CHAPTER 9 – DESIGN GUIDE
9.21 TANK PROGRAM GUIDE
A. GENERAL
1. PROGRAM OVERVIEW a. Back in the mid-1980s the Federal Environmental Protection Agency (EPA) and the NY State Department of Environmental Conservation (DEC) enacted regulations for mitigating fuel oil leaks & spills, and to prescribe spill prevention, response and associated remediation requirements. To assist our state agency clients with both regulatory compliance and planned infrastructure removals or replacement of fuel storage and vehicle fueling installations, OGS Design & Construction established dedicated in-house and contracted resources to provide the associated equipment replacement and environmental remediation services. These collective services became known simply as the “Tank Program”. b. The program’s various services are available to all NY State agencies, in part, by way of regional unit price term construction contracts funded on an individual work order basis by the client agency. Having skilled pre-qualified regional contractors reachable on term contracts with pre- defined work units enables appropriate construction solutions to be quickly available. c. Tank Program projects are frequently initiated:
for planned equipment replacements
in response to DEC and/or EPA violation notices
to achieve remediation of contamination due to compromised fuel storage installations
d. Once a detailed scope of corrective or replacement work is defined and documented, it is implemented via contractor work orders and validated via D&C permitting and inspection services. Throughout the process the D&C team works closely with the client and with DEC personnel, if necessary, to ensure regulatory compliance.

recommendations, remedial system design, remedial system operation and maintenance, preparation and updating of Spill Prevention Control and Countermeasures (SPCC) plans. b. Construction Contracts (Regional): 1) The Work may include any of the following items or other related work as indicated on the drawings and specifications or as directed: a) Remove and dispose of existing fuel from tank. b) Provide temporary fuel storage tanks. c) Excavate, and remove or abandon tank. d) Remove and dispose of contaminated soil, and contaminated water. e) Participate in on-site and/or off-site remediation of contaminated soil and water. f) Provide new tank, or install tank furnished by the State, above or below ground. g) Provide piping and accessories, fuel management systems, fuel polishing systems, gauging and leak detection systems. h) Sampling and laboratory testing of soil or water. i) Test new tank and piping system for leaks. j) Test and/or calibrate all associated new equipment and systems in accordance with manufacturer’s instructions. k) Connect fuel system to facility. l) Backfill excavation. m) Replace or repair concrete pads, concrete or asphalt paving, and lawn areas.
