. Taylor Blalock after December 31, 2018, 32 unless reauthorized in statute; 33 (3) operate any boat, watercraft, or any other type of vessel 34 with an outboard motor having horsepower in excess of the United 35 States Coast Guard rating for the watercraft or with the Coast 36 Guard rating plate missing or changed; 37 (4) operate, anchor, moor, or dock any boat, watercraft, or 38 allow such vessel to enter of any type within five hundred feet of 39 any pump station, water intake of a dam, hydroelectric generator 40 outfall, or spillways, and these restricted areas must be clearly 41 marked with signs designed and installed by the Spartanburg 42 Water System. Boats, watercraft, and other vessels operated for

[558] 4 1 law enforcement, emergency medical service, or dam maintenance 2 and repair are exempted from this requirement; 3 (5) operate, anchor, moor, or dock any boat, watercraft, or 4 any other type of vessel or anchor within one hundred fifty feet of 5 public fishing piers; 6 (6) operate sailing craft with a mast height in excess of thirty 7 feet; 8 (7) wade, bathe, or swim within two hundred feet of any 9 public landing, bridge, or restricted area, and these restricted areas 10 must be clearly marked with signs designed and installed by the 11 Spartanburg Water System. 12 (C) The lake wardens may limit entrance of boats, watercraft, 13 or any other type of vessel onto the lake via the public landings 14 when conditions including, but not limited to, overcrowding or 15 adverse weather create an unsafe boating environment. 16 17 Section 50251340. On Lake H. Taylor Blalock, it is unlawful to 18 waterski or tow rafts, discs, or any other similar floating devices. 19 20 Section 50251350. On Lake William C. Bowen it is unlawful to: 21 (1) waterski or tow rafts, discs, or other similar floating 22 devices within three hundred feet of any bridge or within one 23 hundred feet of public dock facilities of the Spartanburg Water 24 System; 25 (2) waterski and tow rafts, discs, or other similar floating 26 devices upstream and west of the Interstate Highway 26 bridge 27 which crosses over Lake William C. Bowen; 28 (3) pull more than two skiers at one time from any boat or to 29 waterski while carrying one or more persons piggyback; 30 (4) operate a watercraft any boat, watercraft, or any other type 31 of a vessel between midnight and one hour before sunrise. 32 33 Section 50251360. The department, after consultation with the 34 Spartanburg Water System, by special permit, may waive the 35 restrictions and provisions of Sections 50251310 through 36 50251350 to allow for boat testing, water and ski shows, and 37 similar activities. It is unlawful to violate the terms and conditions 38 of the permit. 39 40 Section 50251370. A person violating a provision of this article 41 is guilty of a misdemeanor and must be punished as provided in 42 Section 501130.”

[558] 5 1 SECTION 2. The repeal or amendment by this act of any law, 2 whether temporary or permanent or civil or criminal, does not 3 affect pending actions, rights, duties, or liabilities founded thereon, 4 or alter, discharge, release or extinguish any penalty, forfeiture, or 5 liability incurred under the repealed or amended law, unless the 6 repealed or amended provision shall so expressly provide. After 7 the effective date of this act, all laws repealed or amended by this 8 act must be taken and treated as remaining in full force and effect 9 for the purpose of sustaining any pending or vested right, civil 10 action, special proceeding, criminal prosecution, or appeal existing 11 as of the effective date of this act, and for the enforcement of 12 rights, duties, penalties, forfeitures, and liabilities as they stood 13 under the repealed or amended laws. 14 15 SECTION 3. This act takes effect upon approval by the 16 Governor. 17 XX 18
